SEWARD PLANNING AND ZOMNG COMMISSION, RECOMMENDING THF, KENAI PENINSULA BOROUGH APPROVAL OF THE PRELIMINARY REYLAT OF LOTS I & 2 OF USS 241, CLEARV[EW MANOR, THREE BEARS REPEAT, VACATION OF INTERNAL LOT LINF, AND DEDICATING APPROXIMATELY 46l SQUARE FEET OF IRON DRIVF, RIGHT-OF-WAY, LOCATED AT l7ll SEWARD HIGHWAY, WITHIN THF, AUTO COMMERCIAL ZONING DISTRICT WHEREAS, Cline and Associates Land Surveyors submitted a preliminary plat to the City of Seward for review and recommendation to the Kenai Peninsula Borough; and WHEREAS, this replat vacates the interior lot line combining the existing Lots 1 and 2, USS 241, (Clearview Manor Unrecorded), into one new lotto be known as Lot 1 A, Clearview Manor; and WHEREAS, the new Lot 1 A is approximately 54,804 square feet; and WHEREAS, the existing structures located on this property house the Three Bears Grocery Store and Fuel Station; and WHEREAS, the property is zoned Auto Commercial (AC) which allows all of the existing uses on the property, and the subdivision meets the minimum lot size and width requirements of the Seward Toning Code; and WHEREAS, the property is served by existing public utilities and developed streets, and therefore meets all of the requirements of the Seward Subdivision Code; and WHEREAS, easements have been provided for all known existing utilities; and WHEREAS, the parcel owner has dedicated approximately 4f 1 square feet of property to accommodate an existing Iron Drive right-of--way encroachment; and WHEREAS, the City accepts the existing 50 foot E3ear Drive right-of-way which meets the requirements of Seward City Code§16.05.010, Required Public Improvements; and Seward Planning and Zoning Commission Resolution ?009-15 Page 2 of WHEREAS, as required by Seward City Code X16.01.015, Conditions to plat apps°oval, property owners within 300 feet of the requested replat were notified of the proposed subdivision, and the property was posted with a public notice sign. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission recommends the Kenai Peninsula Borough approve the Lot lA, Clearview Manor, Three Bears Replat combining Lots I and 2, USS 241, into a single lot of approximately 54,804 square feet and the dedication of approximately 461 square feet of Iron Drive right-of--way. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7°i day of July 2009.
