BACKGROUND & JUSTIFICATION:
Planning and Zoning Commissioner McClure has resigned from the Commission upon her election to the
Borough Assembly leaving the Vice -Chair seat vacant. The Commission must elect a new Vice -Chair to
fill the seat until the annual election in the spring of 2010.
It is the duty of the Vice -Chair person to assume the duties of the Chair when necessary.
The Duties of the Chair are as follows:
1. Open the meeting on time and call the meeting to order;
2. Announce in proper sequence the business on the agenda;
3. Recognize members who are entitled to the floor;
4. State and put to a vote all legitimate motions that arise during the meeting:
5. Do not permit debate until there is a motion on the floor;
6. Protect the Commission from frivolous or delaying motions by refusing to recognize
them;
7. Enforce the rules regarding debate and keep order;
8. Expedite business in a way compatible with the rights of the members;
9. Decide all questions of order;
10. Respond to all inquiries of members;
11. Ensure that citizens address all remarks to the Commission; and
12. Declare the meeting adjourned.
The process for election of the Vice -Chair is as follows:
Anyone can nominate another commissioner as Vice - Chair.
• If only one nomination is received, a motion should be made to close nominations and cast a
unanimous ballot for the chosen person. That motion will need a second and can be approved by
unanimous consent. (No role call vote is necessary).
• If more than one nomination is received, I will prepare ballots for each Commissioner to vote for
one nominee and sign his ballot. I will then collect the ballots, read the votes aloud, and
announce the prevailing nominee. A motion is then in order for someone to elect the nominee as
vice - chairperson. A second is needed and the motion can be approved by unanimous consent of
the commission.

A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING JIM HOEFFLER AN AMENDMENT TO
FLOODPLAIN VARIANCE PERMIT 2009 -01, TO PLACE AN 8X10 FOOT
ACCESSORY STRUCTURE ON LEASE LOT 5A, BLOCK 200 SEWARD
AIRPORT
WHEREAS, on May 19, 2009 applicant Jim Hoeffler received Floodplain Variance Permit
2009 -01 to construct an aircraft hanger on Lot 5A, Block 200, Seward Airport, leased from the State
of Alaska, Department of Transportation; and
WHEREAS, the applicant has requested an amendment to Floodplain Variance Permit 2009-
01 to allow the placement of an 8 X 10 foot accessory utility shed on Lot 5A; and
WHEREAS, according to FIRM No. 020012- 3255A, dated May 19, 1981, the Base Flood
Elevation for Lot 5A, Seward Airport is 21.0 feet; and
WHEREAS, based on information from previous site plans prepared by a registered land
surveyor and studies completed by DOWL engineers for the Seward Airport Master Plan, the
existing elevation of the lease lot is approximately 18.0 which is approximately 3 feet below the base
flood elevation; and
WHEREAS, the City of Seward Floodplain Management Ordinance, Seward City Code
Section 15.25.050.B.2.a&b, requires that the lowest floor of non-residential construction be elevated
to the base flood elevation, or be flood - proofed so that below the base flood level the structure is
watertight with walls substantially impermeable to the passage of water; or be constructed with
components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
WHEREAS, the State of Alaska, Department of Transportation, owner of Lot 5A, will not
allow any fill material to be added to the parcel; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for an
amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from the City of Seward
Floodplain Management Ordinance to construct the proposed shed's lowest floor at a grade less than
1 foot above the adjoining airport apron elevation of approximately 18 feet; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for an
amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from the City of Seward
Floodplain Management Ordinance 15.25.050.B.2a. to construct the proposed shed without being
flood - proofed with watertight walls substantially impermeable to the passage of water; and

WHEREAS, the applicant has applied to the Planning and Zoning Commission for an
amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from the City of Seward
Floodplain Management Ordinance 15.25.050.B.2b. to construct the proposed shed without
additional components capable of resisting hydrostatic and hydrodynamic loads and effects of
buoyancy; and
WHEREAS, the public notification process was complied with and the appropriate public
hearing as required by Seward City Code § 15.01.040 was conducted by the Commission on
November 5, 2009.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with Seward City Code Section 15.25.060 the Seward Planning and
Zoning Commission has considered all of the following factors:
a. The danger that materials may be swept onto other lands to the injury of others;
b. The danger to life and property due to flooding or erosion damage;
c. The susceptibility of the proposed facility and its contents to flood damage and the
effect of such damage on the individual owner;
d. The importance of the services provided by the proposed facility to the community;
e. The necessity to the facility of a waterfront location, where applicable; Not
applicable.
f. The availability of alternative locations for the proposed use which are not subject to
flooding or erosion damage;
g. The compatibility of the proposed use with the existing and anticipated development;
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that area;
i. The safety of access to the property in times of flood for ordinary and emergency
vehicles;
j. The expected heights, velocity, duration, rate of rise, and sediment transport of the
flood waters and the effects of wave action, if applicable, expected at the site;
k. The costs of providing governmental services during and after flood conditions,
including maintenance and repair of public utilities and facilities such as sewer, gas,
electrical, and water systems, and streets and bridges.
Section 2. The Commission makes the following specific findings regarding the amendment
to Floodplain Variance 2009 -01 requested by Jim Hoeffler:
1. The majority of the Seward Airport and surrounding property is located within the
floodplain or floodway. Since the applicant's aircraft hanger is dependent upon an airport location
and the accessory utility shed supports the aircraft hanger there are no other feasible locations for the
structure which are not located within the floodplain.

2. Failure to grant the variance would result in exceptional hardship to the applicant for the
following reason: The State of Alaska, Department of Transportation has stated that no fill or
elevation to the parcel is allowed; therefore it is not feasible to elevate the structure at or above the
base flood elevation. The accessory utility shed is an essential component of the aircraft hanger.
3. Granting the requested variance will not result in damage or hardship for this or any other
property. Staff has consulted with Dan Mahalak, Kenai Peninsula Borough Hydrologist for his
professional opinion on the original variance request. He had stated the area is a low flow velocity
area. Mahalak also noted if the structure were to be built above the Base Flood Elevation the added
fill could cause more problems by creating velocity on neighboring properties and/or increase flood
levels in the area.
4. The proposed use is compatible with the surrounding industrial land uses and existing
similar facilities.
5. The applicant has established good and sufficient cause for this Commission to find
pursuant to SCC§ 15.25.060(b)(5) that the granting of this variance amendment will not result in
increased flood heights, additional threats to public safety, extraordinary public expense, create
nuisances, cause fraud on or victimization of the public or conflict with existing laws.
6. Because the proposed variance has low damage potential and otherwise conforms to all
variance criteria in SCC §15.25.060(a) & (b), the Commission finds this application to be one of
those "very limited circumstances" described at SCC§ 1 5.25.060(b)(7) for granting this floodplain
variance amendment on Lot 5A, Block 200, Seward Airport.
7. Considering all of the above findings, the Commission hereby determines that the
requested variance amendment to construct the 8 X 10 foot accessory utility shed on Lot 5A, Block
200, Seward Airport, at an elevation of 18 feet which is approx 3 feet below the base flood elevation,
is the minimum necessary to afford relief
Section 3. Based on the above findings, the Planning and Zoning Commission hereby grants
Jim Moeffler an amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from
SCC §1525.050.B.2. permitting the lowest floor of the proposed accessory utility shed to be
constructed up to three (3) feet below the base flood elevation of 21.0 feet.
Section 4. Based on the above findings, the Planning and Zoning Commission hereby grants
Jim Hoeffler an amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from
SCC §15.25.050B2. permitting the accessory utility shed to be constructed without being flood -
proofed with watertight walls substantially impermeable to the passage of water.
Section 5. Base on the above findings, the Planning and Zoning Commission hereby grants
Jim Hoeffler an amendment to Floodplain Variance Permit 2009 -01 allowing variance relief from

SCC §15.25.050.B2 permitting the accessory utiltiy shed to be constructed without additional
components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy.
Section 6. Base on the above findings, the Planning and Zoning Commission finds the
proposed use, subject to the following condition satisfies the criteria for granting a floodplain
variance amendment, and authorizes the administration to issue an amendment to Floodplain
Variance Permit 2009 -01 to Jim Hoeffler subject to the following condition:
1. Prior to issuance of the Certificate of Occupancy the applicant must submit to the City of
Seward a copy of the required elevation certificate upon completion of the proposed aircraft hanger
and 8 X 10 foot shed.
Section 7. In accordance with SCC §15.25.060.B.8, the Community Development Office
must give written notice to the applicant that the structure will be permitted to be built with a lowest
floor elevation below the base flood elevation and that the cost of flood insurance will be
commensurate with the increased risk resulting from the reduced lowest floor elevation. This
variance to construct the structure below the Base Flood Elevation will result in increased flood
insurance premiums rates as high as $25.00 per $100.00 of coverage.
Section 8. This resolution shall take effect ten (10) days following its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 5 day
of November 2009.

Agenda Item: Jim Hoeffler's Request for an amendment to Floodplain Variance 2009 -01 to
place an 8 X 10 foot shed on Lot 5A, Seward Airport
Background:
Applicant Jim Hoeffler applied for and received Floodplain Variance Permit 2009 -01 to construct an
aircraft hanger, below base flood elevation, on Lot 5A, Block 200, Seward Airport Lease Tracts.
The applicant has applied for an amendment to Permit 2009 -01 to allow the placement of an 8 X 10
foot utility shed on the same lot. The utility shed is an essential component of the aircraft hanger.
The applicant did not realize at the time of the original variance application that every structure
placed on Lot 5A within a mapped floodplain is required to be constructed above base flood
elevation or go through the variance request procedure.
During the building permit review process it was identified that the parcel is located within a Federal
Emergency Management Agency (FEMA) mapped 100 -year floodplain (Zone A3). The City's
Floodplain Management Ordinance (Chapter 15.25) guides development in the floodplain in order to
lessen the economic loss caused by impending flood events. Provisions of the ordinance Section
15.25.050 General Standards provide specific construction standards for development in the
floodplain. Section 15.25.050(B)(2) requires that nonresidential construction must have the lowest
floor, including basement, elevated to the level of the base flood elevation; OR, together with
attendant utility and sanitary facilities, shall:
a. Be flood - proofed so that below the base flood level the structure is watertight with
walls substantially impermeable to the passage of water. The applicant is unable to
meet this requirement. The applicant is requesting a variance.
b. Have structural components capable of resisting hydrostatic and hydrodynamic loads
and effects of buoyancy. The applicant is requesting a variance from the
requirement of adding additional structural components. The shed will be
anchored to the ground.
c. Be certified by a registered professional engineer or architect that the standards of
this subsection are satisfied. The 8 X 10 foot shed will be review for code
compliance by the City of Seward Building Department.
d. Nonresidential structures that are elevated, not flood proofed, must meet the same
standard for space below the lowest floor as described in SCC §15.25.050 B.1.b.
Item d. is not applicable, the utility shed will not be elevated; the lowest floor will
be at grade.
e. Applicants flood proofing nonresidential buildings shall be notified that flood

insurance premiums will be based on rates that are one foot below the flood proofed
level. The applicant has been notified of the increased flood insurance premiums
and shall again be notified in writing through the variance process.
Based on FEMA's Flood Insurance Rate Map (FIRM), the Base Flood Elevation for the applicants
lease parcel is 21.0 feet. The applicant has applied to construct the proposed 8 X 10 foot shed at no
more than one (1) foot above the adjoining airport apron which according to previously submitted
surveys and studies completed by DOWL engineers for the Seward Airport Master Plan, the
elevation of the proposed development area is approximately 18 feet. The applicant has also
submitted building plans that do not plan for wet flood proofing by adding flood vents.
Variance Requested:
The applicant is requesting an amendment to Floodplain Variance 2009 -01 which granted a variance
from Seward City Code§ 15.25.050(B)(2)(a)(b) and (d). in order to construct the proposed 8 X 10
foot shed with the lowest floor approximately 3 feet below the base flood elevation.
CONDITIONS AND FINDINGS FOR GRANTING A VARIANCE
SCC 415.25.060. Appeal and Variance Procedure
(b) Conditions for variances
(1) Generally, the only condition under which a variance from the elevation standard may be issued
is for new construction and substantial improvements to be erected on a lot of 1/2 acre or less in size
contiguous to and surrounded by lots with existing structures constructed below the base flood level,
providing subparagraphs (a) through (k) of subsection (a)(4) of this section have been fully
considered. As the lot size increases the technical justification required for issuing the variance
increases.
Review: The requested amendment to Floodplain Variance 2009 -01 meets this stipulation. The
amendment request to the variance is for construction of a new 8 X 10 foot shed on less than a %2
acre lot, this lot is contiguous to and surrounded by lots with existing structures constructed below
the base flood level.
The following is the consideration of (a) through (k) of SCC§ 15.25.060(a)(4):
In passing upon such applications, the commission shall consider all technical evaluations, all
relevant factors, standards specified in other sections of this chapter, and:
a. The danger that materials may be swept onto other lands to the injury of others; There
is no reason to believe that placement of the 8 X 10 foot shed will increase the danger of materials

being swept onto other lands. Staff has consulted with Dan Mahalak, Kenai Peninsula Borough
Hydrologist for his professional opinion on the original variance request. He has stated the area is a
low flow velocity area. Mahalak also noted, if the structure were to be built above the Base Flood
Elevation the added fill could cause more problems by creating velocity on neighboring properties
and/or increase flood levels in the area.
b. The danger to life and property due to flooding or erosion damage. The past three major
flood events in 1986, 1995 and 2006 did not present any significant threat to life and/or property in
the area of the proposed structure.
c. The susceptibility of the proposed facility and its contents to flood damage and the effect
of such damage on the individual owner. The past three major flood events in 1986, 1995 and 2006
did not present any significant threat of flooding to the area.
d. The importance of the services provided by the proposed facility to the community. The
applicant is a licensed aircraft mechanic and has verbally expressed the desire to open an aircraft
maintenance business at the Seward Airport which would provide a service to the community.
e. The necessity to the facility of a waterfront location, where applicable. Not applicable.
f The availability of alternative locations for the proposed use which are not subject to
flooding or erosion damage. The majority of the Seward Airport and surrounding property is
located within the floodplain or floodway. Since an aircraft hanger requires a location near an airport
and the proposed shed is an essential component of the aircraft hanger there are no other feasible
locations for the proposed structure.
g. The compatibility of the proposed use with the existing and anticipated development.
The proposed use is compatible with the surrounding industrial land uses and existing similar
facilities.
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that area. The 2020 Comprehensive Plan section 3.8.2 addresses
floodplain development by supporting the participation in the National Flood Insurance Program
(NFIP). Flooding of streams and rivers has historically occurred in Seward and the outlying areas as
most flat lands along the south central Alaskan coast is floodplain. The Resurrection River channels
and the airport erosion need continued attention. There is no evidence that this project would in
anyway increase or hinder the existing flooding issues in the area.
i. The safety of access to the property in times of flood for ordinary and emergency
vehicles. It does not appear the proposed structure will add any safety concerns for standard and /or
emergency vehicles during flood events.

j. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood
waters and the effects of wave action, if applicable, expected at the site. The past three major flood
events in 1986, 1995 and 2006 did not present any significant threat to life and/or property in the area
of the proposed structure.
k. The costs of providing governmental services during and after flood conditions,
including maintenance and repair of public utilities and facilities such as sewer, gas, electrical,
and water systems, and streets and bridges. Electrical utilities are the only governmental services in
the general area but not available to Lot 5A, no increased cost expected.
(2) Variances may be issued for the reconstruction, rehabilitation, or restoration of structures listed
on the National Register of Historic Places without regard to the procedures set forth in this section.
Review: Not applicable
(3) Variances shall not be issued within a designated floodway if any increase in flood levels during
the base flood discharge would result.
Review: Not applicable. However it should be noted that the designated floodway is located just
north of the cross wind runway. The main runway is located within the floodway.
(4) Variances shall only be issued upon a determination that the variance is the minimum necessary,
considering the flood hazard, to afford relief.
Review: The majority of the Seward Airport and surrounding property is located within the
floodplain or floodway. Since the aircraft hanger and the proposed 8 X 10 foot shed is dependent
upon an airport location, and it is not feasible to elevate the structure above the base flood elevation,
the requested variance amendment to construct the shed on Lot 5A, Block 200, Seward Airport at an
elevation of 18 feet, which is approximately 3 feet below the base flood elevation, is the minimum
necessary to afford relief.
• (5) Variances shall only be issued upon:
a. A showing of good and sufficient cause;
Review: An aircraft hanger is dependent upon an airport location and the 8 X 10 foot shed is an
essential component to the hanger.
b. A determination that failure to grant the amendment to the variance would result in
exceptional hardship to the applicant;

Review: Failure to grant the amendment to the variance would result in exceptional hardship to the
applicant for the following reason: It is not feasible to elevate the structure at or above the base
flood elevation. The State of Alaska, owners of the airport parcels, do not allow fill to be placed on
the properties due to the needed connectivity to the existing aprons and runways.
c. A determination that the granting of an amendment to the variance will not result in
increased flood heights, additional threats to public safety, extraordinary public expense, create
nuisances, cause fraud on or victimization of the public or conflict with existing local laws or
ordinances.
Review: The past three major flood events in 1986, 1995 and 2006 did not present any significant
threat to life and/or property in the area of the proposed structure. There is no indication that
granting the amendment to Variance 2009 -01 will result in increased flood heights, additional threats
to public safety, public expense, create any type of nuisances, or cause fraud on or victimization of
the public or conflict with existing local laws or ordinances.
6) Variances as interpreted in the National Flood Insurance Program are based on the general
zoning law principle that they pertain to a physical piece of property; they are not personal in nature
and do not pertain to the structure, its inhabitants, economic or financial circumstances. They
primarily address small lots in densely populated residential neighborhoods. As such, variances from
the flood elevations should be quite rare.
Review: This amendment to Variance 2009 -01 is site specific to a physical lot less than the `i4 acre
size as required under 15.25.060(6)(1). Granting the amendment to the variance does not result in a
special privilege. Any other lessee with similar conditions could obtain a similar variance.
(7) Variances may be issued for nonresidential buildings in very limited circumstances to allow a
lesser degree of flood proofing than watertight or dry-flood proofing where it can be determined that
such action will have low damage potential, complies with all other variance criteria except
subsection (b)(1) of this section, and otherwise complies with section 15.25.060(a) and (b).
Review: There is no indication that granting this amendment to variance 2009 -01 will increase any
damage potential to either the applicant's structure or the surrounding structures. The application
complies with all variance criteria of 15.25.060(a) and (b).
(8) Any applicant to whom a variance is granted shall be given written notice that the structure will
be permitted to be built with a lowest floor elevation below the base flood elevation and that the cost
of flood insurance will be commensurate with the increased risk resulting from the reduced lowest
floor elevation.

Review: Staff has verbally discussed the National Flood Insurance Program with the applicant.
Upon approval of this amendment to variance 2009 -01 the Community Development Office shall
give written notice to the applicant that the structure will be permitted to be built with a lowest floor
elevation below the base flood elevation. Staff is also required to provide written notice that the cost
of flood insurance will be commensurate with the increased risk resulting from the reduced lowest
floor elevation. This amendment to variance 2009 -01 to construct the 8 X 10 foot shed below the
Base Flood Elevation will result in increased flood insurance premiums rates as high as $25.00 per
$100.00 of coverage.
Conditions of the Variances
Upon consideration of the above factors and the purposes of Chapter 15.25 Floodplain Management,
the Commission may attach such conditions to the granting of variances as it deems necessary to
further the purposes of this chapter. Based on the above findings and conclusions, the administration
recommends imposition of the following condition for the amendment to floodplain variance permit
2009 -01:
1. Prior to issuance of the Certificate of Occupancy the applicant must submit to the City of
Seward a copy of the required elevation certificate upon completion of the proposed aircraft hanger
and 8 X 10 foot shed.
RECOMMENDATION:
The Commission approve Resolution 2009 -24, granting Jim Hoeffler an amendment to Floodplain
Variance Permit 2009 -01 allowing relief from Seward City Code Chapter 15.25 Floodplain
Management to construct an 8 X 10 foot shed on Lot 5A, Block 200, Seward Airport based on the
findings and the condition stated within the Resolution.

The Commission's next work session is scheduled for 6:30 p.m. on November 17, 2009,
however, there will not be a quorum because of the Planning and Zoning Commissioner's
training in Anchorage on that day. The Commission needs to cancel or reschedule this
work session.
Administration recommends that the Commission cancels the November 17, 2009 work
session and schedules another work session for December 1, 2009 at 6:30pm before their
next regular meeting. Administration would like to hold a work session to discuss the
preliminary Two Lakes Park Subdivision prior to bringing this item forward to the
Commission on December 15, 2009 during a Special Meeting.
Replatting Two Lakes Park is one of the priorities set for the Commission by Council for
2009. Administration has worked closely with the surveyor and city department heads in
developing this resubdivision. Allowing public input and discussion at both a work
session and a public hearing is beneficial to the public process. The work session will
also allow the Commission to ask questions and provide direction prior to addressing the
plat at their business meeting.
If needed, the Commission is allowed under Seward City Code 2.30.320 (a) to designate
their own time and place for Meetings and Work Sessions.
RECOMMENDATION:
The Planning and Zoning Commission should discuss and reschedule the November 17,
2009 work session to December 1 2009 at 6:30pm to address the Two Lakes Park
Subdivision (via motion).
