A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING LUCKY WILSON A FLOODPLAIN
VARIANCE FROM SEWARD CITY CODE CHAPTER 15.25 FLOODPLAIN
MANAGEMENT TO CONSTRUCT AN AIRCRAFT HANGAR ON LOT 9,
BLOCK 200 SEWARD AIRPORT, 2102 AIRPORT ROAD
WHEREAS, applicant Lucky Wilson proposes to construct an aircraft Hangar on lease Lot
9, Block 200, Seward Airport, leased from the State of Alaska, Department of Transportation; and
WHEREAS, Lot 9, Seward Airport is located within a designated 100-year floodplain as
identified on the Federal Emergency Management Agency's (FEMA) Flood Insurance Rate Map
(FIRM); and
WHEREAS, according to FIRM No. 020012- 3255A, dated May 19, 1981, the Base Flood
Elevation for Lot 9, Seward Airport is approximately 20.0 feet; and
WHEREAS, based on information from previous site plans prepared by a registered land
surveyor and studies completed by DOWL engineers for the Seward Airport Master Plan, the
existing elevation of the proposed lot is approximately 16.0 which would place the lowest floor of
the building approximately 4 feet below the base flood elevation; and
WHEREAS, the City of Seward Floodplain Management Ordinance, Seward City Code
Section 15.25.050.B.2.a&b, requires that the lowest floor of non-residential construction be elevated
to the base flood elevation, or be flood -proofed so that below the base flood level the structure is
watertight with walls substantially impermeable to the passage of water; or be constructed with
components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
WHEREAS, the applicant would be unable to access the structure for its designed use if the
structure were to be elevated at or above the base flood elevation which is approximately 4 feet
above the adjacent tarmac; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for a
variance from the City of Seward Floodplain Management Ordinance to construct the proposed
aircraft Hangar's lowest floor at a grade less than 1 foot above the adjoining airport apron elevation
of approximately 16 feet; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for a
variance from the City of Seward Floodplain Management Ordinance 15.25.050.B.2a to construct the

proposed aircraft Hangar and supporting utilities without being flood -proofed with watertight walls
substantially impermeable to the passage of water; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for a
variance from the City of Seward Floodplain Management Ordinance 15.25.050.B.2b to construct
the proposed aircraft Hangar without additional components capable of resisting hydrostatic and
hydrodynamic loads and effects of buoyancy; and
WHEREAS, the public notification process was complied with and the appropriate public
hearing as required by Seward City Code § 15.01.040 was conducted by the Commission on August
3, 2010.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with Seward City Code Section 15.25.060 the Seward Planning and
Zoning Commission has considered all of the following factors:
a. The danger that materials may be swept onto other lands to the injury of others;
b. The danger to life and property due to flooding or erosion damage;
C. The susceptibility of the proposed facility and its contents to flood damage and the
effect of such damage on the individual owner;
d. The importance of the services provided by the proposed facility to the community;
e. The necessity to the facility of a waterfront location, where applicable; Not
applicable.
f. The availability of alternative locations for the proposed use which are not subject to
flooding or erosion damage;
g. The compatibility of the proposed use with the existing and anticipated development;
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that area;
i. The safety of access to the property in times of flood for ordinary and emergency
vehicles;
j. The expected heights, velocity, duration, rate of rise, and sediment transport of the
flood waters and the effects of wave action, if applicable, expected at the site;
k. The costs of providing governmental services during and after flood conditions,
including maintenance and repair of public utilities and facilities such as sewer, gas,
electrical, and water systems, and streets and bridges.
Section 2. The Commission makes the following specific findings regarding the Lucky
Wilson floodplain variance request:

l . The majority of the Seward Airport and surrounding property is located within the Special
Flood Hazard Area or floodway. Since the applicant's proposed aircraft Hangar is dependent upon
an airport location, there are no other feasible locations for the structure which are not located within
the floodplain.
2. Failure to grant the variance would result in exceptional hardship to the applicant for the
following reason: It is not feasible to elevate the structure at or above the base flood elevation. To
do so would not allow the aircraft Hangar to be utilized for its intended purpose.
3. Granting the requested variance will not result in damage or hardship for this or any other
property.
4. The proposed use is compatible with the surrounding industrial land uses and existing
similar facilities.
5. The applicant has established good and sufficient cause for this Commission to find
pursuant to SCC § I 5.25.060(b)(5) that the granting of a variance will not result in increased flood
heights, additional threats to public safety, extraordinary public expense, create nuisances, cause
fraud on or victimization of the public or conflict with existing laws.
6. Because the proposed variance has low damage potential and otherwise conforms to all
variance criteria in SCC§ 15.25.060(a) & (b), the Commission finds this application to be one of
those "very limited circumstances" described at SCC§ 15.25.060(b)(7) for granting this floodplain
variance on Lot 9, Block 200, Seward Airport.
7. Considering all of the above findings, the Commission hereby determines that the
requested variance to construct the aircraft Hangar and supporting utilities on Lot 9, Block 200,
Seward Airport, at an elevation of 16 feet which is approx. 4 feet below the base flood elevation, is
the minimum necessary to afford relief.
Section 3. Based on the above findings, the Planning and Zoning Commission hereby grants
Lucky Wilson a floodplain variance from SCC§15.25.050.B.2. allowing the lowest floor of the
proposed aircraft Hangar and supporting utilities to be constructed approximately four (4) feet below
the base flood elevation of 20.0 feet.
Section 4. Based on the above findings, the Planning and Zoning Commission hereby grants
Luck Wilson a floodplain variance from SCC§ 15.25.050B2. allowing the aircraft Hangar to be
constructed without being flood -proofed with watertight walls substantially impermeable to the
passage of water.
Section 5. Base on the above findings, the Planning and Zoning Commission hereby grants

Luck Wilson a floodplain variance from SCC§15.25.050.B2 allowing the aircraft Hangar to be
constructed without additional components capable of resisting hydrostatic and hydrodynamic loads
and effects of buoyancy.
Section 6. Base on the above findings, the Planning and Zoning Commission finds the
proposed use, subject to the following condition satisfies the criteria for granting a floodplain
variance, and authorizes the administration to issue a Floodplain Variance Permit to Lucky Wilson
subject to the following conditions:
l . Work with staff to obtain a Floodplain Development Permit.
2. Upon completion of the proposed aircraft Hangar and before a Certificate of
Occupancy can be obtained the applicant must submit to the City of Seward a copy of the required
elevation certificate.
Section 7. In accordance with SCC§ 15.25.060.B.8, the Community Development Office
must give written notice to the applicant that the structure will be permitted to be built with a lowest
floor elevation below the base flood elevation and that the cost of flood insurance will be
commensurate with the increased risk resulting from the reduced lowest floor elevation. This
variance to construct the structure below the Base Flood Elevation will result in increased flood
insurance premiums rates as high as $25.00 per $100.00 of coverage.
Section 8. This resolution shall take effect ten (10) days following its adoption.

SCC Chapter 15.25 on Lot 9, Seward Airport

Lucky Wilson applied for a building permit to construct an aircraft Hangar on Lot 9, Block 200,
Seward Airport Lease Tracts. During the review process it was identified that the parcel is located
within a Federal Emergency Management Agency (FEMA) mapped Special Flood Hazard Area.
The City's Floodplain Management Ordinance (Title 15.25) guides development in the floodplain in
order to lessen the economic loss caused by impending flood events. Provisions of the ordinance
Section 15.25.050 General Standards provide specific construction standards for development in the
floodplain. Section 15.25.050(B)(2) requires that nonresidential construction must have the lowest
floor, including basement, elevated to the level of the base flood elevation; OR, together with
attendant utility and sanitary facilities, shall:
a. Be flood -proofed so that below the base flood level the structure is watertight with
walls substantially impermeable to the passage of water. The applicant is unable to
meet this requirement, noting that the aircraft Hangar cannot be constructed to be
watertight. The applicant is requesting a variance
b. Have structural components capable of resisting hydrostatic and hydrodynamic loads
and effects of buoyancy. The applicant is requesting a variance from the
requirement of adding additional structural components.
C. Be certified by a registered professional engineer or architect that the standards of
this subsection are satisfied. Item G is not applicable•. The applicant is requesting a
variance from the flood proofing. Stamped engineered plans for the aircraft
Hangar have been submitted to the City of Seward Building Department.
d. Nonresidential structures that are elevated, not flood proofed, must meet the same
standard for space below the lowest floor as described in SCC§15.25.050 B.l.b.
Item d. is not applicable, the aircraft Hangar will not be elevated, and the lowest
floor will be atgrade. The State ofAlaska does not allowfUl on theAirport Lease
sites and fill if add would render the site inaccessible by aircraft.
e. Applicants flood proofing nonresidential buildings shall be notified that flood
insurance premiums will be based on rates that are one foot below the flood proofed
level. The applicant has been notified of the increased flood insurance premiums
and shall again be notified through the variance process.
Based on the best available data the Base Flood Elevation for the applicants lease parcel is
approximately 20.0 feet. The applicant has applied to construct the proposed aircraft Hangar at no
more than one (1) foot above the adjoining airport apron which according to previously submitted
surveys and studies completed by DOWL engineers for the Seward Airport Master Plan, the
elevation of the proposed development area is approximately 16 feet. The applicant has also
submitted building plans that do not plan for wet flood proofing by adding flood vents.
Variance Requested:
The applicant is requesting a variance from Seward City Code§ 15.25.050(B)(2)(a)(b) and (d). in
order to construct the proposed aircraft Hangar and supporting utilities approximately 4 feet below
the base flood elevation.
CONDITIONS AND FINDINGS FOR GRANTING A VARIANCE
SCC415.25.060. Atmeal and Variance Procedure
(b) Conditions for variances
(1) Generally, the only condition under which a variance from the elevation standard may be issued
is for new construction and substantial improvements to be erected on a lot of 1 /2 acre or less in size
contiguous to and surrounded by lots with existing structures constructed below the base flood level,
providing subparagraphs (a) through (k) of subsection (a)(4) of this section have been fully
considered. As the lot size increases the technical justification required for issuing the variance
increases.
Review. The requested variance meets this stipulation. The variance request is for construction of a
new Hangar and supporting utilities on less than a'/Z acre lot, this lot is contiguous to and surrounded
by lots with existing commercial structures constructed below the base flood level.
The following are the consideration of (a) through (k) of SCC§ 15.25.060(a)(4):
In passing upon such applications, the commission shall consider all technical evaluations, all
relevant factors, standards specified in other sections of this chapter, and:
a. The danger that materials maybe swept onto other lands to the injury of others; There
is no reason to believe that placement of the structure will increase the danger of materials being
swept onto other lands. Staff has consulted with Dan Mahalak, Kenai Peninsula Borough
Hydrologist for his professional opinion. He has stated the area is a low flow velocity area. Mahalak
also noted if the structure were to be built above the Base Flood Elevation the added fill could cause
more problems by creating velocity on neighboring properties and/or increase flood levels in the
area.
b. The danger to life and property due to flooding or erosion damage The past three major
flood events in 1986, 1995 and 2006 did not present any significant threat to life and/or property in
the area of the proposed structure. In review of the draft 2010 FEMA Special Flood Hazard Area

maps due to be approved within the next year, the Seward Airport lease sites are no longer contained
within the Special Flood Hazard Area.
c. The susceptibility of theproposedfacility and its contents toflood lood damage and the effect
ofsuch damage on the individual owner. The past three major flood events in 1986,1995 and 2006
did not present any significant threat of flooding to the area.
d. The importance of the services provided by the proposed facility to the community. The
applicant is a licensed pilot, who has worked closely with the State of Alaska to secure an Airport
lease site for a large Hangar. He has verbally expressed the plans to open an aircraft storage business
at the Seward Airport which would provide a service to the community, increase property value and
tax revenue.
e. The necessity to the facility of a waterfront location, where applicable. Not applicable.
f. The availability of alternative locations for the proposed use which are not subject to
flooding or erosion damage. The majority of the Seward Airport and surrounding property is
located within the mapped Special Flood Hazard Area or floodway. Since an aircraft Hangar
requires a location near an airport, there are no other feasible locations for the proposed structure.
g. The compatibility of the proposed use with the existing and anticipated development.
The proposed use is compatible with the surrounding industrial land uses and existing similar
facilities located at the Seward Airport.
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that area. The 2020 Comprehensive Plan section 3.8.2 addresses
floodplain development by supporting the participation in the National Flood Insurance Program
(NFIP). Flooding of streams and rivers has historically occurred in Seward and the outlying areas as
most flat lands along the south central Alaskan coast is floodplain. The Resurrection River channels
and the airport erosion need continued attention. There is no evidence that this project would in
anyway increase or hinder the existing flooding issues in the area.
is The safety of access to the property in times of flood for ordinary and emergency
vehicles. It does not appear the proposed structure will add any safety concerns for standard and/or
emergency vehicles during flood events.
j. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood
waters and the effects of wave action, if applicable, expected at the site. The past three major flood
events in 1986,1995 and 2006 did not present any significant threat to life and/or property in the area
of the proposed structure.
k. The costs of providing governmental services during and after flood conditions,
including maintenance and repair of public utilities and facilities such as sewer, gas, electrical,
and water systems, and streets and bridges. There are no current or planned public utilities to the

proposed structure.
(2) Variances may be issued for the reconstruction, rehabilitation, or restoration of structures listed
on the National Register of Historic Places without regard to the procedures set forth in this section.
Review. Not applicable
(3) Variances shall not be issued within a designated floodway if any increase in flood levels during
the base flood discharge would result.
Review: Not applicable. However it should be noted that the designated floodway is located just
north of the cross wind runway. The main runway is located within the floodway.
(4) Variances shall only be issued upon a determination that the variance is the minimum necessary,
considering the flood hazard, to afford relief.
Review: The majority of the Seward Airport and surrounding property is located within the
floodplain or floodway. Since the proposed aircraft Hangar is dependent upon an airport location,
and it is not feasible to elevate the structure at or above the base flood elevation, the requested
variance to construct the aircraft Hangar on Lot 9, Block 200, Seward Airport at an elevation of 16
feet, which is approximately 4 feet below the base flood elevation, is the minimum necessary to
afford relief. It is also noted the 2010 Draft Floodplain Maps from FEMA illustrate the current
development areas of the Seward Airport as being removed from the Special Flood Hazard Area.
(5) Variances shall only be issued upon:
a. A showing of good and sufficient cause;

structure above the base flood elevation.
b. A determination that failure to grant the variance would result in exceptional hardship to
the applicant;
Review: Failure to grant the variance would result in exceptional hardship to the applicant for the
following reason: It is not feasible to elevate the structure at or above the base flood elevation. To
do so would not allow the aircraft Hangar to be utilized for its intended purpose.
c. A determination that the granting of a variance will not result in increased flood heights,
additional threats to public safety, extraordinary public expense, create nuisances, cause fraud on or
victimization of the public or conflict with existing local laws or ordinances.
Review: The past three major flood events in 1986, 1995 and 2006 did not present any significant
threat to life and/or property in the area of the proposed structure. There is no indication that
granting the variance will result in increased flood heights, additional threats to public safety, public

expense, create any type of nuisances, or cause fraud on or victimization of the public or conflict
with existing local laws or ordinances.
6) Variances as interpreted in the National Flood Insurance Program are based on the general
zoning law principle that they pertain to a physical piece of property; they are not personal in nature
and do not pertain to the structure, its inhabitants, economic or financial circumstances. They
primarily address small lots in densely populated residential neighborhoods. As such, variances from
the flood elevations should be quite rare.
Review: This variance is site specific to a physical lot less than the %2 acre size as required under
15.25.060(6)(1). Granting the variance does not result in a special privilege. Any other lessee with
similar conditions could obtain a similar variance.
(7) Variances may be issued for nonresidential buildings in very limited circumstances to allow a
lesser degree of flood proofing than watertight or dry -flood proofing where it can be determined that
such action will have low damage potential, complies with all other variance criteria except
subsection (b)(1) of this section, and otherwise complies with section 15.25.060(a) and (b).
Review. There is no indication that granting this variance will increase any damage potential to
either the applicant's structure or the surrounding structures. The application complies with all
variance criteria of 15.25.060(a) and (b).
(8) Any applicant to whom a variance is granted shall be given written notice that the structure will
be permitted to be built with a lowest floor elevation below the base flood elevation and that the cost
of flood insurance will be commensurate with the increased risk resulting from the reduced lowest
floor elevation.
Review: Staff has verbally discussed the National Flood Insurance Program with the applicant.
Upon approval of this variance the Community Development Office must give written notice to the
applicant that the structure will be permitted to be built with a lowest floor elevation below the base
flood elevation. Staff is also required to provide written notice that the cost of flood insurance will
be commensurate with the increased risk resulting from the reduced lowest floor elevation. This
variance to construct the structure below the Base Flood Elevation will result in increased flood
insurance premiums rates as high as $25.00 per $100.00 of coverage.
Conditions of the Variances
Upon consideration of the above factors and the purposes of Chapter 15.25 Floodplain Management,
the Commission may attach such conditions to the granting of variances as it deems necessary to
further the purposes of this chapter. Based on the above findings and conclusions, the administration
recommends imposition of the following condition for the floodplain variance permit:
l . Work with staff to obtain a Floodplain Development Permit.
2. Upon completion of the proposed aircraft Hangar and before a Certificate of

Occupancy can be obtained the applicant must submit to the City of Seward a copy of the required
elevation certificate.
RECOMMENDATION:
Commission approve Resolution 2010-08, granting Lucky Wilson a variance from Seward City Code
Chapter 15.25 Floodplain Management to construct an aircraft Hangar on Lot 9, Block 200, Seward
Airport based on the findings and the condition stated within the Resolution.

BACKGROUND & JUSTIFICATION:
The Planning and Zoning Commission began their current examination of the Title 15 Code Revisions
in June of 2009. Multiple work sessions have been held to address various chapters of the Title
including: Land Use Planning, Seward Zoning Code, Floodplain Management and Signs. Portions of
the Title remain for update and review. Once the Commission's final draft of the Title is completed,
public workshops will be held to discuss the updates and solicit feedback from the community prior to
Council public hearing and adoption.
At tonight's meeting the Commission should formalize their direction to administration by making and
approving a motion clarifying their wishes with respect to the August 17, 2010 Work Session topic and
continued review of Title 15.
RECOMMENDATION
It is the recommendation of administration that the Commission set the work session topic for
August 17, 2010 as "Continued Review of Title 15."

WHEREAS, Cline and Associates Land Surveyors submitted a preliminary plat to the City
of Seward for review and recommendation to the Kenai Peninsula Borough; and
WHEREAS, this replat combines the six (6) existing Lots 1 through 6, Block 13, Federal
Addition, into a single new lot; and
WHEREAS, the new lot will be known as Lot 1 A, Federal Addition, containing
approximately 29,978 square feet; and
WHEREAS, the property is zoned Auto Commercial (AC); and
WHEREAS, the parcels currently contain the Church of the Nazarene structure and the
parking lot; and
WHEREAS, the property is currently serviced by municipal water, sewer, electric and other
utilities City staff have stated that a subdivision installation agreement is not required for this re -
subdivision; and
WHEREAS, as required by Seward City Code § 16.01.015(f), Conditions to plat approval, no
public hearing is required.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends the Kenai Peninsula Borough approve the Federal

BACKGROUND & JUSTIFICATION:
Attached for the Commission's review and recommendation to the Kenai Peninsula Borough
Planning Commission is a preliminary plat. This replat will vacate the interior lot lines
combining the six (6) originally platted parcels of Lots 1 through 6, Block 13, Federal Addition
into a single lot to be known as Lot 1 A, containing approximately 29,978 square feet.
In accordance with Borough requirements, the City must review and comment on a plat before
submittal to the Borough for approval.
Subdivision Review:
Zoning.
The lots are zoned Auto Commercial (AC). SCC 15.05.025 (b) (8) Auto commercial district
(AQ. Intended to provide areas to accommodate highway -oriented commercial activities such
as offices, certain institutional uses, and limited personal services and retail uses requiring
substantial outdoor activity, traffic and parking, and which also serve the offices and nearby
residential areas, and which do not materially detract from nearby residential areas.
Utilities:
The property is served by the existing public utilities and maintained streets, therefore a
subdivision agreement is not required. Existing water, sewer and electric lines are located in the
adjacent rights -of -way. There are several fire hydrants within an approved distance.
Size:
The single lot will contain approximately 29,978 square feet each and will be approximately 300
feet in width. The new lots meet the requirement for minimum lot width and buildable lot size
within the Auto Commercial Zoning District.
Existing Use
Currently the parcel contains the existing structure of the Church of the Nazarene and the
parking lot. Based on aerial photos from 1963, the structure was built prior to zoning in Seward.
Therefore, the structure was built across interior lot lines and is considered a legal non-
conforming structure. The current owner of the land has inquired about remodeling and repair of
the church structure and further development of the current parking lot.
Flood Zone:
The property is not within a FEMA mapped Special Flood Hazard Area.

Morgan thanked unity Development Department staff for the efforts to prepare the
draft language for the W' nergy Conversion System ordinance.
Ecklund said she would like to be excused from the June 15 Planning & Zoning
Commission work session. She also said the Kenai Borough Peninsula Attorney is researching
whether municipal Planning & Zoning Commissioners must abstain from voting on issues that
again come before them when sitting on the Borough commission. The double voting restriction
should be discontinued, Ecklund said.
Roach' also thanked the Community Development Department for the work in preparing
the agenda packet for the meeting. She also said the new city shuttle service had been well
received.

Thank you for the letter dated 13 July, (RE: Political Signage within the City of Seward)
keeping all the Candidates informed as to the City of Seward's policy on political signs.
My wife and I love visiting Seward and do not want to take away, from of such a delightful
town its beauty. We will not be posting signs anywhere within the State of Alaska.
I believe that these signs are an eye sore, that pollutes and often remains in place far after the
elections. What really irritates me is that this practice comes at a time when the State is at its
peak of tourism.
I want people to vote for the candidate because of what they stand for and not because it was
the last name they saw on the way to the polls.

Thank you for the opportunity to provide comments on the preliminary City of Seward Digital .Flood
Insurance Rate Map (DFIRM) and Flood Insurance Study Report. The City appreciates the updates to our
FIRM maps and also the Community Meetings attended by FEMA, your contractors, the State NF.I.P
Coordinator, the Kenai Peninsula Borough, and insurance representatives.
At this time the City has these comments:
1) The City of Seward received verbal confirmation at the meeting held at 9:30am on June 17,
2010 that all Zone Xs would be clearly marked on the final DFIRMS. Not clearly indicating
these areas on the maps leave an ambiguity that will cause confusion with property owners, banks,
insurance companies and others. This item must be corrected and incorporated prior to the
DFIRMs becoming effective. Thank you for listening to our comments and addressing this
labeling request.
2) The City of Seward received verbal confirmation at the meeting held at 9:30am on June 17,
2010 that the areas within the Seward Small Boat Harbor (adjacent to 4te Avenue) would be
updated to reflect the previously issued FIRMS designating the water/tideland area as Zone
A. The VE Zone states that it is a coastal flood zone with a velocity hazard (wave action) and
base flood elevations have been determined. There is no wave action within this area of the
Seward Harbor, due to protection from the breakwater. Additionally, a 250-foot breakwater
extension is currently being constructed by the US Army Corps of Engineers. This project will
greatly reduce the velocity hazard within the Northeast harbor. Thank you for examining our
previously submitted comment regarding this item and reevaluating the zone designation.
3) The City of Seward requests that FEMA review the Zone A along Marathon Creek and
provide a determination to its exact location and clarification for the DFIRM. There seems
to be a discrepancy between the printed version of the DFIRM and the electronic version
presented at the meetings. This needs to be clarified so that the City can accurately regulate this
Special Flood Hazard Area.
Thank you again for the opportunity to comment on the preliminary DFIRMS and FIS Report for Seward,
Alaska. The City of Seward is providing comments at this time per the 30 day comment period discussed at
the community meetings held on June 17, 2010, The City would like to review the updated maps and
reserve additional opportunity to comment on the changes. Please provide the updated maps to the City
within the 30 day comment period or provide written documentation on additional comment opportunity.

The City of Seward appreciates your paving work and the improvements to the town's
infrastructure. As you know, several areas in town are in need of new asphalt. This letter
is to remind you that when working in Seward, certain types of signage are not allowed.
A snipe sign for Gorman Construction has been noted, and we would appreciate your
attention to this matter. A snipe sign is a temporary sign or poster affixed to a tree, fence
or utility pole. Snipe signs are prohibited per Seward City Code, 15.20.35. You may
research the Seward City Code further online at: Municode.com.

The Community Development Department would like to offer assistance in improving the current
condition of the commercial property at 219 Fourth Avenue. The historical structure, sometimes
referred to as the Orlander Building, has fallen into disrepair. The poor condition of the building
is of particular concern because it is located within the heart of the central business district and
stands among the town's most frequented shops.
To assist you, the Community Development Department is willing to reimburse up to $500 for
material expenses toward paining, remodeling and safely securing the exterior of your building.
Please note that the City of Seward also has volunteers who would be willing to paint the
building, with your permission. If you complete the work, you may submit the receipts to:

We would like you to know there are provisions within Title 9 of the Seward City Code that
allow the municipality to take action when structures have fallen into disrepair. Note 9.20.15
Enumerated. * The following acts and conditions shall constitute a public nuisance:
(23) Property including but not limited to building exteriors which are maintained in such
condition as to become so defective, unsightly or in such condition of deterioration or disrepair
that the same causes appreciable diminution of the property values of surrounding property or is
materially detrimental to nearby properties and improvements....

This letter is being sent to seek your cooperation with concerns brought to the attention of the
Community Development Department. Complaints have been received regarding the current
landscape conditions of the parcel located at 425 Fourth Avenue.
As you are aware the Seward Planning and Zoning Commission issued a Conditional Use Permit
(CUP) in 2003 allowing the construction and operation of a Four -Unit structure on the parcel
subject to several conditions being met. Both landscaping and parking plans were conditions
required of the CUP. You submitted a parking and landscape plan in March of 2004 which was
approved by this office March 24, 2004. Copies of your submitted parking and landscape plans
and the approval letter have been attached for your reference.
A site visit today confirms that the fulfillment of the landscape and parking plans have not been
accomplished on the property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, SUPPORTING THE ROAD AND SIDEWALK PRIORITY
LISTS THAT ARE TO BE FUNDED USING THE STATEWIDE
TRANSPORTATION IMPROVEMENT PROGRAM AND FEDERAL
EARMARK MONIES ADMINISTERED THROUGH ADOT&PF
WHEREAS, the City of Seward currently has two earmarks with ADOT; and

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEWARD, ALASKA:
Section 1. The City of Seward, City Council adopts the road and sidewalk
priorities as attached that are to be funded using the Statewide Transportation
Improvement Program and Federal Earmark monies.
Section 2. The City of Seward City Council authorizes the City Manager to
negotiate the priorities and costs with ADOT&PF to formulate a final scope of
work.
Section 3. This resolution shall take affect immediately upon its adoption.

BACKGROUND & JUSTIFICATION:
The City of Seward currently has two federal earmarks for transportation improvement projects. The
first earmark grants the city $2M strictly for road improvement projects. This earmark does not
require a match from the city. The second earmark grants the city $2.7M for road, sidewalk and
drainage improvement projects. This earmark does require a match of approximately $300K from the
city.
A draft list of priorities for both earmarks was presented to council on March 8, 2010 and modified to
come up with a defined priority list for expending the available funds. The city council solicited
public comments on these priorities and have been provided with a copy of all of the public
comments. The city council met to discuss the public feedback and the priority list was again
modified.
In order to obligate these funds, the City must provide a defined scope of work by no later than
September 2010 or the funds may be reallocated. The attached priority lists define the roads and
sidewalks in which the City wishes to expend the federal grant monies. To secure these funds the
City of Seward, City Council must adopt a final road and sidewalk priority list to submit to
ADOT&PF.
INTENT: The City of Seward, City Council adopts the road and sidewalk priorities as attached that
are to be funded using the Statewide Transportation Improvement Program and Federal Earmark
monies. The adopted list will be forwarded to ADOT&PF in order to secure two federal earmark for
road and sidewalk repair and improvements. After ADOT&PF receives the adopted list, they will
assign costs to the associated work and further work with the City to determine a feasible project and
timeline.
FISCAL NOTE: One of the available earmarks requires a match of approximately $300,000.
