RESOLUTION 2010 -091
A RESOLUTION OF THE CITY COUCIL OF THE CITY OF SEWARD,
ALASKA AUTHORIZING A SOLE SOURCE PROFESSIONAL SERVICE
AGREEMENT WITH PND ENGINEERS TO ENGINEER AND DESIGN
TWO DOLPHINS AND DOCK IMPROVEMENTS FOR THE ARRV AT
THE SEWARD MARINE CENTER FOR AN AMOUNT NOT -TO-
EXCEED $202,359, AND APPROPRIATING FUNDS
WHEREAS, the City of Seward secured a FY 2010 Designated Legislative Grant in the
amount of $1,500,000 to provide funding for dolphin installation and dock maintenance at the
Seward Marine Center (SMC); and
WHEREAS, this project will provide dock infrastructure for the new Alaska Region
Research Vessel located at the Seward Marine Center, which is necessary to secure the vessel in
Seward; and
WHEREAS, grant funds may be used to provide contractual services, engineering,
design, planning, permitting, project management and construction; and
WHEREAS, the City has worked collaboratively with UAF to develop a scope of work
for architectural and engineering services for the Seward Marine Center ARRV dolphins and
dock improvements and UAF has a concept design completed in 2001 by PND Engineers, Inc.;
and
WHEREAS, PND's proposal revealed that PND Engineers, Inc. is one of the few
marine -based consultants in the Northwest and are extremely qualified in designing dolphins and
dock improvements and the State of Alaska, USCG and the petroleum industry use PND's
design services for most marine type docks and wave barriers in Alaska, because of their
expertise; and
WHEREAS, the UAF staff assisting with this project has encouraged the City to sole
source and enter into a professional service agreement for the design of the dolphins and dock
improvements with PND Engineers, Inc. due to their previous history and knowledge of this
project and desire to move forward expediently; and
WHEREAS, PND Engineers, Inc. has provided excellent services at competitive prices
for the City of Seward; and
WHEREAS, the City will carefully manage the project with PND Engineers, Inc. to
assure all efficiencies are considered and implemented to save on initial and long -term costs, and
the City will continue to seek additional funding for continued dock improvements, dredging and
upgrades of the cathodic protection systems; and

WHEREAS, the Seward City Code SCC 6.10.120(A)(8) exempts specialized products
and professional services from the competitive procurement process, including professional
services for engineering services; and
WHEREAS, this grant allows the City of Seward to utilize its own procurement code to
expend these grant funds.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEWARD, ALASKA:
Section 1. The City Manager is hereby authorized to enter into a sole source professional
service agreement with PND Engineers, Inc., in substantially the form presented at this meeting,
to design and engineer two dolphins and dock improvements at the Seward Marine Center.
Section 2. The City Council finds that this contract involves professional services as
described in SCC 6.10.120(A)(8) and is therefore exempt from competitive procurement
provisions.
Section 3. The amount of $202,359 is hereby appropriated from the Dolphin Installation
and Dock Maintenance at SMC account number 275- 2750 -5390.
Section 4. This resolution shall take effect immediately upon its adoption.

Agenda Item: SMC sole source professional service agreement
with PND Engineers, Inc. to design and engineer
two dolphins and dock improvements at the Seward Marine Center in an
amount not -to- exceed $202,359
The Seward Marine Center (SMC) is a major coastal marine research facility operated by the
University of Alaska Fairbanks. The waterfront location of SMC is on land that the City of Seward
has provided under a 99 -year lease. It is an excellent deep water location on Resurrection Bay with a
150 foot pier to support research ship operations.
Since 1980, the UAF School of Fisheries and Ocean Science (SFOS) have conducted marine
research at the Seward Marine Center, Seward, Alaska, through the use of a federally owned research
vessel, the Alpha Helix. Over time, there has been a growing need for a newer vessel with improved
technology to support the research operations. The Federal Oceanographic Facilities Committee, the
National Science Board, and the National Science Foundation recognized the need for SFOS to
expand their marine and oceanographic research capabilities. These agencies supported the
replacement of the Alpha Helix with a new, larger marine research vessel, named the SIKULIAQ.
The installation of two moorings and dock improvements would allow larger research vessels to
safely dock and moor in Seward for load out of science equipment; supplies and short duration
stays would greatly expand the current capabilities. The upgrade would consist of two mooring
dolphins installed outboard of the pier connected by a catwalk. It would expand the moorage
capability at SMC by providing fendering and mooring points for vessels up to the length of the
Alaska Region Research Vessel.
Dock improvements anticipated at the site include dredging a basin/channel for safe navigation to
the dock structure. The dock is located near the mouth of Lowell Creek which has deposited a
significant amount of material on the seabed due to the large bed load in the stream. Removal of
this material will greatly enhance navigation safety. Additional dock improvements will be
performed on other items including cathodic protection and electrical upgrades.
The City of Seward is committed to supporting the ship operations and the attributes that Seward
provides including; road system to Anchorage, local shipyard with lift capability to dry -dock the
ship, ice free harbor, existing shore support facility on land provided by the city, location for Gulf
of Alaska science work, access to the Bering Sea and points north, availability of existing facility
for mooring the ship at the cruise ship pier with heavy lift capability for loading vans and heavy
deck gear onto the ship, routine barge deliveries from Seattle for bringing up heavy science load
out items, existence of AVTEC with its maritime training program, simulator, and plans for
firefighting training center.
Seward is committed to assist with this upgrade at SMC dock to allow the ARRV to tie -up at the
existing pier for load out and fair weather mooring.
In May 2009, the City Manager sent a letter to the School of Fisheries and Ocean Sciences
acknowledging the secured funding for the ARRV and soliciting feedback for the initial
requirements for home porting the ARRV at the Seward Marine Center Dock in Seward, Alaska (see
attached letter from the City Manager dated May 12, 2009). Due to the existing infrastructure in
Seward at UAF's marine center; the City of Seward's commitment to upgrade the marine center's
dock; and the availability of the Alaska Railroad Dock facilities, Seward was selected as the home
port for the ARRV (see attached letter from UAF dated January 4, 2010). In June 2010, the City
received another letter from UAF authorizing the City of Seward to proceed with the mooring
improvements at UAF's Seward Marine Center (SMC) (see attached letter from UAF dated June 16,
2010). Since then, the City has collaboratively worked with UAF to develop the scope of work,
timeline and budget for the dolphin and dock improvement project.
In 2010, the City successfully received a State legislative grant for $1.5 million for the following
project: Mooring Dolphins and Dock Improvement at Seward Marine Center. This funding will
enable the City to construct the dolphins and dock improvements to secure a home port for the
ARRV. The objective of this project is to provide dolphins for the new Alaska Region Research
Vessel for access to the Seward Marine Center. The grant funds may be used towards contractual
services, engineering, design, planning, permitting, project management and construction. The
City is actively working to complete construction by the fall of 2011.
This grant allows the City of Seward to utilize its own procurement code to expend these grant

professional services from the competitive procurement process, including professional services
for engineering services.
INTENT: To authorize the City Manager to enter into a sole source professional service agreement
with PND Engineers, Inc., in substantially the form presented at this meeting, to design and engineer
two dolphins and dock improvements at the Seward Marine Center in an amount not -to- exceed
$202,359.

Funding not -to- exceed $202,359 is available from State legislative grant funds.
