RESOLUTION 2003-145
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
AWARDING A SOLE SOURCE CONTRACT IN THE AMOUNT NOT TO EXCEED
$596,556.00 TO EQUIP THE SEWARD EMERGENCY COMMUNICATION CENTER
WITH RADIO CONSOLES AND OTHER EQUIPMENT TO REPLACE AND
UPGRADE OUR CURRENT FAILING EQUIPMENT, AND HAVE THE EQUIPMENT
TO SUPPORT BOTH VHF RADIO FREQUENCY, AND 800 MHZ ALASKA LAND
MOBILE RADIO (ALMR) NETWORK DIGIT ALLY TRUNKED OPERATIONS
WHEREAS, the State of Alaska and Department of Defense awarded Motorola the sole
source contract for the ALMR system for statewide interoperable emergency communications;
WHEREAS, this award was based on fact that Motorola is the only vendor that makes an
Association of Public-Safety Communications Officials (APCO) Project 25 compliant radio
console for digital public safety radio communication;
WHEREAS, ProComm Alaska is Motorola's only Alaska Agent and Manufacture's
Representative, and only contractor authorized by Motorola to design, build and maintain the
radio communications, and will provide unquestioned compatibility of equipment in this award;
WHEREAS, ProComm Alaska designed, installed and will carry the maintenance
contracts for the communities of Homer, Kenai, Soldotna, and that a similar contract will be
offered to Seward, and because all communities are working with ProComm cost effective
results should occur for all the aforementioned communities, and it will also provide
unquestioned compatibility of equipment in this award;
WHEREAS, the grant from the Office of Homeland Security was based on specific
Motorola equipment, and that office has no objection to sole source award;
WHEREAS, the equipment in this award meets future ALMR needs due to cooperative
planning by the City of Seward, the Borough, Soldotna, Homer and Kenai, and local and State E-
911 Boards;
WHEREAS, Motorola dba ProComm Alaska is the only contractor who has submitted
proposals for concept engineering and design, as well as budgetary proposals, for the City of
Seward Emergency Operation Center, Homer Police Department 911 Center, and the Kenai
Peninsula Borough multi-site repeater system during the 2003 Department of Homeland Security
grant application process;

WHEREAS, the City of Seward Emergency Operations Center has received grant funds
for the replacement and upgrade of all the current and failing radio consoles that is being used;
WHEREAS, the Seward Municipal Code provides that equipment or contractual services
that can be furnished only by a single dealer or that has a uniform price wherever bought may be
sole sourced;
WHEREAS, the Council of the City of Seward has determined that this award is in the
best interests of the City and the Emergency Communication Center of Seward as designed by
Motorola, and that the equipment provides interoperability for emergency responders, and is
unique in that it includes the only APCO 25 trunked digital compliant consoles presently
available.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA.
Section 1. Funds in the amount of $596,556.00 be appropriated from the Homeland
Security Dispatch grant, account no. 651-6513-4680-0200 to Homeland Security Dispatch grant
contracted services, account no. 651-6513-5390.
Section 2. That a sole source contract in the amount not to exceed $596,556.00 to equip
the Seward Emergency Communication Center with new and updated radio consoles and related
equipment with Motorola radios and other related equipment supporting both VHF radio
frequency, and 800mhz ALMR network digitally trunked operations be awarded to ProComm
Alaska.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this
24th day of November 2003.

Agenda Item: Sole Source Request for ProComm Alaska
BACKGROUND & JUSTIFICATION:
The Seward Police request an exception to the general rule concerning free and open
competition to design and build the communications system in the City of Seward Emergency
Operations Center, and for the purchase of ALMR digital portable and mobile radios based on
the following criteria:
1.
The State of Alaska and Department of Defense awarded Motorola the sole source
contract for the Alaska Land Mobile Radio (ALMR) system, establishing statewide
interoperable communications for general emergencies and disasters for the entire State;
2.
ProComm is Motorola’s authorized distributor, installer and maintainer in Alaska, and they
are the primary public safety communications equipment vendor in Alaska and the only
contractor to build a radio console, which meets the FCC’s APCO 25 standard;
3.
ProComm designed, installed and will carry the maintenance contract for the City
communications upgrade, and for those in Kenai, Soldotna and Homer which should
result in some cost savings, and will provide unquestionable compatibility of equipment;
4.
ProComm would provide unquestioned compatibility of communications equipment
between the Seward, Kenai, Soldotna, Homer, Borough and State/Federal agencies;
5.
The grant approval to the City at the heart of this request, $700,154.00 from the Office of
Homeland Security, was awarded based on this equipment specifically;
6.
Equipment in the grant was specified to meet future ALMR needs through cooperative
planning by the City of Seward, the Borough, and the cities of Soldotna, Homer and
Kenai, and other unincorporated communities on the Kenai Peninsula;
7.
ProComm/Motorola submitted the only spec packages during the nearly year-long grant
planning phases;
8.
Specifications were developed based on current interoperable communications needs for
emergencies and disasters for multi-agency response and coordination, and for future tie-
in to the ALMR system per the Federal government;
9.
Other contractors cannot provide unquestioned compatibility with communications
equipment local and State emergency providers have in place or are installing now;
10.
ProComm has a local office that reduces mobilization time and cost;
11.
Local and State E-911 Boards participated in the development of necessary equipment
and support the awards as specified.

8.the purchase of professional services. Professional services are those that require special
knowledge and judgment that includes analysis, evaluation, prediction, planning or
recommendations and which results in the production of a report or the completion of a
task
6.10.130 Where competitive bid proposals are not in the public interest.
Restrictions and provisions of this title shall not apply where the city council determines and
makes written findings that the public interest would be best served by not requiring
competitive bids/proposals.
Supporting Justification:
ProComm is Motorola’s authorized distributor, installer and maintainer in
Alaska. The contract includes professional services (engineering). The federal funds grant was awarded
through the Office of Homeland Security based on grant request as specified, award contains specified
equipment. ProComm Alaska is a state contractor with a local office, and the City of Seward would benefit
from the State discount price schedule. Management of this project is the responsibility of the City of Seward
and not the contractor.
