RESOLUTION 2013-01
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL
APPROVE THE ATTACHED ORDINANCE AMENDING THE ZONING
DESIGNATION OF A SMALL PORTION OF CITY OWNED LAND
LOCATED WITHIN TRACT G OF THE WATERFRONT PARK
REPLAT, FROM HARBOR COMMERCIAL (HC), TO PARK (P)
WHEREAS, the Kenai Peninsula Borough approved the Waterfront Park Replat which
was recorded as plat 2012-04 in the Seward Recording District on June 8, 2012; and
WHEREAS, located within Tract G, Waterfront Park Replat is a relatively small,
approximately two-thirds of an acre of land, that is zoned Harbor Commercial (HC); and
WHEREAS, the parcel known as Tract G of the Waterfront Park Replat, is located
immediately south of Tract H which is commonly known as the South Harbor Uplands and east
of the privately owned Harbor Light Apartments; and
WHEREAS, the approximate two-thirds of an acre area, proposed in this rezone has
historically been used as a motor home camping area of Waterfront Park, and
WHEREAS, the Park Zoning District was established to provide areas for recreation and
commemorative property owned by the City, state or federal governments for recreation and
other compatible public purposes; and
WHEREAS the Land Use Plan Map, the 2020 Comprehensive Plan and the Seward
Strategic Plan all support Tract G, Waterfront Park be designated as Park Zoning; and
WHEREAS, it is a goal of the Seward Comprehensive Plan to bring the Zoning Map into
conformance with the Land Use Plan; and
WHEREAS, the public notification process was complied with and the appropriate
public hearing as required by Seward City Code § 15.01.040 was conducted by the Commission
on January 3, 2013.

NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Seward Planning and Zoning Commission supports the proposed zoning
changes and recommends the attached Ordinance 2013-_ be forwarded to City Council for
approval.
Section 2. This resolution shall take effect immediately upon its adoption.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE ZONING DESIGNATION OF A SMALL
PORTION, APPROXIMATELY TWO-THIRDS OF AN ACRE, OF CITY
OWNED LAND LOCATED WITHIN TRACT G OF THE WATER FRONT
PARK BOUNDARY FROM HARBOR COMMERCIAL ZONING (HC) TO
PARK (P) ZONING DISTRICT
WHEREAS, administration hired Cline and Associates Land Surveyors to prepare a
preliminary plat of the City owned lands, establishing the perimeter boundary of the historical area
commonly known as Waterfront Park; and
WHEREAS, by Resolution 2011-037, dated May 23, 2011, Seward City Council
recommended the Kenai Peninsula Borough Plat Committee approve the Waterfront Park replat; and
WHEREAS, the Kenai Peninsula Borough approved the Waterfront Park Replat which was
recorded as plat 2012-04 in the Seward Recording District on June 8, 2012; and
WHEREAS, located within the Tract G, Waterfront Park Replat is a relatively small,
approximately two-thirds of an acre of land, that is zoned Harbor Commercial (HC); and
WHEREAS, the parcel known as Tract G of the Waterfront Park Replat, is located

designation of all lands within Tract G, Waterfront Park to Park Zoning District.
Section 2. This ordinance shall take effect ten (10) days following its enactment.

BACKGROUND & JUSTIFICATION:
Attached for the Commission's review and recommendation to the Seward City Council
is Resolution 2013-01, recommending City Council approval of Ordinance 2013-xxx (attached),
amending the zoning designation of a small portion of Tract G, Waterfront Park Replat from
Harbor Commercial (HC) to Park Zoning District (P).
Administration hired Cline and Associates Land Surveyors to prepare a preliminary plat
of the City owned lands, establishing the perimeter boundary of the historical area commonly
known as Waterfront Park. By Resolution 2011-037, dated May 23, 2011, Seward City Council
recommended the Kenai Peninsula Borough Plat Committee approve the Waterfront Park replat.
The Kenai Peninsula Borough approved the Waterfront Park Replat which was recorded as plat
2012-04 in the Seward Recording District on June 8, 2012.
The area known as Waterfront Park contains 106.97 acres having a legal description of
Seward Original Townsite, Waterfront Park Replat. Tract G of the Waterfront Park is located at
the North boundary, within the established park boundary. The area of Tract G, proposed in this
rezone is south of the South Harbor Uplands and east of the Harbor Lights Apartments. The
small area of Harbor Commercial Zoning within Tract G is approximately 29,500 square feet,
less than two-thirds of an acre. The area has historically been used as a campground for summer
visitors' motorhome parking.
The surrounding zoning is Park on the East and South and Harbor Commercial to the
West and North. Property use to the East is summer camping, parking and Resurrection Bay. To
the South is Scheffler Creek better known as the "Fish Ditch" and Waterfront Park. To the West
is an undeveloped alley containing a tree buffer and the back of the Harbor Lights Apartments.
To the North is the driveway access to the South Harbor Uplands and open parking area.
Seward City Code SCC §15.01.035, Amendments, (b) (3) allows the consideration of this
rezone because the land is contiguous to the requested Park Zoning District and is recommended
by the Land Use Plan.
The Land Use Map, as adopted by the 2020 Comprehensive Plan, designates the area
requested for rezone as Park (P) as defined in SCC 15.05.025 (b)( (12) Parks district (P). Is
intended to designate park, recreation and commemorative property owned by the city, state or
federal governments for recreation and other compatible public purposes.

Staff Comments:
Community Development staff has presented the zoning change to all department heads
for review and discussion. All departments support the requested zoning changes.
Public Comment:
Property owners within three hundred (300) feet of the proposed rezone action were
notified. Public notice signs were posted on the property, and all other public hearing
requirements of Seward City Code § 15. 01.040 were complied with.
One public comment was received in non-support of the rezone. This comment has been
included in your packet. Concern was voiced that the area requested for rezone could be used as
a location for a new Harbor Master building or other commercial shops and not to park "the
Harbor Fleet." Staff has tried to contact Mr. Tougas to discuss his concerns but he is unavailable
until the 10t' of January.
RECOMMENDATION:
Commission approve Resolution 2013-01 recommending City Council approval of the attached
Ordinance 2013-xxx, amending the zoning designation of approximately two-thirds of an acre of
City owned land located within the Waterfront Park boundary, Tract G, Waterfront Park Replat
from Harbor Commercial Zoning District (HC) to Park (P) Zoning District.

Ron and Jim, As you know P&Z is holding a public hearing January 3 on a resolution to rezone a fairly large piece
of land between the Harbor Lights Apartments and the new uplands area from Harbor Commercial to Park. I'm not sure
why this is being done NOW before the new uplands development plan has not been developed or adopted? I think this
land should be included in the consideration of the Uplands site.
As you know one of Seward's greatest weaknesses is the lack of private land available for small business development.
Each Year in the budget there is discussion about how something like 68% of the land in the city is not taxable because it
is owned by the City, the Fed's or the Alaska Railroad.
If we are ever going to be serious about encouraging investment and innovation in Seward we need to address the
"Choke Hold" that the City has on the land. I oppose this effort to rezone at this time unless it's part of a larger Harbor
Development Plan. This might be a good location for Harbormaster office or shop rather than using high value Harbor
Land for parking the Harbor fleet.
I also think that the public notice that calls this area a "Small Portion of City Owned Land" is misleading! This is a large
portion of the remaining Harbor Commercial Land.
Unfortunately I will not be able to attend the P&Z meeting but I wanted to bring up these points now rather than

City Planner Donna Glenz updated the Commission on the following business items:
• Glenz noted that the Shell drillship Nobel Discoverer, with an estimated 70 employees,
was in port for an undetermined duration.
• City Council was scheduled to meet December 10 for the last meeting of the 2012 calendar
year.
• A PACAB meeting was scheduled for noon, December 5 in Council Chambers.
• The next scheduled Planning and Zoning Commission meeting was slated for January 3,
2013.
• Glenz noted that a copy of an historic letter was provided as an informational laydown for
Commissioners. The letter, dated November 19, 1935 was addressed from Anthony J.
Dimond, an Alaska Delegate to the U.S. House of Representatives, to former Sewardite
Hilma Urie. The letter, which cited flooding of the Lowell Creek flume, was provided by
Kenai Peninsula Borough Assembly member Sue McClure, Urie's granddaughter.

issues, then reviewed the proposed changes to the City Parking Code.
Fleming asked if business operators were to be informed of Parking Code changes.
Glenz said the owners and operators of established parking lots would not be required to
meet any new code changes, and added that the public had been informed through published
notices and public meetings.
Notice of public hearing being posted and published as required by law was noted
and the public hearing was opened.

McClure said he enjoyed attending a November 11, 2012 Advanced Planning
Commissioner training in Anchorage.
Fleming added that she would enjoy attending Planning Commissioner trainings in the
future
Butts offered thanks to the public for the efforts to raise funds for local child Finn Michael
Federer, who required a heart surgery. The effort garnered approximately $16,000 in four days, he
said.
Ecklund added that she was pleased the community was able to raise funds for the Federer
Family. Ecklund also noted the benefits of attending the November 11 Advanced Planning
Commissioner training in Anchorage.

Upper Sandy River
Flood -Related Risks
As a result of a flood ravaging the
banks of the upper Sandy River in
Oregon in the shadows of Mount
Hood in January of 2011,
Clackamas County was more
concerned with erosive velocities
and long term changes in the river
alignment than base flood
elevations. The event coincided with
FEMA's effort to restudy the area
using recent high resolution LiDAR
terrain data. The effort involves
multiple partners including the
Oregon Department of Geology and
Mineral Industries (DOGAMI), the
Oregon Department of Land
Conservation and Development, and
STARR.
As a result of the disaster,
Clackamas County asked the State
about potential projects to further
analyze the risks attributed to effects
of long term erosion and urgent
needs for data to help manage
planned bank stabilization projects
during the upcoming summer
building period. Given that a new
study was underway; all
stakeholders concluded that using
the more accurate study data would
be beneficial. However, the
surveying and hydraulic analyses
would not be completed until the
spring of 2013. Clackamas County
was concerned about the upcoming
2012-2013 flood season.
FEMA Regional Engineer David
Ratte learned about the concerns and
proposed that through Risk MAP,
we could better identify the velocity
hazards with a limited -detail
hydraulic model. A limited -detail
model is based on geometry derived
from the LiDAR terrain data rather
than field surveys. The effort would
not be too costly and could be
finished before the flood season.
Furthermore, velocity data could be
ARI?
extracted from the model and
projected on risk maps showing
where the higher velocities were
most likely, as well as ranges. The
areas of highest risk based on depth
and velocity magnitudes could be
color -coded for better graphic
representations. The County and the
state were pleased with the proposal.
Upon completion of the work,
Clackamas County Emergency
Manager Jay Wilson observed that
the products "...help tell the story of
the river and how it changes." The
County used the data to present to
local property owners and
stakeholders at a preparedness
workshop. The results were well
received. The Sandy River Basin
Watershed Council expressed
interest to use the data for their
outreach activities.

The work is a great start towards
developing a better understanding of
the river's powerful impacts, but
more studies are needed to develop
bank stabilization design guidance
and to examine specific properties
and account for side channels. The
new detailed study underway will
help support additional assessments
and the County is planning projects
through the Hazard Mitigation Grant
Program. The maps bring the
dynamic nature of the river to life in
a way that a FEMA Flood Insurance
Rate Map aren't designed to do.

The FEMA GeoPortal Online is an
open web based mapping and data
tool which allows FEMA to post
information outside of their firewall
for the first time. Hurricane Sandy
was the first full-scale disaster that
utilized the online GeoPortal to
showcase various web maps
focusing on shelters, Hazus output,
housing, projected hurricane paths,
flood losses etc.
Region X GeoPortal usage could
include but is not limited to the
following:
• Post information for any large
scale event which FEMA is
responding to.
• Post additional information such
as Hazus outputs.
• Data storage for download
Currently the GeoPortal has a
Washington Hazus User Group that
you can join which provides
updated Hazus datasets for all States
within FEMA Region X. You are
encouraged to look at the Hurricane
Sandy maps which will provide an
overview of the type of datasets that
FEMA can provide in an event.

opportunity for Council to provide direction on the Commission's annual priorities.
Staff is requesting the first topic for the January 15, 2013 P&Z work session as "Review and
Discussion of 2013 Priorities" in preparation for the joint work session with Council. If P&Z has
any preferences for the date of the joint work session with Council, staff will forward those to the
City Clerk. A copy of the 2012 Priorities have been included with this memo.
Staff is requesting the second topic for the January 15, 2013 work session as "Continued
Discussion of the Municipal Lands Management Plan."
Recommendation: Staff suggests Commissioners establish the 2013 priorities during the
January 15 work session.

A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA,
RECOMMENDING CITY COUNCIL APPROVAL OF THE PLANNING
AND ZONING COMMISSION PRIORITIES FROM APRIL 2012 TO
APRIL 2013
WHEREAS, at the February 21, 2012 work session the Planning and Zoning
Commission reviewed their Priorities List; and
WHEREAS, the Seward City Council Rules of Procedure, adopted March 14, 1994, state
that the Council should meet in an annual joint work session with the Commission to address
areas of mutual concern; and
WHEREAS, the Commission and Council held a joint work session, reviewed and
updated the Planning and Zoning 2012 Priorities List on March 28, 2012; and
WHEREAS, at the May 1, 2012 meeting the Planning and Zoning Commission reviewed
and approved the Planning and Zoning Priority List; and
WHEREAS, Council will address a resolution adopting these recommendations.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The following List of Planning and Zoning Priorities is hereby approved and
recommended to Council for their adoption:
Priorities
Short and Medium Term
1) Municipal Lands Management Plan (1995) —Update in conjunction with the Capital
Improvement Plan and the City Land Disposal Policies and Procedures
2) Continued Rewrite of Title 15

3) Nash Road Bench Sturdy (Resource Management Development Impact Study) as funding
allows
Continuing Items
1) Continue recruitment efforts for the Planning and Zoning Commission
2) Continue to pursue compliance with the Seward City Zoning Code
• Submit a resolution to City Council outlining the Planning & Zoning Commission
recommendations for health and safety compliance
3) Annually review the City of Seward Comprehensive Plan
4) Encourage the City Manager to request an update of the Parks & Recreation Master Plan
5) Seek additional funding for Planning & Zoning Commissioner training
• Search out and add funding to the budget
Section 2. This resolution shall take effect immediately upon its adoption.
