RESOLUTION 2013 -01
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL
APPROVE THE ATTACHED ORDINANCE AMENDING THE ZONING
DESIGNATION OF A SMALL PORTION OF CITY OWNED LAND
LOCATED WITHIN TRACT G OF THE WATERFRONT PARK
REPLAT, FROM HARBOR COMMERCIAL (HC), TO PARK (P)
WHEREAS, the Kenai Peninsula Borough approved the Waterfront Park Replat which
was recorded as plat 2012 -04 in the Seward Recording District on June 8, 2012; and
WHEREAS, located within Tract G, Waterfront Park Replat is a relatively small, less
than three -fourth (%) of an acre of land, that is zoned Harbor Commercial (HC); and
WHEREAS, the parcel known as Tract G of the Waterfront Park Replat, is located
immediately south of Tract H which is commonly known as the South Harbor Uplands and east
of the privately owned Harbor Light Apartments; and
WHEREAS, the approximate three -fourth ( of an acre area, proposed in this rezone
has historically been used as a motor home camping area of Waterfront Park, and
WHEREAS, the Park Zoning District was established to provide areas for recreation and
commemorative property owned by the City, state or federal governments for recreation and
other compatible public purposes; and
WHEREAS the Land Use Plan Map, the 2020 Comprehensive Plan and the Seward
Strategic Plan all support Tract G, Waterfront Park be designated as Park Zoning; and
WHEREAS, it is a goal of the Seward Comprehensive Plan to bring the Zoning Map into
conformance with the Land Use Plan; and
WHEREAS, the public notification process was complied with and the appropriate
public hearing as required by Seward City Code § 15.01.040 was conducted by the Commission
on February 5, 2013.

NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Seward Planning and Zoning Commission supports the proposed zoning
changes and recommends the attached Ordinance 2013- be forwarded to City Council for
approval.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 5th day of
February 2013.

WHEREAS, administration hired Cline and Associates Land Surveyors to prepare a
preliminary plat of the City owned lands, establishing the perimeter boundary of the historical area
commonly known as Waterfront Park; and
WHEREAS, by Resolution 2011 -037, dated May 23, 2011, Seward City Council
recommended the Kenai Peninsula Borough Plat Committee approve the Waterfront Park replat; and
WHEREAS, the Kenai Peninsula Borough approved the Waterfront Park Replat which was
recorded as plat 2012 -04 in the Seward Recording District on June 8, 2012; and
WHEREAS, located within the Tract G, Waterfront Park Replat is a relatively small,

Section 1. The official City of Seward Zoning Map is hereby amended changing the zoning
designation of all lands within Tract G, of the Waterfront Park Subdivision to Park Zoning District.
Section 2. This ordinance shall take effect ten (10) days following its enactment.
ENACTED by the City Council of the City of Seward, Alaska, this day of March
2013.

BACKGROUND & JUSTIFICATION:
Attached for the Commission's review and recommendation to the Seward City Council
is Resolution 2013 -01, recommending City Council approval of Ordinance 2013 -xxx (attached),
amending the zoning designation of a small portion of Tract G, Waterfront Park Replat from
Harbor Commercial (HC) to Park Zoning District (P).
Administration hired Cline and Associates Land Surveyors to prepare a preliminary plat
of the City owned lands, establishing the perimeter boundary of the historical area commonly
known as Waterfront Park. By Resolution 2011 -037, dated May 23, 2011, Seward City Council
recommended the Kenai Peninsula Borough Plat Committee approve the Waterfront Park replat.
The Kenai Peninsula Borough approved the Waterfront Park Replat which was recorded as plat
2012 -04 in the Seward Recording District on June 8, 2012.
The area known as Waterfront Park contains 106.97 acres having a legal description of
Seward Original Townsite, Waterfront Park Replat. Tract G of the Waterfront Park is located at
the North boundary, within the established park boundary. The area of Tract G, proposed in this
rezone is south of the South Harbor Uplands and east of the Harbor Lights Apartments. The
small area of Harbor Commercial Zoning within Tract G is approximately 31,000 square feet,
less than three -fourth (%) of an acre. The area has historically been used as a campground for
summer visitors' motorhome parking.
The surrounding zoning is Park on the East and South and Harbor Commercial to the
West and North. Property use to the East is summer camping, parking and Resurrection Bay. To
the South is Scheffler Creek better known as the "Fish Ditch" and Waterfront Park. To the West
is an undeveloped alley containing a tree buffer and the back of the Harbor Lights Apartments.
To the North is the driveway access to the South Harbor Uplands and open parking area.
Seward City Code SCC § 15.01.035, Amendments, (b) (3) allows the consideration of this
rezone because the land is contiguous to the requested Park Zoning District and is recommended
by the Land Use Plan.
The Land Use Map, as adopted by the 2020 Comprehensive Plan, designates the area

requested for rezone as Park (P) as defined in SCC 15.05.025 (b)( (12) Parks district (P). Is
intended to designate park, recreation and commemorative property owned by the city, state or
federal governments for recreation and other compatible public purposes.

Staff Comments:
Community Development staff has presented the zoning change to all department heads
for review and discussion. All departments support the requested zoning changes.
Public Comment:
Property owners within three hundred (300) feet of the proposed rezone action were
notified. Public notice signs were posted on the property, and all other public hearing
requirements of Seward City Code §15. 01.040 were complied with.
One public comment was received in non - support of the rezone. This comment has been
included in your packet. Concern was voiced that the area requested for rezone could be used as
a location for a new Harbor Master building or other commercial shops and not to park "the
Harbor Fleet."
RECOMMENDATION:
Commission approve Resolution 2013 -01 recommending City Council approval of the attached
Ordinance 2013 -xxx, amending the zoning designation of approximately three -fourth ( %) of an
acre of City owned land located within the Waterfront Park boundary, Tract G, Waterfront Park
Replat from Harbor Commercial Zoning District (HC) to Park (P) Zoning District.

Ron and Jim, As you know P &Z is holding a public hearing January 3 on a resolution to rezone a fairly large piece
of land between the Harbor Lights Apartments and the new uplands area from Harbor Commercial to Park. I'm not sure
why this is being done NOW before the new uplands development plan has not been developed or adopted? 1 think this
land should be included in the consideration of the Uplands site.
As you know one of Seward's greatest weaknesses is the lack of private land available for small business development.
Each Year in the budget there is discussion about how something like 68% of the land in the city is not taxable because it
is owned by the City, the Fed's or the Alaska Railroad.
If we are ever going to be serious about encouraging investment and innovation in Seward we need to address the
"Choke Hold" that the City has on the land. I oppose this effort to rezone at this time unless it's part of a larger Harbor
Development Plan. This might be a good location for Harbormaster office or shop rather than using high value Harbor
Land for parking the Harbor fleet.
I also think that the public notice that calls this area a "Small Portion of City Owned Land" is misleading! This is a large
portion of the remaining Harbor Commercial Land.
Unfortunately I will not be able to attend the P &Z meeting but I wanted to bring up these points now rather than

(6) MONTH EXTENSION TO FLOODPLAIN VARIANCE 2012 -01 ISSUED
TO DENNIS AND PATRICIA PERRY TO CONSTRUCT AN AIRCRAFT
HANGAR UP TO 4 FEET BELOW BASE FLOOD ELEVATION ON LOT 7,

WHEREAS, on September 4, 2012 the Planning and Zoning Commission approved
Resolution 2012 -06 granting Dennis and Patricia Perry a Floodplain Variance to construct an aircraft
hangar on Seward Airport Lease Lot 7 Block 200, Seward Airport, leased from the State of Alaska,
Department of Transportation; and
WHEREAS, The Seward City Code (SCC) 15.10.325. (F) stipulates that the Commission
may grant a time extension not to exceed six months upon finding that circumstances have not
changed sufficiently since the date of the initial permit approval; and
WHEREAS, on January 7, 2013, Dennis Perry requested a six month extension of
Floodplain Variance Permit 2012 -01, stating within the request there had been no change in the
plans; and
WHEREAS, The written request for extension was submitted to the Community
Development Department prior to the expiration of the permit.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission finds that circumstances have not changed sufficiently to
warrant reconsideration of the Floodplain Variance Permit issued to Dennis and Patricia Perry on
September 14, 2012, to construct an aircraft hangar up to 4 feet below base flood elevation on Lot 7,
Block 200 Seward Airport, 2106 Airport Road.
Section 2. Floodplain Variance Permit 2012 -01 issued to Dennis and Patricia Perry on
September 14, 2012 is hereby extended until September, 2013.

Background:
On September 4, 2012 the Planning and Zoning Commission approved Resolution 2012 -13 granting
Dennis and Patricia Perry a Floodplain Variance to construct an aircraft hangar on Seward Airport
Lease Lot 7 Block 200, Seward Airport, leased from the State of Alaska, Department of
Transportation.
On January 7, 2013, Dennis Perry requested a six month extension of Floodplain Variance Permit
2012 -01, stating within the request there had been no change in the plans. The applicant also noted
the intent to complete the project within the 2013 building season.
The Seward City Code (SCC) 15.10.325. (F) stipulates that the Commission may grant a time
extension not to exceed six months upon finding that circumstances have not changed sufficiently
since the date of the initial permit approval.
RECOMMENDATION: Commission approve Resolution 2013 -02, granting Dennis and Pat Perry
a six (6) month extension to the floodplain variance issued under Seward City Code Chapter 15.25

I am waiting for a response, at present, from R & M Steel who have completed our hangar package. I asked
them to evaluate Steffan's suggestion re: firewall requirements incorporated in the plans. We will not be
commencing initial construction until April, so it will be necessary to obtain the variance extension. Nothing
has changed re: our plans. They were just delayed by the flood in September. We have fully paid for the
building, and they are holding it for shipping in early spring. Please consider this email our request or the

This Floodplain Variance Permit is granted by the Seward Planning and Zoning Commission to
allow and aircraft hanger to be constructed on the above described property up to four (4) feet below
the base flood elevation of approximately 20.5 feet.
Based on the findings noted in Resolution 2012 -13, the Planning and Zoning Commission
hereby grants Dennis and Pat Perry a floodplain variance from Seward City Code § 15.25.050.B.2. to
allow the lowest floor of the proposed aircraft hanger to be constructed up to four (4) feet below the
base flood elevation of approximately 20.5 feet.
Based on the findings noted in Resolution 2012 -13 the Planning and Zoning Commission
hereby grants Dennis and Pat Perry a floodplain variance from SCC§ 15.25.050.B2. allowing the
aircraft hanger to be constructed without being flood - proofed with watertight walls substantially
impermeable to the passage of water.
Based on the findings noted in Resolution 2012 -13 the Planning and Zoning Commission
finds the proposed use, subject to the following condition satisfies the criteria for granting a
floodplain variance, and authorizes the administration to issue a Floodplain Variance Permit to
Dennis and Pat Perry subject to the following condition
1. Work with staff to obtain a Floodplain Development Permit.
2. Upon completion of the proposed aircraft Hangar and before a Certificate of
Occupancy can be obtained the applicant must submit to the City of Seward a copy of the FEMA
required elevation certificate.
3. As requested, work with the FAA Airway Transportation System, Kenai to obtain an
underground power line locate prior to construction.

In accordance with SCC §15.25.060.B.8, the Community Development Office must give
written notice to the applicant that the structure will be permitted to be built with a lowest floor
elevation below the base flood elevation and that the cost of flood insurance will be commensurate
with the increased risk resulting from the reduced lowest floor elevation. This variance to construct
the structure below the Base Flood Elevation will result in increased flood insurance premiums rates
as high as $25.00 per $100.00 of coverage.

COMMISSION, OF THE CITY OF SEWARD, ALASKA GRANTING
DENNIS AND PAT PERRY A FLOODPLAIN VARIANCE FROM SEWARD
CITY CODE CHAPTER 15.25 FLOODPLAIN MANAGEMENT TO
CONSTRUCT AN AIRCRAFT HANGAR UP TO 4 FEET BELOW BASE
FLOOD ELEVATION ON LOT 7, BLOCK 200 SEWARD AIRPORT, 2106
AIRPORT ROAD
WHEREAS, applicants Dennis and Pat Perry propose to construct an aircraft hangar on
Seward Airport Lease Lot 7 Block 200, Seward Airport, leased from the State of Alaska, Department
of Transportation; and
WHEREAS, Lot 7, Seward Airport is located within a designated 100 -year floodplain as
identified on the Federal Emergency Management Agency' s (FEMA) Flood Insurance Rate Map
(FIRM); and
WHEREAS, according to FIRM No. 020012- 3255A, dated May 19, 1981, the Base Flood
Elevation for Lot 7, Seward Airport is approximately 20.5 feet; and
WHEREAS, based on an elevation survey prepared by a registered land surveyor, the
existing elevation of the proposed development site is approximately 17.0 feet which would place the
lowest floor of the building approximately 3.5 feet below the base flood elevation; and
WHEREAS, based on the same elevation survey the lot corners of Lot 7 are approximately
16.0 feet which would place the adjacent tarmac at more than 4 feet below the base flood elevation;
and
WHEREAS, the City of Seward Floodplain Management Ordinance, Seward City Code
Section 15.25.050.B.2.a&b, requires that the lowest floor of non - residential construction be elevated
to the base flood elevation, or be flood - proofed so that below the base flood level the structure is
watertight with walls substantially impermeable to the passage of water; or be constructed with
components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
WHEREAS, the applicant would be unable to access the structure for its designed use if the
structure were to be elevated at or above the base flood elevation which is approximately 4 plus feet
above the adjacent tarmac; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for a
variance from the City of Seward Floodplain Management Ordinance to construct the proposed

aircraft hangar's lowest floor at a grade of approximately 1 foot above the adjoining airport apron
elevation of approximately 16 feet; and
WHEREAS, the applicant has applied to the Planning and Zoning Commission for a
variance from the City of Seward Floodplain Management Ordinance 1 5.25.050(B)(2)(a) to construct
the proposed aircraft Hangar and supporting utilities without being flood - proofed with watertight
walls substantially impermeable to the passage of water; and
WHEREAS, the applicant has stated he plans to meet the City of Seward Floodplain
Management Ordinance 15.25.050(B)(2)(b) by the providing the additional components capable of
resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
WHEREAS, the public notification process was complied with and the appropriate public
hearing as required by Seward City Code § 15.01.040 was conducted by the Commission on
September 4, 2012.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with Seward City Code Section 15.25.060(a)(4) the Seward
Planning and Zoning Commission has considered all of the following factors:
a. The danger that materials may be swept onto other lands to the injury of others; There
is no reason to believe that placement of the structure will increase the danger of materials being
swept onto other lands. Staff has consulted with Dan Mahalak, Kenai Peninsula Borough
Hydrologist for his professional opinion. He has stated the area is a low flow velocity area. Mahalak
also noted if the structure were to be built above the Base Flood Elevation the added fill would cause
more problems by creating velocity on neighboring properties and/or increase flood levels in the
area.
b. The danger to life and properly due to flooding or erosion damage. The past three major
flood events in 1986, 1995 and 2006 did not present any significant threat to life and/or property in
the area of the proposed structure.
c. The susceptibility of the proposed facility and its contents to flood lood damage and the effect
of such damage on the individual owner. The past three major flood events in 1986, 1995 and 2006
did not present any significant threat of flooding to the area.
d. The importance of the services provided by the proposed facility to the community. The
applicant is a licensed aircraft pilot, the aircraft hangar allows the applicant to protect his investment,
there is no public services planned by the applicant.

e. The necessity to the facility of a waterfront location, where applicable. Not applicable.
f. The availability of alternative locations for the proposed use which are not subject to
flooding or erosion damage. The majority of the Seward Airport and surrounding property is
located within the floodplain or floodway. Since an aircraft hangar requires a location near an
airport, there are no other feasible locations for the proposed structure.
g. The compatibility of the proposed use with the existing and anticipated development.
The proposed use is compatible with the surrounding industrial land uses and existing similar aircraft
facilities.
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that area. The 2020 Comprehensive Plan section 3.8.2 addresses
floodplain development by supporting the participation in the National Flood Insurance Program
(NFIP). Flooding of streams and rivers has historically occurred in Seward and the outlying areas as
most flat lands along the south central Alaskan coast is floodplain. The Resurrection River channels
and the airport erosion need continued attention. There is no evidence that this project would in any
way increase or hinder the existing flooding issues in the area.
i. The safety of access to the property in times of flood for ordinary and emergency
vehicles. It does not appear the proposed structure will add any safety concerns for standard and/or
emergency vehicles during flood events.
j. The expected heights, velocity, duration, rate of rise, and sediment transport of theflood
waters and the effects of wave action, if applicable, expected at the site. The past three major flood
events in 1986, 1995 and 2006 did not present any significant threat to life and/or property in the area
of the proposed structure.
k. The costs of providing governmental services during and after flood conditions,
including maintenance and repair of public utilities and facilities such as sewer, gas, electrical,
and water systems, and streets and bridges. No public water, sewer or electric are provided to this
lot, no additional costs are expected.
Section 2. The Commission makes the following specific findings regarding the Dennis and
Pat Perry floodplain variance request:
1. The majority of the Seward Airport and surrounding property is located within the Special
Flood Hazard Arpa. Since the applicant's proposed aircraft hangar is dependent upon an airport
location, there aro other feasible locations for the structure which are not located within the
floodplain.

2. Failure to grant the variance would result in exceptional hardship to the applicant for the
following reason: It is not feasible to elevate the structure at or above the base flood elevation. To
do so would not allow the aircraft hangar to be utilized for its intended purpose.
3. Granting the requested variance will not result in damage or hardship for this or any other
property.
4. The proposed use is compatible with the surrounding industrial land uses and existing
similar facilities.
5. The applicant has established good and sufficient cause for this Commission to find
pursuant to SCC§ 15.25.060(b)(5) that the granting of a variance will not result in increased flood
heights, additional threats to public safety, extraordinary public expense, create nuisances, cause
fraud on or victimization of the public or conflict with existing laws.
6. Because the proposed variance has low damage potential and otherwise conforms to all
variance criteria in SCC §15.25.060(a) & (b), the Commission finds this application to be one of
those "very limited circumstances" described at SCC §15.25.060(b)(7) for granting this floodplain
variance on Lot 7, Block 200, Seward Airport.
7. Considering all of the above findings, the Commission hereby determines that the
requested variance to construct the aircraft hangar and supporting utilities on Lot 7, Block 200,
Seward Airport, at an elevation of approximately 17 feet which is approximately 4 feet below the
base flood elevation, is the minimum necessary to afford relief.
Section 3. Based on the above findings, the Planning and Zoning Commission hereby grants
Dennis and Pat Perry a floodplain variance from SCC§ 15.25.050.B.2. allowing the lowest floor of
the proposed aircraft hangar and supporting utilities to be constructed approximately four (4) feet
below the base flood elevation of 20.5 feet.
Section 4. Based on the above findings, the Planning and Zoning Commission hereby grants
Dennis and Pat Perry a floodplain variance from SCC § 15.25.050B2(a) allowing the aircraft hangar to
be constructed without being flood - proofed with watertight walls substantially impermeable to the
passage of water.
Section 5. Based on the above findings, the Planning and Zoning Commission finds the
proposed use, subject to the following condition satisfies the criteria for granting a floodplain
variance, and authorizes the administration to issue a Floodplain Variance Permit to Dennis and Pat
Perry subject to the following conditions:
1. Work with staff to obtain a Floodplain Development Permit.

WHEREAS, on January 9, 2013 Mike Insalaco, on behalf of Leif Olson, requested a six
month extension of CUP 2012 -01, stating within the request there had been no changes to the
original plan.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission finds that circumstances have not changes sufficiently to
warrant reconsideration of the Conditional Use Permit issued to Leif Olson for the development
of a single family home on that portion of Govt. Lot 1 lying east of the Seward Highway and the
Alaska Railroad right of way, within the Resource Management Zoning District, located at 2608
Seward Highway.
Section 2. Conditional Use Permit 2012 -01, issued to Leif Olson on August 31, 2012 is
hereby extended until August, 2013.
Section 3. This resolution shall take effect immediately upon its adoption.

BACKGROUND & JUSTIFICATION:
On January 9, 2013 Mike Insalaco, on behalf of property owner Leif Olson, submitted a request for a six
month time extension for Conditional Use Permit 2012 -01. The request for an extension was submitted
prior to the expiration of the permit. The plans to construct a single family home at 2608 Seward
Highway have not changed.
The Seward City Code 15.10.320 G (1) stipulates an approved Conditional Use Permit lapses six (6)
months after approval if no building permit is procured or if the allowed use is not initiated. Conditional
Use Permit 2012 -01 lapses in February 2013, which is six (6) months after the original Conditional Use
Permit was granted.
Seward City Code 15.10.320. G (2) states the Commission may grant time extensions not to exceed six
(6) months each upon the finding that circumstances have not changed sufficiently to warrant a
reconsideration of the approval of the CUP. The applicant has stated in a written extension request that
no changes have occurred or are planned. Construction plans should be completed in time for the 2013
building season.

As we have not started our project I would like to request an extension for CUP permit number 2012 -01 and 2012 -02.
We have not made any changes to the property or the building /campground plan at this time.
We ran out of time to complete the engineering needed for the flood plain permit, we will continue pursuing it in the
spring. We expect to have the engineering done around April and the building permit by May.

6. Any proposed modification plan shall be subject to the public notice and public hearing
requirements of law, which shall occur only after payment of the filing fee established by
resolution of the city council.
7. Any development on the property shall not be within 50 feet of mean high water of Japanese
Creek.

NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC § 15.10.320 (D), the Planning and Zoning Commission
has reviewed the applicant's request for a Conditional Use Permit to construct a single family
home on that portion of Govt. Lot 1 lying east of the Seward Highway and the Alaska Railroad
right of way, within the Resource Management zoning district; located at 2608 Seward Highway
and made the following Findings of Fact:
1. The use Ls consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district
Finding: This condition has been met or shall be through the conditions of the

The development and use, as proposed, are consistent with Seward City Code Land Uses
Allowed Table in 15.10.225. Single family homes within the Resource Management
zoning district are allowed by conditional use permit granted by the Seward Planning and
Zoning Commission.
2. The value of adjoining property will not be significantly unpaired
Finding: This condition has been met or shall be through the conditions.
There is no evidence that the Single Family Home, as it is proposed, will impair
adjoining properties or rights -of -way. The owner plans to construct a 4800 square foot
home with a two -bay garage. The applicant plans a self- contained single family home
and shall obtain all required permits, including but not limited to the Alaska Department
of Environmental Conservation permits for the on -site septic and water.
3. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: This condition has been met or shall be through the conditions.

Finding: This condition has been partially met and shall be completed through the
building and permitting process as well as conditions of the Conditional Use Permit.

SCC §16.01.030(3). If possible power service will be extended to the property. The site

Finding: This condition has been met or shall be through the conditions. There is no
evidence that the construction and operation of the single family home, as proposed,
would be harmful to the public's safety, health and welfare.
All on site water and sewer shall meet the requirements of the State of Alaska
Department of Economic Development. The parcel is located within a mapped flood
hazard area; a floodplain development permit is required. Additional water storage shall
be made available for fire protection.
6. Any and all specific conditions deemed necessary by the commission to fulfill the
above - mentioned conditions shall be met by the applicant. These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be subject to the
following condition:
1. Before any construction begins the applicant shall obtain and comply with all applicable
laws and permitting pertaining to development of the property including but not limited
to the Seward Floodplain Development permit; Seward Building Permit; Alaska
Department of Environmental Conservation; US Army Corp of Engineers; all other State
and Federal Permitting.
2. Continue to work with City staff to coordinate site visits to address and remove any
outstanding code compliance issues prior to issuing a certificate of occupancy.
3. Work with the City Fire Department to meet on site water demands for fire protection.
4. Animal / Bird resistant dumpsters / containers shall be provided for all garbage and
refuse for the life of the use.
5. The Planning and Zoning Commission may modify this conditional use permit if
changed uses no longer conform to the standards and legal requirements justifying its
present approval, or if the permittee applies for a modification to meet a different
development plan that conforms to the standards and legal requirements for approval of a
conditional use permit.
6. Any proposed modification plan shall be subject to the public notice and public hearing
requirements of law, which shall occur only after payment of the filing fee established by
resolution of the city council.

Section 2. The Planning and Zoning Commission finds the proposed use, based on the
application and supporting materials and subject to the above conditions satisfies the criteria for
granting a Conditional Use Permit provided the conditions listed on Section 1, Subsection 6 are
met by the applicant, and authorizes the administration to issue a Conditional Use Permit to Leif
Olson for the construction and use of a Single Family Home located at 2608 Seward Highway, a
• portion of Government Lot 1 lying East of the Seward Highway and Alaska Railroad Right of
Way, within the Resource Management zoning district.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320;
Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit.
Additionally, the administration shall periodically confirm the use conforms to the standards of
its approval.
Section 4. This resolution shall take effect 10 days following its adoption.

WHEREAS, on August 21, 2012 the Planning and Zoning Commission approved
Resolution 2012 -12 granting a Conditional Use Permit to Leif Olson for the development of
an RV /Camper Park on that portion of Govt. Lot 1 lying east of the Seward Highway and the
Alaska Railroad right of way, within the Resource Management Zoning District, located at
2608 Seward Highway; and
WHEREAS, the Seward City Code (SCC) 15.10.320 G (1) stipulates an approved
Conditional Use Permit lapses six (6) months after approval if no building permit is procured
or if the allowed use is not initiated; and
WHEREAS, (SCC) 15.10.320. G (2) states the Commission may grant time
extensions not to exceed six (6) months each upon the finding that circumstances have not
changed sufficiently to warrant a reconsideration of the approval of the CUP; and
WHEREAS, on January 9, 2013 Mike Insalaco, on behalf of Leif Olson, requested a
six month extension of CUP 2012 -01, stating within the request there had been no changes to
the original plan.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission finds that circumstances have not changes sufficiently to
warrant reconsideration of the Conditional Use Permit issued to Leif Olson for the
development of an RV /Camper Park on that portion of Govt. Lot 1 lying east of the Seward
Highway and the Alaska Railroad right of way, within the Resource Management Zoning
District, located at 2608 Seward Highway.
Section 2. Conditional Use Permit 2012 -02, issued to Leif Olson on August 31, 2012 is
hereby extended until August, 2013.
Section 3. This resolution shall take effect immediately upon its adoption.

BACKGROUND & JUSTIFICATION:
On January 9, 2013 Mike Insalaco, on behalf of property owner Leif Olson, submitted a request for a six
month time extension for Conditional Use Permit 2012 -02. The request for an extension was submitted
prior to the expiration of the permit. The plans to construct an RV /Camper Park at 2608 Seward
Highway have not changed.
The Seward City Code 15.10.320 G (1) stipulates an approved Conditional Use Permit lapses six (6)
months after approval if no building permit is procured or if the allowed use is not initiated. Conditional
Use Permit 2012 -02 lapses in February 2013, which is six (6) months after the original Conditional Use
Permit was granted.
Seward City Code 15.10.320. G (2) states the Commission may grant time extensions not to exceed six
(6) months each upon the finding that circumstances have not changed sufficiently to warrant a
reconsideration of the approval of the CUP. The applicant has stated in a written extension request that
no changes have occurred or are planned. Construction plans should be completed in time for the 2013
building season.

a Conditional Use Permit, to construct and operate an RV /Camper Park at 2608 Seward

WHEREAS, the proposed RV /Camper Park will be located on the eastern portion of
a large 11 acre parcel East of the Seward Highway and Alaska Railroad right of way, within
the Resource Management zoning district; and
WHEREAS, an RV /Camper Park is an allowed use within the Resource
Management District according to Seward City Code (SCC) §15.10.225 Land Uses Allowed
Table with a Conditional Use Permit; and
WHEREAS, this parcel of land is located within the 1981 FEMA mapped flood
hazard area and will require a floodplain development permit and include building to
floodplain development standards; and
WHEREAS, the proposed RV /Camper Park development will provide additional
community RV and tent camping opportunities for the general public; and
WHEREAS, having complied with the public notification process; on August 21,
2012, the Seward Planning and Zoning Commission held the required public hearing on the
Conditional Use Permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC§ 15.10.320(D), the Planning and Zoning Commission
• has reviewed the applicant's request for a Conditional Use Permit to construct an RV /Camper
Park on that portion of Govt. Lot 1 lying east of the Seward Highway and the Alaska
Railroad right of way, within the Resource Management zoning district; located at 2608
Seward Highway and made the following Findings of Fact:

The use is consistent with the purpose of this chapter (the Seward Zoning Code)
and the purposes of the zoning district
Finding: This condition has been met or shall be through the conditions of the CUP.
The development and use, as proposed, is consistent with Seward City Code Land
Uses Allowed Table in 15.10.225. RV /Camper Park is allowed within the Resource
Management Zoning District by Conditional Use Permit granted by the Seward
Planning and Zoning Commission.
2. The value of adjoining property will not be significantly impaired
Finding: This condition has been met or shall be through the conditions.
There is no evidence that the RV /Camper Park, as it is proposed, will impair
adjoining properties or rights -of -way. The owner plans to construct a small secluded
RV /Camper Park, with 24/7 management. The owner shall obtain all required
permits, including but not limited to the Alaska Department of Environmental
Conservation permits for the on -site septic and water.

At its organization meeting on October 22, 2012, the City Council directed the City Boards and
Commissions to provide quarterly reports during the Council's regularly scheduled meetings.
The reports would include a brief report of the accomplishments, actions or issues related to the
Planning and Zoning Commission.
The City Clerk has requested that the reports be publicly noticed on the Council agenda. In order
to facilitate public notice, the 2013 reports to Council could be provided at the March 26, June
24, September 23 and December 23 Council meetings.
Recommendation: Staff recommends the Commission designate a Commissioner to provide
quarterly reports to City Council.

Happy New Year! I hope 2012 was a great year for you and that you are looking forward to a healthy
and productive 2013. I want to thank each and every one of you for your work on your
Board/Commission. The City Council and myself are appreciative of the time and effort you put
forward on your Board /Commission and your dedication to the community we live in.
At its organizational meeting on October 22, 2012, the City Council chose to direct Boards and
Commissions to give periodic reports to the City Council during their regular scheduled meetings
[per City Council Rules of Procedure, Rule 29 (c)]. Further, the Mayor and Council directed that
Boards and Commissions please give quarterly reports to the council at a regularly scheduled council
meeting.
On a future agenda, please consider discussing this direction from the council and plan to give a brief
report on what issues /accomplishments /actions your Board/Commission is currently working on a
quarterly basis. It would be ideal for these reports to be publicly noticed on a council agenda, so
please make arrangements with the City Clerk's Office to be placed on a future agenda. The City
Council agendas are set no later than the Tuesday before a Monday council meeting (City Council
Meetings are always the second and fourth Monday of each month, provided there are no holidays on
those days).

City Planner Donna Glenz updated the Commission on the following business items:
• Glenz noted that the Shell drillship Nobel Discoverer, with an estimated 70 employees,
was in port for an undetermined duration.
• City Council was scheduled to meet December 10 for the last meeting of the 2012 calendar
year.
• A PACAB meeting was scheduled for noon, December 5 in Council Chambers.
• The next scheduled Planning and Zoning Commission meeting was slated for January 3,
2013.
• Glenz noted that a copy of an historic letter was provided as an informational laydown for
Commissioners. The letter, dated November 19, 1935 was addressed from Anthony J.
Dimond, an Alaska Delegate to the U.S. House of Representatives, to former Sewardite
Hilma Urie. The letter, which cited flooding of the Lowell Creek flume, was provided by
Kenai Peninsula Borough Assembly member Sue McClure, Urie's granddaughter.

McClure said he enjoyed attending a November 11, 2012 Advanced Planning
Commissioner training in Anchorage.
Fleming added that she would enjoy attending Planning Commissioner trainings in the
future.
Butts offered thanks to the public for the efforts to raise funds for local child Finn Michael
Federer, who required a heart surgery. The effort garnered approximately $16,000 in four days, he
said.
Ecklund added that she was pleased the community was able to raise funds for the Federer
Family. Ecklund also noted the benefits of attending the November 11 Advanced Planning
Commissioner training in Anchorage.

A Virtual Playbook for Natural Hazards Consequences Management

Natural Resources (DNR), Western Washington University's
Resilience Institute, and FEMA's contractor, URS Corporation,
developed a suite of twenty (20) realistic, credible earthquake scenarios
and uniquely blended hazard data with infrastructure and population =_'
data in a Geographic Information System (GIS) environment to enable of :a
better decision support for earthquake mitigation, preparedness,
response, and recovery. Menu of Earthquake Scenarios
The culmination of this 2.5+ year effort has resulted in an online digital scenario catalog that enables any number of
federal, state, tribal, and local stakeholders to customize outputs and visually depict what is at risk during an
earthquake.

Hello again! This memo is to inform you it is that time of year again for the boards and commissions
to meet with the City Council to establish and review your annual priorities for your
board/commission. It's also a great time just to touch base with the council, voice any concerns or
ask for further direction, etc.
At their last meeting, council scheduled this work session for Monday, February 11, 2013, beginning
at 5:00 p.m. I have split the time up as follows:
• 5:00 p.m.: Meet with the Historic Preservation Commission
• 5:30 p.m.: Meet with the Port and Commerce Advisory Board
• 6:00 p.m.: Meet with the Planning and Zoning Commission
Please plan to attend this work session if you can and bring a draft of your annual priorities for the
year. If you don't have something drafted already, you can always bring the results from the
previous year's priority work session as something to start with.
The meeting times this year are much shorter and I apologize for that! If you feel you may need
more time, it may be worth requesting council schedule an additional work session. For this
particular date, council will also be holding their regular meeting, which begins at 7:00 p.m.

1) Municipal Lands Management Plan (1995) — Update in conjunction with the
Capital Improvement Plan and the City Land Disposal Policies and Procedures
2) Nash Road Bench Study (Resource Management Development Impact Study) as
