Adjournment Planning and Zoning Commission Special Meeting Agenda May 22, 2013 2 a Sponsored by: Administration CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2013 -11 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, SUPPORTING THE CONSTRUCTION OF THE ELECTRIC DEPARTMENT WAREHOUSE; THE RELOCATION OF THE CITY WATER WELL DRAINAGE DITCH AND PEDESTRIAN PATHWAY ON CITY OWNED LOT 6A -2, FORT RAYMOND SUBDIVISION NO. 3; AND THE CONSTRUCTION OF THE CONNECTING PUBLIC SIDEWALK; ALL LOCATED AT 605 SEA LION AVENUE WITHIN THE INSTITUTIONAL ZONING DISTRICT WHEREAS, Lot 6A -2, Fort Raymond Subdivision No. 3 contains approximately 10.7 acres, located south of Sea Lion Avenue and the private Kenai Peninsula Borough (KPB) school driveway access; north of the community cemeteries; east of the KPB school baseball field and west of the City owned Air Force lease parcel; and WHEREAS, City Council Resolution 2012 -001, approving the land exchange between the KPB and the City for a small portion of this parcel, stated the use of the land would go before Planning and Zoning Commission; and WHEREAS, the parcel is located within the Institutional Zoning District (INS) and contains the City Electric Department generation plant, Public Works water wells and the City baseball field; and WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), the proposed warehouse structure and use is allowed outright within the Institutional District; and WHEREAS, the warehouse shall meet all City building code requirements with engineered stamped drawings; and WHEREAS, the relocation of the drainage ditch, pedestrian pathway and construction of the connecting sidewalk have been engineered to meet current construction standards. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission supports the construction and use of the Electric Department warehouse on City owned Lot 6A -2, Fort Raymond Subdivision No. 3. 3 Seward Planning and Zoning Commission Resolution No. 2013 -11 Page 2 of 2 Section 2. ' From: Donna Glenz, Planner Agenda Item: Support for the City Electric Department warehouse, the relocation of the City water well drainage ditch and the pedestrian pathway on City owned lot 6A -2, Fort Raymond Subdivision No. 3 and the connecting public sidewalk located at 605 Sea Lion Avenue. BACKGROUND & JUSTIFICATION: Over the past few years the City Electric Department has been working to construct a warehouse on the City owned parcel known as Lot 6A -2, Fort Raymond Subdivision No. 3. With the warehouse construction the Electric Department will also be relocating the water well drainage ditch, pedestrian pathway on City owned Lot 6A -2 and constructing a connecting sidewalk abutting the Kenai Peninsula Borough (KPB) school campus private driveway. This parcel currently contains the City Electric Department generation plant, Public Works water wells and the City baseball field. It is located south and east of the KPB school campus. In March 2012 City Council approved Resolution 2012 -001 approving a land exchange between the KPB and the City. The land exchange was for approximately 0.56 of an acre to allow the new electric warehouse to be located on the northern end of Lot 6A -2 just south of the Sea Lion driveway access to the middle school. WHEREAS number 3 of Resolution 2012 -001 stated "per city code the use of land will go to the planning and zoning commission." Although there is no zoning code or land use requirement for the Commission to review or approve, the warehouse project is being brought forward for your support. Lot 6A -2, Fort Raymond Subdivision No. 3 is zoned Institutional. Title 15.10.225, Land Uses Allowed Table of the City code allows the use outright under "Utility Facility, public electric, water, sewer, etc. " within the Institutional Zoning District. The warehouse shall meet all City building code requirements with engineered stamped drawings and the relocation of the drainage ditch, pedestrian pathway and construction of the connecting sidewalk have been engineered to meet current construction standards. The project has been approved by the City Council and the contract for construction will also be approved by Council. Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is not located within a mapped Flood Hazard Area. Utilities: 5 The property is served by existing public utilities and developed streets. Adequate fire, police and trash services are available. Parking: Adequate parking is available. Public Safety, Heath and Welfare: All construction shall meet current building and fire code requirements and be reviewed through the building permit process. There is no evidence the electric department warehouse will cause any additional concerns to public safety, health or welfare. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The recitals above are incorporated herein by reference. The Council finds that exchanging a 0.56 acre +/- portion of Lot 8A- l of parcel number 14502621 for an 0.56 acre +/- portion of Lot 6A -1, Fort Raymond Subdivision Replat No.2 with the Kenai Peninsula Borough is in the best interest of the City. Section 2. The City of Seward Electrical department will be responsible for all surveying and platting costs associated with the property involved in the exchange. 8 CITY OF SEWARD, ALASKA RESOLUTION 2012 -001 Section 3. The City Manager is authorized to negotiate the exchange and execute an agreement in substantially the form presented at this meeting. • Section 4. OFA •+ +s+ST$Bu �� 9 Agenda Statement e „of se Meeting Date: March 12th, 2012 ut '77 ```�'o To: City Council ;ASS Through: City Manager Jim Hunt From: John Foutz, Electric Utility Manager Agenda Item: Land Exchange BACKGROUND & JUSTIFICATION: The City of Seward Electric Department is the recipient of a state grant as part of Alaska Railbelt Cooperative Transmission and Energy Company (ARCTEC). The grant is for $4,000,000 and includes infrastructure to complete the upgrade. The chosen location for the warehouse is north of the new generator building, off of Sea Lion Avenue and across the street from the Seward Elementary School.(Please refer to attached AutoCad drawing) This location was chosen to give the electric department the ability to bring together personnel, materials and equipment close to the backup generation facility. In order to complete this project the City must acquire land located to the west along Sea Lion Avenue currently owned by the Kenai Peninsula Borough. The land the electric department requires is approximately 0.56 acres and a similar apportionment was chosen to make the property swap equitable to both the City and the Borough. Once the exchange is complete the City will make the following improvements; First, reroute the bike /pedestrian path to better match the flow of children between the Seward Elementary School and Seward High School, Second: reroute the existing drainage overflow ditch for the City's well field, and Third, bury an underground power line to the City's well pumps in a direct route. The city's wells and pumps are critical infrastructure and require a new electric conductor before failure. INTENT: To exchange the specified pieces of land with the approximate equal acreage with the borough to allow the City of Seward's electrical department to move forward with completion. Opening Ceremony Commissioner Campestre led the Pledge of Allegiance to the flag. Roll Call There were present: Sandie Roach' presiding, and Cindy Ecklund Martha Fleming Bixler McClure Alexis Campestre comprising a quorum of the Commission; and Ron Long, Assistant City Manager Donna Glenz, City Planner Dwayne Atwood, Planning Technician Excused was: Dale Butts City Administration Report City Planner Donna Glenz updated the Commission on the following business items: • Glenz noted that the Seward / Bear Creek Flood Service Area Board had hosted a presentation by URS Corp. the evening of May 6. The Hazard Mitigation Plan presentation focused on proposed plan updates for the service area. • Glenz said the new proposed FEMA floodplain maps for the Seward area were available for public review and were scheduled to be adopted by City Council on July 8. • In response to concerns from the Commission, City staff had recently held a meeting to discuss employee camping on the properties just north of Icicle Seafoods. The Fire Department had completed its inspections and all life safety issues had been addressed, Glenz said. • Assistant City Manager Ron Long addressed the Commission, noting recent meetings with U.S. Army Corps of Engineers regarding a proposal to transfer ownership and management of the Lowell Canyon Tunnel to the City of Seward in coming years. The City is currently working to secure funding to conduct a condition study and determine what repairs need to be made. 12 City of Seward, Alaska Planning Commission Minutes May 7, 2013 Volume 7, Page 21 • Long said there had also been recent meetings with the U.S. Army Corps of Engineers to discuss issues related to possible development on the South Harbor Uplands / breakwater. An act of U.S. Congress is needed to allow municipal development, Long said. Fleming asked when the U.S. Army Corps of Engineers might transfer ownership and maintenance of the Lowell Canyon diversion tunnel to the City. Long said the proposed date is approximately 10 years away and that the City is requesting that the Corps retain the diversion tunnel and maintenance responsibilities. Glenz described the rights -of -way extensions and referred Commissioners to displayed wall maps. The subdivision was not served by utilities and staff was preparing a subdivision agreement. Glenz said public questions regarding the replat had been answered and additional information was provided. • Ecklund asked if the subdivision agreement would be in place before the plat was approved. Glenz said staff was preparing the agreement and it would be pre pared before the plat was finalized and approved by the Kenai Peninsula Borough. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. James Allen, whose residence was near the proposed replat, asked if Tract C -5 would be divided into two parcels. Allen asked if public traffic would be traveling the rights -of -way as soon as the plat was finalized. Virginia Allen, whose residence was near the proposed replat, asked if the public's questions regarding the proposed replat could be provided. Motion (Ecklund/Fleming) Approve Resolution 2013 - 07 Campestre asked staff what questions the public may have asked regarding the proposed replat. Glenz said she spoke with the Aliens twice, explaining the rights -of -way access and all other aspects of the replat. Glenz noted that she also spoke with Seward resident Carol Griswold, and the same questions were asked and answered. Glenz addressed James A llen's question regarding rights -of -way development, stating that there was no immediate plan to develop, maintain or plow roads that would be platted through the 33.55 acres. Ecklund requested that future platting actions include former plat maps, as well as proposed plats. Glenz said older plats would be added to meeting packets. Roach' asked if the City would police the area or if the City might clean in the area of the platted rights -of -way. 14 City of Sewar4 Alaska Planning Commission Minutes May 7, 2013 Volume 7, Page 23 Glenz asked Public Works Director W.C. Casey to explain the intended uses of the proposed rights -of -way extensions. W.C. Casey, who was in attendance, said some rights -of -way in lesser developed parts of the City were cleaned and patrolled. The rights -of -way under discussion might not be developed any time soon, he said. The City did not intend to cut brush or open a majority of the rights -of -way easements, but could clean the areas, if needed. Ecklund asked if the issue of splitting Tract C -5 had been thoroughly discussed with the applicants. Glenz said the surveying contractor and the applicant were in agreement with the proposed plat configuration as submitted. Seward Public Works employee Nort Adelmann spoke to Commissioners and explained that the Water Department would mow vegetation where water lines were buried. Motion Passed Unanimous Resolution 2013 -08 of the Planning and Zoning Commission of the City of Seward, Alaska, granting a conditional use permit to James R. Woodside, dba Saltwood Smoke House, to operate a commercial seafood processing and smoking business on USS 149, Lot 1, Tract B, 2101 Seward Highway, within the Auto Commercial Zoning District Glenz described the surrounding properties and referred the Commission to wall maps indicating the location of the proposed business. The operation would be relatively small, compared to the commercial fish processing plants along Seward's waterfront, Glenz said. Staff had received one public question regarding how fish would be transported to the location. Glenz noted the business would not receive deliveries by large trucks. Ecklund asked if the allowed use was "seafood processing," as indicated in City Code. Ecklund said she did not see a category specifically for "fish processing." Glenz said the category used for regulation purposes was the most appropriate category described in Code. The size of the operation, as described, would be limited by the size of the property. Roach' asked if deliveries would be received on the applicant's property or if deliveries could be received in the right of way. Glenz said deliveries could be received in the right of way, as with numerous businesses in various locations around town. 15 City of Sewar4 Alaska Planning Commission Minutes May 7, 2013 Volume 7, Page 24 Roach' asked if the access to Dimond Boulevard from the applicant's parcel was a permitted driveway. A driveway permit would only be required if a culvert was being placed for the driveway, and a culvert was not needed, Glenz said. Campestre asked for clarification of the type of product that would be received. Glenz said the smoking operation would not include the custom processing of fish for individuals. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. CUP applicant James Woodside addressed the Commission, stating he did not intend to custom smoke fish for individuals. The capacity of the plant would be approximately 700 pounds of fish per day. Woodside said he wanted to operate a production facility and was not interested in conducting retail sales on site. Ecklund asked what kind of products might be produced and how they would be packaged. Woodside said he would smoke several types of fish, including salmon and black cod. The fish would be cut into strips and smoked and vacuum sealed, he said. Woodside said he may be able to dispose of scrap fish parts at the commercial plants where he would purchase fish. Motion (Fleming/Campestre) Approve Resolution 2013 -08 Motion Passed Unanimous Unfinished Business — None New Business — Discussion of Proposed Watchman / Caretaker Definition Changes Glenz noted that at the previous work session the Commission had discussed and reviewed possible changes to the Watchman / Caretaker definition, but staff felt more work was needed before a proposed Code change could be brought forward. The City Council was also considering Code amendments that may require further consideration of the definition, Glenz said. Staff suggested the Commission schedule a future work session to be held after City Council addressed temporary structure Code provisions. The Commission agreed to hold a work session after City Council addressed proposed changes to the Building Code. Reschedule the May 21 Special Meeting 16 City of Seward, Alaska Planning Commission Minutes May 7, 2013 Volume 7, Page 25 Glenz said a Conditional Use Permit application was received in time to change the scheduled work session to a special meeting. Glenz noted that Commissioners had discussed rescheduling the May 21 meeting date because the Seward High School graduation ceremony was to take place that evening. Commissioners agreed to hold the Planning and Zoning special meeting on May 22, 2013. Roach' requested to suspend the rules in order to allow Seward / Bear Creek Flood Service Area staff and board members to address the Commission. Stephanie Presley, Seward / Bear Creek Flood Service Area Coordinator, provided a report to the Commission on the updated Hazard Mitigation Plan. The plan will be useful for the City in the future when its own plan needs to be updated, Presley said. Campestre asked about the payment of the $232,220 in grant funds that were to be used to update the Hazard Mitigation Plan. Presley said the bulk of the money had been paid to contractor URS, not including a Kenai Peninsula Borough administration fee. Seward Bear Creek Flood Service Area Board Chairman Bill Williamson said the May 6 presentation on the Hazard Mitigation Plan update was very informative. The presentation was provided by URS, and the content of the new plan has provisions for a variety hazards. McClure thanked staff for the meeting preparations and also congratulated James Woodside on his fish smoking business venture. 17 City of Seward, Alaska Planning Commission Minutes May 7, 2013 Volume 7, Page 26 Ecklund said was hopeful that James Woodside would be able to provide local seafood for the restaurant in the Alaska SeaLife Center. Roach' thanked the Commission and the members of the public for attending and also congratulated James Woodside on his fish smoking venture. They work closely with their State and Tribal counterparts to ensure consistent, high quality service for communities throughout the Region. Many of you many know them as that "FEMA person who reviews my mitigation plan". Yes, they do review all the local, Tribal, and State natural hazard mitigation plans in Region X, but they offer technical assistance to jurisdictions long before the plan makes it to their desks, as well as after the plan is approved. Brett and Kristen are available to help make your plan and planning process efficient and effective, leading to projects or policies that reduce risk in your community. They can attend meetings in- person or virtually to discuss the importance of hazard mitigation planning and/or the FEMA planning requirements; assist with hazard specific or infrastructure data sources; offer best practices and examples froth other mitigation plans; provide ideas on implementing the plan through project development or integration into local comprehensive plans; and provide training in all aspects of hazard mitigation planning. Brett and Kristen also bring their expertise to the Risk MAP projects throughout Region X and coordinate with other Risk Analysis Branch and STARR staff, to ensure Risk MAP produces products and information valuable to mitigation planning and risk reduction activities. Kristen joined FEMA in 2006 to support the Map Modernization Program and transitioned to lead the Mitigation Planning Program in Region X in 2007. In addition to her mitigation planning work, she serves as a Situation Unit Lead in the Regional Response Coordination Center, and is the Mitigation Division lead for the Region's Threat/Hazard Identification and Risk Assessment (THIRA). She has degrees in Geology and Urban Planning from Pennsylvania State University and University of Washington, respectively. Brett has called the Seattle area home since 2009 when he joined FEMA's Risk Analysis Branch. In addition to his mitigation planning duties, he also serves as a Situation Unit Lead in the Regional Response Coordination Center, and Chairs the Regional SharePoint Committee. His prior work experience includes working as a wildland firefighter for the National Park Service and U.S. Forest Service, working as a parks planner for a private firm in Portland, and serving as a Peace Corps volunteer in Armenia. He has a Masters of Community and Regional Planning from the University of Oregon.
