A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A
CONDITIONAL USE PERMIT TO ALASKA ROAD BUILDERS TO
EXTRACT GRAVEL, SET UP AND OPERATE AN ASPHALT PLANT ON
LOTS CL AND CK, FOREST ACRES SUBDIVISION AND EASTERLY
PORTIONS OF THE JAPP CREEK DRAINAGE, WITH KENAI
PENINSULA BOROUGH TAX PARCEL ID NUMBERS OF 14503202,
14531038 AND 14503106, WITHIN THE RESOURCE MANAGEMENT
ZONING DISTRICT
WHEREAS, Alaska RoadBuilders, Inc. has applied for a Conditional Use Permit (CUP)
from the Seward Planning and Zoning Commission to extract gravel from the Japp Creek
drainage and establish an asphalt batch plant utilizing three lots having the legal descriptions of:
Lots CL and CK, Forest Acres Subdivision, and Govt. Lot 1 of Sec 33; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225,
"resource extraction, commercial surface, i.e., gravel" is allowed in the Resource Management
Zoning District as a conditionally permitted use; and
WHEREAS, these properties are located within the Resource Management Zoning
District; and
WHEREAS, the owner (Afognak Construction) of these parcels holds a current CUP for
gravel extraction and has leased these parcels to the applicant, Alaska RoadBuilders, Inc; and
WHEREAS, the gravel extraction for this project has taken place under the current
gravel extraction CUP and is currently stockpiled on the leased Lots CL and CK, Forest Acres
Subdivision, awaiting processing; and
WHEREAS, the applicant has submitted an application and site plan to operate an
asphalt plant on Lots CL and CK, for approximately 10 days between the end of August 2013
and the end of September 2013; and
WHEREAS, having complied with the public notification process, on August 20, 2013,
the Seward Planning and Zoning Commission held the required public hearing on the
Conditional Use Permit application.

NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC §15.10.320(D), the Planning and Zoning Commission has
reviewed the applicant's request for a CUP to operate a gravel extraction and asphalt plant on
Lots CL and CK, Forest Acres Subdivision, and Govt. Lot 1 of Sec 33 and declared the
following Findings of Fact:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district
Finding: This condition has been established at the time of agenda distribution.
The property is zoned Resource Management. The Resource Management Zoning
District provides for "Lands, which are generally undeveloped and cannot be precisely
zoned due to inadequate information on the extension of public services and utilities; the
suitability of the land to support commercial, residential, industrial or public uses; and
other possible environmental consideration."
The gravel extraction operation is allowed in the Resource Management district by
Conditional Use Permit from the Planning and Zoning Commission. A gravel extraction
Conditional Use Permit was issued for these parcels in April 2005, no adverse impacts to
adjoining properties or other properties in the area have been received in the past 8 years.
The requested asphalt plant operation utilizing the extracted gravel is allowed by
Conditional Use Permit as a component of a gravel extraction operation.
B. The value of adjoining property will not be significantly impaired
Finding: This condition has been met. The neighboring properties are vacant and
undeveloped. Minimal impact is expected for the adjoining properties. There is no
indication that the approximate 10 day operation of the asphalt plant will negatively
impact the value of adjoining properties. Other properties along Resurrection River have
been used for gravel extraction and asphalt plant operation with no known adverse
impact.
C. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: The proposed use is not specifically mentioned in the Seward 2020
Comprehensive Plan or in the Strategic Plan (1999). However, both plans encourage
ongoing and additional economic activities within the community and support flood
hazard mitigation of Japanese Creek by gravel bed load removal.
D. Public Services and facilities are adequate to serve the proposed use.
Finding: Water, sewer, and power are not currently available to these parcels;
however they are not needed for this activity. Emergency service vehicles can access the
property via Dieckgraeff Road to Dimond Boulevard.
E. The proposed use will not be harmful to the public safety, health or welfare.

Finding: The approximate 10 day asphalt plant operation during the end of August
through the end of September 2013 shall meet all local, State and Federal requirements.
No harm to public safety, health or welfare is expected.
F. Any and all specific conditions deemed necessary by the commission to fulfill the
above - mentioned conditions shall be met by the applicant These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
Based on the above fmdings and conclusions, approval of the CUP shall be subject
to the following conditions:
1. This Conditional Use Permit authorizes the approximate 10 day asphalt plant
operation between the end of August 2013 and the end of September 2013.
2. The hours of operation shall be between lam and 7pm.
3. The asphalt plant shall be removed from the site at the end of September 2013.
4. Traffic control Plan A, shall use easement across University of Alaska property to
Dimond Boulevard, out to Seward Highway on Dieckgraeff Road.
5. Traffic control Plan B, shall be South on Pine to Cottonwood Street, East on
Cottonwood to Maple Street, North on Maple to Dieckgraeff Road and the
Seward Highway.
6. Fuel storage shall only be allowed for the onsite asphalt plant operations and the
storage tank shall meet all local, State and Federal laws.
7. Adequate sanitation facilities, such as portable latrines, shall be onsite and
available during all periods of operation.
8. Issuance of this permit does not alleviate the applicant's responsibility to obtain
all local, state and federal permits, if required.
9. The Planning and Zoning Commission may modify this conditional use permit if
changed uses no longer conform to the standards and legal requirements justifying
its present approval, or if the permittee applies for a modification to meet a
different development plan that conforms to the standards and legal requirements
for approval of a conditional use permit.
10. Any proposed modification plan shall be subject to the public notice and public
hearing requirements of law, which shall occur only after payment of the filing

fee established by resolution of the city council.
Section 2. The Planning and Zoning Commission finds that the proposed use, subject to the
above conditions satisfies the criteria for granting a Conditional Use Permit provided the
conditions listed on Section 1, Subsection F. are met by the applicant, and authorizes the
administration to issue a Conditional Use Permit for asphalt plant operation to Alaska
RoadBuilders, Inc.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320;
Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit.
Additionally, the administration shall periodically confirm the use conforms to the standards of
its approval.
Section 4. This resolution shall take effect 10 days following its adoption.

BACKGROUND & JUSTIFICATION:
Alaska RoadBuilders, Inc. has applied for a Conditional Use Permit (CUP) to extract gravel and
operate an asphalt plant on portions of Lots CL and CK, Forest Acres Subdivision and a portion of
Govt. Lot within Section 33, within the Resource Management Zoning District. These properties
contain just over 33 acres of vacant and undeveloped land.
The proposed activity, "resource extraction, commercial surface, i.e., gravel" is allowed in the
Resource Management Zoning District as a conditionally permitted use, as per Seward City Code
(SCC) Land Uses Allowed Table 15.10.225. The Resource Management Zoning District provides
for "Lands which are generally undeveloped and cannot be precisely zoned due to inadequate
information on the extension of public services and utilities; the suitability of the land to support
commercial, residential, industrial or public uses; and other possible environmental consideration."
A gravel extraction Conditional Use Permit was issued in April 2005 and is currently still valid for
the same parcels. The gravel extraction that has been accomplished for this particular project has
been completed under the 2005 Conditional Use Permit. The gravel has been stockpiled on Lots CL
and CK, Forest Acres Subdivision awaiting processing in the asphalt plant.
The applicant has applied for a Conditional Use Permit to operate an asphalt plant for approximately
10 days, between the end of August 2013 and the end of September 2013. The asphalt plant will be
completely removed from the area by the end of September 2013.
Surrounding land uses and zoning:
Lots CL & CK Forest Acres Subdivision are located at northern reaches of the Forest Acres
Subdivision. All the surrounding parcels to proposed asphalt plant site (Lots CL & CK, Forest Acres
Subd.) are vacant, undeveloped parcels. The parcel to the North is a large vacant, 160 acre parcel
owned by the University of Alaska. The undeveloped parcels to the South are privately owned and
contain approximately 12 acres of vacant land. The undeveloped parcel to the West is a large 31 acre
privately owned parcel. The undeveloped parcels to the East are also vacant, approximately 10 acres
and privately owned with the exception of two parcels owned by the City.
Utilities:
There are currently no utilities available to these lots. There is no need for utilities for this type
of an activity. Emergency service vehicles can access this property from Dieckgraeff Road.
Floodplain status:
The proposed asphalt plant will be placed on Lots CL and CK, which are outside of the mapped
Special Flood Hazard Area.
Traffic impacts.
The applicant's first route choice is to obtain an access easement from the University of Alaska and
cross the University land to the North, accessing Dimond Boulevard and Dieckgraeff Road directly
out to the Seward Highway
The applicant's second choice (if unable to obtain the easement from the University) is to exit Lots
CL & CK to the south on Pine Street, head east on Cottonwood Street turning north on Maple Street
to Dieckgraeff Road then out to the Seward Highway.
Public Safety, Health and Welfare:
Noise Impacts
Noise is controlled by the Seward City Code Chapter 9.25. General hours of operation are allowed
from 7 a.m. to 10 p.m. The applicant has requested hours of operation as 7 a.m. to 7 p.m.
Health Hazards
Asphalt plants, fuel storage and sanitary facilities are all regulated under local, State and Federal
guidelines.
Emergency Access
Emergency service vehicles can access the property via Dieckgraeff Road to Dimond Boulevard.

Property owners within three hundred (300) feet of Lots CL and CK, Forest Acres Subdivision were
notified of this proposed conditional use permit action. Public notice signs were posted on the
property, and all other public hearing requirements of Seward City Code §15. 01.040 were complied
with.
RECOMMENDATION:
Staff recommends approval of Resolution 2013 -14 granting a Conditional Use Permit to Alaska
RoadBuilders, Inc. to set up and operate an asphalt plant on Lots CL and CK, Forest Acres
Subdivision, subject to the conditions noted within the Resolution.

Dear Donna,
I am writing concerning the proposed Asphalt Plant that would be located in the northwest corner of the Forest Acres
Subdivision in Seward, Alaska. While I support economic development in our town, I am concerned about the proposed
location of this plant.
Forest Acres is regarded as a favorable neighborhood to live in because it is quiet, has great mountain views, is visited by
lots of wildlife, and is inhabited by people who maintain their properties /homes in ways that support a healthy & steady
real estate value.
This neighborhood has some unique challenges, such as flooding in the lower areas and high winds in the higher areas.
In the summertime, the wind usually blows from the south. During the rest of the year, the wind typically whips
between Benson and Resurrection mountains, bringing a strong, northerly wind that is almost constant (more so than in
other parts of Seward). It can be quite chilly! But living in this part of Seward makes dealing with the wind a fair trade-
off.
Should an asphalt plat be permitted in the northwest portion of Forest Acres, there is a high likelihood that the
tranquility and enjoyment of this neighborhood will be at risk. The first would be caused by strong, caustic -like odors
being carried by the wind from the asphalt plant into the upper regions of Forest Acres most of the year. The second
would be caused by the noise level, especially if the city grants more than 8 hours of legal "hours of operation" per day.
I personally enjoy coming home from work and sitting on my porch at 7 pm to enjoy the natural beauty and quiet
surroundings of my Forest Acres home. I also sleep with windows open all year long. I fear that my quality of life will be
negatively impacted if hot tar smells are being carried into my open window well into the evening — should operation
hours be allowed until 10 pm, for example. I also feel sad to think I will always have to listen to the churn of heavy
equipment. Should that become a reality, it will be enough to make me move away.
I hope that the commissioners on our planning and zoning commission, the city planner, the city manager, and others
who are involved in the permit process will consider the damage that will be caused to the quality of life in Forest Acres
Subdivision by an asphalt plant operating on the northwest corner of our neighborhood and up and down Japp Creek.

I am concerned about the proposed asphalt plant in the Forest Acres Subdivision for these reasons:
This process should not yet be going to public hearing when all information on the application that is required to be
received by the Development Office 3 weeks prior to the public hearing has not yet been received. According to Dwayne
Atwood (phone conversation on August 9th at 3 pm with my wife), he said that nothing on part F. of the Conditional Use
Permit Application has been submitted by Alaska Roadbuilders Inc.
While Alaska Roadbuilders Inc, may not be planning to build permanent structures, nowhere in the documentation
requested by the Community Development Department is there a provision for a description of what temporary and /or
working equipment will be put and used on the land parcels. It is important to know this because of the decibels,
emissions, and other machinery- related concerns that arise.
I have attached a government document about the emissions that result from asphalt plants and ask you to look at
these prior to holding a public hearing. Here is an excerpt:
The primary emission sources associated with HMA production are the dryers, hot bins, and mixers, which emit
particulate matter (PM) and a variety of gaseous pollutants. Other emission sources found at HMA plants include
storage silos, which temporarily hold the HMA; truck load -out operations, in which the HMA is loaded into trucks for
hauling to the job site; liquid asphalt storage tanks; hot oil heaters, which are used to heat the asphalt storage tanks;
and yard emissions, which consist of fugitive emissions from the HMA in truck beds. Emissions also result from vehicular
traffic on paved and unpaved roads, aggregate storage and handling operations, and vehicle exhaust.
Additionally, since part of the process is retrieving gravel from the parcel # 14531038, 100 W. Ash Street, which is the
gravel bed in Japp Creek, and which runs almost the entire length of the Forest Acres Subdivision's western border, the
noise pollution to the neighboring homes caused by the equipment must be considered by Seward's Community
Development Department and its commissioners. I do not understand why anyone would destroy the quality of life in a
pristine neighborhood by allowing this to occur.
I consider the proposal of an asphalt plant so close to one of Seward's largest neighborhoods to be harmful to the public
safety, health, and welfare, per the Seward City Code, Conditional Use Permits, #15.10.320.
(d) (5), because of the noise pollution and emissions that will occur.

Resolution 2013 -13 of the Planning. and Zoning Commission of the City of
Seward, Alaska, providing recommendations to City Council regarding the
parcel legally known as the West % of Lots 19 and 20, Block 30, Original
Townsite of Seward, located at 408 Madison Street
Glenz noted the history of the property and the life safety issues related to the unsecured,
abandoned structures and junk on the lot. The property was owned by the late D.E. Wood. She
stated no heirs had been willing to accept ownership of or responsibility for the parcel and property
taxes had not been paid for several years.
The property ownership was to be transferred to the City of Seward through the Kenai
Peninsula Borough tax foreclosure process and Administration was seeking direction on whether
to retain the property or dispose of it for private use.
Glenz noted the City Building Inspector and the Fire Chief had stated the structures on the
parcel were unsafe and required demolition. Staff had received verbal communication from the
adjoining property owner and other members of the public regarding the unsafe conditions. The
City had no beneficial reason to retain the property, Glenz said.
Fleming asked if the City should clean up the property, or if the property could be given to
the adjoining property owner to clean up.
Glenz said Administration was working with the City Attorney to determine how the
property might be transferred to the adjoining property owner, who was willing to take the
responsibility of clean up. Glenz noted the high cost of the City cleaning up the parcel with little
option of recouping the dollars spent. There were no other development options for the land,
because it did not meet the minimum size to build on, per Code.
Ecklund asked if the proposed transfer of the property was to be a sole source negotiation.

Glenz said that appeared to be the best course of action since the size of the lot made it
undevelopable as a standalone lot.
Ecklund said she would consider placing a time limit on the cleanup of the property,
because of the health and safety issues.
Glenz said the adjoining property owner was very eager to clean up the property and had
been concerned about fire danger and other issues for several years. She noted that the adjoining
property owner had made the effort to keep the grass, bushes and weeds mowed to reduce the fire
danger.
Butts asked how the lot had been configured to the dimension of 50 feet wide by 60 feet
deep.
Glenz approached the drawing board directly behind the Commissioner dais and illustrated
the warranty deed transfer that resulted in bisecting two 30 by 100 foot lots, creating the described
parcel, which was too small to be developed under current City code.
Motion (Fleming/Butts) Approve Resolution 2013 - 13
Butts questioned if the Commission needed to indicate whether money or trade value
should be noted as part of the resolution.
Ecklund reasoned that there was no benefit to setting a timeline for the cleanup, and the
market value was hard to establish given the needed demolition and cleanup. It was best to get the
property cleaned up and back on the tax rolls as quickly as possible, eliminating the life safety
issues, she said.
Butts asked if there had been some safety assessment or an audit of potentially hazardous
materials.
Glenz responded by noting an abatement assessment had not been conducted but there
were derelict vehicles and large amounts of debris on the lot as well as the old structures. She
noted the Building and Fire Department had done a minimal inspection and had expressed life
safety concerns.
Roach' asked if the City Attorney would be working on the various issues related to the
disposal and cleanup of the property while negotiations continue with the adjoining property
owner.
Glenz and the City Attorney were both dedicating a considerable time and energy to

Glenz said.

the meeting. The meeting could be rescheduled to August 20, if there was a business item that
needed to come before the Commission, Glenz said.

recent demolition of two older structures on Second Avenue.
Ecklund noted the Kenai Peninsula Borough's recent approval of area Digital Flood
Insurance Rate Maps. Ecklund also said two local properties would soon be disposed of through
the tax foreclosure process and the public would be able to bid on the properties. The information
was available through the borough and the Community Development office.
Roach' thanked staff for the meeting preparations and also mentioned that the Kenai
Peninsula Borough School District would be working with the City of Seward to improve any
crosswalks in the area of the Seward Elementary School. Roach said she had also noticed several
cleanup efforts around the community.
