A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A
CONDITIONAL USE PERMIT (CUP) AMENDMENT, REDUCING THE
NUMBER OF PARKING SPACES REQUIRED BY CUP 2003-02 ISSUED
TO SALTWATER SAFARI TO CONSTRUCT AND OPERATE A 12-UNIT
HOTEL IN THE HARBOR COMMERCIAL ZONING DISTRICT, AT 1210
FOURTH AVENUE, LOT 12, BLOCK 6, SEWARD SMALL BOAT
HARBOR SUBDIVISION
WHEREAS, Robert Candopoulos, owner of Saltwater Safari Co. has applied for an
amendment to condition 2 of Conditional Use Permit (CUP) 2003-02 issued by the Seward
Planning and Zoning Commission to construct and operate a 12-unit hotel/lodgc located at 1210
Fourth Avenue; and
WHEREAS, condition 2 of CUP 2003-02 required one (1) off -site parking space per
guest unit be provided for a total of twelve (12) spaces; and
WHEREAS, the original building plans and the CUP issued for the Saltwater Safari
Lodge were based on a 12-unit hotel/lodge; however, during construction the plans were changed
and a 9-unit lodge was built; and
WHEREAS, the Saltwater Safari Lodge is located on Lot 12, Block 6, Seward Small
Boat Harbor R.eplat, within the Harbor Commercial Zoning District; and
WHEREAS, the applicant has provided the 12 off -site parking spaces on Lot 7, Block 2,
Oceanview Subdivision, located at the corner of Van Buren Street and. Fourth Avenue for the
past 10 years; and
WHEREAS, the applicant has applied for an amendment to condition 2 of CLIP 2003-02
requesting the Commission reduce the off -site parking requirement from one (1) space per guest
unit to one (1) space per two (2) guest units; this would require five (5) spaces based on the nine
(9) unit lodge; and
WHEREAS, the applicant is currently requesting a reduction in the number of required
spaces due to the lack of utilization of these spaces which would allow Lot 7 to be commercially
developed; and
WHEREAS, having complied with the public notification process, on October 3, 2013,.

the Seward Plaiu-ring and Zoning Commission held the required public hearing on the
Conditional Use Permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC§15.10.320(D), the Planning and Zoning Commission has
reviewed the applicant's request to amend condition 2 of CUP 2003-02 reducing the number of
required off -site parking spaces from one (1) space per guest unit to one (1) space per two (2)
guest units and declared the following Findings of Fact:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning districts.
Finding: This condition has been met. The Saltwater Safari Lodge property is
within the Harbor Commercial (HC) Zoning District. The Harbor Commercial Zoning
District provides an area for water -dependent or water -related uses with particular
emphasis ontransportation, tourist, recreational, commercial or industrial enterprises
which derive major economic or social benefit from a harbor location (SCC 15-05.025.
(b) (7). Operating a hotel/lodge is consistent with the other uses in the Harbor
Commercial Zoning District and is allowed by Conditional Use Permit. No off street
parking is required within the Harbor Commercial Zoning District.
B. The value of adjoining property will not be significantly impaired
Finding: This condition has been met. This property is located in a portion of the
harbor which has many businesses providing services similar to and compatible with the
Saltwater Safari Lodge. There is a large public parking lot directly to the west of the
lodge. There is no indication that the proposed reduction of off -site parking spaces
would negatively impact the value of the adjoining properties.
C. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: The proposed reduction in off -site parking is not specifically mentioned in
the Seward 2020 Comprehensive Plan or in the Strategic Plan (1999). However, both
plans encourage growth and development within the Small Boat Harbor and Uplands,
including public parking.
D. Public Services and facilities are adequate to serve the proposed use.
Finding: All public services are available to these parcels; however, no additional
public services are needed for the proposed reduction in off -site parking.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: Public parking is available closer to the Saltwater Safari Lodge in addition

the applicant has proposed five (5) additional offsite parking spaces. No harm to public
safety, health or welfare is expected.
F. Any and all specific conditions deemed necessary by the commission to fulfill the
above -mentioned conditions shall be met by the applicant. These inay include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
Based on the above findings and conclusions, approval of the CUP amendment shall
be subject to the following conditions:
This Conditional Use Permit amendment authorizes the reduction of the required
off -site parking spaces from one (1) space per guest unit to one (1) off site space
per two (2) guest units.
2. All other conditions of the original Conditional Use Permit 2003-02 remain in
place for the life of the Saltwater Safari Lodge
Section 2. The Planning and Zoning Commission finds that the proposed use, subject to the
above conditions satisfies the criteria for granting a Conditional Use Pen -nit Amendment
provided the conditions listed on Section 1, Subsection F. are met by the applicant, and
authorizes the administration to issue a Conditional Use Pen -nit Amendment reducing the
required off -site parking for the Saltwater Safari Lodge.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320;
Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit
Amendment. Additionally, the administration shall periodically confirm the use conforms to the
standards of its approval.
Section 4. This resolution shall take effect 10 days following its adoption

Since the applicant has stated that the guests who require parking prefer to use the City's south
public parking lot, staff requested the Parking Department provide a review of the use for the parking
lot this past summer. The report stated there were 4 days in June, 20 days in July and 13 days in
August when the parking lot was full. The Parking Department noted there were 180 stalls and
estimated the lot to be 50% full weekdays and 80% full weekends between late June and the end of
August.
Surrounding land uses and zoning:
All parcels surrounding the Saltwater Safari Lodge are within the Harbor Commercial Zoning
District and provide the harbor board walk, harbor related services and visitor needs. The parcels to
the north contain gift shops, harbor master building and charter offices. Parcels to the south contain
the City boat launch and access to the South Harbor Uplands. To the east is the Small Boat Harbor.
The parcel adjoining to the west is the Kenai Fjords Park harbor office. To the west across Fourth
Avenue is the City's south public parking lot.
Utilities:
All required utilities are provided; no change to current use is required for this requested
amendment.
Floodplain status:
The Saltwater Safari Lodge is located within a Special Flood Hazard Area. The required floodp,lain
permits were applied for and received during the building permit process.
Parking.
Although SCC § 15.10.215 Parking does not require offstreet parking within the Harbor Commercial
Zoning District, public Right of Way parking is limited in the harbor area, The Commission has
historically required the applicants of Hotel/Motel CUP's to provide on or off -site parking.
Condition 2 of the original CUP required one parking space per guest unit for the life of the
Saltwater Safari Lodge. While the applicant continues to provide the required off site parking he has
submitted a written request to reduce the number of required spaces to provide less than one space
per guest unit. The applicant has reviewed the 10 year history of the lodge occupancy, the use of the
off -site parking by guests and provided a written account for the Commission to review. The
applicant is requesting the Commission allow him to provide one (1) off -site space per two (2) guest
units. This would require five (5) spaces for the nine (9) unit lodge

BACKGROUND & JUSTIFICATION:
Applicant Robert Candopoulos, owner of the Saltwater Safari Hotel/Loge has applied for an
amendment to condition 2 of Conditional Use Permit (CUP) 2003-02, granted by the Corru-nission to
construct and operate a 12 unit hotel/lodge within the Harbor Commercial Zoning District. During
the construction of the Saltwater Safari Lodge a design change was made and only nine (9) lodging
rooms were built.
The Saltwater Safari Lodge has provided the required parking on Lot 7, Block 2, Occanview
Subdivision, located at the comer of Fourth Avenue and Van Buren Street for the past 10 years. The
applicant has submitted the request to reduce the number of parking spaces for several reasons. The
applicant has reviewed and tracked the use of the off -site parking over the past ten (10) seasons and
found the required parking and the lot to be underutilized. He has made a business decision to
develop Lot 7 with a commercial structure. He has worked with tile adjoining parcel owner to lease
the required off -site parking spaces.
The applicant has several options for providing the required off -site parking accommodations. These
suggestions are included in the letter dated September 10, 2013 and included in the packet to the
Commission. Working with staff, the applicant shall provide the required parking for the life of the
Saltwater Safari Lodge and shall meet the parking code requirements of the City Code and be
detailed within the recorded Parking Agreement Document.
In the applicant's request for a parking requirement reduction he has stated that, of the guests
requiring parking, at least 75% prefer to pay for parking in the City parking lot. He also noted that a
large percentage of the guests staying at the lodge arrive by bus or a group package and do not
require any parking during their stay. He also noted that in the past three (3) years approximately
3% of the guests stay longer three (3) nights or longer and that 3%, of the overall guests, are the ones
who chose to use the off -site parking spaces.

responsibility of the business owner to provide and maintain said off-street

business.
Property owners within three hundred (300) feet of the Saltwater Safari Lodge were notified of this
proposed conditional use pen -nit amendment. Public notice signs were posted on the property, and
all other public hearing requirements of Seward City Code § 15. 01.040 were complied with.
All departments were notified of the requested CUP amendment. No concerns were voiced by any
department head.
At this time of publication of this report, staff has received no public comments. If any comments
are received after.thi,s publication, they will be presented as a lay down to the Commission and the
public at the October 3' 2013 meeting.
RECOMMENDATION:
Staff recommends approval of Resolution 2013-15 granting an amendment to Conditional Use
Permit 2003-02, amending
ending condition number 2 by reducing the parking requirement from one (1)
space per guest unit to one (1) space per every two (2) guest units.

As you are aware, the existing conditional use permit for the Saltwater Safari
Company lodging facility, or Safari Lodge, requires parking for a total of 12 units.
Prior to construction, I personally acquired the lot on the corner of 4th Ave and Van
Buren and leased it back to Saltwater Safari to facilitate that requirement.
After the conditional use permit was issued, and during physical' construction of
Safari Lodge, ifwas decided that three of the nightly rental rooms were going to be
removed and a resident managers apartment was built in place of them. Based on
this, we actually only now need 9 parking spaces to be compliant with the CUP.
Through the many years of operation at Safari Lodge, we offer each of our guests
free, off -site parking at our 411, and Van Buren location. Every guest is also issued a
parking pass for their vehicles to display in their windows. Our staff also hands each
guest a map, showing our "free" parking location, as well as the alternative "paid"
parking lots that the city offers.
It is surprising to see how many guests would actually prefer to pay and park,
versus walking the one block to our lodge. With parking directly across the street, I
would venture to say that at least 75% of our nightly guests would choose that
option.
Our parking area does get utilized more often when we have guests with us for
extended stays of 3 or more days. I ran some numbers on this and did a three season
average on how many people stay with us for more than three nights and using
2011, 2012 and 2013, came up with approximately 3% of all guests.
Anothbr aspect of the type of clientele that we have is that'many of our guests are
groups that are bussed in and out of Seward. A huge portion of our business are oil
company "team building" fishing and lodging charters and those folks are bussed in.
On their overnight stays, that bus leaves and returns the following evening to pick
up the groups.

Based on my observations in running this lodging operation, I feel that the
requirement for a total of 9 parking spaces for this lodge should be revisited by the
planning department.
I have several alternative options that I'd like to present:
First, Id be very willing to purchase 9 annual parking permits for the city lot to offer
my guests on an as need basis. They would pay a refundable deposit when the pass
is returned upon checkout.
Second, I have spoken with Tom Tougas about leasing 4 parking spots in an area
closer than my lot whereby giving my guests easier access. Tom is willing to lease
me whatever is required for Safari Lodge parking for the duration on my lease.
Third is to remove the parking requirement completely, and let my guests pay the
daily parking fee to the city in the lot located across the street. This lot is not usually
full, especially in the- evening when our guests are checking in,
The reasoning for wanting to change how I do business with regard to parking is
simple. The 4th and Van Buren ➢ot is a prime location for a future business expansion
and opportunity, As I had mentioned to you when we spoke, I have a great desire to
build a laundry facility / bunkhouse on that property and would like free up the
Safari Lodge parking requirements there.

An approved conditional use permit lapses six (6) months after approval if no building permit is
procured or if the allowed use is not initiated. The Seward Planiling and Zoning Commission may
grant time extensions not to exceed six (6) months each upon a finding that circumstances have not
changed sufficiently to warrant reconsideration of the approval of the conditional use permit. A
request for an extension must be submitted prior to the expiration of the permit. A public hearing
shall not be required prior to granting an extension of time (SCC' 15.10.320.G).
Failure to adhere to all the conditions of this permit may result in revocation of the permit and
possible civil and criminal penalties.

sufficiently to warrant a reconsideration of the approval of the CUP; and
WHEREAS, on August 26, 2013 Mike Insalaco, on behalf of Leif Olson, requested a
second six month extension of CUP' 2012-01, stating within the request there had been no
changes to the original plan.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:.
Section 1. The Commission finds that circumstances have not changes sufficiently to
warrant reconsideration of the Conditional Use Permit issued to Leif Olson for the development.

Alaska Railroad right of way, within the Resource :Management Zoning District, located at 2608
Seward Highway.
Section 2. Conditional Use Permit 2012-01, issued to Leif Olson on August 31, 2012 is

Section 3. This resolution shall take effect immediately upon its adoption.

BACKGROUND & JUSTIFICATION:
On August 24, 2013 M ' ike Insalaco, on behalf of property owner Leif Olson, submitted a request
for a second six month time extension for Conditional Use Permit 2012-01, which was granted in
August of 2012. The request for a second extension was submitted prior to expiration. The plans
to construct a single family home at 2608 Seward Highway have not changed.
The Seward City Code 15.10.320 G (1) stipulates an approved Conditional Use: Pen -nit lapses six
(6) months after approval if no building permit is procured or if the allowed use is not initiated.
Conditional Use Permit 2012-01 would have lapsed in August 2013, which is six (6) months
after the original Conditional Use Permit extension was granted. The second extension shall
expire in February, 2014.
Seward City Code 15.10.320. G (2) states the Commission may grant time extensions not to
exceed six (6) months each upon the finding that circumstances have not changed sufficiently to
warrant a reconsideration of the approval of the CUP. The applicant has stated in a written
extension request that no changes have occurred or are planned. Construction plans should be
completed in time for the 2014 building season.

5. The Planning and Zoning Commission may modify this conditional use permit if changed
uses no longer conform to the standards and legal requirements justifying its present
approval, or ifthe permittee applies for a modification to meet a different development plan
that conforms to the standards and legal requirements for approval of a conditional use
permit.
6. Any proposed modification plan shall be subject to the public notice and public hearing
requirements of law, which shall occur only after payment of the filing fee established by
resolution of the city council.
7. Any development on the property shall not be within 50 feet of mean high water of Japanese
Creek.
An approved conditional use pen -nit lapses six (6) months after approval if no building permit is
procured or if the allowed use is not initiated. The Seward Planning and Zoning Commission may
grant time extensions' not to exceed (6) months each upon a finding that circumstances have not
changed sufficiently to warrant reconsideration of the approval of the conditional use permit. A
request for an extension must be submitted prior to the expiration of the permit. A public hearing
shall not be required prior to granting an extension of time (SCC' 15,10.320.G).
Failure to adhere to all the conditions of this permit may result in revocation of the permit and
possible civil and criminal penalties.

WHEREAS, on August 21, 2012 the Planning and Zoning Commission approved
Resolution 2012-12 granting a Conditional Use Pennit to Leif Olson for the development of an
RV/Camper Park on that portion of Govt. Lot 1 lying east of the Seward Highway and the
Alaska Railroad right of way, within the Resource Management Zoning District, located at 2608
Seward. Highway; and
WHEREAS, the Seward City Code (SCC) 15.1.0�.320 G (1) stipulates an approved
Conditional Use Permit lapses six (6) months after approval if no building pen -nit is procured or
if the allowed use is not initiated; and
WHEREAS, (SCC) 15.10.320. G (2) states the Commission may grant time extensions
not to exceed six (6) months each upon the finding that circumstances have not changed
sufficiently to warrant a reconsideration of the approval of the CUP; and
WHEREAS, on August 24, 2013 Mike lnsalaco, on behalf of Leif Olson, requested a
second six month extension of CUP 2012-02, stating within the request there had been no
changes to the original plan.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1.. The Commission finds that circumstances have not changed sufficiently to
warrant reconsideration of the Conditional Use Permit issued to Leif Olson for the development
of an RV/Camper Park on that portion of Govt. Lot 1 lying east of the Seward Highway and the
,Alaska Railroad right of way, within the Resource Management Zoning District, located at 2608
Seward Highway.
Section 2. Conditional. Use Permit 2012-02, issued to Leif Olson on August 31, 2012.is
hereby extended until February, 2014.
Section 3. This resolution shall take effect immediately upon its adoption.

Glenz noted the hist of the applicant's'permit submission and pointed out the location

gravel extraction at the property, Alaska Road Builders had amended its CUP application to limit
its asphalt plant operation to 10 days, Glenz said.
Glenz pointed out two access / traffic routes the applicant intended to use to access
Dieckgra&ff Road to habl'asphalt. Staff had received several comments about the proposed project,
whichhad,been provided in the meeting packet and as a laydown for the Commission, Glenz said.
Ecklund, asked for infon-nation about the duration of the 2005 Conditional Use Permit that
was issued for the property.
Glenz said the issued Conditional Use Permit would continue indefinitely, provided the
permitted use was active as allowed by the permit.
Butts asked if the previously permitted gravel operation generated any complaints.
No complaints had been received until recently, when daily work started before 7 a.m.,
Glenz said. The City Manager spoke with the operator to resolve that issue, Glenz said.
Ecklund asked for clarity on the proposed work hours noted by the applicant.

Denise Plush, a city resident, said she was concerned about air quality and the potential
impact to elderly residents of Seward Mountain Haven.
Kxisty Sholly, a city resident, questioned why an asphalt plant would be located near
schools. She said the noise and potential pollution was a concern.
Virginia Allen, a city resident, asked whether the Commission might consider postponing
action until more project information could be obtained. Allen said she believed the proposed
project was not compatible with a residential neighborhood.
David Paperman, a resident of the city, said he recently,fived outside of the city limits and
enjoyed having fewer regulations. Within the city, more code, compliancei's required, and property
owners are reassured that development will be reasonable, he said. fle'said ,the proposed project
was surprising for that reason.

Roach' requested the applicant to step forward from the audience to answer Commission
questions.
Chuck Davis of Alaska Road Builder's 'agreed to answer questions and apologized for any
inconvenience to residents. Davis said the gravel in the Japp Creek drainage was very high quality
and any removal of material would help to mitigate flooding. Davis described the emission
controls and other features of the, asphalt plant and state licensing required for operation. Davis
said he would not apply for another Conditional Use Pen -nit to produce asphalt at the proposed
location.
Commissioners asked Davis specific questions about the ability to operate in other
locations and the number of -possible asphalt jobs.
Davis said the company planned to produce asphalt for the Seward Highway from mile
post 17 to, ' 24, for Spring Creek Correctional Center and a new State of Alaska maintenance shop
that was being constructed near Crown Point.
Commissioners further discussed the planned operation and location.
Roach' confirm ' ed the"Conditional Use Permit was for approximately 10 days of operation
and that another permit would be required for operation next season.
Glenn explained the permit process, noting when the permit under discussion would expire.
Roach' addressed the audience, pointing out that the City of Seward did not have a Code
compliance officer to enforce violations and that the public might lobby for funding to provide that
position.

McClure thanked the public for attending and providing input.
Fleming said the process for the Conditional Use Permit application passed too quickly.
Butts thanked staff for the meeting preparation and also thanked the public for providing
input. Butts encouraged the public to apply to fill a Commission vacancy.
Ecklund said the discussion and debate was not intended to stop'a business from operating,
but to move the location farther from residences.
Roach' requested Administration hold a work session with applicants before Planning and
Zoning Commission meetings are held, to help resolve any issues that might arise.

Ecklund said she was encouraged by public comment and the commitment that residents

Roach' encouraged the public to attend future work sessions when issues arise.
Long said the paving of city roads will require a public process to protect all interests. The
City guiding plans and use tables do not provide adequate guidance on how roads are built and
what the processes may be. Long encouraged the public to attend future Planning and Zoning

Washington DOE Hazard September is National
Reduction Grants Preparedness Month!
The Washington State Legislature
has provided $11.25 million to the
Department of Ecology to run a
competitive flood hazard reduction
projects grant program. The funds
will be used to provide grants to
communities for projects that reduce
flooding hazards while also
providing benefits to salmon
recovery efforts, water quality
improvements, habitat recovery,
open space preservation, farmland
preservation and more.
Communities that qualify will
submit project applications and must
explain how their projects will meet
the multiple benefit criteria.
Projects will be scored and ranked
and winning applications provided
grant funding, There is a 20%
match requirement for all grants
awarded. DOE is working out the
details on the application process,
and will be posting more
information on its website in the
coming months.
The Legislature also provided more
than $38 million for specific
projects that also meet the "multiple
benefits" criteria. Most of them are
contained in the "Coordinated
Investment for Puget Sound
Floodplains".,. an initiative headed up
by The Nature Conservancy. Those
funds will be combined with those
from other funding partners to
advance the initial projects around
Puget Sound to preserve natural
floodplain functions, reduce flood
hazards and improve salmon habitat.

The Biggert-Waters Flood Insurance
Reform Act of 2012 (BW12) has
resulted in a phasing out of certain
subsidies that have been in place for
decades. Beginning this year, BW12
will eliminate: flo'od "insurarce
subsidies for frequently flooded
properties, severely damaged
properties, businesses, second
homes and non -primary residences.

understand how BW12 will impact
their communities, FEMA has
created an interactive map that
shows a county -by -county
breakdown of subsidized insurance
policy holders (see sample above).
The map shows the total number of
NFIP policyholders within a state or

BW12.

NORFMA 2013 Conference
NORFMA has awarded 18
scholarships to individuals with
roles in floodplain management to
attend the annual conference,
September 18-20 at Skamania
Lodge. The conference has a full
program of speakers, concurrent
sessions, and workshops. A CFM
refresher course and exam is also
being offered. Current registrations
for the 2013 Conference are on track
for record attendance.
2014 ASFPM Conference Planning
The Association of State Floodplain
Managers national conference will
be held in Seattle during the week
ek of
June 1-6, 2014. As the regional
Chapter of the ASFPM, NORFMA
will be the local host for next year's
conference. The ASFPM annual
conference is recognized as the most
important floodplain conference in
the United States every year. It is�
expected that next year's conference
in Seattle will break the previous
attendance records, and that well
over 1,500 could be in attendance.
Requests for abstracts will be
distributed around the first week in
September and abstracts will be due
for submittal by October 31.
Continued planning and requests for
volunteer help before and during the
ASFPM conference will be a topic
of discussion at the NORFMA 2013
conference in Skamania. NORFMA
will also be requesting contributions
from local consulting firms for
assistance in sponsoring the opening
welcoming session at the 2014
ASFPM Conference in Seattle.

Subject: October 15, 2013, Planning & Zoning Commission Joint Work Session with the
Moose Pass Advisory Planning Commission and Kenai Peninsula Borough staff
A joint work session between the Seward Planning and Zoning Commission, the Moose Pass
Advisory Planning Commission and Kenai Peninsula Borough staff has been scheduled for 6
p.m. Tuesday, October 15 to review proposed changes to KPB Title 20, Subdivisions. A draft of
the proposed amendments has been provided as a laydown. Additional copies will be provided
for the work session. The Borough has noted that the last major revision to the subdivision code
was written in 1978, when the Borough population was less than half of the 56,900 residents we
have today.
The first of two public hearings by the Borough Planning Commission is scheduled for October
28, 2013. Your input, along with the comment of other local commissions, is important. The
Kenai Peninsula Borough Assembly will also hold public hearings prior to considering the
adoption of any code changes.
Recommendation: Staff recommends that the Commissioners who are available attend the
scheduled joint work session at 6 p.m. Tuesday, October 15.
