Sponsored by: Applicant CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2013-18 RESOLUTION 2013-18 OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO WAYNE MOORE TO OPERATE TWO (2) EFFICIENCY APARTMENTS WITHIN A COMMERCIAL STRUCTURE IN THE CENTRAL BUSINESS ZONING DISTRICT, ON LOTS 1 AND 2, BLOCK 18, FEDERAL ADDITION AT 903 FOURTH AVENUE WHEREAS, Wayne (Luke) Moore has applied for a Conditional Use Permit (CUP) to operate two (2) efficiency apartments within a commercial structure on Lots 1 and 2, Block 18, Federal Addition; and WHEREAS, the property is located on the northwest corner of Fourth Avenue and C Street,within the Central Business Zoning District (CBD); and WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), "Dwelling, apartment in a commercial building (two or more units)" is allowed within the Central Business District(CBD)by Conditional Use Permit(CUP); and WHEREAS, having complied with the public notification process; on November 7, 2013, the Seward Planning and Zoning Commission held the required public hearing on the Conditional Use Permit(CUP) application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1: In accordance with SCC § 15.10.320 (D), the Planning and Zoning Commission has reviewed the applicant's request for a CUP to operate two (2) efficiency apartments on Lots 1 and 2,Block 18, Federal Addition, and made the following Findings of Fact: 1. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district Finding: This condition has been met or shall be through the conditions. The property is located within the Central Business Zoning District (CBD). "Dwelling, apartment in a commercial building (two or more units)" is allowed with a CUP by the Land Uses Allowed Table (15.10.225). A building permit was issued in June of 2004 for an addition to the shop/garage. There was no indication within the building permit application the addition was intended to be used as apartments; therefore no Conditional Use Permit was required at the time. The applicant has stated the two efficiency 3 Seward Planning and Zoning Commission Resolution No. 2013-18 Page 2 of 4 apartments were constructed within the addition and have been in use for a number of years. While the Central Business District (CBD) does not require off street parking, Seward City Code (SCC) 15.10.215 parking does requires 1 (one) off street parking per efficiency apartment in other zoning districts. 2. The value of adjoining property will not be significantly impaired. Finding: This condition has been established or shall be through the conditions. The neighboring properties are a mix of residential and commercial uses. The parcels to the South, across C Street are zoned Auto Commercial and contain the Nazarene Church, a hotel and commercial storage units and rental business. The parcel to the West is zoned Auto Commercial and contains an annex of the hotel. The parcels to the North are zoned Central Business and contain the Wells Fargo Bank and a Murphy's Motel. The parcel to the East across Fourth Avenue is the City baseball field and is zoned Park. There is no indication the efficiency apartments have negatively impacted the value of any of adjoining properties. 3. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: This Condition has been met. There is an identified community need for all types of housing in Seward. The operation of the two efficiency apartments is consistent with the Seward Comprehensive and Strategic Plans. Seward 2020 Comprehensive Plan (approved by Council,2005) The Comprehensive Plan recommends continuing every effort to encourage the development of affordable housing for Seward's growing housing needs. Section 3.2.1.2 Expand the opportunity for affordable, diverse, year-round housing through appropriate land use regulations. Section 3.3.1.1 supports a range of housing choices that meet the needs of people in various income and age groups (page 22). Strategic Plan (1999) The Strategic Plan encourages the expansion and availability of affordable, diverse, year-round housing. (page 18) • Seward has a wide range of housing alternatives to meet the varied needs of Seward's long term and seasonal residents. The Strategic Plan also promotes residential and commercial development inside the City (page 9). • Encourage construction of residential and seasonal housing at all market levels. 4 Seward Planning and Zoning Commission Resolution No. 2013-18 Page 3 of 4 4. Public Services and facilities are adequate to serve the proposed use. Finding: This condition has been met or shall be through the conditions. Water, sewer, and power are available and in use on the property. Adequate fire, police and solid waste disposal services are available to the property. City code also requires that every building or building site within the City must provide containers suitable for refuse collection (SCC 14.05). All containers shall be watertight with an animal-proof lid. 5. The proposed use will not be harmful to the public safety, health or welfare. Finding: This condition has been established or shall be through the conditions. There is no evidence the two efficiency apartments have caused any additional concerns to public safety, health or welfare. Adequate fire, police and solid waste disposal services are available to the property. A parking plan shall be provided at a rate of one (1) space per each efficiency apartment, two (2) spaces for the drop off/pickup repair business and two (2) spaces for the single family home. No parking concerns have been submitted 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above fmdings and conclusions, approval of the CUP shall be subject to the following conditions: 1. A parking plan providing six (6) off street sites shall be submitted, approved and provided for the life of the apartments, small engine repair business and the single family home. 2. Animal / Bird resistant dumpsters / containers shall be provided for all garbage and refuse for the life of the uses. 3. The Planning and Zoning Commission may modify this conditional use permit if changed uses no longer conform to the standards and legal requirements justifying its present approval, or if the permittee applies for a modification to meet a different development plan that conforms to the standards and legal requirements for approval of a conditional use permit. 4. Any proposed modification plan shall be subject to the public notice and public hearing requirements of law, which shall occur only after payment of the filing fee established by resolution of the city council. 5 Seward Planning and Zoning Commission Resolution No. 2013-18 Page 4 of 4 Section 2. The Planning and Zoning Commission finds the proposed use, subject to the above conditions satisfies the criteria for granting a conditional use permit provided the conditions listed on Section 1, Subsection 6 are met by the applicant, and authorizes the administration to issue a Conditional Use Permit to Wayne (Luke) Moore to operate two (2) efficiency apartments within a commercial structure at 903 Fourth Avenue; subject to the above conditions. Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320; Conditional Use Permits, and authorizes the administration to issue a conditional use permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. This resolution shall take effect 10 days following its adoption. The applicant applied for a building permit on September 4,2013 to construct additional living space to his single family home located on the same lots as his commercial small engine repair business. During the building permit review process it was discovered the commercial structure contained two (2) efficiency apartments but had not gone through the Conditional Use Permit review process or been granted a permit. These parcels are within the Central Business Zoning District. A building permit was issued in June of 2004 for an addition to the shop/garage. There was no indication within the building permit application the addition was intended to be used as apartments; therefore no Conditional Use Permit was required at the time. The applicant has stated the two efficiency apartments were constructed within the addition and have been in use as apartments for a number of years. The two (2) efficiency apartments are allowed in the Central Business Zoning District as a conditionally permitted use, as per Seward City Code(SCC) Land Uses Allowed Table 15.10.225 "Dwelling, apartment in a commercial building (two or more units)." Staff has required the applicant to go through the CUP process to bring the parcels into compliance with the Seward zoning and land use code. Public notice signs were posted on the property, and all other public hearing requirements of Seward City Code §15. 01.040 have been complied with. At the time of this publication staff has received no inquiries regarding the proposed Conditional Use Permit. If any comments are received after this publication, they will be presented to the Commission at the November 7, 2013 meeting. City staff have reviewed the proposed CUP application and have provided no objections to the use. From: Donna Glenz, Planner dIt U Agenda Item: Resolution 2013-19 recommending City Council and Kenai Peninsula Borough approval of the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Washdown Pad Replat BACKGROUND &JUSTIFICATION: Attached for the Commission's review and recommendation to City Council and the Kenai Peninsula Borough Planning Commission is a preliminary plat submitted by Cline and Associates on behalf of the City of Seward. In accordance with Seward City Code (SCC) 16.01.015(B) "No preliminary plat of City-owned property may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior consent of the City." This replat is located at the south end of the Seward Marine Industrial Center (SMIC). This platting action subdivides Lot 4, Block 7, Seward Marine Industrial Center, Fourth of July Creek Subdivision creating three (3) parcels to be known as Lot 4A, 4B and 4C, totaling approximately 15.4 acres. The new Lot 4B establishes the boundary and provides parcel lot lines for the new vessel wash down pad and existing driveway easements. SUBDIVISION REVIEW: Zoning: The replat is within the Industrial Zoning District. Development surrounding this replat includes the Seward Ship's Drydock and the Polar Seafood lease parcels. To the North across Tract 3 (known as Morris Avenue) is the City boat storage yard. Utilities: The replat area is currently serviced by private roads, municipal water, sewer, electric and other utilities; no a subdivision installation agreement shall be required. Existing Uses: Lot 4A is a large undeveloped lot containing approximately 11 acres. Lot 4B is approximately 1.5 acres and contains the new Vessel Washdown Pad, Driveway and Utility Easements. The area adjoining to the west and southwest is the Air Force Recreation Camp, with a parking lot and outbuildings. The parcels to the east and northeast across the highway and Leirer Road are leased by numerous industrial users. Parcels to the South of Sea Lion Avenue contain largely undeveloped land. There is no indication the commercial seafood processing business will negatively impact the value of any of the nearby properties or businesses. 3. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: This Condition has been met. The Seward Comprehensive Plan and the Strategic Plan support the attraction of new business and industry to the greater Seward area. The expansion of the commercial seafood processing business is consistent with these plans. Opening Ceremony Commissioner Fleming led the Pledge of Allegiance to the flag. Roll Call There were present: Sandie Roach' presiding,and Cindy Ecklund Martha Fleming Dale Butts Wendy Shaffer comprising a quorum of the Commission;and Donna Glenz, City Planner Dwayne Atwood,Planning Technician Excused was: Bixler McClure City Administration Report City Planner Donna Glenz updated the Commission on the following business items: • New Commissioner `Wendy :Shaffer was in attendance and was introduced to the Commission and the audience by Glenz. • Glenz noted the beneficial service of former Commissioner Alexis Campestre, who had recently resigned. • Glenz informed the Commission of the recent municipal elections results, noting that Jean Bardarson had been elected mayor. • Planning Technician Dwayne Atwood had compiled the annual Community Rating System annual report for the City of Seward and had submitted it to FEMA for acceptance. • Glenz noted a series of floodplain development permits had been issued by the Community Development Department, including a permit for emergency repairs to the airport's northeast runway. • Glenz noted a series of boat harbor projects,including the reconstruction of D Float and the required platting for a vessel washdown pad at the Seward Marine Industrial Center. � 2 City of Seward,Alaska Planning Commission Minutes October 3, 2013 Volume 7, Page 51 • Glenz noted that 65 percent conceptual plans for the proposed remodel of the Jesse Lee Home structure had been submitted to the City Building Department. • The cause of a fire that destroyed Ray's Reusables, located at 310 A Street, was under investigation. • A Marine Firefighting for Land Based Fire Fighters Symposium was scheduled to be held in Seward on October 8 through October 10. • Commissioners had been provided a draft of the Kenai Peninsula Borough Title 20, Subdivisions, updates that were to be discussed during an October 15 work session with Borough staff and the Moose Pass advisory planning board. • The Blood Bank of Alaska was scheduled to hold a blood drive at Seward Mountain Haven on October 11. Commissioner Ecklund asked staff for additional information about the location of the Alaska Road Builders asphalt plant location in the Seward area. Glenz noted the location of the plant, near the Seward Highway and Nash Road, outside of City Limits. Roach' asked staff about potential upcoming training opportunities for Commissioners. Glenz said a Commissioner training was planned for November, but the details were being discussed. Glenz referred to maps on the wall to point out the location of the applicant's lodge and the proposed parking area. The lodge guests had rarely used the dedicated off-site parking and had relied on the nearby City-operated parking lot, Glenz said. Many of the guests also arrived by bus, Glenz said. The applicant intended to develop the parcel that had been used for dedicated off-site lodge parking. Parking was to be provided at a nearby lot,Glenz said. Butts asked for a procedural clarification regarding the Conditional Use Permit. Glenz said the primary condition in new the permit would reduce number of required parking spaces to 1 space for every two guest rooms... Ecklund asked staff to explain the parking alternatives,such as leasing parking spaces from the City. Glenz said the applicant could arrange for parking with the City of Seward, but that option would not be added to the Conditional Use Permit as a condition. The parking would be provided by a nearby private property owner,via a recorded parking agreement. Roach' asked for clarification regarding the required parking and any additional spaces that might be put into use. Glenz noted that lodging operators within the Harbor Commercial Zone were not required to provide parking spaces. The off-site parking for Saltwater Safari was required when the Conditional Use Permit for the lodge business came before the Commission. Commissioners further discuses parking requirements for the various lodging and hotel businesses in Seward. �. Notice of public hearing being posted and published as required by law was noted and the public hearing vias opened. There were no requests to be heard and the public hearing was closed. Motion (Fleming/Butts) Approve Resolution 2013-15 Roach' noted that public parking is limited in many areas of town and hotels should be required to provide adequate parking. Ecklund asked if the other hotels and lodges in the harbor area were required to provide parking under a Conditional Use Permit. Lot 1 lying east of the Seward Highway and the Alaska Railroad right of way,within the Resource Management Zoning District,Located at 2608 Seward Highway Glenz explained the purpose of the resolution, which was a standard extension of an existing Conditional Use Permit. City Code allowed for the extension of Conditional Use Permits, provided there had been no substantial changes to project plans,Glenz said. Roach' asked staff is there was a fee associated with the extension request. Glenz said there was no fee, beyond the original fee required for the Conditional Use Permit application. A public hearing was not 'required for 'a Conditional Use Permit extension, Glenz said. Butts asked what,cpntact ,had been made bylhe applicant and how many extensions could be granted. • • Glenz explained that an email message was adequate for requesting an extension and that the Community Development had received an extension request. Glenz said extension requests were not limited, but the Commissioi might consider amending the City Code in the future to extend the ogginal permit peod or limit the number of extensions that could be granted. Motion (Ecklund/Fleming) Approve Resolution 2013-16 �4 r Butts said he wanted to see the applicant comply with all City Code requirements before gaining a Conditional'Use Permit extension. Butts said that railroad box cars had been placed along the applicant's property frontage,which was not allowed by City Code. Glenz said the Community Development Department was preparing to give notice of the railroad box car violation to property owner Leif Olson. Commissioners discussed the possibility of denying the Conditional Use Permit extension request. Butts read into record Condition No. 2 from Conditional Use Permit 2012-01: "Continue to work with City staff to coordinate site visits to address and remove any outstanding code compliance issues prior to issuing a certificate of occupancy." Commissioners further discussed issues related to property clean up and the possibility of tabling the resolution until speaking with the applicant. Commissioners agreed to grant the Conditional Use Permit extension and requested that staff and the Building Department address any property concerns and City Code issues.
