A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL
AMEND PORTIONS OF SEWARD CITY CODE §15.10.140.B
DEFINITIONS, AND §15.10.225 LAND USES ALLOWED TABLE, TO
ALLOW STORAGE, WAREHOUSE AND OR DISTRIBUTION IN THE
RESOURCE MANAGEMENT ZONING DISTRICT BY CONDITIONAL
USE PERMIT
WHEREAS, members of the public have requested a code change to allow the
construction and operation of warehouses in the Resource Management Zoning District; and
WHEREAS, November 18, 2014 the Planning and Zoning Commission held a public
work sessions to discuss land use and development issues related to storage, warehouse and or
distribution; and
WHEREAS,the Public Hearing notification process has been complied with.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends Ordinance 2015- attached and
incorporated herein by reference, be forwarded to City Council for approval,
amending portions of Seward City Code §15.10.140.B Specific Definitions, and
§15.10.225 Land Uses Allowed Table; to allow storage, warehouse and or
distribution within the Resource Management Zoning District by conditional use
permit
Section 2. This resolution shall take effect immediately upon its adoption.

BACKGROUND &JUSTIFICATION:
The Commission held a public work sessions on November 18, 2014 to review and discuss issues
related to the construction and use of warehouses and or distribution within the Resource
Management Zoning District.
The Commission determined the current City code to be restrictive in not allowing the use.
Members of the public have expressed interest in developing warehouses within the Resource
Management Zoning District.
The Commission has recommended changes and updates to §15.10.140.B Definitions, and
§15.10.225 Land Uses Allowed Table. Specific additions, deletions or changes are as follows:

The attached ordinance was submitted to the City Attorney for a cursory review.
Seward City Code§15.01.035(c)(2)&(3) provides that the Planning and Zoning Commission shall
hold a public hearing and forward written recommendations to the City Council before the City
Council amends or repeals any land use regulations, or changes zoning or land use boundaries.
As per City Code§15.01.040 Public Hearings;the public notice requirements were met. At the time
of publishing this agenda, no public inquiry had been received.
RECOMMENDATION:
Staff recommends the Commission approve Resolution 2015-01, recommending the City Council
enact the attached Ordinance amending Seward City Code§15.10.140.B Definitions,and§15.10.225
Land Uses Allowed Table, to allow Storage, Warehouse and or Distribution in the Resource
Management Zoning District,by Conditional Use Permit.

Subject: Planning& Zoning Commission January 20 Work Session Topic
The Planning and Zoning Commission is scheduled to hold a regular work session at 6 p.m. on
Tuesday, January 20. No topic has been set. It is recommended that the meeting include a
discussion of the Commission's annual priorities for 2015. The Commission will be meeting
with City Council in March to set the annual priorities. The 2014 priorities are included for your
review.
Recommendation: Staff recommends the Commission poll members for the availability of a
quorum for the January 20 work session and set the work session topic.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA ADOPTING THE PLANNING AND ZONING COMMISSION
PRIORITIES FROM APRIL 2014 TO APRIL 2015
WHEREAS, at the January 21, 2014 Planning and Zoning work session the Commission
reviewed and updated their Priorities List; and
WHEREAS,the Seward City Council Rules of Procedure, adopted March 14, 1994, state
that the Council should meet in an annual joint work session with the Commission to address
areas of mutual concern; and
WHEREAS, the Commission and City Council held a joint work session, reviewed and
updated the Planning and Zoning Priorities List on March 3, 2014; and
WHEREAS, at the April 1, 2014 meeting the Planning and Zoning Commission
approved P & Z Resolution 2014-05 recommending Council adoption of the 2014 Planning and
Zoning Priority List.

BACKGROUND&JUSTIFICATION:
Annually,the Planning and Zoning Commission establishes their priorities. The Commission began
this year's process by reviewing their Priority List at their January 21, 2014 work session in
preparation of their joint work session with Council scheduled for March 3,2014. During the joint
work session,the Commission and Council reviewed and updated the Planning and Zoning Priorities
List.
At their April 1,2014 meeting the Planning and Zoning Commission approved Resolution 2014-05
recommending Council adoption of the Commission's April 2014 to April 2015 Priority List.

Subject: Planning and Zoning Commissioner Training
Staff is currently working to establish the Commissioner training schedule for 2015. Currently
we have a DVD presentation that we did not utilize during 2014. The topic of the presentation/
training is storm water management and floodplain development. The training (approximately 30
minutes) can be scheduled at the direction of the P&Z Commission.
Recommendation: Consider scheduling a time for a 30 minute presentation on floodplain
management concepts as part of the 2015 training schedule.

Item: Training for Commissioners
The following information is provided to help with discussions about P&Z training.
2013 Training Schedule:
• The City offered an ethics training from 6 p.m. to 8 p.m. Tuesday, May 14 in City
Council Chambers. Jeff Lucas of the Alaska Municipal League Joint Insurance
Association led the training. The training session provided insight into ethical
behavior, inherent conflicts and exercising individual judgment and reasoning in
addressing ethical dilemmas. Interested Commissioners were invited to attend.
• The City offered a Planning and Zoning Commissioner training from 6 p.m. to 8
p.m. on Tuesday, November 19 in City Council Chambers. Assistant City
Manager Ron Long led the training, which provided insight into findings of fact
and other topics covered in the Alaska Planning Commission Handbook.
2014 Training Schedule:
• The City offered a travel stipend and paid the registration fees for Commissioners
who attended the 2014 Alaska Planning Conference training for Planning
Commissioners. Sessions were held throughout the day on Sunday, November 16
at the Hotel Captain Cook in Anchorage.
2015 Training Schedule:
• Community Development Department staff is currently offering a video
presentation/training on storm water management and floodplain development.
The training(approximately 30 minutes) can be scheduled at the direction of the
P&Z Commission.

was called to order at 7:00 p.m. by Chair Cindy Ecklund.

City Planner Donna Glenz updated lated the Caitmission on the following business items:

decision to serve.

• The Planning 1„Zoning Commission quarterly reports to City Council were changed to
semi-annual reprts, due in March and September.
• Community Development Director Ron Long and City Council member Christy Terry had
recently been appointed to a Seward Airport working group to provide input for proposed
maintenance and construction work.
• City Council had approved the federal, state and municipal legislative funding priorities.
The City Clerk's office had additional information about the priorities, Glenz said.
• City Council was scheduled to hold one meeting during the month, on November 10.
• The City of Seward Fire Department had issued a public service announcement to review
appliance recall listings and change batteries in smoke detectors.

• The Bear Creek Flood Service Area Board had changed meeting times to 6 p.m. Regular
meetings were scheduled for the first Monday of each month, and work sessions on the
third Monday of each month.
• City offices were scheduled to be closed November 11, 2014 for Veteran's Day.
Ecklund noted that the March semi-annual report to City Council will be provided during a work
session, not regular, televised meeting.

Citizens' Comments on any subject except those items scheduled for Public Hearing—
Seward resident Lisette Richmond commented on the lack 9f available housing and said she was
interested in receiving information about development standards for a possible project. Richmond
also asked about the possible usage of shipping contaers for structural development.
Richmond was provided a contact phone number for ConsteMnity Development Department
and was encouraged to speak with the City Planner for de ' 'information.

Glenz said the previoris Municipal Lands Inventory and Management Plan had been adopted in
1995 noting that many changes had occurred over the years. She noted the Plan was a living
document and continued to change as City owned parcels were developed, acquired and/or
disposed of. The 2014 update reflects the changes. Glenz stated the Commission had held
numerous public work sessions over the past 18 months updating the plan. The Plan was noticed
as a Public Hearing and that no public concerns or comments had been received. She stated staff
recommended approval of Resolution 2014-11 recommending Council approval of the 2014
update to the Municipal Lands Inventory and Management Plan.

Notice of public hearing being posted and published as required by law was noted and the
public hearing was opened. There were no requests to be heard and the public hearing was
closed.

Resolution 2014-12 of the Seward Planning,Mid Zoning Commission of the
City of Seward, Alaska, granting a six (6), onth extension to height Variance
2014-01, allowing Shoreside Petroleum,,' c to constmict four (4) 40-foot-tall
petroleum storage structures on Lot 2, Bloc ,Leidustrial Subdivision,
located between Alameda Street and Leirer Ro hin the Industrial Zoning
District
Glenz noted the history of the height vari allowed fot foot-tall bulk fuel storage
tanks. Zoning variances and conditional use rmitt after six iWonths, she said A six month
extension was allowed, provided the permits pr, c 4Ity had not changed. Shoreside
Petroleum planned to begin construction during t2015 conction season.
Commissioner Anderson requested a ruling regarding any potential conflict of interest because of
her family relationship with the owners of Shoresetroleum. Chair Ecklund, in questioning
Anderson, noted there was no financial gain or bens it at stake. The Commission concluded there
was no legal reason`for Anderson to abstain from voting.

Resolution 2014-13 of the Seward Planning and Zoning Commission of the
City of Seward, Alaska, granting a six (6) month extension to Conditional Use
Permit 2014-01:issued to Shoreside Petroleum, Inc. to construct and operate a
bulk fuel storage facility on Lot 2, Block 2, Leirer Industrial Subdivision,
located between Alameda Street and Leirer Road, within the Industrial Zoning
District
Glenz reiterated the information provided for the extension of the height variance for the bulk fuel
storage project. Some site preparation had been undertaken, but a building permit had not been
received. A second extension could be required in May, 2015.

Ecklund asked Glenz to explain the conditional use permit requirement for the benefit of the newer
members of the Commission. Glenz reviewed the permit process and requirements and noted that
the various conditions of operation and development were listed in the original resolution, which
was included in the meeting packet.
Commissioner Anderson requested a ruling regarding any potential conflict of interest because of
her family relationship with the owners of Shoreside Petroleum.
Ecklund noted for the record that Anderson was an extended family member, but would not
directly benefit from the measure and would be allowed to vote.

Anderson said she would like to see the Planning and Zoning Commission take proactive actions,
such as seeking new locations for the local animal shelter and City Public Works Department shop.
Anderson said she would also like the Commission to look more closely at the South Harbor
Uplands and the development potential.
Coulter thanked staff and the Commission for preparing the Municipal Lands Management Plan
draft.
Fleming also thanked staff fc `the work on the Municipal Lands Management Plan and reiterated
the importance of the plic participate in work sessions.
Ecklund said she was pleased with the Municipal Lands Management Plan draft and also thanked
Anderson for her decision serve on the Commission.

Subject: Information related to questions of Conflict of Interest.
Issues related to Conflict of Interest were discussed at the November 18, 2014 Planning
and Zoning work session, and some questions remained. Attached is the citation (from
Page 18 of the Planning and Zoning Commission Rules of Procedure) that addresses the
basic question and the process for making a ruling.
Recommendation: The Commission review Rule 31 of the Planning and Zoning
Commission Rules of Procedure.

RULE 31. CONFLICT OF INTERESTS. (a) A commissioner may not participate in an
official action in which that commissioner or his or her immediate family has a substantial
financial interest. Participation includes not only voting but also engagement in any
conversations, investigations, deliberations or discussions of any nature directly or indirectly
with any other commissioner. To preserve the appearance of impartiality for the Commission,
the conflicted commissioners should in most instances leave the hearing room during
proceedings pertaining to the matter creating the conflict of interests.
[AS 29.20.010(a)(4) and SCC §2.10.035(D)]
(b) The immediate family of a commissioner includes his or her spouse or domestic partner and
all dependent children. Child includes biological child, stepchild and adopted child.
(c) The term "financial interest" includes any property, ownership, management, professional or
private interest from which a commission member or his or her immediate family receives or
expects to receive a financial benefit.
(d) A financial interest is presumed to be substantial whenever the commissioner and his or her
immediate family cumulatively control a financial interest
• worth $5,000 or more in an investment that might proximately be affected, favorably or
adversely,by the matter being considered by the Commission, or
• worth less than $5,000 in an investment that might increase in value above $5,000 as a
proximate result of a favorable or unfavorable decision on the matter being considered by
the Commission, provided however that
• the application of the Rule of Necessity may supercede the measures in subsections (i)
and(ii) above, as provided in Rule 12(b).
(e) Whenever a commissioner suspects that s/he may have a substantial financial interest that
might be affected by a matter of official business before the Commission, s/he shall disclose to
the full Commission all of the circumstances of that potential conflict. Applying the standards of
subsections (a) through (d) above, the Chair shall decide whether the circumstances constitute a
substantial financial conflict of interests. The determination of the Chair is binding on the
disclosing commissioner, unless other commissioners move to sustain the ruling of the Chair,
and a majority of those other commissioners votes against that motion, thereby overruling the
Chair.
