Adjournment Planning and Zoning Commission Meeting Agenda February 3, 2015 2 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2015-02 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO THE PUBLIC WORKS DEPARTMENT OF THE CITY OF SEWARD TO CONSTRUCT AND OPERATE A 600,000 GALLON WATER STORAGE TANK ON CITY OWNED LOT C-6, GATEWAY SUBDIVISION, ADDITION 2, LOCATED AT 2301 HEMLOCK STREET, WITHIN THE SINGLE FAMILY ZONING DISTRICT WHEREAS, the City of Seward Public Works Department has requested a Conditional Use Permit (CUP) to construct and operate a 600,000 gallon water storage tank and pumping facility on Lot C-6, Gateway Subdivision, Addition 2; within the Single Family Zoning District (R1); and WHEREAS, in accordance with the Land Uses Allowed Table §15.10.225, Utility Facility: water, is allowed within the Single Family Zoning District (R1) by CUP; and WHEREAS, the City Water Department has diligently worked to secure funding and a site location since the Design Study Report of the Seward water system was completed in 2000 by CRW Engineering Group, LLC; that report identified a 520,000 gallon water storage tank as a necessary improvement to the City's infrastructure; and WHEREAS, the site location of Lot C-6, Gateway Subdivision, Addition 2 was selected because it met the required needs of elevation, access, lower overall operational cost and northern location; and WHEREAS, the site for the North Seward Water Tank, Lot C-6 located at the south terminus of the Hemlock Street right of way, is approximately 1.4 acres; and WHEREAS, the surrounding parcels to the west, south and east are wooded, undeveloped and within the Single Family Zoning District; two (2) of the four (4) parcels to the north are currently developed with single family homes, the other two (2) parcels are undeveloped; and WHEREAS, having complied with the public notification process; on February 3, 2015, the Seward Planning and Zoning Commission held the required public hearing on the Conditional Use Permit application. 3 Seward Planning and Zoning Commission Resolution 2015-02 Page 2 NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. In accordance with SCC§15.10.320(D), the Planning and Zoning Commission has reviewed the applicant's request for a CUP to construct and operate 600,000 gallon water storage tank and pumping facility on City owned Lot C-6, Gateway Subdivision, Addition 2 and declared the following Findings of Fact: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition has been met. The purpose of the Zoning Code is to promote public health, safety and general welfare by providing for planning and land use regulations within the City. This parcel is within the Single Family Zoning District. According to the Zoning Code, Land Uses Allowed Table, Utility Facilities, Water is allowed with a Conditional Use Permit in the Single Family Zoning District. The proposed project requires a building permit, as well as other State and Federal permits. The project site plan meets all setback and structure height requirements. The water storage tank will provide additional storage capacity at the north end of Seward and provide chlorine contact time for disinfection of the City's water supply. The proposed use as a water storage facility is consistent with the purpose of the Zoning Code and the Single Family Zoning District. B. The value of adjoining property will not be significantly impaired Finding: This condition has been met. The proposed water storage facility is to be located on an approximate 1.4 acre parcel that is owned by the City of Seward. The adjoining properties to the west, south and east are zoned Single Family Residential and are undeveloped. The adjoining parcels to the north are zoned Rural Residential, two (2) parcels are undeveloped and two (2) have single family homes on them. Water, sewer and electric utilities will be brought closer to currently undeveloped areas. Fire protection hydrants will be added and potable water will become available to some areas in the vicinity of the tank that currently do not have access to the water system. The applicant plans to remove only the vegetation necessary to accommodate the water tank and pumping facility, to build an access road and to install eight(8) foot security fencing. There is no indication the proposed structure or use will significantly impair the value of adjoining properties. C. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: This condition has been met. The 2020 Comprehensive Plan, section 3.7.3.1 encourages the continued upgrade and expansion of City utilities to meet the existing needs and encourage future development. The Plan also supports the recommendations of the 2000 Water and Sewer Analysis, 4 Seward Planning and Zoning Commission Resolution 2015-02 Page 3 which the proposed development follows. Utilization of this site may encourage the development of multiple undeveloped residential properties. Water, sewer and electric utilities will be closer to the adjacent undeveloped areas. Fire protection measures will be added and potable water will become available. D. Public Services and facilities are adequate to serve the proposed use. Findings: This condition has been or will be met through the development of the project. The general area of the project is undeveloped. Access to the parcel will be from the public right-of-way (ROW) of Hemlock Street. This platted 34 foot ROW has not been developed but will provide access and utility corridors for this project. All public utilities of water, sewer, and electric will be made available to this parcel. The Electric Department has requested the applicant start a job order to provide a review of planned power needs and work with the department to meet all National Electric Safety Code (NESC) regulations. No additional requests or comments were received from other City department heads. E. The proposed use will not be harmful to the public safety, health or welfare. Findings: This condition has been met. To obtain a building permit issued by the City, the applicant is required to submit engineered construction plans for review that meet the International Building Code as adopted by the City Council. As required by City Code the structure shall meet all setbacks and zoning requirements. Community fire protection will be increased by maintaining additional water storage and adding additional hydrants. The new facility will also provide chlorine contact time for the disinfection of the City's water supply. The applicant has noted that the current plan includes security fencing around the perimeter of the site to discourage animals and/or people from entering. F. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. The applicant shall obtain a current Building Permit before construction begins on the site. 2. The applicant shall obtain all necessary Federal, State and local permits required for construction and operation. 3. The applicant shall start a Job Order and work with the City Electric Department to provide the required electric power needs. 5 Seward Planning and Zoning Commission Resolution 2015-02 Page 4 4. The applicant shall work with the City Electric Department to meet all the National Electric Safety Code requirements. 5. The applicant shall provide safety and security fencing for the project. 6. The applicant shall work to install security lighting to reflect away from adjacent residential areas. 7. The undeveloped Hemlock Street Right of Way shall be restricted to public access until such time in the future it is fully developed and maintained. 8. The Planning and Zoning Commission may modify this CUP if changed uses no longer conform to the standards and legal requirements justifying its present approval, or if the permittee applies for a modification to meet a different or additional development plan that conforms to the standards and legal requirements for approval of a CUP. 9. Any proposed modification plan shall be subject to the public notice and public hearing requirements of law, which shall occur only after payment of the filing fee established by resolution of the city council. 10. Per Seward City Code §15.10.325.F. an approved CUP shall lapse six months from the date of approval if the use for which the permit was issued has not been implemented or a building permit obtained. The Commission may grant a six month extension upon fmding that circumstances have not changed sufficiently since the date of initial permit approval. Section 2. The Planning and Zoning Commission fords the proposed use, subject to the above conditions satisfies the criteria for granting a Conditional Use Permit provided the conditions listed on Section 1, Subsection F. are met by the applicant, and authorizes the administration to issue a Conditional Use Permit for construction and operation of a 600,000 gallon water storage tank and pumping facility on Lot C-6, Gateway Subdivision, Addition 2 within the Single Family Zoning District, as generally depicted on site plan dated on 1/23/2015 and included with this Resolution. Section 3. The Planning and Zoning Commission fords that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320; Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. This resolution shall take effect 10 days following its adoption. In accordance with the Land Uses Allowed Table §15.10.225, Utilities Facility, Public Water is allowed within the Single Zoning District(R1)by CUP. In 2000, the Design Study Report completed by CRW Engineering Group, LLC identified a 520,000 gallon water storage tank as a necessary improvement to City infrastructure. The proposed site for the new water storage tank was the Forest Acres area, at an elevation that matched the Lowell Canyon tanks. For the past 15 years CRW and the City have worked to pursue funding for this project. The North Seward Water Storage Tank & Pumping Facility (North Tank) is to be sited south of Hemlock Street and east of Afognak Avenue, in the northeast corner of the Gateway Subdivision. This tank will provide critically-needed storage to the north part of the City of Seward's water distribution system, consolidate the chlorination system in one location and provide chlorine contact prior to distribution of water. The North Tank will fill the Lowell Canyon Tanks and will replace the Swetmann Booster Station as the source of water to the Gateway Subdivision Tank and nearby residences. The North Tank is designed to be 68 feet wide and 24 feet high. Security fencing of eight(8)feet in height is proposed for the site. SURROUNDING LAND USE AND ZONING: Lot C-6 is located at the northeast corner of the Gateway Subdivision, within the Single Family Zoning District. The surrounding parcels to the west, south and east are wooded, undeveloped and within the Single Family Zoning District; two (2) of the four (4) parcels to the north are currently developed with single family homes; the other two(2)parcels are undeveloped. 8 Planning and Zoning Agenda Statement Resolution 2015-02 Page 2 of 3 Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is located outside of any special flood hazard area areas. Utilities: Water, sewer, and electric will be made available to the parcel during the development of this site. At the time of this publication the Public Works Director, Fire Chief, Building Inspector, Police Chief and Administration have expressed no concerns for the project. The Electric Department has requested the applicant submit a job order request to provide a review of the applicant's power needs and work with the department to meet all the National Electric Safety Code requirements. Parking: The proposed water storage facility is not expected to generate any substantial parking demand. Adequate parking is available on site. The current address of Lot C-6, Gateway Subdivision, Addition 2 is 2301 Hemlock Street. The 34 foot, North/South Right of Way named Hemlock Street was dedicated many, many years ago but has remained undeveloped. Because the City already has a dedicated and developed Right of Way named Hemlock Avenue, the Emergency 911 system will not allow duplication on street names. The Planning and Zoning Commission will hold a public work session and work on recommendations for renaming Hemlock Street in the next few months. Property owners within three hundred(300) feet of Lot C-6, Gateway Subdivision were notified of this proposed Conditional Use Permit. Public notice signs were posted on the property, and all other public hearing requirements of Seward City Code §15.01.040 Public Hearings were complied with. The Public Works Department also notified neighboring property owners and those who have commented on the project, of a Wednesday, January 28, 2015 open house to present the project and answer questions. The open house was well attended, questions were asked and answered, and general support for the project was voiced. At the time of the publication of this report, staff has received one phone call regarding the open house and project questions. The questions were answered and the call was also referred to the Public Works Department for further clarification. Two email inquiries were received, which are included in the packet, the questions and comments were discussed and answered during the open house. Any further comments received after this publication will be presented as a lay down to the Commission and the public at the February 3, 2015 meeting. Please describe the use. Though the lot is zoned for single family residential, use of the site for a water storage tank and pumping facility is allowable via CUP. We intend to construct a 600,000 gallon water storage tank and pumping facility, including pressure distribution pumps, an energy efficient pump house that includes a hand/eye washing station and/or restroom facility, yard piping to interconnect to the existing water system and a water main that connects to both the Gateway and Lowell Canyon water storage tanks. This system will eliminate the Swettman booster station currently feeding the Gateway tank, which will save money. The elevation of this particular site is also favorable as it is slightly higher than the Lowell Canyon tank. This will save energy due to the use of gravity instead of electric pumps to fill the Lowell Canyon tank. Utilization of this site will also encourage the development of multiple residential properties that are undeveloped. This site will provide an extension of utilities to one of the last remaining undeveloped residential areas within the Seward City limits. This site is also favorable for a future production water and is the most cost efficient, saving the City money in electric costs over its entire lifespan. B) Describe any impacts to the adjoining properties and how property values may be affected. There will be routine visits for operation and maintenance of the pumping facility. In the event of a power outage, there may be a muffled sound of a standby generator. Vegetation will be removed as necessary to accommodate the water tank and pumping facility, to build the access road and to install a security fence. Utilizing this site will bring water, sewer and electrical utilities closer to this undeveloped area. With the new distribution lines, fire protection measures (hydrants) will be added and potable water will become available to some areas in the vicinity of the tank that currently do not have access to the water system. The potential for affecting property values is related to the utilities being extended closer to the undeveloped residential lots in the area. C) How is the proposed use consistent with the Seward Comprehensive Plan? Explain. This project is consistent with section 3.7 Public Facilities and Service; section 3.7.3.1 to continue to upgrade and expand utilities to meet existing needs and encourage future development. Now that we can see where it starts, I would like to be sure that there is a locked gate at the entrance just past the first ditch to restrict unauthorized traffic and use. I was told that the AKRR has a counter weighted gate around Mile 12 that seems very well designed and prevents sagging. Worth looking into. I also have concerns about what chemicals will be stored on-site,the quantity, how they will be kept safe and secure, and what containment provisions will be available on-site in case of a spill or release. I assume there will be a fence with barbed wire along the top around the facility. Please consider the neighbors when installing lights and provide shields on the lights. Borough maps not matching public notice maps, questions about variances and other ROW issues through a promised publicly noticed Subdivision Agreement, etc.) we did not go down the process road because we realized the city had few options for the much needed water tank and prefer to be cooperative rather than confrontational. Below is a list of"good suggestions" and"good questions"regarding this project: Questions: 1. What is the plan for dust mitigation during construction? Members of our family have health issues that require the need for dust mitigation. 2. Timeline of project? When can we expect construction to be over? 3. For curiosity,where did the trees that were cut down go? Suggestions: 1. Hemlock Street(N-S)name should be changed to avoid confusion with Hemlock Ave(E-W)(another tree name?) 120 2. The access along the section line easement will be restricted to that 33'portion which is already dedicated 3. There will be minimal disturbance to the living trees and shrubs along the new access road 4. During construction of the road and installation of the pipes and tank,the hours of operation will be restricted to after 7 am and before 7 pm Monday through Saturday,and closed on Sunday. 5. All woody debris will be removed from the site and not burned or left as slash piles. 6. Install a lockable gate on the north end of the access road which will be kept locked 7.Lighting sufficient to ensure security of the facility without overly impacting the homes adjacent to it.(Hooded light fixtures that keep most of the light in a cone under the fixture) 8.Move the light pole from the West corner where it is ineffective to the East corner so it will illuminate the new Hemlock(or other name)street section. Again hooded light fixture to aim light down the street. 9.Paint color and fencing that are tasteful and not detrimental to the adjacent properties.(No prison puce and concertina wire) 10.A lower profile tank would be less intrusive than a tall tank It certainly is disappointing to purchase property in an area because it is zoned residential expecting to live in a neighborhood and then have it turn in to an industrial site.
