CITY OF SEWARD, ALASKA
ORDINANCE NO. 95-18
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING THE SEWARD CITY CODE
TO ABOLISH THE COMMUNITY HOSPITAL BOARD, DECLARING AN
EMERGENCY, AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE
WHEREAS, pursuant to Chapter 16 of the Seward City Charter, the City of Seward (the
"City") has established the Community Hospital Board (the "Board") and delegated to the Board
powers to administer Seward General Hospital (the "Hospital"); and
WHEREAS, among the powers delegated to the Board are the powers to adopt and revise
a budget for the Hospital and to employ and supervise administrative staff for the Hospital; and
WHEREAS, due to a deficiency in revenues from operations, the Hospital faces an
imminent depletion of its cash reserves, requiring immediate action to effect a significant reduction
in the Hospital's expenses from the amounts budgeted for the current fiscal year; and
WHEREAS, the administrator of the Hospital has resigned, requiring the recruitment and
selection of a new person to administer the Hospital, including effecting the expense reductions
required to avoid depletion of the Hospital's cash reserves; and
WHEREAS, the City Code provides that the Board shall consist of seven members, and
through resignations and term expirations the number of Board members has declined to three, which
does not constitute a quorum to conduct the business of the Board; and
WHEREAS, Section 3.6(a) of the Seward City Charter authorizes the Council in its
discretion by ordinance to abolish City boards; and
WHEREAS, under the circumstances described above, the Council finds that it is in the
public interest to abolish the Board, with its duties devolving upon the Council and City
administration, who may act immediately to relieve the fiscal crisis at the Hospital;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. The Council finds and declares that the circumstances described in the recitals
above constitute an emergency warranting the enactment of an emergency ordinance at the same
meeting at which the ordinance is introduced, pursuant to Section 4.1 (b) of the Seward City Charter.

In accordance with Seward City Code Section 2.15.040.A., the recitals above constitute the
statement of facts upon which the Council finds and declares that this ordinance is necessary as an
emergency measure for preserving the public health, welfare and safety.
Section 2. Pursuant to Seward City Charter Section 3.6(a), the Community Hospital Board
is hereby abolished, and Seward City Code Sections 2.30.110 through 2.30.145 are hereby repealed.
Section 3. All powers and duties formerly performed by the Community Hospital Board
shall be performed by the Councilor City administration in accordance with the general assignment
of powers and duties to the Council and City administration under the Seward City Charter and
Code.
Section 4. This ordinance shall take effect immediately upon its enactment and shall remain
in effect for 60 days from the date of its enactment.

27th day of November, 1995.
