HomeMy WebLinkAboutRes2016-013 Sponsored by: Applicant CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2016-13 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD ALASKA, RECOMMENDING KENAI PENINSULA BOROUGH APPROVAL OF THE TRACT A LEIRER INDUSTRIAL SUBDIVISION, WALIEZER REPLAT, CREATING TWO PARCELS TO BE KNOWN AS TRACT A-1 AND TRACT A-2, WITHIN THE INDUSTRIAL ZONING DISTRICT WHEREAS, McLane Consulting Inc. has submitted a preliminary replat to the City of Seward for review and recommendation to the Kenai Peninsula Borough; and WHEREAS, the proposed replat of Tract A, Leirer Industrial Subdivision, creates two parcels to be known as Tract A-1 containing 11,281 square feet and Tract A-2 containing 12,958 square feet; and WHEREAS,the properties of this replat are located within the Industrial Zoning District (I) and exceed the minimum lot size and lot width as required by City Code, with frontages on Port Avenue and Leirer Road; and WHEREAS, the two parcels are currently serviced by municipal water, sewer, electric and other utilities; therefore a subdivision installation agreement is not required; and WHEREAS, the current parcel contains four (4) existing structures, all built in the 1980's, portions of these structures do not meet current front, side, side to a street or rear set- backs; and WHEREAS, with the existing structures, the proposed replat creates a 1.2 inch encroachment into the side set-back for each new parcel; and WHEREAS, it is the Planning and Zoning Commission's responsibility to act in an advisory capacity to the Kenai Peninsula Borough regarding subdivision plat proposals; and WHEREAS, as required by Seward City Code §16.01.015, Conditions to plat approval, property owners and lease holders within 300 feet of the proposed replat were notified and the parcels were posted with public notice signage. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Seward Planning and Zoning Commission Resolution No. 2016-13 Page 2 of 2 Section 1. The Commission recommends that, in accordance with Seward City Code Section 16.01.015, the Seward Planning and Zoning Commission approves the submittal of the Leirer Industrial Subdivision, Waliezer Replat to the Kenai Peninsula Borough and recommends approval subject to the following conditions: 1. Correct City of Kenai to the City of Seward... in Certificate of Acceptance block. 2. Dedicate a 20 foot utility easement centered on the proposed east/west property line (between the proposed Tract Al and Tract A2), from the existing west property line to a point one (1) foot from the west wall of the existing structures, then reduced to an 18 foot utility easement centered on the proposed property line between the two (2) structures to the existing east property line. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 4th day of October 2016.
