Vessel Traffic -
In September 15 vessels docked at our docks. These vessels included our final cruise ships of
the season, Samson and Alaska Logistics barges, research vessels, fuel barges and vessels
requiring maintenance and repairs.
In October 10 vessels docked at our docks. These vessels included Samson and Alaska
Logistics barges, project specific barges, research vessels and vessels requiring maintenance
and repairs.
October and November Events at the Terminal-
• Seward Terminal Marine Expansion Planning Community Meeting was held on October 11, 2016
6:00-8:30 PM. ARRC also met with the City Manager, Assistant City Manager, Mayor and
Executive Liaison. Thank you to everyone that attended the meetings. Materials can be found at
railportseward.com.
• City of Seward hosted Halloween Carnival October 31, 2016.
• Friends of the NRA will hold their annual fundraising banquet on November 5, 2016 beginning at
5:00 PM.
• City of Seward Archery club will meet each Wednesday night through November.
Other Items of Note-
0 Usibelii was in Seward October 17'h and 181h with final load out of coal back to Healy by train.
They conducted local sales during the load out, but there are no planned additional local sales
from the terminal. A company interested in possible deliveries to Seward is North Pole Coal-
907-488-8550.
• Additional piling repairs to the Cruise Ship Dock will begin soon with plans to complete by the end
of the year. The successful bidder was Global Diving & Salvage, Inc. Our first set of piling
repairs was completed in 2015 and also involved repairs and additions to the cathodic protection
system.
• Alaska Railroad President and Chief Executive Officer Bill O'Leary and Manager External Affairs
Timothy M. Sullivan will be in Seward to present to the Chamber of Commerce Membership
luncheon on November 4'h.
• 1 will attend the Pacific Marine Expo on behalf of the Alaska Railroad as part of the multi -
organization group staffing the Chamber of Commerce booth.

The 3rd annual Energy Forum & Fair was held at the AVTEC Student Services Building on
October 141h & 15". Senator Peter Micciche made a day of it in Seward visiting the Alaska
SeaLife Center, the Senior Center, the Energy Fair where he was a panelist, and stopped
by the reception at Zudy's that evening. The Energy Bike was a favorite along with the
Art Contest. A big thank you to Bethany Waggoner, Seward High School Art Teacher for
once again allowing class room time, encouraging students to participate in Energy Art.

The Pacific Marine Expo Booth supplies have been shipped to Seattle --- the dates of the
expo this year are November 17 — 19". As I've bragged about before, The Port of
Seward has increased the size of their real estate to a double booth this year! Partners
include the Harbormaster's office, AVTEC and the Alaska Railroad Corporation.
The Seward Chamber is switching up to even a better "A" Game for our Marketing Plan.
Pat McGaughey, America's Chamber Mentor says you shouldn't have a budget.
You should have a Profit Plan! And that's what we're aiming for in 2017. Of course the
`profit' will be realized by chamber businesses and the community of Seward.
Alaska Marketing Consultants has become our official Ad Agency. In addition to this
role, Yvette will also be responsible for the first time ever Halibut Tournament Event

Guide — which joins the ever popular Mt. Marathon Race Guide and the Silver Salmon
Derby Guide. With this valuable addition we have high hopes for putting more "butts in
seats" on the charter boats during the month of June.

specific to the Kenai Peninsula from the McDowell Group. Typically this kind of data
would be well out of my budget, but by sharing the expense between the Peninsula
Chambers & KPTMC, it's doable.

HARBOR
• Harbormaster is attending the International Association of Maritime and Port Executives
conference.
• Deputy harbormaster spent last week In Dutch Harbor at the AAHPA convention, it was
quite informative and positive. The position that Seward holds in trade and tourism is
very exciting.
• Hamilton Construction is continuing to move forward in their completion of the
breakwater. They have finished stacking the secondary armor rock for the first 300 ft. and
have primary armor rock on its way over from Kodiak.
• Hamilton is also transporting over some rock for the Snow River Project.
• The uplands restrooms and North launch ramp restrooms have been winterized and
secured for the season
• The weather has been a little bit warmer than in the past so the water on the floats has
been left on a little longer than usual.
• Boat lifts are still a good amount of our work load and the 30 ton is staying busy in our
yard and the neighbors' yards. Raibow's new layout seems to be filling up and getting
more new customers.
• Tug boats and Barges are starting to make moves towards winter moorage in the Harbor.
• We are getting many questions about future moorage at SMIC from Foss, Crowely and
Kirby Tug and Barge companies.
• The 2 NO WAKE Buoys have arrived along with 20,18 x 18 inch NO WAKE stickers
for the top of the piling. These will be applied when the weather is a little warmer. The
buoys need some custom anchoring.
• We have installed 4 NO WAKE signs inside the channel so far.

called to order at 12:01 p.m. by Chair Darryl Schaefermeyer.

Alaska Railroad Report — Report was given electronically

Harbormaster Report --Harbormaster Regis reported that Hamilton construction has continued
work on the SMIC breakwater project. There have been 10 new meters added to SMIC this is a huge
benefit to boats being hauled out for winter storage and repairs. Harbor has started the process with
ADF&G to replace the south launch ramp the city will be responsible with a 25% match. Regis
reported that the City Administration and Coast Guard are working on getting the 2 fast boats to
Seward. 2 no wake buoys have been purchased along with additional signs these will be installed
throughout the Harbor after they are received.

Leslie Pemberton stated she was addressing the board regarding a letter that was sent to the
Harbormaster and overall harbor behavior. Pemberton wanted to make others aware of their
business policies regarding fellow boaters
Rebekah Christenson spoke to the board about an incident that happened to her at the
harbor while she was working.

working.
Bob Candopoulos wanted to make the board aware of the accusations regarding unsafe maritime
practices made by individuals in email and letters.
Bob Goodell spoke to Board regarding an incident that happened in the harbor. He would like the
board to review the possibility of moving recreational and charter vessels.
Nate Smith spoke to Board regarding an incident that happened in the harbor. He would like the
Board to review the Harbor's Live -A- Board policies.
Phil Smith spoke to Board regarding an incident that happened in the harbor. He would like the
Board to review the definition of residence in the code and asked that they also review the Live -A -
Board policies and possibility of moving recreational and charter vessels.
Mark Clemens wanted to address accusations made by letter/ emails regarding his company and
their policies.
Robert Chadwell addressed the Board about accusations made by letter/ emails sent to various
individuals.
Chair Shaefemeyer wanted the Citizens to know that the Board had not received a copy of the
letter/ emails because it was not specifically requested to be given to the Board. Bob
Candopoulos then gave his copy of to the board.
Paul Rupple would like the board to review the possibility of moving recreational and charter
vessels. He would like to suggest that the Harbor remind all vessels owners of noise ordinance.
Niklas Ranta wanted to address accusations made regarding unsafe maritime practices made by
individuals in email and letters. He would like to have the harbormaster to have a way allow citizens
to voice a complaint.
Tom Stables wanted to address accusations made regarding unsafe maritime practices made by
individuals in email and letters. He would like the board to review the possibility of moving
recreational and charter vessels.
Deborah Altermatt wanted to address accusations made by letter/ emails regarding sail boaters. She
also wanted to remind the Citizens in the audience that everyone needs to communicate.
Katherine Goodell spoke to Board regarding an incident that happened in the harbor. She would
like the Harbormaster to have a complaint process.

Terry wanted to know what information would be given to board to review; she requested that
administration provide a copy of the presentation that would be given on 09/16/2016. Regis
stated he would provide requested information. Terry would like to have the Board incorporate
affordable house be addressed in the new comp plan.

Discussion of correspondence regarding letter that was sent to State Representatives and
possible letter of response
Terry wanted to know if administration responded to the State Representatives regarding
allegations made in letter that was presented to the board today. Regis stated that Assistant City
Manager and City manager had both responded. Terry stated that since administration had
already responded she didn't think the board would need to draft a letter or response.
Jaffa asked if the Harbormaster had contact any other harbors regarding segregation of vessels.
Regis stated that he had and that every harbor has similar issues but has not addressed them.
Jaffa wanted to know if there is a process for filing complaint. Regis stated that they do have an

incident report and have procedures for follow up of complaints. Unfortunately people don't file
them; he has had a total of 3 complaints this year.
Discussion of possible work session to review Harbor slip owner's policy, procedures and code
Board discussed possible future dates for work sessions regarding slip owner's policy, procedures
and code review. At request of board information will be added to the October 5, 2016 regular
business meeting agenda.

BOARD COMMENTS
Andrews- stated that she was glad to be back, was surprised with the amount of Citizens in
attendance and looks forward to a resolution.
Linville thanked everyone for coming and speaking. He works in multiple harbors he suggest.
that if people want to be moved from the noise they can request a slip transfer to a new location.

Jaffa- welcomed everyone and thanked the citizens in attendance.
Schaefermeyer thanked everyone for coming and speaking. He would like to remind
everyone that there is a vacant board seat. He would also like to review the alcohol policy in the
Harbor.
CITIZENS' COMMENTS -
Victor Martin- spoke to Board regarding an incident that happened in the harbor, he believes that
everyone needs to be educated on the Harbor rules. He also wanted to remind the Citizens in the
audience that everyone needs to communicate.
Elle Zerina wanted to to remind everyone that the Harbor is a working harbor it's going to be noisy,
rules and regulations need to be reasonable for all user groups.
Nate Smith also wanted to remind the Citizens in the audience that everyone needs to communicate.
He would like to have the board review the alcohol policies in the harbor.
Phil Smith wanted to remind everyone can request a copy of the Harbor Code.
Kathleen Christenson spoke to the board about an incident that happened to her at the harbor while
her daughter was working. She would like to remind everyone that our children are learning from us
and that maybe we can lead by better example.
Leslie Pemberton wanted to stress that everyone needs to communicate directly with the businesses.
She has worked for 25 years to get to her current slip, if recreational boaters have an issue with
charters maybe they can put in for a slip transfer.

Deborah Altermatt stated that there are a lot of recreational boaters; she would like to see the board
to have a work session in the evening so that everyone can attend. She would like the board to
review and develop the Harbor policies.

Jaffa doesn't think the issues addressed in the letter aren't a Federal problem this issue is a Seward
problem. He would like the alcohol policy to be reviewed.
Hughes welcomed the comments of everyone and promised to help remind the harbor and board that
these issues be addressed.
Linville thanked everyone for attending.
Terry asked for copies of the Code, Live -A -board policy, incident report form and alcohol use in the
harbor for the October 5, 2016 meeting.
Regis wanted everyone to know that the code is available online. The Harbor does follow up with all.
complaints that are reported.

It is that time a year again when Live Aboards need to register with the harbor. This needs to be done
every year per (City Code: 7.10.541) No vessel within the harbor may be used for permanent living
quarters while moored unless a permit is first obtained from the harbormaster. These permits are
good from Jan 1" to Dec 3 1 " of each year.
Please fill out the Live Aboard Application and return it to the Harbor office and we will issue you a
permit to be displayed on your vessel that is good until Dec. 31, 2012.

130 RIGHTS OF THE CITY OF SEWARD
(3) Movement of Vessels to Reduce Congestion or Maximize Services. In his discretion, the Harbormaster shall at all
times have the right to move or rearrange any vessel from its present
location to any other location in order to reduce congestion within the harbor or to prevent disruption of
customary services to the public.
150 SAFETY, SANITATION AND HOUSEKEEPING
(a) Safety and Sanitation. All users of city docks and terminal facilities and all permit holders of the shiplift system
shall exercise due care for the protection of life and property and the protection of the public from injury or damage.
Additional safety and sanitation rules applicable to docks and terminal facilities, including the shiplift system,
should be consulted. Portions of the City of Seward Code of Ordinances of particular relevance include Chapter 9.15
(Eire Prevention and Uniform Fire Code), Title 14 (Utilities including Garbage, Sewer, Refuse, Electricity and
Water) and Chapter 7.10 (Ports and Harbors).
All safety and sanitation laws, regulations and policies of the City of Seward, the Kenai Peninsula Borough, the
State of Alaska, and the United States of America, including those adopted by international treaty, apply to city
docks and terminal facilities, including the shiplift system. All users, including shippers, permit holders, vessels and
consignees, are hereby warned that the party or parties responsible for infractions of such laws, regulations or
policies will be subject to and responsible for any penalties that may result from their violation of those laws,
regulations or policies.
200 MOORAGE
Outside the Small Boat Harbor: Vessels berthing or departing city docks, wharves, or any other terminal facility,
including the shiplift system, must use sufficient tugs so that vessels can be berthed or removed in a safe manner.
Berthing speed shall not exceed sixteen feet per minute, unless approved by the Harbormaster.
Within the Small Boat Harbor:
(a) Assignment of Berths. The Small Boat Harbor is often congested and it is the policy of the City of Seward to
provide for the maximum public use of available facilities. The Harbormaster shall have discretion to implement that
policy.
Berth assignments to particular slips on the City of Seward float system are made by the Harbormaster. Berth
assignments are made to a particular combination of vessel and owner/operator, are not assignable by the
owner/operator and automatically expire upon sale or transfer of the vessel to another owner/operator.
A berth assignment is not a lease or an exclusive right to occupy any particular slip. In order to maximize the
public's use of existing facilities, it is common for the Harbormaster to temporarily assign vessels to slips normally
used by another vessel when that vessel is out of the harbor.
• 14.20.060. - Unlawful discharges.
(a)
No person shall discharge or cause to be discharged any of the following described waters or wastes in
any public sewer:

Any gasoline, benzene, naphtha, fuel oil, or other explosive liquid, solid, or gas;
Any waters or wastes containing toxic or poisonous solids, liquids, or gases in sufficient
quantity, either singly or by interaction with other wastes, to injure or interfere with any sewage
treatment process, constitute a hazard to humans or animals, create a public nuisance, or create

any hazard in the receiving waters of the sewage treatment plant, including but not limited to
cyanide in excess of two mg/l2 as CN in wastes as discharged to the public sewer;
Any waters or wastes having a pH lower than 5_5 or having any other corrosive property capable
of causing damage or hazard to structures, equipment, and personnel of the sewage works;
Solid or viscous substances in quantities or of such size capable of causing obstruction to the
flow in sewers, or other interference with the proper operation of the sewage works such as, but
not limited to, ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar,
plastics, wood, unground garbage, whole blood, paunch manure, hair and fleshings, entrails and
paper dishes, cups, milk containers, etc., either whole or ground by garbage grinders.
No person shall discharge or cause to be discharged the following described substances, materials,
waters, or wastes if it appears likely in the opinion of the city engineer that such wastes can harm
either the sewers, sewage treatment process, or equipment, have an adverse effect on the receiving
waters, or can otherwise endanger life, limb, public property, or constitute a nuisance. In forming his
opinion as to the acceptability of these wastes, the city engineer will give consideration to such factors
as quantities of subject wastes in relation to flows and velocities in the sewers, materials and
construction of the sewers, nature of the sewage treatment process, capacity of the sewage, treatment
plant, degree of treatability of wastes in the sewage treatment plant, and other pertinent factors. The
substances prohibited are:
(1)
Any liquid or vapor having a temperature higher than 150 degrees Fahrenheit (65 degrees
Centigrade);
(2)
Any water or waste containing fats, wax, grease, or oils, whether emulsified or not, in excess of
one hundred mg/I or containing substances which may solidify or become viscous at
temperatures between 32 and 150 degrees Fahrenheit (zero and 65 degrees Centigrade);
(3)
(4)
Any garbage that has not been properly shredded;
Any waters or wastes containing strong acid iron, pickling wastes, or concentrated plating
solutions whether neutralized or not;
(5)
"Septic" sewage.

Please see the attached memo reflecting the direction given by the City Council at the October 24, 2016 meeting. Each
year, the council organizes after the municipal election and directs boards and commissions to give periodic reports to
the City Council. This is not the same as your annual work session to discuss annual priorities.
PACAB staff, I will include a hard copy of this memo in your box here at City Hall. Please include this on an upcoming
agenda for future planning (I recommend Other New Business or Informational Items and Reports). The board should
discuss who and when will deliver these periodic reports to the City Council.

RULE 29.
(c) Council Liaisons. In order to build additional Council expertise in various areas of city
operations, the Presiding Officer may appoint One Council member to serve as a liaison to the Planning and
Zoning Commission. These appointments shall be made at the Council's organizational meeting in
October. If appointed, the council representative to the Kenai Peninsula Borough Economic Development
District shall serve as liaison to the Port and Commerce Advisory Board. If council liaisons were not
appointed, a member of each Board and Commission will arrange to give periodic reports to the city
council during Councils regular scheduled meetings.

This booklet will help you install or upgrade sewage holding tank systems to be in compliance with existing laws governing
marine sanitation devices (MSD's). You will find information on how to choose a system, sewage system design and the
selection of system components, plus helpful tips for installation and maintenance.
What is the law?
In response to growing fears of the "death" of our nation's bodies of water, Congress enacted the Clean Water Act of 1972
(amended in 1987). This law addresses a wide spectrum of water pollution problems, including marine sewage from boats in
navigable U.S. waters including coastal waters from a distance of 3 miles offshore. The law further provides for "no discharge"
by boats operated in enclosed lakes and reservoirs or in rivers not capable of interstate navigation. States may apply to the
EPA to have certain other waters declared "no discharge zones" if discharge of treated sewage would be harmful. In short,
boats with installed toilets must have an operable Coast Guard approved MSD designed to either hold sewage for pumpout
ashore or for discharge in the ocean beyond the three mile limit, or to treat the sewage to Federal standards prior to discharge.
Why should you act now to comply with this taw?
First of all, it is the law! All boats built since 1977 with installed toilets must have an operable approved type MSD. Sincet980,
all boats (including those built before 1977) with installed toilets must have an operable MSD. Nevertheless, boaters often
bypass these systems and discharge untreated sewage directly overboard. If you flush your boat's toilet in violation of the law,
you can assume others do too.
The basis for arguments that boat sewage is "peanuts" compared to other sources of pollution, that holding tanks "stink," that
there's no place to pump out, and that the law isn't being enforced anyway, is weakening fast in these changing times. These
facts are clear:
Growth in boating is placing an additional environmental on crowded recreational waters.
Government and citizens' groups are working aggressively to contain and prevent all forms of water pollution.
Government grant money is funding a tremendous increase in the number of Pumpout facilities.
Advancing technology has given a wide range of "user friendly" sanitation system options.
Against this backdrop, it is not surprising that congress is considering proposals that would increase fines for flushing raw
sewage and provide states with incentives for enforcing current laws. Clearly, it's time for all boaters to "do the right thing."
What can you do now to comply with the law?
Boaters share a common desire to play in and on sparkling clean waters. We can choose to pollute or not to pollute. We can
do the right thing now, take action, and obey the law! Good environmental citizenship will help ensure our continued delight in
clean waters. Use this information in choosing a marine sanitation device that best fits your needs.
What are your choices for compliance?
There are three types of Coast Guard approved marine sanitation devices (MSDs):
Type I MSDs treat sewage so that the discharged effluent meets specified standards for bacteria content and contains
no visible floating solids.
Type 11 MSDs are similar, but must meet a higher standard of sewage treatment.
Type 111 MSDs retain sewage for shore based disposal or discharge beyond the three mile offshore limit.
Boats 65 feet in length or less may install a type I, 11, or III device. Vessels over 65 feet must install a type II or III MSD.
An approved system (Type l or 11) will have a label verifying that it meets the Coast Guard regulations for design and
construction and the Environmental Protection Agency (EPA) regulations and standards as required by the Clean Water Act.
Holding tanks (Type III) do not require a certification label if they simply store sewage at ambient temperatures and pressures.
What system should you install?
If the boat is operated in waters designated for "No Discharge," you only have one choice ... you must retain all sewage, treated
or not, for disposal ashore. Choosing the system that works best will depend on several factors. The answer to a few questions
about how the boat is used should help you narrow the choices and determine optimal holding tank capacity:

Flow many people are usually on board for a trig?
Is the boat usually used for day trips or for longer periods and overnight cruises? Usually day trips do not generate
much solid waste. Ovemighting virtually guarantees it.
Does the boat anchor out overnight or tie up at a marina? When dockside, will you use the marina toilets?
Are pumpout facilities located nearby?
What are the boats design and space limitations for MSD installation?
Is the electric power supply adequate for an electrically operated system?
