HomeMy WebLinkAboutRes2004-030 Sponsored by: Shealy I CITY OF SEWARD, ALASKA RESOLUTION 2004-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A NEW LEASE AGREEMENT WITH DEBORAH ALTERMATT FOR A PORTION OF LOT 1, BLOCK 6, SEWARD SMALL BOAT HARBOR SUBDIVISION, CONTAINING 8,520 SQUARE FEET, MORE OR LESS WHEREAS, Deborah Altermatt currently leases property adjacent to Lot 1, Block 6 (the "Property"), Seward Small Boat Harbor Subdivision for the purpose of operating Sailing Inc; and WHEREAS, Ms. Altermatt requests to lease the Property to expand and enhance her business; and WHEREAS, the City Council has determined that the continued development of the harbor area and operation of Sailing Inc at Lot 1, Block 6, is in the public interest. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. For the reasons stated in the recitals and incorporated herein by this reference, it is in the public interest to lease a portion of Lot 1 Block 6 Seward Small Boat Harbor Subdivision. The City Manager is authorized and directed to enter into a lease agreement with Deborah Altermatt in substantial form as attached hereto; notwithstanding the foregoing, the City Manager may make such changes or corrections as needed to finalize the lease transaction but without changing the essential terms and conditions as set out in the attached lease. The City Manager is also authorized to sign and record any and all related documents in connection with this transaction such as the plat, the lease termination, the memorandum of lease, and the like. Section 2. The effective date of the new lease shall begin following the effective date of this resolution and upon the signing of the lease and any associated documents and recording of the new memorandum of lease. Section 3. The lease rate will be at the existing rate of adjacent property reflecting the year 2000 fair market appraisal adjustments as applicable. The lease rate under the new lease will be subject to periodic re-appraisals as provided in the lease, and, for this reason, the public interest will not be served by requiring an appraisal at this time. Section 4, This resolution shall take effect 30 days after adoption and posting. I PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 22nd day of March 2004. Beckham Agenda Item: Authorizing the City Manager to Enter into a New Lease Agreement with Deborah Altermatt for a Portion of Lot 1, Block 6, Seward Small Boat Harbor Subdivision. BACKGROUND & JUSTIFICATION: Deborah Altermatt has requested to lease the remaining portion of Lot 1, Block 6, Seward Small Boat Harbor Subdivision to expand and enhance her business, Sailing, Inc. The “sliver” has long been an area of discussion and is essentially a small piece of real estate between the city owned and Alaska Railroad owned uplands. Leasing this small sliver will allow expansion and enhancement of an existing harbor area business and provide continuity of ownership for maintenance issues in that area, such as snow removal. An appraisal is not necessary at this time because the year 2000 reappraised rates from the prior leases will be continued, and the lease rates will be adjusted in 2005 and each five years thereafter under the terms of the lease. 1. This lease will generate approximately $9,542 ($1.12/sq ft (arrc-city sliver lease) or $1.08(gateway tex lease)) in annual rent. Approved by Finance Department RECOMMENDATION: Council approve Resolution 2004-27, authorizing the CityManager to enter into a new lease agreement with Deborah Altermatt for a portion of Lot 1, Block 6, Seward Small Boat Harbor Subdivision.
