RESOLUTION 2017-029
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ADOPTING RECOMMENDATIONS FROM THE PORT AND
COMMERCE ADVISORY BOARD FOR DEVELOPMENT OF THE
SOUTH HARBOR UPLANDS
WHEREAS, the Seward Port & Commerce Advisory Board held a Regular Board
Meeting on April 5, 2017 and a work session on April 12, 2017 to discuss developing the South
Harbor Uplands; and
WHEREAS, a financial split of 50150 with Lessee's for utilities improvements on the
South Harbor Uplands development with Lessee paying their portion over 15 years was
discussed and approved; and
WHEREAS; in Resolution 1997-056 council approved a similar financing agreement
with lessees for upgrading utilities to the eight lease sites behind the harbormasters office; and
WHEREAS, to allow for more infrastructure space on the uplands it was determined that
all the utilities should be located into one utility easement; and
WHEREAS, the South Harbor Uplands development should be consistent with and
complement the existing Harbor Boardwalk parcels; and
WHEREAS, the Seward Planning and Zoning Commission in Resolution 2017-005
recommends that the' City Council amend portions of City Code 15.10.220 Development
Requirements Table`— Notes to extend the maximum 26 foot building height'area to include the
South Harbor Uplands, Tract H, Waterfront Park Replat; and
WHEREAS; extending the 26' height limit to include Tract H South Harbor Uplands
maintains consistency with the existing. Harbor area standards; and
WHEREAS, continuation of the harbor boardwalk and bike path to the South Harbor
Uplands area is a development goal.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Sectionl. The Seward City Council approves the recommendations from the Port and
Commerce Advisory. Board for the South Harbor Uplands.
1. A financial 50150 split between the City and the Lessee's for utility improvements at
the South Harbor Uplands, with up to fifteen year financing available.
2. Locate all the utilities into one utility easement.
3. Development to be consistent with the existing harbor boardwalk parcels.
4. Extend the 26 foot height limit to include Tract 14, South Harbor Uplands
5. Connect the harbor boardwalk/bike path with the South Harbor Uplands.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 22`t'
day of May 2017.

Agenda Item: Adopting recommendations from PACAB for developing the South Harbor
Uplands
BACKGROUND & JUSTIFICATION: The Port & Commerce Advisory Board at the April 5,
2017 regular meeting discussed and approved the development of the South Harbor Uplands. The
recommendations for the upland development were discussed and the following items were
approved.
The City shares 50% of the utilities costs with Lessee's for improvements on the South Harbor
Uplands development with Lessee paying their portion over 15 years. This is similar to the financial
agreement approved by council in resolution 97-056 for the utility upgrades for the 8 lease sites
behind the harbormasters office.
Combine all the utilities to the center road utility easement to increase the area available for
structures and parking.
Keep the height limit on the South Harbor Uplands at 26 feet to match the current Track H height
limit.
(The Planning and Zoning Commission passed Resolution 2017-005 recommending City Council
amend portions of the City Code 15.10.220 Development Requirements Table —Notes to extend the
maximum 26 foot building height area to include the South Harbor Uplands, TRACT H,
WATERFRONT PARK REPLAT, and the ordinance enacting that code change is before you this
evening.)
Extend and connect the Boardwalk/Bike Path with the South Harbor Uplands.
South Harbor Uplands development should be consistent with and complement the existing Harbor
Boardwalk parcels.
PACAB approved Resolution 2017-002 at their May 3, 2017 regular meeting; Recommendations to
Council for the South Harbor Development plan.
INTENT: To have a development plan for the South Harbor Uplands with a 50/50 split for utility
upgrades, one utility easement, lot sizes for replat mirroring the existing harbor boardwalk sites to
include the continuation of the boardwalk and maintain harbor building height limits.

FISCAL NOTE: The cost of installing utilities to the South Harbor uplands area has not yet been
determined. Prior to installing utilities and determining whether and how to assess the costs of
utilities among the upland sites and/or the City, an assessment district will be formed, a public
hearing will be held, and any potential utility cost allocation will be determined, with the expectation
that each utility will be trade financially whole. Installation of utilities in the harbor uplands does
not include paving. Any cost associated with a particular site will be billed as an additional annual
lease billing based on the amortization period and interest rate to be determined by the Seward City
Council.
The transition of harbor uplands from paid parking to retail shops will result in a decrease in
available parking in this area, resulting in a reduction in annual parking revenues, and offset by some
reduced level of parking maintenance and monitoring costs. In 2016, parking revenues in this
location were approximately $24,000, with an additional $13,000 in vehicle -with trailer -permits sold.
