MANAGER’S REPORT

HARBOR
Conducted meetings with Hamilton Construction and R&M for the Breakwater project on 09-28-17 and
10-04-2017.
Base and core rock are complete. The entire footprint of the breakwater is in place. We are waiting on the
surveying report. Hamilton is continuing to work on the punch list.
The boat lift schedules for both sides of the bay are continuing.
Hamilton Construction has sent the City a construction schedule for change order #8, North Dock cell wall,
adding a tail wall, anodes and new fender piling, installing a 10 ton crane on the North Dock, installing a 15’
floating dock, widening the 330 ton travelift pit, and heating the wash down pad, with a completion date of April
2018.
We are currently working on the 2018-2019 budgets.
The Park Service has started their $2,000,000 refurbishment of the Park Service Building.
PACAB is currently working on the SMIC development plan.
Kendrick Equipment has completed the replacement of the Salami valve system on the 50 ton travelift.
ELECTRIC DEPARTMENT

As of Friday, September 29, the boring is expected to be complete within a week and we will be scheduling our
crews.
The electric department is planning on working with Mike Hubbard again next year with regards to our purchase
agreement expiring in 2020. We will be exploring many different options for our power needs.
We are once again experiencing a spike in job order requests. We would like to remind and encourage the
public to submit their requests as soon as possible.

PUBLIC WORKS
Water, Wastewater Utilities
The SMIC side utilities suffered a power surge last week that damaged the electric infrastructure in the water
well house and sewer pump house. We are up and running manually and working on repairs. The costs are
rising over $20K. The crews will start flushing out water and sewer mains soon after SMIC repairs are finished.
Shop
Fall is here. Services are being completed on all equipment. Winter use vehicles are being double checked and
pre-serviced for the season. Sand and salt supplies are being added to and filled.
Streets
Paving is finished. The project is almost complete. Only some striping and punch list items remain. It has been a
long summer working hard to complete the project in just one season. We are very happy to have everyone
driving on new pavement! The lines seem to make it all look official and clean. New “No Parking” signs going
up.

Sports and Rec

Competitive Volleyball started Wednesday, September 27 with four teams.
Recreational Volleyball is set to start Monday, October 16th at the Middle School. We currently have seven
teams signed up.

Racquetball League and Adult Basketball will begin Tuesday, October 17
Recruiting for Urbach Youth Coaches, Referees.
Archery is around the corner, starting in November.
Sports & Recreation Gym Winter Hours: Tuesday-Friday 9:30am-9:00pm, Saturday 10:00am-6:00pm
Adult/Youth Skating: Saturdays 2:00pm-3:30pm, Pickleball: Friday 5:00pm-6:30pm; Open Volleyball: Fridays

Teen Rec Room
The TRR is up and in full swing now that school has started. Attendance has begun to increase, with the past
two weeks averaging in the high 20’s. There are a lot of new faces this school year and they are really enjoying
pool, ping pong, skee-ball, air hockey and foosball. Glad to see they are more active than ever.
We welcome back Reed Lane (who worked at TRR last winter) and Kelley Wiley Lane to the team.
Junior and Teen Council will be starting in October at the TRR. We are hoping to take the Youth/Junior/Teen
councils on a retreat to energize them for the upcoming school year. It will be a time to teach leadership, a
time to bond with other members of councils and spell out the expectation of each council member for the
school year.

Upcoming events: The Family Masquerade Ball will follow the Pumpkin Prowl on Saturday, October 28. This
event will be held at the Army Rec Camp from 7:00pm – 9:00pm. Following the Family Masquerade Ball will be a
TEEN Party from 9:00pm – 11:00pm. We are planning a dance and group contests.

Halloween Carnival, October 31
at the Railroad terminal. The Councils will have multiple booth spaces.
TYC
Preparations for Halloween Carnival have begun.
Still seeking a part time position to assist with After School Program and weekends.
Attendance ranges from 12-20 kids a day. Programs include crafts, outdoor activities and STEM programs.
Wrapping up summer paperwork and working on reports.
Our summer program is being highlighted along with the Alaska Afterschool Network in the annual report of
Alaska Children’s Trust (ACT)
Working on a grant to attend the Afterschool Network conference in Fairbanks in November.

NON-CODE ORDINANCE 2017-003
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, RESCINDING SECTION 4 OF NON-CODE ORDINANCE 2013-
012 WHICH AUTHORIZED SOLE SOURCE NEGOTIATION FOR
DISPOSAL OF THE PROPERTY DESCRIBED AS THE WEST ½ OF
LOTS 19 AND 20, BLOCK 30, ORIGINAL TOWNSITE OF SEWARD;
WITH TAX PARCEL ID NUMBER 14813010, LOCATED AT 408
MADISON, AND INSTEAD AUTHORIZE DISPOSAL BYSEALED BID
AT A MINIMUM BID OF $36,700
WHEREAS,the Seward City Council approved Non-Code Ordinance 2013-012 on
August 26, 2013, authorizingforeclosureon the above-named property for delinquent property
taxes and because the property was vacant andhad become a public safety hazard, and
authorizing the disposal by sole source negotiation with the adjacent property owner who had
agreed to provide for the full demolition, removal and clean-up of the parcel; and
WHEREAS,at the time of enactment of Non-Code Ordinance 2013-012, the 50 foot x
60 foot parcel was a non-conforming undevelopable parceldue to its size, but since that time, the
Seward City Council enacted Ordinance 2016-009 on January 23, 2017, modifying the minimum
lot size to 3,000 square feet, making this parcel a developable parcel; and
WHEREAS, since enactment of Non-Code Ordinance 2013-012, the adjacent property
owner decided not to acquire the property by sole source negotiation, and the parties ceased to
negotiate; and
WHEREAS,the City obtained title to the property from the Kenai Peninsula Borough in
accordance with Section 2 of Ordinance 2013-012, has completed the process of removing
structures from the property and cleaning upthe property and is proceeding to dispose of the
parcel; and
WHEREAS,Seward City Code §7.05.210 establishes that the sale of real property be by
public auction or sealed bid and the administration recommends sale of this parcel for cash
deposit and a purchase agreement by sealed bidat a minimum bid of $36,700 reflecting the 2017
Kenai Peninsula Borough property assessment on the land, considered to be lower than fair
market value, but covering the City’s costs of property foreclosure and clean-up; and
WHEREAS, Seward City Code §7.05.220 provides that sealed bids shall be submitted in
a sealed envelope marked “Real Property Bid” and must be accompanied by a check or money

order made payable to the city, and this sale will require a bid deposit equal to 20% of the
amount bid; and
WHEREAS, upon successful receipt of bids, the City Council will approve the final
disposition of the real property based on thehighest bid received, and shall approve any purchase
agreement prior to its execution by the City, and should purchaser fail to meet the terms of the
purchase agreement at any time after award by Council, purchaser shall forfeit bid deposit and the
next highest bidder shall be considered the successful bidder, upon approval by the Seward City
Council.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA,HEREBY ORDAINSthat:
Section 1. This is a Non-Code Ordinance.
Section 2. The City has determined by Non-Code Ordinance 2013-012 that it has no
public purpose for West ½ of Lots 19 and 20, Block 30, Original Townsite of Seward.
Section 3. The Seward City Council hereby rescinds Section 4 of Non-Code Ordinance
2013-012 which authorized sole source negotiations for disposal of the property described as the
West ½ of Lots 19 and 20, Block 30, Original Townsite of Seward, with tax parcel ID number
14813010 located at 408 Madison, and instead authorizes disposal by sealed bid at a minimum
bid price of $36,700.
Section 4.The City Manager and Finance Directorare hereby authorized to conduct a
public sale by sealed bid advertised in a newspaper of local circulation. The agreement will be
subject to approval by the Seward City Council.
Section 5.The City Council hereby finds it to be in the public interest to sell this parcel
for a minimum bid of $36,700 which may be less than fair market value, recognizing that State
law requires that any amount received in excess of the City’s cost to foreclose, demolish
structures, clear the property and prepare the property for sale shall revert to the last known
owner of record of the property prior to foreclosure.
Section 6.The recitals stated above arehereby adopted as findings of the City Council.
For these reasons, the City Council authorizes the sale and transfer of this property as is, where
is, with no warranties, and for less than fair market value.
Section 7.This ordinance shall take effect ten days following its enactment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A

FIVE-YEAR SPECIAL ELECTRIC RATE CONTRACT WITH THE
council amend the title to read a THREE-year
SEWARD ASSOCIATION FOR THE ADVANCEMENT OF MARINE
contract.
SCIENCE (SAAMS), ESTABLISHING ATRANSITION TO LARGE
GENERAL SERVICE RATE CLASS BY 2025
WHEREAS,SAAMS and the City are parties to the Agreement for Lease, Operation and
Maintenance of the Alaska Sealife Center, with SAAMS operatingthe Alaska Sealife Center and
providing full-time jobs in the community; and
WHEREAS, job creation, job retention, and promotion of marine research and economic
development are important to residents of Seward, and economic stability of the Alaska Sealife
Center is important to the City, as owner of the facility; and
WHEREAS, the initial rate class of the Alaska Sealife Center was the industrial rate class
which was eliminated in 2010, resulting in the creation of a Special Contract with SAAMS to
transition toward the Large General Service rate class due to the actual electrical demand being
higher than 750 kW; and
WHEREAS,the Utilities Manager is authorized to negotiate a special contract, subject to
approval by the City Council, for customers who have ademand in excess of 750kW or that have
unique power requirements that cannot be reasonably addressed by the Large General service tariff;
and
WHEREAS,the City Councilhas recommended a ten-year glide path to migrate SAAMS to
the Large General Service rate class, with the initial two years of that transition occurring in 2016
and 2017, and with the proposed Special Contract coveringthe period 2018 through 2020, leaving
fiveremaining years before reaching the ten-year transition to LGS rate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The City Manager is hereby authorized to enter into a Special Contract for
Electric Rates ("Contract") in substantially the form presented at this meeting.
Section 2. The recitals stated above are incorporated herein by reference as findings of the
City Council.
Section 3.This resolution shall be effective immediately. The contract shall be effective
January 1, 2018.

CALL TO ORDER
The September 25, 2017 regular meeting of the Seward City Council was called to order at
7:00 p.m. by Mayor Jean Bardarson.
OPENING CEREMONY
Police Chief Tom Clemons led the Pledge of Allegiance to the flag.

CITIZEN COMMENTS ON ANY SUBJECT EXCEPT THOSE ITEMS SCHEDULED FOR
PUBLIC HEARING
Willard Dunhamthanked the council for shiny new streets in townand congratulated them
on getting the project completed.Dunham invited the council to meet with a small Japanese
delegation visiting Seward on Friday to commemorate Jujiro Wada, a historical Seward pioneer and
Japanese icon.
Tim McDonaldsaid they were talking about the electric utility rate schedule during the work
session earlier tonight and he was concerned by the figures being reported, specifically the gross
revenue, the Payment in Lieu of Taxes (PILT), depreciation and other administrative expenses.Staff
reported they have $1.5 million in administrative expenses, and he would like more explanation of
how that figure was calculated.

Keil requested Resolution 2017-052 be placed on the consent agenda.
Bardarson added the following to the agenda:the Attorney report, a discussion item on implementing
a traveling flag program, and a discussion item to direct administration to explore with the

Department of Transportation the possibility of constructing a roundabout at the Seward Highway
and Port Avenue.

Non-Code Ordinance 2017-003, Rescinding Section 4 Of Non-Code Ordinance 2013-012 Which
Authorized Sole Source Negotiation For Disposal Of The Property Described As The West ½
Of Lots 19 And 20, Block 30, Original Townsite Of Seward; With Tax Parcel Id Number
14813010, Located At 408 Madison, And Instead Authorize Disposal By Sealed Bid At A
Minimum Bid Of $36,700.(Introduced and set for public hearing and enactment on October 9,
2017)
Resolution 2017-052, Accepting Funds From The Alaska State Library For The Public Library
Assistance Grant In The Amount Of $7,000.00 And Appropriating Funds.
Approval of the September 11, 2017 Regular City Council Meeting Minutes.
SPECIAL ORDERS, PRESENTATIONS AND REPORTS
Proclamations & Awards
Proclamation for Seward Drag Racer Shelby Roy.
Chamber of Commerce Report. Clock was not present for the meeting and provided a
written report in the agenda packet.
City Manager Report. Jim Huntstated the following purchase orders between $10,000
and $50,000 approved by him since the last council meeting:
·$19,012.50 to T2 Systems from the Parking Department for updated controllers
for Luke pay stations.
·$33,575.25 to Univar from the Public Works Department for salt and calcium
chloride.
Hunt noted staff was hearing some complaints of ripples in the new roads since the paving,
but he was informed it would likely smooth out over time and traffic.He noted there was a warranty
in place, as well.
In response to McClure, Long stated the clearing of the vacated U.S. Air Force Rec Camp
land was in progress and should be cleared off before the snow started coming down.
In response to McClure, Hunt thanked Assembly Member Kenn Carpenter for his support in
appropriating funds for the Eastern Kenai Peninsula Highway Emergency Service Area Board and
noted the assembly dedicated $232,000.Hunt added that he was concerned with the lack of presence

planned for Alaska State Troopers in the service area.
In response to McClure,Electric Utility Manager John Foutzsaid the equipment put in
place last year at Snow River to prevent damage to electrical equipment held up very well with the
recent glacial dam and flooding created from high rains.The Electric Department would continue to
monitor the area.
City Attorney Report.Will Earnhart referred to his written reportprovided to council.He
stated his report was similar to last month.He was waiting to hear new news on the Bradley Lake
mediationsas well as a decision on the Orion litigation.Earnhart worked with staff on general
matters such as refining joint use agreements, leases and land dispositions, and varying types of
records subpoenas.

NEW BUSINESS
Resolution 2017-053, Amending The Fire Department 2017 Budget For Additional Hydrant
Water Charges, And Authorizing $278,050 In Payment Of Under-Billed Fees From The
General Fund To The Water Fund Since 2005, And Appropriating Funds.
Motion (Keil/McClure) Approve Resolution 2017-053
Long said it was discovered there were some errors in the water tariff beginning in 2005that
resulted in adeficit of funds owed to water enterprise fundthat should have been paid by the general
fund. Staff recommended council approve this corrective measure.

Resolution 2017-054, Transferring $254,544 To The Capital Acquisition Fund Representing
50% Of The General Fund Annual Surplus For 2015 And 2016, And Appropriating Funds.
Motion (Keil/McClure) Approve Resolution 2017-054
Long said budget policy recommended the city have 3-6 months of reserve funds set aside.
Over the last two years, the city accrued $509,089in surplus funds from 2015 and 2016.Staff was
recommending council authorize setting aside half of this surplus from the general fund reserves to
the capital acquisition fund. Long added this would reduce the reserves to 4.33 months which was
within the established goal. This was consistent with their budget policies approved by council.

Other New Business Items
Discussion on process for request for information.(Bardarson)
Bardarson requested the clerk provide some information on the process to request public
documents. Hunt noted he was currently copied on each request form, excluding requests for police
records. Hunt indicated he would like to receive his copy of the request form electronically.
Discussion to direct administration to explore with the Department of Transportation the
possibility of constructing a roundabout at the Seward Highway and Port Avenue.(Bardarson)
Bardarson noted the Department of Transportation was planning to improve mile 1-8 of the
Seward Highway next year, and wondered if administration could at least contact the state to see the
feasibility of incorporating a roundabout or even other ways to relieve congestion at Port Avenue and
the Seward Highway. Council agreed to direct administration to look into this.
Discussion item on implementing a traveling flag program.(Bardarson)
Bardarson thought it would be nice to give a City of Seward flag to people to travel all over
the world, and document itstravels over time. Altermatt talked of an exchange of flags. McClure had
an idea of print outs of the diary that could be kept in a binder for public review. Council supported
the idea and directed staff to begin implementing a program.

COUNCIL COMMENTS
Altermattcongratulated Shelby Roy onher racing accomplishmentsand wished her the best
on her upcoming championship in Memphis. She thanked staff for the great roads.
Bardarsonthanked the volunteers for Seward Music and Arts Festival (SMAF) and the
Alaska Railroad for providing the event space.She encouraged the community to please vote on
October 3, 2017.
Keilannounced there would be budget work sessions on September 27, 2017, October 2,
2017, and October 3, 2017.She hoped all candidates would come to these work sessions as it would
be their budget to approve if they were elected.

Squirescongratulated Shelby Roy on her accomplishments this summer and wished her luck
atthe international race championship in October.He thanked the community for coming out for
tonight’s work sessions. There was an open house for the Alaska Railroad tomorrow night.
McClurecongratulated Shelby Roy.She noted the SMAF event had a great turnout.She
thanked all those that volunteered.McClure stated tonight’s work sessions had great public input and
she was pleased to see theattendance tonight. She encouraged candidates and the public to attend the
budget work sessions, noting the sessions would also be televised.
Bardarson wished a Happy Birthday to the City Clerk.
Altermattcongratulated Brenda Ballou as the next City Clerk, pending negotiations. Council
selected Ballou last week after interviewing her. She noted outgoing City Clerk Johanna Kinney’s
last meeting was October 9, 2017.
Bardarsonsaid they would have a special open houseat 6:30 p.m.on October 9, 2017 to
celebrate Kinney. Kinney added Bardarson should be part of the celebrations as well.
Huntstated the city would be closing the roads once a week in the winter time to clear roads
and drainage. It seemed like they were still receiving a lot of visitors in town and it was nice to see
tourists in the shoulder season.
Long congratulated Shelby Roy.
CITIZEN COMMENTS
TimMcDonaldwanted to know if the public bathroom downtown was still open. He agreed
there was a traffic issue at Port Avenue but he didn’t think the city would want to install a light or
roundabout because of some of the load limits of some of the large vehicles that traveled that area.

Bardarsonthought it was still prudent to have a conversation with Department of
Transportation to determine the challenges with such a project.Keil wondered how trucks traveled
through Anchorage with roundabouts.
Squiresasked about the downtown bathroom closure.Hunt didn’t know if it was currently
opened or closed.

As agreed upon by Resolution 2017-044, my last day of work as the City Clerk for the City of
Seward is October 9, 2017.
Brenda Ballou will be in Acting City Clerk status beginning Tuesday,October 10, 2017 until a
formal appointment by the City Council is made.
Brenda has the same authority vested as the City Clerk, and can sign and attest during this time until
the City Council deems otherwise.

Subj: 2017 Records Destruction
Council,
On September 28, 2017, the City Clerk’s Office conducted an authorized records destruction of
city records. Past software issues have caused this annual process to be delayed, but I am happy
to report we are back on track and purged a large amount of city records that, under the council
approved Records Retention Schedule, were due for destruction.
With the help of staff from many departments, 345 boxes were hauled up from the basement of
City Hall. Despite the heavy rains, crews went above and beyond to help us with a task that
alone would have taken us all day to complete. I would like to extend many thanks to Parks and
Recreation, MIS, Public Works and the Harbor Departments for their assistance, and to Deputy
City Clerk Brenda Ballou for the many hours put into and taking the lead on this project.
Shred Alaska conducted the destruction, shredding almost 9,000 pounds of paperwork.
