ORDINANCE 2017-012
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE CHAPTERS 2, 7, 8, AND
15 RELATING TO CAMPING REGULATIONS
WHEREAS, regulation of public and private camping is addressed in several sections of
the Seward City Code; and
WHEREAS, it is desirable to make all camping ordinances throughout the Seward City
Code consistent with one another; and
WHEREAS, it is desirable to amend the camping ordinances for public campgrounds to
clarify fees for public campgrounds and to assist park staff with enforcing ordinances, including
fee collection; and
WHEREAS, Alaska Statutes 18.35 and the regulations adopted in 18 AAC 30.400-.470
establish minimum standards of health and sanitation for the protection of the public health and
welfare in campgrounds; and
WHEREAS, purposes of the camping regulations are to protect the public's health,
safety and general welfare, prevent overcrowding and unsanitary conditions in the City, to
provide a wholesome community environment, adequate public services, to conserve natural
resources, and to provide clean, safe and attractive recreational and tourist facilities; and
WHEREAS, in addition to several work sessions, the Planning and Zoning Commission
held a public hearing and recommended City Council approval of the proposed City Code
amendments at its April 3, 2018 meeting.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Seward City Code Sections 2.25.065 and 2.25.125 are hereby amended to
read as follows (Strikeout=deletions, bold italics underline=additions):
2.25.065. - Harbor department—Powers and duties.
The harbor department shall:
(1) Formulate, recommend and administer policies and procedures pertaining to the
operation of the Seward harbor and its facilities;

(2) Collect harbor fees and charges and maintain such records as are necessary for the
fulfillment of the department function;
(3) Provide for the enforcement of all city regulations pertaining to the harbor;
facilities;
(5)al Provide other services and duties as directed by the city manager.
2.25.125.-Parks and recreation department—Powers and duties.
The Parks and Recreation Department shall:
(1) Organize various recreational programs for individuals of all ages within the City;
(2) Coordinate recreational activities and programs with the Kenai Peninsula Borough
Community Schools programs and other local recreational entities;
(3) Maintain City recreational facilities;
(4) Provide for the operation, maintenance and collection of fees for the city camping
facilities;
(4)L.51 Provide other services and duties as directed by the City Manager.
Section 2. Seward City Code Section 7.15 – Campgrounds, Parks, and Open Spaces is
hereby amended to read as follows (Stpikeent=deletions, bold italics= additions):
7.15.010. -C ,
7.15.010. Camping, municipal.
(a) No camping, other than as specified in section 5.15.510 15.10.226, shall be allowed within
the City limits except in areas designated as municipal campgrounds by resolution of the
City Council or in private camper parks operating under a permit. "Municipal
campgrounds" means campgrounds owned or operated by the City and designated as
public campgrounds by resolution of the City Council. Fees for camping in designated
pnblie municipal campgrounds shall be set by resolution of the City Council. Camping on
private land is subject to Chapter 8.15 and Title 15.10.

Disabled and/or senior citizens age 62 and over may camp for extended periods of time
provided that they first obtain a special permit and monthly pass from the City Parks and
Recreation Department. Tents or structures of plastic sheeting, canvas or similar
materials are not eligible for monthly passes or special permits.
(c) Persons camping Campers must be housed in a camping unit. • -. •• : . ' . _. .

(d) Camping in designated public municipal campgrounds shall be allowed between April 15
and September 30 each year, provided, however, that the City Manager may delay modify
the opening of municipal campgrounds until such time as staffing and weather conditions
permit such use. In no event shall camping by one party be allowed for more than 14
consecutive days in one designated municipal campground for a maximum of 28 days,
except as noted in (b). Except for those areas opened for camping by resolution of the
council or stated in subsection (e) below, all public municipal campgrounds shall be closed
to camping beginning October 1 through April 14, annually.

Such Citations or complaints by authorized personnel shall include a complete description
of the violation and any contact between the violator and parks staff.
7.15.020. - Municipal campgrounds, registration and permits.
Municipal campgrounds are designated as self--registration fee areas. Unless otherwise
posted, persons camping Campers shall self-register and pay the established fees as posted
before occupying a campsite. A valid camping permit must be visibly displayed and attached to
all camping units at all times. Failure to self-register and pay the established fee shall result in
a fine of$50. If fine is paid within ten days, the fine shall be reduced to $25. For the purposes

Article 1. - General Provisions
8.15.110. -Definitions.
As used in this chapter the following terms are specifically defined as follows:
Addition. An enclosed structure of conventional construction, or a manufactured home unit,
attached to a mobile home.

Space. A defined land area in a mobile home or camper park on which a mobile home or
camping unit, • : - .• - , .. - may be placed and which is described by boundary
lines measured in terms of:
(1) Its depth expressed as a mean distance between the front and rear of the space,
measured in the general direction of the side space lines;

(2) Its width expressed as a mean distance between the side lines of the space, measured in
the general direction of the front and rear space lines.
Used/occupied. As applied to any land, buildings, mobile home, or camping unit travel
trailer ,er camper, the words "used" or "occupied" shall be construed to include the words
"intended, arranged or designed to be used or occupied."
8.15.115.- Location.
(a) Mobile home parks; and camper parks, require a conditional
use permit and administrative permit and are considered permitted allowed uses per the
Land Uses Allowed Table in Title 15. in R3 or AC districtJ, provided they are approved by
the Seward Planning and Zoning Commission after public hearing.
(b) Mobile home or camper spaces must be located a minimum of 75 feet from any permanent
residence building located outside the park unless separated therefrom by a barrier such as a
right-of-way or a fence or wall at least 36 inches in height.

8.15.120. -Mobile home park and camper park regulations—Applicability.
(a) All mobile home parks and camper parks within the city of Seward shall be constructed,
operated and maintained in accordance with the standards set forth in this chapter. It shall be
unlawful for any person to own or operate a mobile home or camper park which does not
meet the standards of this chapter.
(b) Nothing in this chapter shall be construed as prohibiting the placement of modular or
prefabricated homes in any district where other single-family dwellings are allowed,
provided the homes meet other applicable zoning, setback, and construction code
requirements of the city, Kenai Peninsula Borough and the state.
8.15.125. - Enforcement of chapter; violations and penalties.
(a) This chapter governing mobile home parks and camper parks shall be enforced by the city
fire chief and the city clerk.

(b) Whenever a violation occurs, any person may file with the city clerk a complaint in regard
thereto. All such complaints shall be properly recorded and immediately investigated by the
appropriate city official who shall report his findings to the city manager.
(c) For any and every violation of the provisions of this chapter, the owner, agent, contractor,
lessee, or tenant of any premises where such violations exist, or any other person who
commits, takes part or assists in such violations or who maintains any building or premises
in which any violation shall exist, may be assessed a penalty of not more than $300.00. Each
and every day that such violation continues shall be deemed a separate and distinct violation.
(d) Any structure which is in violation of the provisions of this chapter shall be and the same is
hereby declared to be unlawful and a public nuisance and the city manager shall, upon order
of the city council, commence lawful action to abate or remove such building, structure or
use or to restrain any violation of this chapter.
(e) All remedies provided for herein shall be cumulative and not exclusive.
(f) The issuance or granting of a building permit or approval of plans or specifications under the
authority of the building code shall not be deemed or construed to be a permit for or an
approval of any violation of any of the provisions of this chapter or any amendment thereto.
8.15.130. - Compliance with other laws.
Mobile home parks and camper parks shall be constructed, operated and maintained in
conformance with all applicable state and local statutes, ordinances or regulations.

8.15.140.- Fire prevention.
(a) Every mobile home park or camper park shall be equipped with fire extinguisher(s) as
determined by the Fire Chief.Fire extin'uisher(s) shall be accessible to the users of
mobile home park and camper park during all operational periods. a 15 pound carbon

(d) Containers for fuel to be used by mobile home, travel trailer or occupants shall be
connected in a leakproof leak proof manner to the stoves or heaters by copper or other
metallic tubing in accordance with manufacturer recommendation. approved—by—the

8.15.145.—Recreational vehicles and mobile homes outside of Municipal Campgrounds,
Camper Parks and Mobile Home Parks.

Article 2. - Permits
8.15.210.- Mobile home park and camper park annual permit required.

without first obtaining an annual permit in accordance with this chapter.
(b) The permit shall be issued by the city clerk after investigation and inspection by the city
eensttuetion building inspector and fire chief.
(c) The annual permit, along with a copy of this chapter, shall be posted in a conspicuous
location on the premises of the Mobile Home Park or Camper Park at all times.
(d) All mobile home parks, camper parks, or other trailer courts in existence in any area
annexed to the city in the future shall have ninety days subsequent to such annexation to
obtain a city permit.
(e) The city council may by ordinance restrict the total number of mobile home park permits
and camper park permits to be issued.

8.15.215.- Initial permit.
(a) An application for an annual mobile home park or camper park permit shall be submitted to
the city Clerk on a form provided by the City. The application shall include the following
information:
(1) The name and physical address of the Mobile Home Park or camper park;
(2) The name and mailinjz address of the applicant, indicating whether operator or owner;
(3) The name and mailing address of the owner if different from the applicant.
(b) The application shall be accompanied by a dimensional site plan at a scale of one inch to 20
feet showing the following:
(1) The specific layout of mobile home or camping unit spaces, camper or travel trailer
spaces setting forth the dimensions of each space;

8.15.410. - General Provisions.
(a) Camper parks may be established to provide temporary spaces and facilities te-campersbz

8.15.445.- Prohibitions generally.

rent or lease.
(b) No vehicle in a camper park may be rendered immobile except by the unhitching of a
separate towing vehicle, if any. Gamper Recreational vehicles may be temporarily tied
down only as required for the safety of the vehicle and the area. Removal of wheels,
addition of skirting, attachment of structures, kgs additions or foundations or any
other act evidencing permanency of occupancy shall not be permitted.
8.15.450. - Registration required.
The owner or operator of a camper park shall maintain a register containing the name and
mailing address of each person occupying the park, a license or identification number and
description of each vehicle occupying the park and the date of each arrival and departure on a
form approved by the city. This register shall be retained for at least three years, and shall be
available for inspection by the city at any time. No person who refuses to register may be granted
occupancy in the camper park -•-• _ . - • _ .
8.15.455. -Alaska landlord-tenant act inapplicable.
A camper park is not a mobile home park as set forth in AS 34.03.360(3). Structures and
mobile homes within the terms of AS 34.03.360(3) are not permitted in a camper park.

(i) Camping is allowed subject to the following:
(1)No Camping for a fee shall be allowed within the city limits only in municipal
campgrounds, as defined in section 7.15, or in private camper parks operating under a
permit, as defined in section 8.11
(2) Other than permitted camper parks, camping on privately owned lots as an accessory
use to an occupied, single family home is limited to private non-commercial use and for
no fee. Such occupancy shall be limited to one camping unit at a time and shall be for
recreational or vacationink purposes only. Camping as provided in this section shall not
occur earlier than April 15` and no later than September 30th
(i) Employee Campgrounds are allowed in accordance with table 15.10.226 of this chapter
subject to the following:
(1) Employee campgrounds are for established businesses with high seasonal employment
of transient workers, and are not to be construed as construction camps. No employee
campground may be open for more than 150 days per calendar year, and may not open
earlier than April 15, nor remain active later than September 30, except by resolution of
the city council based on specific findings that a longer term, earlier opening date and/or
later closing date is warranted because of special circumstances.
(2) Occupancy in an employee campground is limited to the transient workers of that
industry or business granted a conditional use permit and annual permit
(3) Garbage and refuse. The requirements of section 8.15.340 shall also apply to employee
campgrounds.
(4) Sanitary facilities shall include either permanent or portable toilets. If permanent
facilities are constructed, they shall conform to section 8.15.425(b). Shower facilities may
either be on-site in conformance with section 8.15.425(b), or provided on the job site of the
employer.
(5) The requirements for spacing shall be at least ten feet clear space between camping
units. Vehicles other than those being used for living accommodations shall not be parked
within the campground area proper.

Agenda Item: Amending Portions of Seward City Code Titles 2, 7,
8, and 15 to clarify campground uses, definitions, and requirements
BACKGROUND &JUSTIFICATION:
At the request of the public, Planning and Zoning Commission, and City Council, city staff has
completed a review of portions of the City Code relating to camping and campgrounds in the
City of Seward. Review of the camping code is currently a council approved priority of the
Planning and Zoning Commission. Camping and campgrounds are currently addressed within
Titles 2, 7, 8 and 15 of the City Code.
The Planning and Zoning Commission has held public work sessions to review and update
portions of the City Camping Code. Four work sessions were held on the following dates:
August 29 and September 19, 2017 and January 16 and February 6, 2018.
Upon review, staff determined it important to distinguish between public (municipal-run)
camping, private camping (as a business), and camping on privately owned lots (for no fee) and
to better clarify definitions and terms.
Specific additions, deletions or changes are explained as follows: (Proposed change is indented
and the staff explanation follows)

In their research, staff determined the role of providing for the operation, maintenance and

Department instead of the Parks and Recreation Department. It is recommended to correctly
place this duty under the Parks and Recreation Department's powers and duties.
Title 7.15— Campgrounds, Parks and Open Spaces
For clarity and to minimize confusion, staff recommends placing all terms related to public
(municipal) camping in this section, and to refer to city-run campgrounds as "municipal
campgrounds". Staff also requests to remove and replace the term "Camper" with "persons
camping" so there is no confusion if "camper" means a person or a camping unit. Parks and

Title 8.15— Trailers,Mobile Home Parks, Camper Parks and Camping
It is proposed to use Title 8.15 with regard to those intending to own and operate a private
camper park or mobile home park. For the purposes of this resolution staff did not review
portions of this code pertaining to mobile home parks.
Changes are proposed to clearly define camping units, camper parks, and recreational vehicles.
For Camper Parks, language regarding technical specifications have been either deleted or
simplified.
Articles 5 and 6, pertaining to Camping (generally and on privately owned lots) and Employee
Campgrounds were revised and moved to Title 15 under Planning Land Use Regulations as they
are not associated with camping for a fee(municipal or private).
Title 15.10—Seward Zoning Code
Proposed changes to Title 15 are to elaborate the definitions of campground, separating
municipal and private.
Articles 5 and 6 from Title 8.15 are moved to this section under Land Uses Allowed.
Language was developed to allow for private, temporary camping on privately owned lots for no
fee, as an accessory to a single family home. This allows residents to have out of town guest's
camp on their property, as it is currently not an allowed use.
The Land Uses Allowed table was amended to separate private and municipal camping and has
been added as Title 15.10.226 to better assist public searches on Municode.

WHEREAS, Micheley Kowalski, has applied for a Conditional Use Permit (CUP) to
construct a single family dwelling within the Central Business Zoning District(CBD); and
WHEREAS, the proposed single family home will be located on Lots 31-33, Block 15,
Original Townsite of Seward, located at 320 Third Avenue ; and
WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), detached

Commission that:
Section 1. In accordance with SCC § 15.10.320 (D), the Planning and Zoning Commission has
reviewed the applicant's request for a CUP to construct a single family home within the Central
Business Zoning District (CBD) 320 Third Avenue with a legal description of Lots 31-33, Block
15, Original Townsite of Seward, and made the following Findings of Fact:
1. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district
Finding: This condition has been established or shall be through the conditions.
The development and use, as proposed, are consistent with Seward City Code Land Uses
Allowed Table in 15.10.225. The property is located within the Central Business Zoning
District (CBD). Single family structures are allowed in the Central Business District by
Conditional Use Permit.
2. The value of adjoining property will not be significantly impaired
Finding: This condition has been established or shall be through the conditions.
There is no indication the requested single-family structure will negatively impact the
value of any of adjoining properties. The neighboring parcels contain a variety of
residential and commercial uses.

3. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: This Condition has been met.
There is an identified community need for all types of housing in Seward. The proposed
development is consistent with the Seward Comprehensive and Strategic Plans.

3.2.1 Promote residential and commercial development within the city of Seward and its
vicinity in accordance with community values (page 13).
3.2.1.2 Expand the opportunity for affordable, diverse, year-round housing through

Strategic Plan (1999)
The Strategic Plan encourages the expansion and availability of affordable, diverse, year-

The Strategic Plan promotes residential and commercial development inside the City
(page 9).

4. Public Services and facilities are adequate to serve the proposed use.
Finding: This condition has been established or shall be through the conditions.
Water, sewer, and power are available to the property. Adequate fire,police and solid
waste disposal services are available to the property. City code also requires that every
building or building site within the City must provide containers suitable for refuse
collection (SCC 14.05). All construction waste and debris must be removed weekly and
upon completion of construction.
5. The proposed use will not be harmful to the public safety, health or welfare.
Finding: This condition has been established or shall be through the conditions.
Based on Code, two parking spaces are required "per dwelling unit." Although within
the Central Business District no on-site parking is required for commercial uses, the
applicant has indicated two (2) on-site parking spaces are available. The construction
shall meet all current building and fire code requirements and be reviewed through the
building permit process. Adequate fire and police services are available to the property.
6. Any and all specific conditions deemed necessary by the commission to fulfill the
above-mentioned conditions shall be met by the applicant These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be subject to the

following conditions:
1. Construction waste and debris if any shall be removed weekly and upon
completion of construction project.
2. The applicant shall continue to work with City staff through the building permit

issued.
3. The Planning and Zoning Commission may modify this conditional use permit if
changed uses no longer conform to the standards and legal requirements justifying
its present approval, or if the permittee applies for a modification to meet a
different development plan that conforms to the standards and legal requirements
for approval of a conditional use permit.
4. Any proposed modification plan shall be subject to the public notice and public
hearing requirements of law, which shall occur only after payment of the filing
fee established by resolution of the city council.
Section 2. The Planning and Zoning Commission finds the proposed use, subject to the
above conditions, satisfies the criteria for granting a conditional use permit provided the
conditions listed in Section 1, Subsection 6 are met by the applicant, and authorizes the
administration to issue a conditional use permit to Micheley Kowalski to construct a single-
family home within the Central Business Zoning District at 320 Third Avenue.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320;
Conditional Use Permits, and authorizes the administration to issue a conditional use permit.
Additionally, the administration shall periodically confirm the use conforms to the standards of
its approval.
Section 4. This resolution shall take effect 10 days following its adoption.

BACKGROUND &JUSTIFICATION:
Applicant Micheley Kowalski as has submitted an application for a Conditional Use Permit to
construct a single-family, detached dwelling unit on Lots 31-33, Block 15, within the Original
Townsite of Seward, located at 320 Third Avenue; within the Central Business Zoning District.
The Central Business Zoning District provides for an area of convenient, attractive, concentrated
commercial development primarily intended for retail, financial, entertainment and professional
services occurring within enclosed structures. Regulations applying to this zone are designed to
encourage a compact group of businesses of the type which are mutually beneficial and located
close enough together to encourage walk-in trade. In accordance with the Land Uses Allowed
Table(15.10.225), detached single-family homes are allowed within the Central Business Zoning
District (CBD)by Conditional Use Permit.
SURROUNDING LAND USE AND ZONING:
Lots 31-33, Block 15 consists of approximately 9,000 square feet. The current use of the
property includes the Resurrect Art Coffee House, with attached owner-occupied dwelling. The
neighboring property to the north is zoned Central Business District (CBD) and is currently used
as a commercial kayak guide outfit. Properties to the east, immediately across the alley, and the
parcel immediately to the south, are Central Business District (CBD), and are used as a church
and a single-family home. Properties across Third Avenue to the west are all zoned Central
Business District (CBD) and contain a mix of single-family homes and commercial uses. No
adverse impacts to adjoining properties or other properties in the neighborhood are anticipated.
Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is not
located in a special flood hazard area.
Utilities: The property is served by the existing public utilities and maintained streets. Existing
water, sewer and electric lines are located in the adjacent rights-of-way. The applicant stated that
they intend to connect this building to public utilities in adherence to Seward City Code. The
applicant has met with Community Development, Electric Department, and Building Department
staff throughout this application process to ensure that the building design and placement are
compliant with Code. The applicant stated that they will work with the Electric Department to
ensure that placement of the building meets utility easement requirements, as well as clearance
requirement for overhead service line.

Parking: Seward City Code 15.10.215 Parking, does not require permanently maintained off-
street parking in the Central Business or Harbor Commercial districts. In all other Zoning

requirement for on-site parking, and will be reviewed again during the building permit process.

DISTRICT
WHEREAS, Peter Toloff has applied for a Conditional Use Permit (CUP) to operate a
Motel and multi-family dwelling within the Central Business Zoning District (CBD); and
WHEREAS,the property is located on Lots 1-3, Block 11, Original Townsite of Seward,
physical address of 235 Third Avenue; and
WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), motels and
multi-family dwellings are allowed within the Central Business Zoning District (CBD) by
Conditional Use Permit (CUP); and
WHEREAS, in accordance with section 15.10.315 (h) (1), a use was legal and did not
require a Conditional Use Permit when it was initiated, but now requires a Conditional Use
Permit and shall be considered a legal conforming use and may continue to exist as a conditional
use subject to the provisions of this chapter and may be modified in accordance with section
15.10.320; and
WHEREAS, in accordance with section 15.10.320 (g)(4), Conditional Use Permits may
be transferred from one owner to another for the same use, but if there is a change in use on the
property, a new permit must be obtained; and
WHEREAS, having complied with the public notification process; April 3, 2018, the
Seward Planning and Zoning Commission held the required public hearing on the Conditional
Use Permit application; and
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC § 15.10.320 (D), the Planning and Zoning Commission has
reviewed the applicant's request for a CUP to operate a motel and multi-family dwelling within
the Central Business Zoning District (CBD) Lots 1-3, Block 11, Original Townsite of Seward,
physical address of 235 Third Avenue and made the following Findings of Fact:

1. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district.
Finding: This condition has been established or shall be through the conditions.
The property is zoned Central Business District, both motels and multi-family dwellings
are an allowed use with a Conditional Use Permit approval in this district according to
the Table of Allowed Uses SCC 15.10.225.
2. The value of adjoining property will not be significantly impaired
Finding: This condition has been established or shall be through the conditions. There is
no indication the use as a Motel or multi-family dwelling will negatively impact the
value of any of adjoining properties. The neighboring properties contain a variety of
residential and commercial uses. The nearby parcels are predominantly a mix of
businesses and single family homes.
3. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: This Condition has been met.
There is an identified community need for all types of housing in Seward. The proposed
development is consistent with the Seward Comprehensive and Strategic Plans.
Seward 2030 Comprehensive Plan (approved by Council,2017)
3.2.1 Promote residential and commercial development within the city of Seward and its
vicinity in accordance with community values (page 13).
3.2.1.2 Expand the opportunity for affordable, diverse, year-round housing through
appropriate land use regulations (Bullet 1).
• Support mixed commercial and residential uses in the Seward downtown
business district (Page 14).
Strategic Plan (1999)
The Strategic Plan promotes residential and commercial development inside the City
(page 9).
• Encourage construction of residential and seasonal housing at all market levels.
The Strategic Plan encourages the expansion and availability of affordable, diverse, year-
round housing (page 18).
• Seward has a wide range of housing alternatives to meet the varied needs of
Seward's long term and seasonal residents.
4. Public Services and facilities are adequate to serve the proposed use.
Finding: This condition has been established or shall be through the conditions.
Water, sewer, and power are available to the property. Adequate fire, police and solid
waste disposal services are available to the property. City code also requires that every
building or building site within the City must provide containers suitable for refuse
collection(SCC 14.05). All construction waste and debris must be removed weekly and

upon completion of construction.
5. The proposed use will not be harmful to the public safety, health or welfare.
Finding: This condition has been established or shall be through the conditions.
Based on Code, two parking spaces are required "per dwelling unit." Although within
the Central Business District no on-site parking is required for commercial uses, the
applicant has indicated three(3) on-site parking spaces are available. The construction
shall meet all current building and fire code requirements and be reviewed through the
building permit process. Adequate fire and police services are available to the property.
6. Any and all specific conditions deemed necessary by the commission to fulfill the
above-mentioned conditions shall be met by the applicant. These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be subject to the
following conditions:
1. Construction waste and debris if any shall be removed weekly and upon
completion of construction project.
2. The applicant shall work with City staff through the building permit process to
address and accomplish any required upgrades or modifications.
3. The applicant shall work with all City Utility Departments for any possible
upgrades to the water, sewer and/or electric utilities prior to a certificate of
occupancy being issued.
4. The Planning and Zoning Commission may modify this conditional use permit if
changed uses no longer conform to the standards and legal requirements justifying
its present approval, or if the permittee applies for a modification to meet a
different development plan that conforms to the standards and legal requirements
for approval of a conditional use permit.
5. Any proposed modification plan shall be subject to the public notice and public
hearing requirements of law, which shall occur only after payment of the filing
fee established by resolution of the city council.
Section 2. The Planning and Zoning Commission finds the proposed use, subject to the
above conditions, satisfies the criteria for granting a conditional use permit provided the
conditions listed in Section 1, Subsection 6 are met by the applicant, and authorizes the
administration to issue a conditional use permit to Peter and Jodi Toloff for the operation of a 9-
room motel and multifamily dwelling on Lots 1-3 Block 11, Original Townsite, at 235 Third
Avenue located in the Central Business Zoning District
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320;
Conditional Use Permits, and authorizes the administration to issue a conditional use permit.

Additionally, the administration shall periodically confirm the use conforms to the standards of
its approval.
Section 4. This resolution shall take effect 10 days following its adoption.

BACKGROUND & JUSTIFICATION:
Applicant Peter And Jodi Toloff have requested a Conditional Use Permit(CUP) to operation of
a 9-room motel and multifamily dwelling On Lots 1-3 Block 11, Original Townsite, this parcel is
approximately 9,147.6 square feet, located at 235 Third Avenue in the Central Business Zoning.
The applicant has indicated a mix of monthly, weekly and nightly rentals.
In accordance with the Land Uses Allowed Table (15.10.225), motel and multifamily dwellings
are allowed within the Central Business Zoning District (CBD)by Conditional Use Permit.
SURROUNDING LAND USE AND ZONING:
The Central Business Zoning District provides for an area of convenient, attractive, concentrated
commercial development primarily intended for retail, financial, entertainment and professional
services occurring within enclosed structures. Regulations applying to this zone are designed to
encourage a compact group of businesses of the type which are mutually beneficial and located
close enough together to encourage walk-in trade.
The current use of the property includes the Taroka Inn. The neighboring property across Third
Avenue to the East is zoned Central Business District (CBD) and is currently a restaurant that is
being renovated. The parcel across Adams Street to the North and the parcel immediately to the
south, are Central Business District (CBD), and are used as a church and a single-family home.
Properties to across the alley the West are Zoned single-family residential, and consist of single-
family homes.
There is no indication the development will negatively impact the value of any of adjoining
properties.
Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is not
located in a special flood hazard area.

Utilities: The property is served by the existing public utilities and maintained streets. Existing
water, sewer and electric lines are located in the adjacent rights-of-way. The applicant has met
with Community Development and Building Department staff throughout this application
process to ensure that the building is compliant with City Code.
Parking: Seward City Code§15.10.215 Parking, does not require permanently maintained off-
street parking in the Central Business or Harbor Commercial districts. In all other Zoning
districts, the code requires two parking spaces for each residential dwelling unit. The applicant
intends to provide tree (3) onsite parking spaces. The parking plan shall meet the Code
requirement for on-site parking, and will be reviewed again during the building permit process.

discussing land use requirements. Petersen stated that he did not support the creation of long term

Replat, from Reece Management (RM) to Auto Commercial (AC), and vacation of interior
utility easement
Wilde stated that the appIt put forward this Zoning amendment to bring their property into
conformance with the Future Land Use Plan. Wilde further stated that the request to vacate the
interior utility easement was due to a replat of Lot B1 that increased the Lot size and enveloped the
easement. When the replat of Lot B1 was finalized, utility easements were platted around the west
and north lot lines. The utility easement in question was permitted to GCI.GCI and City of Seward
utility staff were given notice of the request to vacate this utility easement and Planning staff
received no objection. GCI staff specifically stated in an email that they were not opposed to the
vacation of this utility easement.
Notice of public hearing being posted and published as required by law was noted and the
public hearing was opened.

Ecklund asked about a portion of a plat of Lot B1 that was included in the meeting packet, and
noted that an incomplete plat would not be accepted by the Kenai Peninsula Borough Platting
Commission. Wilde replied that a rezone application did not require a full plat and that this
portion of the plat was included for reference only.

2018-003 Resolution of the Seward Planning and Zoning Commission of the City of Seward,
Alaska, recommending City Council approval of the Cliff Addition Thomas Replat Number
Two, a re-subdivision of Lot 15A Block 6 Cliff Addition Thomas Replat, creating two Lots
known as Lot 15B and 16B
Notice of public hearing being posted and published as required by law was noted and the
public hearing was opened.
Charbons asked for clarification on the location'of the shed in the alley Right of Way.
Flemiked for clation that this platting action only requests the division of one Lot into
two, and asked about the lion of a trash receptacle shed located in front of the property.
Wilde stated at this platting ion will result in the subdivision of one Lot into two Lots that will
be similar in size to the originally platted Lots. Lot 15A is currently improved with a single-family
home,and the never created Lot 15B will be slightly larger in order to meet setback requirements for
the single-family how The preiiiinary plat shows two encroachments from the proposed Lot 15B
into the undeveloped altey right of way.The surveyor stated that the property owner could have the
temporary shed moved prior to final plat approval. The chain link fence that encroaches
approximately one foot into the same alleyway was constructed without a building permit,as Code
does not require building permits for fences less than seven feet. The encroachment will be allowed
to remain,but not improved upon or reconstructed once it is past its useable life.The proposed Lot
16B is undeveloped, except for a gravel driveway along its north Lot line. The creation of Lot 16B
will not result in any new encroachments or expand any nonconformity. To date, Community
Development has received no public comment on this platting action. City Staff have reviewed the
preliminary plat and have no objection,but have stated that they recommend that the property owner
install additional protection around the electric pedestal that is located near the proposed Lot line that
will separate Lots 15B and 16B.

Commissioners discussed scheduling a Work Session for April 3`d at 5:30 PM to review draft
Ordinances for Development Requirements and Camping Code.
Wilde asked Commissioners if,in instances where a Work Session is scheduled to take place
prior to a Regular Meeting,they would like her to advertise to the public that a Work Session
may be resumed immediately following the Regular Meeting.Commissioners approved that
by consensus.

A. Planning and Zoning "Did You Know"
Wilde told everyone that the Community Development office had recently been made aware of a few
address numbering discrepancies between the City, Borough and local businesses, resulting from
property owners obtaining or providing inaccurate information.Wilde stated that she was working to
correct these with all interested parties,and meant for this informational bulletin to remind everyone
that the most important reason for accurate address numbering is to aid emergency responders.

Charbonneau thanked Staff for the information packets provided to the Commission.

Fleming stated that she would encourage everyone to thank Margaret Anderson when they see her.
Fleming also thanked Staff for continuing their work on analysis of nightly lodging and housing
needs in Seward.
Ecklund stated that she appreciates the information that Staff provides, and thanks the Community
Development Department for the work they are taking on,but also cautions Staff against taking on
too much.

Brad Snowden,inside city,suggested that the Commission consider raising the maximum building
height, at least in the Central Business District, in response to the City of Seward's acquisition of a
ladder fire truck.

Ecklund reminded evoke that at this time the ladder truck is on the other side of the bay,and until
the ladder truck can be housed on this side of the bay the Commission will not be considering a
change to Unum building height. Ecklund further stated to follow up on her previous comment;
she is not coned with Staff analysis of nightly lodging in Seward, since that is something the
Commission has requested in the past. Ecklund was specifically concerned with the Community
Development Forum and the potential for Staff to spend time putting something together that may
receive little public participation.
Wilde responded that this Forum may come in the form of an online resource for the public.
