CITY OF SEWARD, ALASKA
RESOLUTION NO. 80-47
A RESOLUTION SUPPORTING THE ISSUANCE
OF A SECTION 404 PERMIT TO
KENAI LUMBER COMPANY
WHEREAS, in the opinion of the U.S. Army Corps of
Engineers, Kenai Lumber Company violated Section 404 of the
Clean Water Act by placing approximately 19,600 cubic yards of
fill material in a "wetland" area adjacent to Resurrection
Bay owned by the Alaska Railroad; and
WHEREAS, the U.S. Army Corps of Engineers, pursuant
to the provisions of 33CFR, Section 326.3, has requested
comments from the City of Seward on whether the activity to
date has created any significant adverse effects on the
public's interest within the City's area of expertise;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Seward, Alaska that:
Section 1. The alleged violations of Section 404
of the Clean Water Act by Kenai Lumber Company has not created
any adverse effects on the public interest,
Section 2. The failure to permit Kenai Lumber
Company to continue dumping the mill wastes could result in
closure of the mill which would have a significant adverse
effect on the public interest in Seward as nearly 40 jobs
would be lost with an annual payroll in excess of $1,000,000.

SEWARD, ALASKA, this 28th day of July, 1980.
