AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING THE SEWARD CITY CODE
TO ABOLISH THE COMMUNITY HOSPITAL BOARD
WHEREAS, pursuant to Chapter 16 of the Seward City Charter, the City of Seward (the
"City") has established the Community Hospital Board (the "Board") and delegated to the Board
powers to administer Seward General Hospital (the "Hospital"); and
WHEREAS, among the powers delegated to the Board are the powers to adopt and revise
a budget for the Hospital and to employ and supervise administrative staff for the Hospital; and
WHEREAS, due to a deficiency in revenues from operations and an imminent depletion of
the hospital's cash reserves and the fact that the number of qualified Board members had declined
to a number less than a quorum to conduct business, at its regular meeting of December 11, 1995,
the City Council enacted Ordinance No. 95-18, abolishing the hospital board and assuming its
powers under the Code and Charter's emergency ordinance provisions; and
WHEREAS, following enactment of Ordinance No. 95-18, the City Council appointed
Deputy City Manager Michael Yanez to act as the hospital's interim administrator until a qualified
operator could be found to assume operational control of the hospital; and
WHEREAS, under Yanez's direction, specific cuts in personnel and other costs have been
made to reduce the hospital's operating losses; and
WHEREAS, on January 2, 1996, acting as the hospital board, the City Council approved a
motion to begin negotiations with Providence Hospital to operate Seward General Hospital; and
WHEREAS, since it is the intent of the City Council to transfer operations of the hospital
to Providence or some other qualified operator as soon as negotiations and all other steps required
to effect such a transfer have been completed, the City Council wishes to continue to serve as the
hospital board during this interim period; and
WHEREAS, under the circumstances described above, the Council finds that it is in the
public interest to formally abolish the Board, with its duties devolving upon the Council and City
administration, who may continue to act to relieve the fiscal crisis at the Hospital;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Pursuant to Seward City Charter Section 3.6(a), the Community Hospital Board
is hereby abolished, and Seward City Code Sections 2.30.110 through 2.30.145 are hereby repealed.
Section 2. All powers and duties formerly performed by the Community Hospital Board
shall be performed by the Councilor City administration in accordance with the general assignment
of powers and duties to the Council and City administration under the Seward City Charter and
Code.
Section 3. This ordinance shall take effect ten days following passage and posting as
required by law.

22nd day of January, 1996.
