CITY OF SEWARD, ALASKA
RESOLUTION NO. 81-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, DECLARING THAT AN APPRAISAL
AND PUBLIC BID PROCEDURE FOR THE CONTRACTING
FOR OPERATION OF A PORTION OF THE MARINE
INDUSTRIAL TERMINAL IS INAPPROPRIATE AND NOT
IN THE BEST INTERESTS OF THE CITY OF SEWARD.
WHEREAS, the City of Seward has been attempting to attract a
Marine Industrial Terminal to Seward in order to create jobs and
stimulate the economy, and
WHEREAS, the City of Seward has leased certain lands to VECO
OFFSHORE, INC., for construction and operation of a marine con-
struction and repair facility, and
WHEREAS, the VECO-owned facilities will be adj acent to a
portion of the Public Port Facility to be constructed by the City
of Seward at the Marine Industrial Terminal in the vicinity of
the 4th of July Creek area on Resurrection Bay, and
WHEREAS, some of the facilities to be constructed by the
City of Seward will be utilized by members of the public who will
be customers of VECO OFFSHORE, INC., and
WHEREAS, VECO OFFSHORE, INC., has an interest in maintaining
the highest standards of operation and maintenance on those
portions of the Public Port Facility which will be utilized by
customers of VECO OFFSHORE, INC., and
WHEREAS, the City of Seward shares that same interest in
providing the highest level of maintenance and standards of
operation for the entire Public Port Facility, and
WHEREAS, VECO has offered to operate for the City of Seward
portions of the Public Port Facility to be constructed at the
Marine Industrial Terminal, and
WHEREAS, under the terms of the proposed agreement, VECO
OFFSHORE, INC., will pay to the City of Seward a percentage of
all revenues generated by the operation of those facilities, and
WHEREAS, the pricing structure and rules and regulations for
operation of the Public Port Facility, including those portions
to be operated by VECO OFFSHORE, INC., are subject to approval by
the City Council, and by exercising such approval, the City
Council of the City of Seward can adequately protect the public
interest, and

WHEREAS, the public interest will be adequately protected by
such future action, and the conditions to be set forth in a
public tariff which will govern the operation of the VECO-operated
portion of the Public Port Facility, and
WHEREAS, the public will benefit from the efficient operation
of the Public Port Facility, which efficient operation will also
benefit tenants of the Marine Industrial Terminal, including VECO
OFFSHORE, INC., and
WHEREAS, the successful operation of the Public Port Facility
and the businesses located thereon will enhance the economy of
Seward by creating jobs and providing a stable employment climate,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Seward, Alaska, that;
section 1. The City of Seward hereby determines that solicit-
ing or obtaining a contract for the operation of a portion of the
Public Port Facility by way of sealed bid would not be in the
public interest for reasons cited above, and in accordance with
Seward Code section 2-92, the City Manager is authorized to
negotiate a contract for the operation of a portion of the Public
Port Facility to VECO OFFSHORE, INC., subject to final approval
by the City council.
section 2. The City of Seward hereby determines that an
appraisal of the value of the contract for operation of a portion
of the Public Port Facility would not serve the public interest,
and for the reasons set forth herein, and in accordance with
Seward Code section 2-87, an appraisal is determined not to be in
the public interest and that the public interest is adequately
protected by the terms of the proposed agreement.
PASSED AND APPROVED by the city Council of the City of
Seward, Alaska, this 27th day of July, 1981.
