While an attempt could be made to determine the number of cruise passengers that visit the Alaska Sea Life Center, a proper and reasonable allocation would need to be made based on actual data.To my knowledge this information has not been collected and, in my limited conversation with local business owners, the prevailing knowledge seems to be that perhaps 20%of their business is derived from cruise ship passengers. A February 2016 Legislative Audit requested by the Legislative Budget and Audit Committee criticized various entities for not using the funds for allowable purposes and indicated that while some of these entities had anecdotal evidence to support their claim, they had not developed a cost allocation methodology to support the use of CPV funding for various purposes.While the Alaska Sea Life Center is certainly a worthy attraction it may be difficult to argue that it provides a service to service to passengers of commercial vessels. In the event that the Sea Life Center is not eligible for federal or state financial assistance being rolled out as a result of the COVID19 pandemic or other sources, 1 believe it would be more appropriate to provide a loan at current low interest rates.The Sea Life Center is an important attraction for the City of Seward and enhances the community's ability to attract summer tourism. If approved by the Council, I will watch for near term maturities of time value investments and work with our attorney to draw up a loan agreement with the Sea Life Center not to exceed$350,000, However, it should be noted that the ability of the City to assist the Sea Life Center is limited. If the pandemic isn't resolved in the near term, Sales Tax revenue for fiscal year 2020 could be severely affected and the City may need to stretch it's reserves to maintain basic municipal operations. The City of Seward, through the electric department, is working with AEA and other agencies to create the backbone of this infrastructure throughout the major road system of the state. The particular element COS is working on is to add electric vehicle charging stations in the Seward area. Seward is a popular travel destination and, with the additional support, could offer additional services which could grow the economy of the area. COS has worked with outside sources for appropriate locations that will enhance the use of the new EV facilities as well as benefit the local businesses located in close proximity to the stations. COS worked with the local Chamber of Commerce and the Sealife Center on the site locations. Both entities are willing and capable to host a sight for the EV charging stations and the electric department has facilities nearby that can serve the power needs for these stations. The City of Seward is willing to contribute labor of their four man linemen crew as a grant match to the installation of the needed infrastructure to energize the stations. The City of Seward and the Electric Department appreciate the Alaska Energy Authority's proactive plan and we look forward to continuing to work with them and the other participants to fulfill this deficiency. Box 167 Telephone (907)224-4047 Seward,AK 99664 Facsimile (907) 224-4038 MANAGER'S REPORT April 7, 2020 The following purchase orders between $10,000 and $50,000 have been approved by the City Manager since the last council meeting: 3/30/2020 Parking Department $58,671.00 Craig Taylor ToolCat Replacement 4/07/2020 Teen Youth Center $170,000.00 Boys & Girls Club Comprehensive Youth Programs Services ADMINISTRATION • Alaska Municipal League conferences • JIC Meetings for Seward CV-19 • Inter-coordination between Seward Community Health Center and Providence Seward Medical Center HARBOR • The 50-ton lifts have picked up, and the harbor crew is still working through COVID-19 issues. • The 33- ton lifts have also picked up; several vessels have been placed back into the water and some have been taken out for maintenance. • All the water has been turned off for the winter; there are 4 year-round water locations in the harbor located at the F float trestle, at the end of F-float, the T-dock, on Z-float and fisherman's float located at SMIC. (Water will probably be turned on around May Is'.) • We are still working with ADF&G to replace the North East Boat Launch Ramp; funding is currently available through the same grant; looks like the Governor approved the funding at this point. • The harbor crew is continuing maintenance throughout the harbor. • The US Coast Guard contacted the harbor about location and designs for the new FRC, which will be located at SMIC, we are currently looking at 3 concepts. More information to come later. • The 2020 appraisal process is complete LESSEE'S have been contacted. • The Harbor has upgraded with the new software and are still running parallel to fix any issues. The harbor will be bringing a resolution to council with a Tariff change in early 2020. 10 • The harbolmaster is working on the 2022 Municipal Facility Grant to replace G, K and L-float, a few resolutions to follow for grant process. PUBLIC WORKS • The Lowell Point Road Storm Surge Damage Repair Project has been working on adding and compacting layers of subbase gravel to the south end of the road. They will be required to do compaction tests before adding the next layer to the subbase. They also received another barge load of rip-rap rocks today and will be working through the weekend to unload the barge and replace the rock. • Public Works departments are continuing to work on daily duties while taking care to practice required COVID-19 guidelines including the social distancing, disinfecting techniques, and hand washing protocols. -we will soon need more supplies of hand sanitizer, sanitizing wipes, masks, etc. • Water and Sewer crews continue with water line freeze-ups and turn-ons turn-offs around the City. They also are performing most duties and are continually testing and reporting to DEC to ensure the public water system stays safe and the public sewer system is operating to the levels on the permit. • Streets crews continue to maintain and grade gravel roads as they can. They are also clearing small rockslides daily to keep traffic moving. PARKS AND RECREATION In response to the Covid-19 situation, we have taken the following actions: • All municipal campgrounds ore closed to new visitors until May 1, 2020. • All programs and events ore cancelled until further notice. • In coordination with AVTEC, the gym (aka the Student Services Center) is closed to the public until further notice. Dates are subject to change based on the situation. Upcoming • Formulating plan to shift programming into the latter half of the summer season. COMMUNITY LIBRARY AND MUSEUM Team Work! All staff are working their full hours whether or not they're working remotely or in the building. Director Kingsland thanks her team for embracing the challenges of remote work, technology and their amazing dedication to the Library & Museum and our community! Here's what a day in the life of our staff work looks like: • Daily communications, meetings, trainings, technology problem-solving. • Researching: COVID-19 library/museum issues, library services, museum exhibits, online sources, digital collections and resources, disaster/emergency planning. • Virtual programming planning, development, production and marketing. • Library collection cataloging,processing and database cleanup and management projects. Yes, we continue to catalog new material so it can be ready for when we open! Technician, Evan Hinton, and Aide, Susan Moseman, do a great deal of work on these projects! • Maintaining and updating our webpage. Director Kingsland is also assisting with the City COVID-19 webpage. • Director Kingsland purchased Zoom for staff meetings, virtual programs and recordings, so keep on the lookout for updates. • And, much more... Museum • Curator Yanusz completed a 10-week online course: PRESERVATION 101: Preservation Basics for Paper and Media Collections through the Northeast Document Conservation Center. • We are also in the process of developing emergency and disaster preparedness policies and procedures. Curator Yanusz is using resources shared by professional museum organizations and Plan, an online disaster planning tool. • We anticipate setting up a new window display when we open and are planning a new temporary exhibit. • We are also investigating how to use Zoom to create a virtual tour of the Museum. 12 Library • ALL library loans have been extended to May 15, including those from other libraries. Call or email if your items are not due May 15th. It's okay to hang on to library material while we are closed. • ALL Seward item overdue fines will be forgiven through the end of April, which is our annual tradition for Library Amnesty Month. • Holds are also temporarily suspended, but not deleted. • The Alaska Digital Library (adl.overdrive.com) is available to our regular library card holders. If you have been blocked before, it has been temporarily lifted for all libraries to provide access. Call or email if you need assistance. We will be purchasing digital material and will post an online request form on our website, but you may also send your requests for digital eBooks and audiobooks to Director Kingsland at vkingsland2cityofseward.net. • Director Kingsland is also working on other digital resources, which will be added to our website as they are developed. Programs • First Virtual Story Time! Rainbows, with songs, rhymes, and puppets was recorded and distributed to our Story Time email list and has been viewed 17 times in the first 24 hours after distribution. More Virtual Story Times are in production to be released on a regular basis, and additional virtual programs are in planning phases - stay tuned! This survey was open from March 20t" to March 27tn and was completed by 721 businesses across the Borough. The individual responses of the survey are confidential, however the collective data will be used to identify the measurable impact this virus has had on our communities. Res 20-028 42 CITY OF SEWARD, ALASKA COVID-19 EMERGENCY ORDER 01 City Manager Scott Meszaros, in his capacity as the Director of Civil Defense and Disaster, hereby institutes the following revisions to City of Seward, Alaska's Temporary Emergency Rules and Procedures Regarding the COVID-19 Public Health Emergency ("Seward Emergency COVID-19 Rules"). These revisions become effective upon implementation by the City Manager and are necessary to protect the public health, welfare, and safety within the boundaries of the City of Seward. These rules and procedures may be identified as the "Emergency COVID-19 Rules" for ease of reference. These revised rules shall be posted on the City website and the City Clerk shall provide City Council members notice of these rules within five days of their adoption. City Council may repeal these rules in whole or in part via resolution. Except as otherwise provided in this revision, the Emergency COVID-19 Rules previously implemented by the City Manager remain in full force and effect. The revisions contained in this Emergency Order are bolded and underlined, with deletions stricken out. Rule 1. Electronic City Council Meetings. Any regular or special meetings of the City Council should be conducted via electronic means, including audio or video conference, unless the Mayor determines that a meeting must be conducted at City Hall and that doing so does not pose a risk to the public health, safety, and welfare. The City Clerk shall post telephone number(s) to call into telephonic or video conference meetings on the City of Seward website and on the written agenda for all regularly scheduled and special meetings. Council shall ensure that reasonable accommodations are made to afford the public a right to be heard telephonically. Telephonic participation by the public is not ideal but is reasonable when weighed against the substantial risk to public health, welfare, and safety posed by group gatherings during the COVID-19 outbreak. In the event the Mayor determines an in- person meeting is necessary and does not pose a risk to public health, welfare, and safety, no more than five members of the public shall enter the same space to make comments at one time. The public may also submit written public comments for all telephonic or video conference Council meetings. The public written comments shall be read into the record during the public comment period at all Council meetings held electronically, except Council work sessions. If written public comments exceed three minutes, the first three minutes of the written comment shall be read during the meeting. Written comments must include the name of the contributor in order to be read publicly during telephonic or video conference meetings. Current time limits placed on public comments and testimony shall apply to telephonic and written public comments submitted under this rule. The City must continue to comply with meeting attendance and scheduling requirements under the Seward City Charter Section 3.2. Rule 2. Council Meeting Notice and packet materials. The City Clerk shall provide the public and media notice that is reasonable under the circumstances for all emergency special meetings held by Council. All special meetings and agenda items shall be posted on the City website no less than six hours before a special meeting. Temp. Rule 3. Meetings of Boards and Commissions. The City Manager may cancel meetings of any board or commission if he finds that cancellation is necessary to protect public health, safety, and welfare. Any such cancellation shall automatically extend such deadlines for required actions by such board or commission as is specified in the cancellation notice. All board and commission meetings may be held electronically in the same manner proscribed for Council meetings in Rule 1. Rule 4. Suspension of all Non-essential meetings and agenda items. All non-essential government meetings shall be postponed until no earlier than April 24, 2020. Non-essential action items shall also be postponed until no earlier than April 24, 2020 unless doing so would pose substantial financial harm on the City or another party. Any person objecting to the postponement of an action item may notify the City Manager in writing regarding his or her objection. The City Manager shall review any written objections received and shall determine if the objection warrants consideration of an action item by Council or the appropriate commission or board before April 24, 2020. The City Manager shall notify the Mayor of all written objections received and his determination. Upon receipt of a written objection, the Mayor may override the City Manager's decision to postpone an action item. Rule 5. Licensed or Permitted Activities. The City Manager may suspend licenses or permits for special events or any other licenses or permits issued by the City which in the judgment of the City Manager could impact the public health or well-being of residents or visitors to the community. Rule 6. Purchases. The City Manager may authorize any purchase for which funds are available reasonably related to the emergency. Such purchases may be made without following each formal requirement of Title 6 of the Seward City Code. Rule 7. Personnel Policies. The City Manager may adjust any personnel policies related to leave time, other benefits or terms and conditions of employment as are reasonably related to providing sufficient staffing during the term of the emergency while protecting City employees and the community from COVID-19. Rule 8. Bargaining Units. The City Manager is hereby authorized to enter into such temporary agreements, including memoranda of understanding with the City's bargaining units in order to promote the provision of City services and the health and safety of the public and employees during the emergency. The City Manager may close City facilities or limit hours of operation as is reasonably required to protect the health of the public and employees of the City. Rule 10. The Harbormaster office and the Police Department dispatch window remain open to the public for service. City services and departments remain accessible to the public via telephone and email. Individuals may request appointments for in-person meetings with City staff, which will be accommodated if doing so will not jeopardize the health or safety of the community of Seward or its members. Rule 11. Private Facilities. The City Manager may require businesses and commercial enterprises operating within the City to close or limit operations if necessary to protect public health, welfare, and safety. The City Manager may only order such closures or impose limitations on private businesses and commercial enterprises when the State of Alaska formally recommends that such action be taken. Any action by the City Manager under this rule must be narrowly tailored to meet State of Alaska recommendations. Rule 11.1 Business COVID-19 Protection Measures and Protocols. All businesses operating within the City shall comply with all relevant State of Alaska Health Mandates. All businesses serving members of the public at a physical location within the City shall post "COVID-19 Protection Measures and Procedures" on all entrances to and exits from the business. The "COVID-19 Protection Measures and Procedures" shall include, at minimum: A. A brief statement identifying the essential service or critical infrastructure operation permitting the business to continue operations under the "State of Alaska Essential Business and Critical Infrastructure Workforce Order" B. The sanitation measures taken by the business to prevent the spread of COVID-19 B. The social distancing measures taken by the business to prevent the spread of COVID-19 C. The description of a process for obtaining goods or services from the business without entering the business, if such a process is at all feasible. D. A contact number for individuals to report any violations of these measures to the business owner or his or her designee. An example of COVID-19 Protection Measures and Procedures will be posted on the City website. A "business" for purposes of this rule does not include state, federal or municipal government operations or facilities. Temp. Businesses identified as "essential" or as "critical infrastructure workforce" under the State of Alaska Essential Business and Critical Workforce Infrastructure Order (State Health Mandate 12 Attachment A) shall submit all Protocols or plans required by State of Alaska Health Mandate to the City as soon as possible after filing these protocols or plans with the State of Alaska. Businesses shall also provide the City confirmation of the State's approval of its plan or protocol no more than five days after receiving such approval. In the event a business plan or protocol requires amendment or is rejected by the State, the business submitting that plan or protocol must notify the City no more than 48 hours after receiving the State's notification of deficiency. Businesses required to submit a State plan or protocol under this rule shall complete a "State Protocol Acknowledgement" form and submit that form to the City with its protocol or plan. Submissions under this rule should be submitted electronically to manager(d)-cityofseward.net. Businesses submitting a State plan and State Protocol Acknowledgement form under this rule are exempt from filing a mutual aid agreement under Rule 11.3. Rule 11.3 Mutual Aid Agreements. All businesses continuing to operate at a physical location within the City or on its waters with more than 25 employees must complete and file a Large Operator Mutual Aid Agreement with the City. This agreement will be available on the City's website. Submissions required under this rule shall be electronically submitted to manager(a-)-cityofseward.net. Businesses filing a State protocol or plan and State Protocol Acknowledgement form under Rule 11.2 are not required to file a mutual aid agreement under this rule. "Businesses" under this rule do not include state, federal or municipal government operations or facilities. Rule 12. Social Distancing. All individuals shall comply with all State of Alaska Health Mandates while located within the City and no person shall enter City boundaries for an activity or in a manner that violates any State of Alaska Health Mandate. The City reserves the right to enforce these rules and State health mandates to the maximum extent permitted under law. Rule 13-1-2. Amounts Due and Owing. The City Manager, upon the recommendation of the Finance Director, is hereby authorized to extend deadlines for payment related to any amounts due and owing to the City. Duration. These rules, as revised, are effective for 90 days from their date of implementation. Council may repeal any or all of these rules by resolution. No rule shall remain in effect for longer than is necessary to protect the public health, safety, and welfare from the emergency public health crisis caused by COVID-19. Both the City and Operator acknowledge that COVID-19 is a national pandemic that poses a substantial risk to public health, safety, and welfare within the City. The following written Citizen Comments were submitted in advance and read into the record by the City Clerk: Carol Griswold wrote, "If the new Parks and Rec Toolcat had not gone through the ice at Second Lake on January 7t1i, would Parks and Rec be asking for another new Toolcat now? According to the Resolution,insurance paid$46,890,minus the$10,000 deductible.But apparently the Toolcat wasn't totaled; it was repaired and is now in use at the Harbor. When did the Harbor request a Toolcat? I don't recall this going through the budget or Council process. In the interest of being very conservative with expenditures in these uncertain times, I would rather Council put the insurance money back in the Motor Pool or General Fund and give the repaired Toolcat back to Parks and Rec where it belongs. Let the Harbor make its case for a Toolcat separately through the budget process if necessary." 82 City of Seward,Alaska City Council Minutes March 23, 2020 Volume 41,Page x Michael Mahmood wrote, "I think that the city should not enter into agreement with the Financial Engineer Company to do an electrical rate study. I think they should put this out to bid." Bruce Jaffa wrote, "As a general note for our times I offer this comment. When no emergency exists it is often easy to assume money or effort for a future eventuality may not be needed. We often see this reticence in all disaster planning even, fire and police protection. When current expenditures work, there appears to be less need for them. At times of trial and stress, it is important to act smartly and deliberately. Now is that time.I speak in favor of Resolution 2020-004. Passing this resolution will allow an immediate implementation of other rule changes critical to fighting the current COVID-19 contagion. A "sunset provision" is included and should not be abused. I firmly support Resolution 2020-024 that continues planning for the Lowell Canyon Flood Diversion Feasibility Study. This resolution follows previous approvals of funding for this joint multi-agency effort. The feasibility study will provide for the best technical solution to the Lowell Canyon Diversion Tunnel. Voting for 2020-024 is forward thinking. Resolutions 2020-025 and 2020-026 provide extraordinary authority to the Manager to deal with an unprecedented public health dilemma. I fully support a strict interpretation of our Federal Constitution,the State and Local Laws that flow from it. I also understand tactics and in a battle there must be a unified control.Providing this power to the manager,who I take to be a good man,with the"sunset provision"and oversight of the Council is appropriate and necessary. I support the passage of these resolutions." Sarah Spanos wrote, "Please share with the Seward City Council that I would support the electric utility study to follow the proper procurement procedure and have this be put out for an RFP. Also,I would like to see the suspension of the seasonal electrical rate,slated for increase mid April, to be suspended indefinitely until the COV19 issue has passed." A representative from the Seward Community Health Center provided the following comments: Albi Tatum stated, "I'm a nurse and clinical supervisor at Seward Community Health Center,training officer and EMT 3 with Seward Volunteer ambulance and hometown Seward girl. I grew up in Seward, graduated from high school here, left for 20 years and almost two years ago my family and I finally moved home. Seward is and always will be my home. I wrote this previous to the Governor's Health Mandate Number 10,but it's still relevant.I come to you today as a healthcare provider, representing the Seward Community Health Center with the support of other health care entities in our community to desperately urge the local and state leaders to immediately issue a strict shelter in place order in addition to a strict statewide travel ban. It is our recommendation that in addition to limiting highway traffic to essential travel only as outlined by state officials with their strong advisory on Friday, that we also place the same limitations on our port ensuring that any vessels that come into the port are held to the same standards. Additionally, even those that fall under the Critical Workforce Infrastructure should be held to a very high standard with specific direction from the leadership on the expectations. For example, if a seafood processor,which does fall under that critical infrastructure,is continuing to bring people into the community because they fall under the critical workforce umbrella and they cannot abide by the recommended quarantine guidelines they should be forced to self-isolate as a company and restrict their employees from going anywhere except their facility and their housing. The following are excerpts from a letter by the Collective Physicians of Alaska which was sent to the Governor's office on March 21". They wrote: 83 City of Seward,Alaska City Council Minutes March 23, 2020 Volume 41,Page x "Data suggests that the majority of COVID19 infections are transferred from people who are asymptomatic.Until we build the testing capacity to test everyone in the state and everyone coming into the state and receive rapid results, the only solution to contain this outbreak is to institute an immediate non-essential travel ban and home quarantine. We thank you for the steps that you have already taken to restrict travel and encourage Alaskans to stay home, however, recommendations against non-essential travel, and for voluntary self-isolation and social distancing are insufficient. Due to the currently low number of reported cases, many Alaskans have not embraced the need for more stringent measures and are continuing to move around the state without regard for their potential to be affected or to be a carrier. This disregard has consequences which we have seen borne out in other regions. The death toll is rising in New York,medical systems are near collapse in Italy and our citizens continue to interact with large numbers of people for non-urgent causes. Our medical resources are finite and we are potentially a week away from New York and 2-3 weeks from Italy." City Manager Report. Scott Meszaros reported the following purchase orders between $5,000 and $30,000 had been approved by the City Manager since the last council meeting: None. Meszaros announced that the Deputy Fire Chief had been hired,the Human Resources officer had submitted his resignation,and that the Library's seasonal positions would not be filled right now. In response to Butts,Meszaros said all non-essential employees were working full-time from home, and essential employees were working full-time from their offices, including the police department and all department heads. All city travel had been cancelled. Employees who were working from home may be tasked with helping out in different areas. Not all employees owned computers at home,and the city was not connecting personally-owned devices to the city's systems. In response to Butts, Meszaros said the city had activated a virtual Emergency Operations Center(EOC). In response to Baclaan, Meszaros confirmed the personnel officer was leaving. Baclaan wondered if outsourcing that position would be feasible.Meszaros said he would have to review the duties of the position and determine whether it could be handled in that way. Terry suggested speaking to the Alaska Municipal League(AML)about outsourcing Human Resources.In response to McClure,Meszaros said the seasonal positions had started to be advertised,but it was difficult to know right now how they would be interviewed, and even if they would be needed. In response to Baclaan,Meszaros said he would like to have council direction on whether or not to issue a shelter-in-place mandate. Meszaros said the city was trying to be proactive with the measures it was taking. Baclaan asked if the seasonal electric rate could be addressed, and wondered if perhaps the seasonal summer rate could be suspended.He wondered what the potential impact would be. Seese, McClure,and Terry suggested the summer rate increase could be delayed.Electric Utility Manager John Foutz cautioned council about cutting the summer rate because of the impact it would have on the city's revenues. Terry reiterated Baclaan's original request of examining what the potential impact would be. Meszaros stated that other communities were planning to forgive late fees and interest, but were not planning to reduce the actual rates. Baclaan appreciated the city manager's input,but said he would like to see what the potential impact would be;he was bringing this forward at the wish of the public who had contacted him. Council directed the city manager to look at the impact of not instituting the seasonal summer rate for 30 days and 60 days by Friday this week. Terry wished to impose a "Hunker Down" order, similar to the one put in place for Anchorage which was in effect until March 31, 2020. Crites and Baclaan concurred. 85 City of Seward,Alaska City Council Minutes March 23, 2020 Volume 41,Page x Motion (Terry/Crites) Establish an emergency "Hunker Down" order for the City of Seward modeled after the Municipality of Anchorage, going into effect March 25, 2020 at 5:00 p.m. and ending April 24,2020 at 5:00 p.m. Butts thought the city was complying with the governor's mandates,and was concerned that if the city imposed additional restrictions,the city would potentially be held accountable to provide financial relief to businesses in the future.Baclaan agreed that the city was already complying,but he thought it would be beneficial if the city's Hunker Down was released as a guideline, not an enforceable mandate. McClure thought Seward had already complied with the state mandates for non-essential closures. Meszaros said he would accept council's direction to impose a Shelter-In- Place for Seward because it would be in keeping with the governor's mandates. Motion Failed Yes: Baclaan, Crites, Terry No: Butts,McClure, Osenga, Seese Terry said the Alaska SeaLife Center (ASLC) had submitted a letter requesting some financial relief,the city owned the building.Meszaros said this was the time of year for the ASLC to start earning revenues, but because of the situation that couldn't happen. He said they had reserve funds, but they had requested to delay payments on their electric bill; he added the city was not charging late fees. Meszaros said the ASLC had requested to use Commercial Passenger Vessel (CPV)funds,but he would be more comfortable having the finance director deliberate that request. Baclaan believed the ASLC was an integral part of the fabric of Seward. Baclaan was torn because he wished the ASLC would diversify their revenue streams more,but he also wanted to help them;he requested to see their plan to remedy their financial hardship situation long-term. Seese said the ASLC was not the only business in town that needed help. McClure wondered if using Commercial Passenger Vessel(CPV)funds to help the ASLC would be allowable. Terry stated that council had a general consensus that they would like to see how the ASLC planned to address the shortfall in the future,and to look at potential funding sources,including CPV,if possible. Meszaros said he would investigate and bring something back for council's consideration. City Attorney Report.Holly Wells reported that the firm had spent 20 hours on personnel issues, costing $14,000, and 32 hours on other legal work. The city's insurance policy required attorney involvement for any proposed termination,which was part of the reason why the firm had spent so many hours. In addition, Wells' firm had been preparing memos and updates for all communities related to upcoming or proposed legislation, and would be sharing that at no charge to the city. Baclaan recalled that the city had three 30-minute sessions available for personnel consultation through the city's insurance firm,AML/JIA;he was concerned that there were so many personnel issues. Wells agreed that AML/JIA would be a good resource. 86 City of Seward,Alaska City Council Minutes March 23, 2020 Volume 41,Page x Other Reports and Announcements Chamber of Commerce Executive Director Jason Bickling joined the meeting telephonically. Chamber of Commerce Report. Jason Bickling said the chamber's concern, first and foremost, was for the health and well being of the community. He was immersed in trying to find resources for businesses and was advocating with legislators on behalf of the business owners. He was facilitating connecting business needs with available staff throughout the community.In keeping with Alaska Travel Industry Association (ATIA) guidelines, Bickling said the chamber had suspended marketing messages and replaced them with `find happiness at home' messages. In response to McClure,Bickling said he was preparing contingency plans for the Fourth of July Festival and the Mount Marathon Race, and was hoping not to have to cancel. Baclaan appreciated the chamber's efforts to help local businesses,and wondered what steps business owners needed to take to apply for Small Business Administration (SBA)loans. Bickling said the best advice was to apply as soon as possible to get in the queue;business owners could apply at www.sba.gov/disaster. In response to Seese, Bickling said the grant writing class was postponed for now, but the chamber was trying to find ways to teach future classes virtually, including using social media and Google. In response to Baclaan,Bickling said the chamber had decided to temporarily suspend filling the Marketing Director position; instead, the chamber had hired a contractor to help fill the gap. Terry noted that in the chamber report,it stated that local business owner Bob Candopoulos had submitted an application to be on the Alaska Economic Stabilization Team,and she wondered if the chamber would be supporting his application. In response, Bickling said the chamber would support him, and he would also welcome a letter of support from the city. Terry wished to have council send a support letter; council concurred. The city manager was directed to send a letter of support on behalf of the city. Presentations —None PUBLIC HEARINGS Ordinances for Public Hearing and Enactment Terry read the following passage into the record: Ordinances 20-002 and 20-003 are due to come for public hearing and enactment tonight, but will be postponed to a future meeting when it is safe for the public to appear and provide testimony, in keeping with CDC guidelines on COVID-19. 87 City of Seward,Alaska City Council Minutes March 23, 2020 Volume 41,Page x Emergency Ordinance for Enactment Emergency Ordinance 2020-004, Temporarily Authorizing The Suspension And/Or Modification Of Various Sections Of The Seward City Code And City Council Rules Of Procedures Manual Regarding Public Meetings And Participation In Order To Ensure The Health, Safety, And Welfare Of Our Community During The Public Health Emergency Caused By COVID-19. Motion (McClure/Osenga) Enact Emergency Ordinance 2020-004 Meszaros stated this emergency ordinance would be in effect for 60 days. In response to Baclaan, Meszaros said this was in response to the Governor's emergency declaration of March 11,2020. This ordinance would restrict public gatherings,cancel non-essential travel,and close public facilities in an effort to contain the spread of the Coronavirus.Meszaros said current events were changing very rapidly, even throughout the day, and he needed to be able to respond quickly during this crisis. Baclaan expressed concerns about the proposed process, and asked for more clarification. City Attorney Holly Wells said the city manager needed the latitude to make decisions quickly and effectively under the provisions outlined in the city's Emergency Operations Plan while under the COVID-19 emergency. Wells said the city's Charter required council to continue having its regularly-scheduled meetings. Wells added that, in the event two council members requested a special meeting, but the city manager and mayor overruled and denied their request, the council members would have the opportunity to bring something forward at the next regularly-scheduled council meeting. In response to Terry, Wells stated that these rules were already in place, and council was ratifying them tonight. If council objected,then council could bring forward a resolution to alter the rules. The vendor proposed to conduct this study had performed the last two rate studies for the Electric Utilities Department, and had been sole sourced because professional services were exempt from competitive procurement under city code, and also because they had past experience and knowledge of the city's system. McClure said she removed this from the consent agenda in response to public concern that this was sole sourced and that it was the same vendor who had done the previous rate studies. She wondered if there were alternative options for going out for a Request for Proposals (RFP). Seese concurred. Baclaan wondered how old this quote was, because it listed the services coming out of the 2020 and 2021 budget. In response,Foutz said this quote was from September 2019,for work to be done in 2020 and 2021. Foutz said that the frozen rates for 2020 needed to be analyzed,and then the rates for 2021 would have to be adjusted accordingly; this company would perform an analysis on what the impact of the 2020 rate freeze was. Baclaan was concerned that the analysis would be based on non-regular data,and wished to have the analysis performed on regular rate data;he suggested perhaps using 2018 through 2020 data to reflect two years' worth of regular rates plus one year of special rate data. In response to Seese,Foutz said previous rate studies had not gone out to RFP before. Meszaros said he had pushed the Electric Utility Department to correct the rates for the city's four largest industrial users. Foutz recommended that previous years not be included in the study because they were already covered under audit conditions; rate studies used previous findings to project future rates. Butts thought this resolution needed to wait until the economy stabilized, and with an RFP. Osenga wondered what the results would be if this study was delayed. Foutz said in 2009, the city had an industrial rate class in addition to the three it currently has; it was abolished because it was considered ineffective because the rates were so low.In response to his largest customers asking for financial assistance,Foutz approached the contractor to look at what re-establishing an industrial rate class would look like; this would impact three customers. Terry wished to see an RFP that included an examination of the city's current rates,a review of the city's current classifications, including the potential of re-establishing an industrial rate, as well as an efficiency study of the Electric Utility structure from a revenue and expense standpoint. Terry thought the study could be conducted without requiring the vendor to travel to Seward. Osenga thought the city should be trying to fix the industrial rate as quickly as possible. Seese wondered if residents would get a break on their bill if an industrial rate was re-established. In response to Terry,Meszaros said the situation was difficult because the city needed to charge enough to make money without overcharging the customers. Motion (McClure/Osenga) Approve Resolution 2020-023 Meszaros said the Toolcat owned by the Parks & Recreation Department had sunk in First Lake earlier this year; it was retrieved, but the insurance company said it was totaled and paid the city$46,890 for the loss. The insurance company didn't want to haul it off,so they offered the city to buy it for $500; the Harbor Department purchased the recovered Toolcat for $500. Harbormaster Norm Regis said the Toolcat was running, but not fixed; he had spent approximately $4,000 to get it running so far, and there were more items that needed to be fixed. Once it was fixed and operational, Regis said the Toolcat would be used for sweeping and snow removal. In response to Seese,Regis confirmed that the cost of repair would come from his budget. In response to Baclaan,Meszaros said the Parks&Recreation Department used their Toolcat for sweeping sidewalks and snow removal. In response to Butts, Regis confirmed that all the accessories were interchangeable between all the city-owned Toolcats. Baclaan wondered if this purchase was absolutely necessary,under the current situation of the city's state of emergency. In response, Regis said the order would take 2-3 months to come in, and the city would have to be able sweep parking lots and sidewalks. Motion Passed Unanimous Resolution 2020-025, Ratifying Temporary Emergency Operation Rules And Procedures Implemented By The City Manager In Response To The Public Health Emergency Caused By COVID-19. Motion (McClure/Seese) Approve Resolution 2020-025 Terry stated that she had removed this resolution and the next from the consent agenda because she wanted to make sure there was an opportunity for a clear explanation of why these were necessary; she appreciated the city manager bringing them in a timely manner. I can tell you right now that Seward cannot handle even half of those if they all come at once. As of today at 1:00 p.m.we currently have one confirmed case of COVID-19 in Seward. The capacity to testis severely limited at this time locally, statewide and nationwide which translates to we don't know how many cases there currently are in our community. There is ongoing community collaboration occurring officially 3 times per week and multiple times daily at the healthcare level to continue our efforts to keep our community healthy and prepare for what is inevitably coming next. We at the healthcare level are doing all that we can do at this point. So now to the personal level of all of this. Every citizen has a critical part to play in how this pans out for us both nationally and locally. If our healthcare system fails, part of that is on each person in our city, state and nation. I have noticed some drastic changes over the past week and I appreciate the changes that have been made thus far but I fear they will not be enough. If you want to understand the gravity of this situation ponder this for a moment,the United States has one of the most robust and advanced healthcare systems in the world...all we have right now to combat this is STAY HOME. That's it. That is all we can do at this point. That is how serious this is. This is an unknown and invisible enemy. We're not asking people to go out and fight we're asking people to stay home, severely limit who you come into contact with, and strictly quarantine even if you have only mild symptoms. Only go to the store if you absolutely have to, only go to the post office if you MUST and limit the number of times a week you do this. ERRORS IN THE NOTICE OF VIOLATION The Notice of Violation has at least two (2) factual errors which are discussed below. The actual facts and the NOV errors are as follows: 1) The bartender was the only staff person on premises. However, he never directly served alcohol to Mr. Lewis. 2) Julie Kim, a friend of Mr. Lewis, purchased a drink at 11:15 p.m. and delivered it to Mr. Lewis. 3) Subsequently Mr. Simon Swiderski purchased another drink at 11:25 p.m. which he apparently delivered to Mr. Lewis. 4) Two more drinks were purchased by Julie Kim and apparently delivered to Mr. Lewis at 11: 36 and 11:57 p.m. Because others purchased the alcohol and gave it to Mr. Lewis the bartender did not have the opportunity to observe him when the alcohol was purchased, The second error is the statement in the NOV that a "At no time does it appear that staff cut Lewis off or told him to leave the bar." i 124 l) In fact, at 12:07 (some 50 minutes after Mr. Lewis entered the premises) the bartender told Mr. Lewis's friends that he (Mr. Lewis) "needs to go home" and offered to call a cab to take him home. 2) Mr. Lewis's friends told the bartender that they had already called a cab and it was on its way. 3) The cab arrived at 12:19 a.m. and his friends escorted Mr. Lewis out of the bar and into the cab. RESPONSE TO THREE (3) STATUTORY REFERENCES IN THE NOV 1) The NOV alleges a violation of AS O4.16.140 which states: "A drunken person may not knowingly enter or remain on premises licensed under this title." This provision applies to Mr. Lewis, but the conduct of the bartender is also in question in the NOV, so it is relevant to this matter. Note the "knowingly" qualifier to this provision. The bartender did not "knowingly allow" Mr. Lewis to enter or to remain on the premises because initially Mr. Lewis appeared sober and when his intoxication became apparent, the bartender told Mr. Lewis's friends that he needed to go home. 2) The NOV further alleges-a violation of AS O4.16.030 (a) which states: "A licensee, an agent or employee may not with criminal negligence (1) sell, give or barter alcoholic beverages to a drunken person; (2) allow another person to sell, give or barter an alcoholic beverage to a drunken person within licensed premises; (3) allow a drunken person to enter and remain within licensed premises or to consume an alcoholic beve3rage within licensed premise: (4) permit a drunken person to sell or serve alcoholic beverages". Alaska Statute AS 11.81.900 defines criminal negligence as follows: (a) (4) a person acts with "criminal negligence" with respect to a result or to a circumstance described by a provision of law defining an offense when the person fails to perceive a substantial and unjustifiable risk that the result will occur or that the circumstance exists; the risk must be of such a nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation. __ _There:is no.evidence.of-a:"gross--deviation"from-the-standard-of-care-that a reasonable person would observe in the situation. As noted in the NOV, Mr. Lewis did not, on his entry to the premises, "display conduct of a drunken person. 2 125 3) Finally, the NOV cites AS O4,21.030. Responsibility of Licensees, agents and employees. The Licensee was not on the premises at the same time that Mr. Lewis was on the premises The standard applicable to licensee's is ...to exercise that degree of care that a reasonable person would observe to ensure that a business under the person's control is lawfully conducted". Subsection (1) of AS O4.21.030 defines the licensee's duty to ...ensure the compliance by agents or employees with this title and regulations adopted under this title." d This subsection imposes a "reasonable diligence standard". The is no evidence that the Licensee violated this standard in any away whatsoever. The bartender on duty was TAPS trained and performed as expected in the circumstances of this matter. NO_ACTION SHOULD BE;TAKEN AGAINST THE BARTENDER OR THE LICENSEE We concur with the statement in the NOV that when Mr. Lewis entered the licensed premises he "did not display conduct of a drunken person." Like many heavy drinkers, Mr. Lewis was able to maintain the appearance of sobriety when most people could not maintain that appearance. When Mr. Lewis arrived at the bar at approximately 11:00 p.m., the on premises video clearly demonstrates that Mr. Lewis did not appear drunk. As the NOV states Mr. Lewis"did not display conduct of a drunken person" when he entered the premises. Subsequently, according to the on premises video and as stated in the NOV, Mr. Lewis succumbed to the effects of the alcohol that he consumed on premises (and, apparently at other bars). A short 52 minutes after Mr. Lewis entered the premises, in an apparently sober condition, the bartender observed Mr. Lewis's intoxicated condition and took action to have Mr. Lewis taken off premises and driven home in a cab. Subsequently, Mr. Lewis was apparently injured after being taken home. When he was discovered the next morning there was a large gash on his head and he had vomited all over himself. In short, when Mr. Lewis entered the premises the bartender observed what the __ ._. ... house video„depicted_- a.pez-sonMwho was.not:visibly..intox cated-when-he-came on premises. Within a short period of time (52 minutes), it became apparent to the bartender that Mr. Lewis was intoxicated. At that time, the bartender told Mr. Lewis's friends that Mr. Lewis would have to leave the premises and offered 3 126 to call a cab. The bartender was advised by Mr. Lewis's that they had already called a cab. CONCLUSION In conclusion, there is no evidence to support an accusation that Mr. Lewis was allowed to remain on premises once his drunken condition was observed.
