Planning and Zoning Commission -Work Session September 15, 2020 6:00 PM City Council Chambers Topic:Discussion of a Walkable Mural application and Title 15 Lodging PUBLIC NOTICE TEMPORARY PROCESS FOR CITIZEN COMMENTS & PUBLIC PARTICIPATION AT THE September 15, 2020 SEWARD PLANNING AND ZONINIG COMMISSION WORK SESSION The Seward Planning and Zoning Commission will hold a Virtual Work Session on Tuesday, September 15, 2020 at 6:00 PM in City Council Chambers. Because the City of Seward is currently experiencing a declared public health emergency due to Coronavirus Disease 2019 COVID- 19), alternate methods for providing Citizen Comments and Public Participation have been created: How to Attend the Work Session in person: Due to the size of the Council Chambers and the required social distancing no more than 5 members of the community can be in the room at one time with the commission. If there are more people interested in attending in person groups of 5 will be rotated in from distanced waiting stations in the hall. • Participants will be required to wear a face covering during the meeting. • Participants will be required to use provided hand sanitizer on entry to Council chambers • Participants will be required to sign in, and have their temperature taken upon entry How To Virtually Attend The Meeting 1. How To Submit Your CITIZEN COMMENTS 1. Email your written Citizen Comments to planningOcityofseward.net no later than 2:00 p.m. on Tuesday, September 15, 2020. Identify whether you want your comments READ ALOUD at the meeting or EMAILED to the commission upon receipt. Comments requested to be read aloud will be delivered verbally to council by the Planner at the appropriate time during the meeting. In response to your email, you should expect to receive a verification email from the Planner—if you do not receive this email, please call the Planner at 224-4020. 2. If you wish to be called on the telephone during the meeting to provide your comments telephonically, send an email request to the Planner along with your contact information to plan ningO-citvofseward.net, including your full name and the telephone number you wish to have called. The Planner must receive your request no later than 2:00 p.m. on September 15, 2020. Identify whether you wish to be called during the TELEPHONE citizen comment period. Applications without the above attachments will not be approved. Maintenance and Permit Holder Agreement 1. Walkable Mural/Crosswalk permit holders are responsible for installing and maintaining the art within the crosswalk and understands that the City will not maintain the artwork, and will not replace artwork if the crosswalk fades, is damaged, or is not adequately maintained.Approved permits are valid for 3 years. 2. Walkable Mural/Crosswalk permit holders understand that roads are subject to repaving and maintenance at any time and that City will not be held responsible for replacing the artwork shall this occur. 3. At the program's discretion, additional permittee responsibilities may be stated on the Working in the Right of Way permit. 4. No modification shall be made to any crosswalk installation that was authorized by a Working in the Right of Way permit without prior approval from the Community Development and Public Works Director. 5. Failure to maintain approved Walkable Mural crosswalk will result deposit being forfeited and the crosswalk being returned to its prior condition upon repaving the street, or during regularly scheduled maintenance. 6. A traffic control plan and Working in the Right of Way permit must be permitted every time the Walkable Mural crosswalk requires maintenance. 7. Failure to adhere to these permitee responsibilities may result in the issuance of administrative citations,the removal of the crosswalk art, and revocation of the street occupancy. Indemnity Agreement As a condition of the permit requested,the permit holder agrees to defend, indemnify, reimburse and hold harmless City, its appointed and elected officials, agents and employees for,from and against all liabilities, claims,judgments, suits or demands for damages to persons or property arising out of, resulting from, or relating to the work performed under the permit("Claims"), unless such Claims have been specifically determined by the trier of fact to be the sole negligence or willful misconduct of the City. This indemnity shall be interpreted in the broadest possible manner to indemnify City for any acts or omissions of the holder of the permit or its subcontractors either passive or active, irrespective of fault, including City's concurrent negligence whether active or passive, except for the sole negligence or willful misconduct of City. (a) Surface. All streets within a mobile home park shall be surfaced with all-weather materials, such as gravel, cinders, asphalt, or concrete to a minimum surface width of 34 feet. (b) Right-of-way. Any street within a mobile home park that serves one hundred spaces or more shall be classified as a major street. Major streets shall have a minimum right-of-way width of 50 feet. All other streets shall have a minimum right-of-way width of 40 feet. Streets within mobile home parks are not required to be dedicated as public rights-of-way. (c) Cul-de-sac streets. No street within a mobile home park shall dead-end except for cul-de-sac streets which are no more than 650 feet in length and have a minimum turning radius of 50 feet at the termination point of the cul-de-sac. (d) Intersections. No street within a mobile home park shall extend more than 650 feet in length between street intersections. Intersecting streets shall cross at ninety-degree angles from an alignment point one hundred feet from the point of intersection. No street intersection shall be closer than 125 feet from any other street intersection. (e) Street frontage. Double frontage spaces are prohibited except that reverse frontage lots may back against streets bordering the mobile home park. (f) Street layout. Streets shall be laid out so that their use by through traffic will be discouraged. However, dead-end streets other than cul-de-sacs are not allowed. (g) Street grades. Street grades shall not exceed six percent. Street grades within one hundred feet of intersections shall not exceed four percent. (h) Street curves and visibility. The radius of street curves (between intersections) shall exceed 100 feet. Streets shall be constructed to provide clear visibility as measured along a centerline of the street for a minimum distance of 150 feet. (i) Drainage. All spaces and streets shall be designed to ensure roper drainage. All areas of the mobile home park shall be designed to prevent the accumulation of standing groundwater. (j) Crosswalks. Pedestrian crosswalks not less than ten feet in width may be required in blocks longer than 330 feet when deemed essential to provide reasonable circulation or access to schools, playgrounds, shopping centers, convenience establishments, service buildings or other community facilities. (k) Lighting. All streets shall be lighted at night in such a manner that illumination is equivalent to that provided on residential streets having medium-density traffic. (1) Walkways. Walkways not less than two feet wide shall be provided from spaces or lots to service buildings. The walkways shall have a stabilized surface, be well marked in the daytime and lighted at night. (Ord. 522, § 2 (part), 1984) 11.05.045-Crosswalks and safety zones.
