Historic Preservation Commission Article 4. Historic Preservation Commission 2.30.410 Established. (a) An historic preservation commission is hereby created, consisting of seven residents of the City of Seward or surrounding areas, who shall be appointed by the council. If there is more than one applicant for the position, the council shall appoint by ballot voting. Applicants must receive at least four votes in order to be appointed. No officer or employee of the city may be appointed a member of the commission. (b) To the extent available in the community, three commission members shall be professionals, as defined in Appendix A of 36CFR 61, from the disciplines of history, architecture or architectural history and archaeology. If the commissioners are not professionals in the disciplines of history, architecture or architectural history, and archaeology, then consultants in these disciplines will be appointed as consultants to the historic preservation commission. Consultant appointments shall be approved by the historic preservation commission and must be qualified under the standards defined in Appendix A of 36 CFR 61. (c) A chairman of the commission shall be selected annually by the appointed members. (Ord. 94-04; Ord. 2000-13, § 3, 2000) 2.30.415 Terms of office; filling vacancies. (a) Members of the historic preservation commission shall be appointed for a term of three years, provided that the terms of initial appointments shall be staggered so that as nearly as possible a pro rata number of members shall be appointed for each year. (b) The city council, may appoint any qualified person to fill a vacancy of any member of the board provided that the appointment shall be for the unexpired term of the vacancy. (c) Following a member's absence from three consecutive regular meetings of the commission, the remaining commission members shall decide whether the commission member should be retained or whether to request council appointment of a new member. (Ord. 94-04; Ord. 2000-13, § 3, 2000) 2.30.420 Meetings and quorum. (a) The commission will meet at least twice each year at a time and place to be designated by the commission. (b) Four members of the commission shall constitute a quorum for the transaction of business, except that, in the absence of a quorum, any number less than a quorum may adjourn the meeting to a later date. The affirmative votes of at least a majority of those commission members present shall be required for any action. (c) All meetings and records of the commission shall be open to the public. The commission shall keep minutes of proceedings showing the vote of each member upon each question and shall keep records of any actions, all of which shall be immediately filed in the office of the city clerk and shall be a public record. Currently, the Commission meets on the third Wednesday of each month. Membership on the Historic Preservation Commission is open to citizens of the City of Seward and surrounding areas. The Historic Preservation Commission has the following duties: 1. Surveys and inventories community historic resources; 2. Reviews proposed nominations to the National Register of Historic Places; 3. Provides advice and information regarding the identification and protection of local historic and archaeological resources; 4. Supports the enforcement of state and local historic preservation laws; 5. Reviews and makes recommendations about local projects; 6. Develops a local historic plan; and 7. May give periodic reports to the City Council at Council's regular scheduled meetings. 8. Shall have no authority to expend or commit city funds without first obtaining approval by and any necessary appropriations from Council. 9. The annual report shall include, at the minimum, a report on the prior year's activities, a list of any anticipated requests for appropriations for the year's planned activities and a recommendation regarding the continuation of the board; (2) Make recommendations to the city council concerning the design and coordination of projects to promote and develop transportation, trade, energy and commerce throughout Seward; (3) Provide input to the city council on policy and procedural matters involving the establishment and continuance of commercial activity, improving the quality of life and protecting the public's best interest; (4) Advise the city council on matters involving the establishment of support services towards the objectives outlined in subsections 2.30.325(a)(2) and 2.30.325(a)(3); (5) Perform other duties as requested by the city council. (b) The board shall have no authority to expend or commit city funds without first obtaining approval by and any necessary appropriations from the city council. The city council, at the first meeting of each fiscal year by an affirmative vote, may continue the existence of the board. If appointed at Council's organizational meeting in October, the council's representative to the Kenai Peninsula Economic Development District (KPEDD) is the liaison to this board, attends its meetings, and reports regularly to Council regarding its activities. If a liaison was not appointed, a member of this board will be appointed to give periodic reports to the city council. The Port and Commerce Advisory Board will automatically dissolve if not continued by the affirmative vote of the Council at its first meeting of the fiscal year. Membership on the Port and Commerce Advisory Board is open to citizens of the City of Seward and surrounding areas. The Port and Commerce Advisory Board has the following duties: 1. (a) The Seward Planning and Zoning Commission shall meet at 7:00 p.m. in the city council chambers on the first Tuesday of each month. Special meetings may be held at the call of the chair or the city manager, and at such other times as the commission may determine. (b) Four members of the commission shall constitute a quorum for the transaction of business; except that, in the absence of a quorum, any number less than a quorum may adjourn the meeting to a later date. The affirmative votes of at least a majority of those Commissioners present shall be required for official action unless a larger majority is required by law. (c) All meetings and records of the commission shall be open to the public. The commission shall keep minutes of the proceedings, showing the vote of each member upon each question, and shall keep records of any other of its official actions, all of which shall be immediately filed in the office of the city clerk and shall be a public record. (a) The commission shall take no official action or address any other items on the agenda after 10:30 p.m. and shall adjourn any regular or special meeting no later than 10:30 p.m. The time for conclusion of business and adjournment is mandatory. In the event the commission's business has not been completed by the time set herein, the commission may recess the meeting to another day, call a special meeting to complete the agenda and adjourn, or adjourn. (b) If the meeting is adjourned without making other provisions for completion of the agenda items, then such uncompleted matters shall be presented at the next regularly scheduled commission meeting under the agenda section for unfinished business. (a) The commission shall perform the following duties: (1) Interpret the provisions of this title and make compliance determinations when requested by the administrative official; (2) Review and act upon requests for variance permits, conditional use permits, and other matters requiring consideration under the Seward Zoning Code; (3) Review the City of Seward Comprehensive Plan on an annual basis and conduct a minimum of one public hearing. Said recommendations shall be forwarded to the council for consideration; and (4) Promote public interest and understanding of comprehensive planning, platting, zoning, land management and other issues relating to community planning and development. (b) The commission shall act in an advisory capacity to the city council regarding the Seward Zoning Code, Seward Comprehensive Plan, Official Zoning Map, Official Land Use Plan Map, and other duties as requested by the city council. (c) The commission shall act in an advisory capacity to the Kenai Peninsula Borough Planning Commission regarding the following matters: (1) Subdivision plat proposals; (2) Right-of-way and easement vacation petitions; (3) Kenai Peninsula Borough Comprehensive Plan and Coastal Zone Management Plan development, updates and amendments; and (4) City of Seward Comprehensive Plan amendments not otherwise delegated to the City of Seward. All commissioners must live within the City of Seward. If appointed at Council's organizational meeting in October, the council liaison to the commission attends the meetings and makes regular reports to Council regarding issues before the commission. If a council liaison is not appointed, the Commission will designate a member to give periodic reports to the Council at the regular scheduled meetings. Council also meets in an annual joint work session with the commission in March to address areas of mutual concern. Membership on the Planning & Zoning Commission is open to citizens of the City of Seward. The Planning & Zoning Commission performs the following duties: Interprets the provisions of the zoning code and makes compliance determinations when requested by the Community Development Director; 2. Reviews and acts upon requests for variance permits, conditional use permits and other matters requiring consideration under the Seward zoning code; 3. Reviews the city comprehensive plan on an annual basis, conducts a minimum of one public hearing and forwards recommendations to Council for consideration; 4. Promotes public interest and understanding of comprehensive planning, platting, zoning, land management and other issues relating to community planning and development; 5. Acts in an advisory capacity to the City Council regarding the zoning code, the comprehensive plan, official zoning map, official land use plan map and other duties as requested by the City Council; and 6. Acts in an advisory capacity to the Borough Planning Commission regarding subdivision plat proposals; right-of-way and easement vacation petitions; Borough Comprehensive Plan and Coastal Zone Management Plan development, updates and amendments; and city comprehensive plan amendments not otherwise delegated to the City of Seward. 7. Shall have no authority to expend or commit city funds without first obtaining approval by and any necessary appropriations from Council. 8. WHEREAS, the Planning and Zoning Commission held a work session on February 15, 2022 to review and update the Planning and Zoning annual Priorities; and WHEREAS, the Seward City Code §2.30.225.b states that "the Commission shall act in an advisory capacity to the City Council regarding the Seward Zoning Code, Seward Comprehensive Plan, Official Zoning Map, Official Land Use Plan Map, and other duties as requested by the City Council; and WHEREAS, City Council will address a resolution adopting these recommendations. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The following list of priorities with status updates and timelines is hereby recommended to the City Council for approval: JANUARY 2022 TO JANUARY 2023 PRIORITIES Short Term 1) Through powers of the Commission, contribute and collaborate as needed to help be part of the solution for the housing issues that Seward is facing. 2) Review and update the Municipal Lands Inventory and Management Plan 3) Make recommended updates to Title 15: Dwelling definitions, height restrictions, etc. 4) Current planning and zoning, including the subdivision of land, replats, conditional use permits 5) Planning and Zoning commissioner training Continuing 1) Review and make recommendations to update Title 15 as needed. (Status: Ongoing. Title 15 is a living document and keeping it current is part of the role of Community Development and the P&Z Commission.
