Planning and Zoning Agenda Statement Meeting Date: August 2, 2022 To: Planning and Zoning Commission Through: Jason Bickling, Community Development Director From: Courtney Bringhurst, Planner Agenda Item: Resolution 2022-016: Application for a Conditional Use Permit to Robert and Susan White to install a radio antenna on Lot 14A, Block 17, Seward Original Townsite White Replat; located at 313 Sixth Ave, within an Auto Commercial (AC) Zoning District. Background and justification: Robert and Susan White have applied for a Conditional Use Permit (CUP) from the Seward Planning and Zoning Commission to install a radio antenna on their property located at 313 Sixth Ave, Lot 14A, Block 17, Seward Original Townsite White Replat. The definition of antenna in Seward City Code is "a device used to transmit and/or receive radio or electromagnetic waves between terrestrially and/or orbital based structures." The definition of a commercial communications tower in Seward City Code is "a structure intended to support equipment used to transmit and/or receive communication signals including monopoles, guyed and lattice steel structures. This definition does not include a tower that supports only one or more amateur radio antennas." "Amateur radio antenna" is not defined in Seward City Code, nor is it specified in the Land Use Table. Due to the similarity in design and structure of the proposed tower to pictures of amateur radio towers, as well as the intended use, which would be to support one antenna used to transmit the non-commercial Christian Broadcast Station, Community Development staff feels that this qualifies as an amateur radio antenna. However, although "antennas" are allowed outright in every zoning district except for Park, the description in the Land Use Table refers to smaller antennas such as satellite dishes and those used for personal TV. Seward City Code 15.10.125(b) states, "In cases of reasonable doubt as to whether a use is permitted in a specific zone, the guidelines established for conditional uses in section 15.10.320 shall apply." In accordance to this section in Seward City Code, a Conditional Use Permit (CUP) has been required. Surrounding Land Use and Zoning: Devei®pmentRequirements: As a reference, the size requirements for a commercial communication tower in the Auto Commercial Zoning District must be less than 16 feet in diameter and less than 75 feet in height. If mounted to a building, the communications tower/antenna cannot reach 30 feet above the highest part of the building. The applicant has stated that the radio antenna will be supported by a 12" triangular tower that will be between 40-50 ft tall. Surrounding Land Use: One block to the west of the proposed location, there are three large communication towers. Two on the ground and one on the roof of the City Hall building. Floodplain status: According to the Kenai Peninsula Floodplain Map, the area is not located within a flood zone. Utilities: Current utilities on the property are adequate to support a radio antenna. Parking; N/A Comprehensive and Strategic Plan Consistency Information This legislation is consistent with (citation listed): Comprehensive Plan: Vol 1, Chapter 2.2.11 — "Provide modern communications infrastructure." Public notice signs were posted on the property and all other public hearing requirements of Seward City Code §15.01.040 were complied with. At the time of this publication the Community Development Department has received public inquiries regarding the proposed Conditional Use Permit. If any further correspondence is received after publication of this agenda statement, it will be submitted to the Planning and Zoning Commissioners for their review. Recommended Conditions 1. Applicant must acquire a building permit and provide structural engineering for both the tower and foundation prior to installation of the tower. 2. If any cabling or guy -wires are used, they may not be placed near the alley. 3. Anti -climb panels must be installed on the lower portion of the tower, or a fence must be built around the base of the tower. 4. Per Seward City Code §15.10.325(f). an approved CUP shall lapse six months from the date of approval if the use for which the permit was issued has not been implemented or a building permit obtained. The Commission may grant a six-month extension upon finding that circumstances have not changed sufficiently since the date of initial permit approval. 5. Modification of final approval of a conditional use permit may, upon application by the permitee, be modified by the Planning and Zoning Commission: a. When changed conditions cause the conditional use to no longer conform to the standards for its approval. b. To implement a different development plan conforming to the standards for its approval. c. The modification plan shall be subject to a public hearing and a filing fee set by City Council Resolution. Sponsored by: Applicant Public Hearing Date: August 2, 2022 CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2022-016 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO ROBERT AND SUSAN WHITE TO INSTALL A RADIO ANTENNA, ON LOT 14A, BLOCK 17, SEWARD ORIGINAL TOWNSITE WHITE REPLAT; LOCATED AT 313 SIXTH AVE; WITHIN AN AUTO COMMERCIAL (AC) ZONING DISTRICT WHEREAS, Robert and Susan White have applied for a Conditional Use Permit (CUP) from the Seward Planning and Zoning Commission to install a radio antenna at 313 Sixth Avenue, Lot 14A, Block 17, Original Townsite of Seward White Replat; and WHEREAS, the property is in an Auto Commercial (AC) Zoning District; and WHEREAS, the definition of a commercial communications tower in Seward City Code is "a structure intended to support equipment used to transmit and/or receive communication signals including monopoles, guyed and lattice steel structures. This definition does not include a tower that supports only one or more amateur radio antennas"; and WHEREAS, there is no definition in Seward City Code for a "amateur radio antenna" or the type of tower that can support it; and WHEREAS, the radio antenna will be used by Christian Broadcasting, a non-commercial radio station operator; and WHEREAS, the proposed radio tower is self-supporting and will not have any guy -lines; and WHEREAS, photos of "amateur radio antennas" located in other places are very similar to the proposed radio antenna to be placed at 313 Sixth Avenue; and WHEREAS, Seward City Code, 15.10.125(b) states, "In cases of reasonable doubt as to whether a use is permitted in a specific zone, the guidelines established for conditional uses in section 15.10.320 shall apply;" and WHEREAS, acquiring a conditional use permit has been recommended for the proposed use of a radio antenna at 313 Sixth Ave; and WHEREAS, the applicant has complied with all of the public hearing requirements of Seward City Code § 15.01.040; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC 15.10.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: The Land Use Table in City Code § 15.10.226 allows antennas in all zoning districts and allows a Commercial Communications tower in an Auto Commercial Zoning District with an approved Conditional Use Permit. These two uses are comparable to the proposed use of an amateur radio antenna. According to Seward City Code § 15.10.125, a Conditional Use Permit has been required. B. The value of adjoining property will not be significantly impaired. Finding: The surrounding properties are primarily zoned Auto Commercial and Central Business. There are three large communication towers located one block to the west of the proposed location for the radio antenna. C. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: This condition has been met. The proposal is in harmony with the Seward 2030 Comprehensive Plan (2017) and Strategic Plan (1999) Seward Comprehensive Plan (approved by Council, May 30, 2017) Vol 1, Chapter 2.2.11 — "Provide modern communications infrastructure." Strategic Plan (1999) "Endeavor to provide modern communication infrastructure" (Page 5). "Promote the development of local communication networks" (Page 13). D. Public Services and facilities are adequate to serve the proposed use. Finding: This condition has been met. Current utilities on the property are adequate to support a radio antenna. E. The proposed use will not be harmful to the public safety, health or welfare. Finding: The applicant will acquire a building permit and provide structural engineering for both the tower and foundation prior to installation. F. Any and all specific conditions deemed necessary by the commission to fulfill the above -mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use, and other similar aspects related to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. Applicant must acquire a building permit and provide structural engineering for both the tower and foundation prior to installation of the tower. 2. If any cabling or guy -wires are used, they may not be placed near the alley. 3. Anti -climb panels must be installed on the lower portion of the tower, or a fence must be built around the base of the tower. 4. Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320: Conditional Use Permits, and authorizes the administration to issue a conditional use permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. However, this replat needs to be reviewed by the Planning and Zoning Commission again for two reasons. First, the Preliminary Right of Way (ROW) Acquisition plat includes City -owned property and must be reviewed and approved by City Council per City Code 16.01.015(b). The City Council did not review or approve Resolution 2021-014. Second, the State of Alaska Department of Transportation and Public Facilities (DOT&PF) is using federal funds to finance the Seward Airport Improvement project; and funding constraints and federal oversight limit what improvements can be implemented in this project. There is currently no legal public access on or through the airport property and the Federal Aviation Administration (FAA) will not allow the DOT & PF to grant new public access due to flight safety concerns. The public will continue to have the right to navigate on the water and to walk on the exposed tidelands at low tide. Fire protection for the Seward Airport is provided by tank water on both Seward Fire Engines and Tankers provided by an automatic aid agreement with Bear Creek Fire Department; and extending and installing utilities to the leased lots on the Seward Airport property is not an eligible cost for federal funding. The Kenai Peninsula Borough requires documentation from the City of Seward that the conditions from Section 2 in Resolution 2021-014 are no longer required before they can grant approval of the final replat. K11 The attached preliminary ROW acquisition plat submitted by Alaska DOT & PF shows the parcels that need to be acquired and replatted for the necessary ROW on the new runway. Parcel 1 is owned by Civil Air Patrol and Parcel 5 is owned by the City of Seward. Parcel 4 is also shown on the preliminary plat, but does not require replatting as the larger parcel was acquired fully by DOT&PF this past year. These parcels are located within Sec 2 & 3, T1S, R1W and Sec 34 & 35, T1N, R1W, Seward Meridian SW, and will be part of the Airport Improvement Project to create new ROW for Runway 16/34, which will be shifted, lengthened, and raised above the 100-year flood level. The Seward Airport has needed improvements for some time now that will substantially reduce the damage the airport is experiencing from recurrent flooding, and to meet FAA design standards based on current aircraft utilizing the airport and forecasted aviation needs. Currently, the runway lighting is old and needs replacement. Much of the pavement needs rehabilitation or replacement. Testing has revealed a weakened embankment under the pavement of Runway 13/31, necessitating a restriction of allowable aircraft weights to those under 12,500 pounds. Improvement of aging and deteriorating airport facilities is another major goal of this project. The river delta adjacent to the airport has been rising relative to airport elevations, increasing the frequency and severity of overtopping floods. The existing main runway (RW 13/31) is now too low and in the direct path of the river, which has been repeatedly damaging it during high water events. Overtopping events were initially limited to the fall but have been occurring June through November in recent years, making maintaining RW 13/31 increasingly difficult. In response to multiple flood events during of the summer of 2013, DOT&PF constructed an emergency dike that is providing some temporary relief. The most recent revision of the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) has now established a regulatory floodway across the existing main runway (RW 13/31) of the airport. By federal regulation, allowable construction is extremely limited in a regulatory floodway. DOT&PF completed a hydrologic study to help identify and evaluate feasible alternatives. RW 13/31 is adjacent to the Resurrection River which has flooded it and Taxiway A repeatedly in recent years, periodically closing the runway and causing ongoing repair expenses. To address this problem, this project will shift, lengthen, and raise the current crosswind runway (RW 16/34) above the 100-year flood level. Some taxiways will be raised to meet the new runway elevation while others will be removed in accordance with current FAA guidance. New runway and taxiway lighting will be installed. The riverside of the raised runway will receive rip rap armoring to protect it during flood events. The aprons will be repaved, and new navigation aids will be installed. RW 13/31 will be closed and the pavement removed, but the runway embankment will be left in place as additional protection against future flood events. Three alternatives were evaluated during the scoping and environmental process. The current project scope corresponds to Alternative 2.2 in the approved Environmental Assessment. Alternative 2.2 had the most advantages and the least significant disadvantages. He stated that city council had taken several steps towards addressing housing concerns in Seward, and this resolution would help solve the issue. Although this resolution was not the only answer to solving Seward's housing shortage, it would help. Sowell said he moved to Seward and had a family of five children; he hoped his children would have the opportunity to continue living in Seward as adults. Jim McCracken, outside the city, owned property near the Hemlock Subdivision property. He encouraged the commission to fail the reconsideration of Resolution 2022-009 because he didn't believe the math made sense; housing prices per square foot were around $250. Peggy Ventura, outside the city, owned property inside Seward. She did not support the reconsideration of Resolution 2022-009 and wished the property would remain a campground. She did not believe the city should be competing with private property ownership and development. She also didn't think that a lot of people realized that the Hemlock Subdivision being talked about was the Forest Acres Campground. She was greatly concerned with the scope of what was proposed; 40 homes on this property was too much. She wondered how parking would be handled, because there was already a parking problem in town. She believed there should be improvements to existing infrastructure be addressed for the current residents first before a bunch of new houses were planned. Becky Dunn, inside the city, lived nearby the Forest Acres Campground. She was concerned that there were no minutes from the last P&Z meeting. She believed there were only five usable acres in the Forest Acres Campground that could reasonably be used for this housing development, and she didn't understand how 40 houses would fit. She was concerned about parking, snow removal, and traffic; she didn't think any housing could be considered affordable right now. Carol Griswold, inside the city, believed the city should not be competing with private developers, and it would be a sacrifice to turn Forest Acres Campground into housing. Her understanding was, after speaking with the borough, that the proposed replat being presented in the packet should be pretty close to final; the documents in the packet were incomplete. David Paperman, inside the city, believed the Forest Acres Campground should not be converted to housing; he said the city's comprehensive plan spoke directly against this concept. He didn't think there had been adequate public comment about this idea before the city started moving forward. Under today's building conditions, any homes built would be starting at a minimum of $400,000, which was not a starter home price. The infrastructure necessary to install water, sewer, and electric would take time and be costly. The priority should be put on multifamily homes within city limits, and single family homes outside the city where utilities would be less costly. Beverly Clausen, inside the city, lived in Forest Acres. She drove by the Forest Acres Campground almost every day and witnessed how much activity it got. She knew that area was prone to flooding when it rained, and thought the property would require a lot of fill to raise the ground level. She did not support the reconsideration of Resolution 2022-009, and she did not believe the reconsideration had been adequately communicated to the public. Other New Business Items Set work session topic for June 21, 2022. Bickling said the work session that was originally scheduled for June 14, 2022 had to be rescheduled to June 21, 2022, and the topic would be short term rentals. There would be another work session on June 28, 2022 which would be to review the municipal land plan. INFORMATIONAL ITEMS AND REPORTS Reminder: June 14, 2022 Rescheduled (from May) Planning and Zoning work session at 6: 00 p.m. Reminder: June 21, 2022 Planning and Zoning work session at 6: 00 p.m. Reminder: July 5, 2022 Planning and Zoning regular meeting at 7: 00 p.m. CITIZEN COMMENTS David Paperman, inside the city, requested the city host a public input forum to gather feedback about addressing housing ideas, including Forest Acres Campground, as well as about relocating the public works facility. He believed high density housing options within walking distance to grocery stores would help solve some problems. He requested that this topic be addressed in the fall and winter, rather than during the busy summer. Becky Dunn, inside the city, appreciated the commission's work and service. She wondered if other properties could be considered. Dunn would support creative ideas to incent year round renters. Peggy Ventura, outside the city, asked that no trees be cut down or removed until or unless final plans were made for the Forest Acres Campground. COMMISSION AND ADMINISTRATION COMMENTS Verhey appreciated everyone's input and feedback. Sullivan echoed that sentiment, and hoped that other solutions could be brought forward for solving the housing crunch. There were many large employers in Seward that needed housing for employees, including the schools, the prison, and soon the coast guard.
