I I Sponsored by: Garzini Introduction Date: Januarv 22 1996 Public Hearing Date: F ebruarv 12 1996 CITY OF SEWARD, ALASKA ORDINANCE NO. 96-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, MAKING CERTAIN HOUSEKEEPING CHANGES TO SEWARD CITY CODE, TITLE 2, ADMINISTRATION WHEREAS, a review of Seward City Code, Title 2, Administration, by the City Attorney revealed several housekeeping changes necessary to more accurately reflect the current city departmental structure; and WHEREAS, Seward City Charter Section 5.3(a) governs the appointment and terms of appointive city officers, and the amendment to SCC S 2.20.010 in this ordinance is intended to state existing law in terms more consistent with those used in the Charter, and is not intended to change existing law; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code (SCC) Section 2.01.010 is hereby amended by striking out the word "workmen's" and inserting in its stead the word "workers"'. Section 2. SCC Section 2.01.015 is hereby amended by striking out the words "city clerk" and inserting in their stead the words "finance department" and by striking out the word "Work- men's" and inserting the word "Workers"'. Section 3. SCC Section 2.10.100 B. is hereby amended to read as follows: 2.10.100 eomvensation of councilmembers. B. eompensation shall be paid quarterly on the payday for the first pay period ending in January, April, July and October of each year. Section 4. SCC Section 2.20.010 is hereby amended to read as follows: 2.20.010 Avvointed officers and terms of o(fice. The city manager, city attorney and city clerk shall be appointed by a majority vote of council and shall serve at the pleasure of the council. Section 5. SCC Section 2.20.015 shall be amended by striking out the words "city engineer" and inserting the words "manager of engineering and utilities" and by striking out the words "finance director" and inserting the words "director of finance and administrative services", CITY OF SEWARD, ALASKA ORDINANCE NO. 96-07 Section 6. SCC Section 2.20.035 is hereby amended by adding a new subsection 12 to read as follows: 2.20.035 eity manager duties. 12. Appoint the personnel officer and provide for the management and administration of the city personnel regulations pursuant to Ordinance No. 437. as amended (See Title 3.) Section 7. The following sections are hereby deleted in their entirety: Section 2.25.010, Building department--established. Section 2.25.015, Building department--powers and duties. Section 2.25.020, Electric department--established. Section 2.25.025, Electric department--powers and duties. Section 2.25.070, Maintenance department--established. Section 2.25.075, Maintenance department--duties. Section 2.25.080, Personnel department--established Section 2.25.085, Personnel department--powers and duties. Section 2.25.100, Public works department--established. Section 2.25.105, Public works department--duties. Section 2.25.110, Purchasing department--established. Section 2.25.115, Purchasing department--powers and duties. Section 8. SCC Sections 2.25.030 and 2.25.035 are hereby amended by inserting the words "and utilities" after the word "engineering" in the catch lines of each section. Section 9. SCC Section 2.25.030 is further amended inserting the words "and utilities" after the word "engineering" in the first line of text and by striking out the words "city engineer" and inserting the words "manager of engineering and utilities" in the second sentence. Section 10. SCC Section 2.25.035, Subsection 5, is hereby amended by adding the words "and maintained by the department" at the end ofthe section just before the semi-colon and by adding the following new subsections: 8. provide for the lawful compliance of new construction and building renovation within the city limits by the issuance of building permits and the performance of building inspections, regulating buildings, housing, fire zones, plumbing, heating and electrical installations; 9. provide for the abatement of dangerous buildings and public nuisances according to law; 10. provide for local compliance with the Seward Zoning eode; -2- . I I CITY OF SEWARD, ALASKA ORDINANCE NO. 96-07 11. coordinate services with the borough assessor to provide such records of building changes which would affect the borough assessed valuation for tax purposes; 12. provide policies and procedures pertaining to the management, operation, design, construction, repair, development, maintenance, improvement and extension of the electric utility owned and operated by the city; 13. maintain such maps and records as are necessary for the fulfillment of the departmental function and record thereon any changes on the official copy, which shall be filed with the city clerk and maintained by the department; 14. obtain easements necessary for the maintenance and extension of the electrical system and the water and sewer utilities; 15. provide advice and assistance in formulating policies and rate schedules to be used in the sale of services and answer customers' inquiries regarding the electrical tariff and the water and sewer services; 16. install, maintain and operate the electrical trqffic control devices and street lighting system of the city; 17. operate the city garage and machine shop, keeping a record of the work performed; 18. maintain the operating records of all motorized equipment used or operated by the city; 19. provide for a prevention maintenance program for all mechanical equipment owned and operated by the city; 20. provide maintenance for all public buildings and mechanical equipment of the city; 21. be responsible for the function of traffic engineeringfor the city and maintain all markings for traffic control placed upon the streets or curbs; 22. provide policies and procedures pertaining to the management, operation, design, construction, repair, development, maintenance, improvement and extension of the city water and sewer utilities; 23. cooperate and coordinate departmental efforts with the fire department in the installation, repair and maintenance of a water system adequate for the needs of the fire department; 24. provide for the necessary inspections relative to new and extended servIces. Section 11. SCC Section 2.25.040 is hereby amended by striking out the words "finance director" and inserting the words "director of finance and administrative services" in the second sentence. Section 12. SCC Section 2.25.045 is hereby amended by adding the following new subsections: -3- CITY OF SEWARD, ALASKA ORDINANCE NO. 96-07 12. provide for all city purchases in conformity with the procedures established for that purpose (see Title 6); 13. maintain supply storage facilities and inventorying and stock control records as necessary; 14. maintain all related department records as required; 15. provide for signing of purchase orders not exceeding jive hundred dollars by the purchasinglbenefits clerk upon authorization by the city manager and in conformance with the procedures establishedfor that purpose; 16. provide for the administration of the city employee insurance program; 17. provide for the administration of workers' compensation and OSHA regulations. Section 13. SCC Sections 2.25.060 and 2.25.065 are hereby amended by striking out the words "small boat" preceding the word "harbor" throughout. Section 14. SCC Section 2.25.120 is hereby amended by inserting the words "parks and" preceding the words "recreation department" in the catch line and in the first sentence of the section and by striking out the words "recreation supervisor" and inserting the words "parks and recreation director" in the second sentence of the section. Section 15. SCC Sections 2.25.130 and 2.25.135 are hereby amended by striking out the word "librarian" and inserting the word "library director" throughout each section. Section 16. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 12th day of February, 1996.
