C ) 0I Q�c oS go L A\[ pow we 1 I s ; Resolution 2023-001 6\ 1 () 0 IA/ Breeze Lease This has been one of my most difficult issue since being elected to Council, and I dedicated time to research historical data directly related to Mr.Jackson and all Entities he represents within the City of Seward dating back to 2011,this information was provided by planning&zoning, building department, and the fire and safety department. I am not making my decision from emotions, or my personal past experiences with Mr.Jackson, nor I am apart of some "back-door deal" as implied by some members of our community. Since our last meeting I have received a lot of"thank you"from the community, but I have also received threats to my personal businesses and business growth within this community. I have listened/read all the emails, text messages,voicemails, and verbal interactions that I have received over the last few weeks regarding the lease transfer of the Breeze. My decision was based solely on the communication I have received from the parties who support the transfer of the lease, and/or those with financial interest. From this group the same word continues to come up"Precedents." Websters Dictionary Definition: to decide something that will be used as an example or rule to be followed in the future. EXP:The ruling in the case is likely to set a precedent for how future cases are decided. The common example was,the City can't or shouldn't set a "Precedents"of not transferring city-leases to anyone or business entity that wishes to purchase an existing business that is operated on leased city land. Setting this "Precedents" would cause finacel harm to anyone or entity that currently holds a lease in the event they want to sell and transfer. The City has proven to continually work with Mr. Jackson and all Entities he represents. The city has allowed these businesses to remain open even though the building fire safety was not up to National or Seward City Code. In addition, allowing Mr.Jackson to open and operate at least one business without completing building code or permit requirements in the time allowed.The city did this to give Mr.Jackson plenty of time to make the necessary code repairs because the City is pro-Business and respects the local economy. The city's historical data relating to all code and permit dealings with Mr.Jackson and the entities he represents show additional "Precedents." From ongoing fire and safety failings for not maintaining fire extinguishers,fire suppression systems, restaurant hood ventilation, emergency exits, proper emergency lighting, and not following building code permit requirements. Even the basic code of maintaining the snow and ice on sidewalks around these locations hasn't been done consistently if done at all.These issues are not at just one or even two locations, but each location. Finally,the city has and needs to continue the Precedents of not leasing city property to those people or entities that do not follow city code or make the necessary code requirement changes in a timely manner. To: File Record From: Janice/Admin Date: January 15, 2019 Re: Fire Inspections and building permit for Sea Salt/Elliott Jackson Received application for liquor license renewal and called to set up an appointment for fire / life safety inspection to be completed. Communicated with Elliott Jackson via email as well- I was told to contact Gary Elde to do the inspection since Elliott was out of town. Set appointment for December 7 2018. Both Stefan — Building inspector and Deputy Clinton Crites went for the inspection. I had been in a conversation earlier in the week where Gary was talking about the construction he was doing inside the Sea Salt and what he was finding with old burned walls and electrical. We had no building permit issued for this work- so Stefan went to see the extent of the work being done, since the email from Elliott had said they were just working on the floor. The restaurant is closed for the season and under construction in the kitchen area. The things from the kitchen are in the dining area. Construction was being done in the kitchen area with floor drains and floor torn up. Because of the construction the fire/ life safety inspection could not be completed. Gary Elde was told he needed to come in and apply for a building permit since the work being done was extensive enough to require one. Gary did come in the following week and picked up a building permit packet. Stefan was out of the office at a class, but Gary was familiar with our office and building permits so he was told the basic drawing, scope of work and application needed to be returned. He was also told- he could come in and talk with Stefan about the work and with Deputy about the process so the fire/ life safety inspection could be done soon for the liquor license renewal. No building application has been received to date. I called Gary on his cell number 907-362-1113 several times to let him know Stefan was in and he could bring in the application. No response. While there are numerous fire and life safety violations noted at the Van Gilder, I would not deny the Business License Application(2020) on the grounds that doing so could hinder the CARES grant application process and funds from this grant could assist in making repairs: I am working with Mr. Jackson to remedy violations at the Marina ad Murphy Motel and feel confident we can find solutions to correct those violations,therefore I would not oppose the business license process for these two locations(2020)under the premise that the CARES grant money could assist in correcting violations here as well. However, No occupancy shall be allowed,indefinitely,in the Van Gilder until conditions are deemed safe by the Seward Fire Department.The Seward Fire Department will work with Mr. Jackson on items that are costly to work on a plan of action at all three locations. I have also reviewed the reports of Rob Mathis and Nate Crossley completed on 5/16/16 and 5/19/21. Both are trained and certified ICC fire inspectors. Violations currently known to exist are listed below: IFC 1029.2 Windows are not egress windows: 108, 109, 205, 208, 209, (301& 302) these are a 2- room suite, neither room has egress windows along with rooms 306, 308, 309, 312, 313 Windows permanently affixed or not open at all: 208, 301, 302, 306,313-screwed shut. Headboards blocking window: 306, 309, 313 Not all rooms have been inspected due to the rooms being occupied at the time of inspection. The building could not be considered compliant until all rooms have been inspected and meet code. To my knowledge there has not been any corrections to the above deficiencies. Normally, it is my preference to work with an owner to try to achieve compliance without having to resort to citations or other enforcement actions. The fire department has tried to obtain a plan of action from this business for several years to begin working on the violations. However, Mr., Elliot has shown no interest in making corrections to fire and life safety violations,other than replacing a rotted fire escape noted in 2016 which was completed 7/21/2021. Mr., Crossley is trained and a certified ICC fire inspector. Violations currently known to exist are listed below: IFC 1029.2 Windows are not egress windows: 107, 108, 109, 112, 113, 114, 115, 116, 117. IFC 703.2.2 Boiler room does not have self-closure device. IFC 315.3.1 Boiler room combustibles need to be less than 2 feet from ceiling. IFC 605.6 Electrical/Fire hazards: many areas outside with open junction boxes noted with bare wires sticking out. Fixing these issues requires an electrician who would have to pull a permit from the City. IFC 605.3 Boiler room, maintain clearance of at least 30 inches from electrical equipment. IFC 908.7 Carbon Monoxide detectors required at street rooms open to parking area: Rooms 107- 111 I have met with the owners of Murphy's Motel, their employees or representatives on multiple occasions. Most recently on 9/20/2021 at 0830hrs I met with Mr. Elliott Jackson along with City Manager Janette Bower and Assistant City Manager Stephen Sowell and discussed the importance of code compliance for fire and life safety. Mr. Jackson was advised by the three above mentioned city staff, that a business license would be denied if the violations were not corrected by the 2022 license cycle.To my knowledge there has not been any corrections to the above deficiencies. Normally, it is my preference to work with an owner to try to achieve compliance without having to resort to citations or other enforcement actions. The fire department has tried to obtain a plan of action from this business for several years to begin working on the violations. The firefighters who may be called upon for any emergency are also threatened due to hazardous conditions, multiple victims trapped and the lack of fire control measures. I am working with Mr. Jackson to remedy violations at the Marina ad Murphy Motel and feel confident we can find solutions to correct those violations,therefore I would not oppose the business license process for these two locations(2020) under the premise that the CARES grant money could assist in correcting violations here as well. However,No occupancy shall be allowed,indefinitely, in the Van Gilder until conditions are deemed safe by the Seward Fire Department. The Seward Fire Department will work with Mr. Jackson on items that are costly to work on a plan of action at all three locations. If violations are not corrected,or a plan of action in writing and approved by this department is not submitted by Mr. Jackson for the Van Gilder, Marina Motel,and Murphy's Motel by April 1st 2021,then a Notice of Violation IFC 109.3 will be issued along with a Stop Work Order IFC 111.1 and a denial of the 2021 Business License.
