OUTCOME GOALS
FOR WORK SESSION
1) Determine how to appropriately reference Title 7.20 - Cemetery and Burial
requirements in Title 15.
2) Discuss proposed revisions to Title 7.20 - Cemetery and Burials
3) Discuss cemetery regulations that need to be updated or added to the
Cemetery Management Plan
BACKGROUND:
The Cemetery Management Action Plan was established in 1996, and has not
been updated since. Furthermore, the plan contains more recommendations than
it does actual regulations. Cemetery regulations facilitate in establishing a
pleasing and organized environment, allows for easier maintenance of the
grounds, and establishes a more orderly account of burials.

15.10.140 Definitions.
A. General interpretation.
1. Words used in the present tense include the future tense.
2. The singular number includes the plural.
3. The word "person" includes a corporation as well as an individual.
4. The word "lot" includes the word "plot"or"parcel."
5. The term "shall" is always mandatory.
6. The word "used"or"occupied"as applied to any land or building shall be construed to include the
words"intended," "arranged,"or"designed to be used or occupied."
B. Specific definitions. (Parenthetical references are for cross-reference only.) In this chapter, unless otherwise
provided or the context otherwise requires:
1. Accessory building.A detached structure that:
a. Is clearly incidental to and customarily found in connection with a principal building or use;
b. Is subordinate to and serves a principal building or use;
C. Is subordinate in area,extent or purpose to the principal building or use served;
d. Contributes to the comfort,convenience or necessity of occupants, business or industry in the
principal building or use served; and
e. Is located on the same or adjacent lot under the same ownership as the principal building or use
served.
An accessory building shall be considered to be a part of the main building when joined by a common
wall or connected by a breezeway to the main building.Accessory building means any structure
regardless of type of foundation or base support, including skid-mounted or other moveable
structures.
(Accessory or mother-in-law apartment. See Dwelling, Efficiency apartment)
2. Agriculture.Commercial farming,dairying, pasturage, horticulture,floriculture,viticulture,or animal
and poultry husbandry including buildings used to shelter farm implements, hay,grain, poultry,
livestock or other farm produce in which there is no human habitation and which is not used by the
public.
3. Airport. A place where aircraft can land and take off, usually equipped with hangars,facilities for
refueling and repair,various accommodations for passengers,and business lease sites.
4. Alley.A dedicated public way which affords a secondary means of access to abutting property and not
intended for general traffic circulation.
5. Alteration.Any change,addition or modification in the construction, location or use of a building.
6. Amusement and recreation facility. Establishment engaged primarily in providing entertainment for a
fee including such activities as bowling alleys, billiards and pool,dance hall, pinball machines,video
games or other similar player-operated amusement devices.
7. Antenna. A device used to transmit and/or receive radio or electromagnetic waves between
terrestrially and/or orbital based structures. Includes satellite dish.

(Apartment. See Dwelling)
8. Auto repair station.A place where a qualified automotive mechanic provides services such as general
motor vehicle and engine repair, reconditioning or rebuilding,and collision service including body,
frame and fender straightening and repair, painting and undercoating of motor vehicles.
9. Auto service station.A place used primarily for the retail dispensing of motor fuels and/or installation
of tires, batteries and other accessories and services which do not customarily or usually require the
services of a qualified automotive mechanic.Also known as a gas station.

( Boarding or rooming. See Lodging)
10. Brewpub.An establishment that is primarily an eating place which includes the brewing of beer as an
accessory use.
11. Building.Any structure built for the support,shelter or enclosure of persons,animals,chattels or
property of any kind.
12. Building area.A total area taken on a horizontal plane at the main grade level of the principal building
and all accessory buildings,exclusive of external steps.
13. Building,existing.A building erected prior to the adoption of this Code or one for which a legal building
permit has been issued.
14. Building height. The vertical distance above a reference datum measured to the highest point of the
coping of a flat roof or to the deck line of a mansard roof or to the average height of the highest gable
of a pitched or hipped roof.The reference datum,which must be between the building and the
property line or in a dedicated public right-of-way that is accessible to fire suppression personnel and
rescue equipment,shall be selected by either of the following,whichever yields the greater height of
the building:
a. The elevation of the highest adjoining sidewalk or ground surface within a five-foot horizontal
distance of the exterior wall of the building when such a sidewalk or ground surface is not more
than ten feet above the lowest grade; or
b. An elevation ten feet higher than the lowest grade when the sidewalk or ground surface
described in subsection a.,above is more than ten feet above the lowest grade.The height of a
stepped or terraced building is the maximum height of any segment of the building.
15. Building, principal or main.A building in which is conducted the principal or main use of the lot on
which the building is situated.Attached garages, porches and carports shall be considered to be part of
the principal building.

16. Business,general sales.A premises where the sale of goods or commodities to the consumer takes
place; i.e.,groceries; bakeries; hobby,knot or yarn shops, book,gift or apparel shops;fishing
equipment, hardware or vehicle sales; restaurants;vehicle rentals or variety stores.
17. Business, personal service.The conduct of business where personal assistance is offered for
compensation; i.e.,dressmaking,tailoring, barbers and beauty,etc.
18. Campground.A plot of ground upon which two or more campsites are located,established or
maintained for occupancy by camping units as temporary living quarters for recreational or vacation
purposes.

a. Campground, municipal. Campgrounds owned or operated by the City and designated as public
campgrounds by resolution of the City Council.
b. Campground, private camper parks.A privately owned and operated campground on any parcel,
or adjacent parcels of land in the same ownership,which is used by two or more camping units.
C. Campground,employee.An area operated by an established business with high seasonal
employment of transient workers as a housing alternative and not construed to be a construction
camp.
19. Camper park.A privately owned and operated campground on any parcel,or adjacent parcels of land
in the same ownership,which is used by two or more camping units.
20. Camping unit.A tent or recreational vehicle.
21 Cemetery.A private or public parcel of land used for the disposition of the remains or cremains of
deceased individuals.All cemeteries,including private cemeteries, will abide by the rules and
regulations set forth in§7.20.
-24. Child care, licensed home. In accordance with Alaska Statutes,a private residence where adult care,
protection and supervision is provided for children other than the occupant's.Also called day care,
nursery school,preschool and kindergarten.
Q? Church.A building,structure or group of buildings or structures primarily intended for conducting
organized religious services and associated accessory uses.The definition of a church shall be
dependent upon U.S. Internal Revenue Service and the Kenai Peninsula Borough Assessor's Office
interpretation.A standard single-family residence not remodeled for public meetings shall not be
considered a church.
'L3. Clinic.A building or portion thereof containing offices and facilities for providing out-patient medical,
dental or psychiatric services,and which may include a dispensary to handle medication and other
merchandise prescribed by physicians in connection with their medical practice.
24 Club, private.A building and related facilities owned or operated by a corporation,association or group
of individuals established for the fraternal,social,educational, recreational or cultural enrichment of its
members, but not primarily for profit,and whose members meet certain prescribed qualifications for
membership and pay dues. Includes lodges.
Cluster subdivision.A development design technique that permits a reduction in lot area provided
there is no increase in the number of lots permitted under a conventional subdivision or increase in
overall density of development by concentrating buildings in specific areas on a site to allow the
remaining land to be used for recreation,common open space and preservation of environmentally
sensitive areas.
(Commercial building apartment. See Dwelling)
2b. Commercial communications tower.A structure intended to support equipment used to transmit
and/or receive communication signals including monopoles,guyed and lattice steel structures.This
definition does not include a tower that supports only one or more amateur radio antennas.
2-7. Commercial use.An occupation,employment or enterprise that is carried on for profit by the owner,
lessee or licensee.

Chapter 7.20. Cemeteries and Burials
7.20.010 Purpose and intent.
It is the intent of this Code to establish a community cemetery with adequate administrative and
maintenance provisions to provide for proper burial; ensure the continuity of its operation; provide for
accountable record keeping; provide for protection of public property; and provide for the safety, health and
welfare of the public.

7.20.015 Definitions.
For the purposes of this chapter,the following terms, phrases,words and their derivations will have the
meaning given herein. Words used in the present tense include the future,words in the plural number include the
singular number,words in the singular number include the plural number and words in the masculine gender
include the feminine.The word "will" is always mandatory and not merely directory.
Burial (interment)Ppea++s the permanent disposition of the remains or cremains of a deceased person by
crypt or vault entombment, inurnment of cremains in a niche or container,or earth burial.
Exhumation(Disinterment)k^ ,;;FneaRs the legal removal of a deceased person's remains from a
grave.
Burial lot-R4ea44&a single platted parcel of land within a cemetery designed for interment of human remains.
Includes grave, plot,site or space.
Burial preparation�rthe excavation, backfill and removal of excess material from a burial lot and
replacement of the turf.
Burial permit rmeaRs a valid City permit allowing the burial of a deceased person in any cemetery.A valid
State of Alaska burial permit is required to obtain a City permit.
Cremains rmeaRs the cremated remains of a deceased person.
Columbaria.a place that is designated for the interment of the ashes after someone is cremated.
Cemetery .a parcel of land used for burials.
City-R�the city of Seward.
Grave reservation permit Mea;s a revocable use permit to reserve a burial lot(s) in the cemetery.
Memorial meaRs any marker, monument,tablet, headstone or structure upon or in a burial lot, niche or
crypt placed thereupon for the identification or memory of the interred. (Use the term'marker'instead?See
fetter'c'and below)
Perpetual care mea;s attending to the normal and reasonable maintenance of burial lots,the grounds,
walks, roadways, boundaries and structures in order that the grounds shall remain and be reasonably cared for as
cemetery grounds forever. By way of illustration it includes cutting of grass at reasonable intervals; removal of
rubbish;general care and pruning of trees and shrubs that may be along the walks, roadways and boundaries. It
does not include unique or special provisions for the care or cultivation of any special flowers, shrubs,trees or
other plants on any lots and grave spaces; nor the repairing, removal, replacement, reconstruction or maintenance

of monuments or memorials; nor the construction or reconstruction of any marble,granite, bronze or concrete
work on any lot where same is damaged from any cause whatsoever. Remains means any part or parts of the body
of a deceased person. Reservation means reserving a burial lot(s) in advance of interment,and does not imply any
fee simple transfer of ownership. (See"grave reservation permit.")

7.20.020 Generally applicable to private and public cemeteries.
(a) Permits required.
(1) There shall be no burials or exhumations within any cemetery within the city or under city ownership
without an appropriate city burial/exhumation permit issued in accordance with the provisions of this
chapter.
(2) City permitting will be in addition to any provisions or authorization, if required, in cemeteries owned
and/or operated by private organizations.
(b) Burial.
(1) It shall be unlawful to bury any human remains within the corporate limits of the city except in a
platted and duly authorized cemetery.
(2) The remains of any person may not be exhumed without submission of a valid state of Alaska permit
and any applicable fees.
(c) Markers.
(1) A permanent marker identifying the person interred must be placed on a grave within one year of
interment.
(2) Minimum and maximum marker size and type must be in accordance with rules and regulations
adopted by the City Council.
(d) Records.
(1) The city will permanently maintain records of all burial and exhumation activity in all private and public
cemeteries within the city or under city ownership.
(2) The city will permanently maintain official maps of all cemeteries within the city or under city
ownership depicting burial or exhumation locations.The city will not be responsible for the accuracy of
burial records prior to the enactment date of this chapter.

7.20.025 City cemetery created.
(a) All that portion and parcel of lands described as the Woodlawn Cemetery Plat,dated October 17, 1916,and
Lot 1, Fort Raymond Subdivision Plat No. 87-12,dated July 2, 1987, both filed in the Seward Recording
District and owned by the City of Seward,are hereby set aside and dedicated for cemetery purposes as a
burial place for the dead and,subject to the provisions of this chapter,are open to all persons regardless of
race,creed,color, religion or national origin.
(b) The Woodlawn Cemetery is considered to be historic and not open to new burials.
(c) The city manager will cause the city cemetery to be surveyed, laid out and platted into burial lots,duly
numbered,and a map thereof made and filed with the city clerk.

7.20.030 Rules and regulations—Promulgation and authority.
(a) All land within the city cemetery and within any extension of the cemetery at any time hereafter made will
be subject to and regulated and controlled by the provisions of this chapter and any rules adopted by the
city.The police power of the city is extended over all of the cemetery.
(b) The city manager may promulgate rules and regulations,subject to approval of the City Council,governing
the use, maintenance and operation of city owned cemeteries, including but not limited to the:
(1) Replat,change of boundaries or grading of any part thereof;
(2) Reservation, use and disinterment of any burial site;
(3) Type and size of burial markings,decorations and memorials;
(4) Issuance of permits for the reservation, use and disinterment of burial sites;
(5) Establishment of fees for service and permits issued in connection with the cemetery;
(6) Interment locations,space,capacity;
(7) General access including pedestrian and vehicle traffic;and
(8) Maintenance, landscaping,care,construction, repairs and grave preparation.
(c) Said rules and regulations will be on file with the city clerk and available for perusal by any interested person
upon request during regular city business hours.
(d) Within the guidelines established by said rules and regulations,the city manager will have the final
administrative responsibility for management of city owned cemeteries.

7.20.035 Operation of cemetery.
The city reserves the right at any time to enlarge, reduce, replat or change the boundaries of city cemeteries
or any part thereof;to modify, change location, move or regrade roads,drives,walks or any part thereof;to lay,
maintain,operate,alter or change pipelines,gutters,sprinkler systems or drainage; and to relocate grave sites or
allow disinterment upon proper legal authority.The city reserves for itself the perpetual right of ingress and egress
over all plots for the purpose of maintenance, operations or any emergency work necessary to the operation of
the cemetery.

7.20.040 Burial site reservations.
(a) Upon establishment of rules and procedures by City Council resolution, burial sites may be reserved on a first
come,first served basis by any person for himself or immediate family members to a maximum of ten burial
sites. In order to encourage family grave lot use and to discourage institutional speculation,funeral homes
and other similar corporate or business entities are excluded from acquiring burial sites except for a specific
immediate burial.

(b) The city manager will maintain burial reservation records to include at a minimum the name and address of
the permittee and the date of reservation.The city manager will not authorize the use of reserved burial
sites by anyone other than the purchaser or his properly designated representative.
(c) Burial reservation rights to any unused plot may be relinquished to the city but may not be sold to a third
party.
(d) Reservation fees for a space vacated due to exhumation will not be refunded,and the burial site will return
to the pool of unreserved sites.
(e) After 10 years if a reserved plat has not been used,the person who reserved the site will be contacted and
requested to renew their reservation. If no renewal is made,the reserved site will be released.

7.20.045 Cemetery funding.
In order to provide for the management,operation and improvement of the cemetery, it will be the duty of
the city to account for all receipts and expenditures arising from burial site reservations,operation fees,donations
and other sources to be exclusively used, under the direction of the City Council, in payment for operations and
improvements to the cemetery.

7.20.050 Grave preparation.
All grave openings,closings,site preparation, interments,exhumations, marker placement and removals will
be in accordance with rules and regulations adopted by the City Council.
• Applicant will be responsible for grave openings,closings,site preparation,interments,exhumations,
and marker placement
• All grave openings must be 6ft deep
• After interment,all excess soil and rock must be removed and burial site must be level with the
surrounding ground
o If excess soil is not removed and/or a mound is left on the burial site,the applicant's deposit
MY not be refunded

7.20.055 Standards for grave markers.
No memorial marker will be accepted which does not conform to standards for memorials as specified in
rules and regulations adopted by the City Council.

7.20.060 Care of cemetery.
(a) The city will maintain or cause to be maintained the general cemetery appearance including any driveways,
gates or fencing and may close access to such facilities for the protection of public property or to provide for
the safety, health and welfare of the public.

(b) The city will take reasonable precautions to protect all grave markers within the city cemetery from loss or
damage, but expressly disclaims any responsibility for loss or damage from causes beyond such reasonable
precautions.The city will not be responsible for damages incurred directly or collaterally and caused by or
resulting from thieves,vandals, malicious mischief or accidents.

7.20.065 Enforcement.
The city manager or his designated representative will enforce all cemetery regulations.

7.20.070 Prohibited acts.
A. Deposit of materials. No person will deposit any rubbish,filth,waste or other unclean or unsightly substance
in the cemetery.
B. Vehicle operation limitations. Except as authorized by the city manager or his designee for the operation of
the cemetery, it is unlawful for any person to operate or drive any vehicle, motorized or non-motorized, in
the cemetery except on the established roadways and in accordance with the city code.Vehicles may not
exceed a speed of 10 MPH. No vehicle may enter the cemetery except for the purpose of attending funerals,
visiting graves or other lawful mission.
C. Nuisance conditions designated—Abatement.Any tree,shrub, plant,fencing or other structure,enclosure,
decoration, headstone,tomb, marker or monument located on any individual grave space which becomes
dangerous or detrimental to the operations of the cemetery or interferes with or encroaches upon adjacent
grave spaces will be removed.
D. Planting of trees,etc., . No person may plant or set any tree,shrub,
flower,grass or other plant of any kind in the cemetery witheut Eity appFeval.
E. Animals. It is unlawful to ride or drive any animal upon,over or across the lands or lots of any cemetery
except on established vehicle ways; or to hitch or tie any animal to any trees,shrubs, plants or other
ornament within any cemetery,or permit any animal to be pastured in the cemetery. It is unlawful to bury
any animal remains in the cemetery.
F. Noise. It is unlawful for any person,except a city employee or contractor in the performance of his duty in
caring for the cemetery,to willfully make any unnecessary noise or disturbance within the cemetery.

7.20.075 Violations—Penalties.
Any person,firm or corporation who violates any provision of this chapter will, be subject to a fine as
provided in section 1.05.010. Each day such violation is committed or permitted to continue will constitute a
separate offense and will be punishable as such hereunder.

Examples:
• Flowers and decorations are allowed in vases as follows
o Permanently affixed onto hearths or in a foundation with a five inch
concreate or granite wash
o Permanent flower holders, including shepherd's hooks, are allowed on the
side of the stones and must be set with a concrete or granite wash at least
five inches in width around sides and flush to the ground to permit
mowing
• Artificial flowers and wreaths are allowed, and may be left indefinitely on plots if
placed upon a permanent base which shall be a part of the monument, flush with
ground level and extend at least four inches beyond the flowers or wreaths.
• Fresh and artificial decorations are permitted only under the following conditions
o The placement shall not interfere with normal mowing, trimming and
sprinkling operations
o Plot owners shall check the conditions of all decorations frequently and
remove parts that become brittle
o Decorations must be securely fastened. They will be discarded when
blown off and found in obstruction of grounds maintenance.

Examples:
• Allowable floral and decorative items may be placed in cemetery ground five
daysprior to Memorial Day through Sunday folowing Memorial Day
• No decorations allowed on graves for longer than 3 days except during the
period from Dec 1 and March 1 , and for one week following Memorial Day.
Unless removed by the owner within the above time, the cemtery staff will
remove all items.
• All floral tributes will be removed when they become wilted, damaged, unsightly,
or blown off headstones. Holiday floral tributes will be removed within thirty days.

Purpose
The City of Kenai has ordinances and regulations in place for the administration of the Kenai Municipal Cemetery.
These regulations apply to all persons utilizing the Kenai Municipal Cemetery. This document has been prepared as
an informational guide and is not inclusive of all ordinances and regulations. Administration and General Provisions
The Kenai City Clerk is charged with administration and maintains necessary records required by the State to ensure
continuity in the operation of the cemetery. The Parks and Recreation Director enforces all cemetery regulations.
Administration and General Provisions
Hours of Operation:The Kenai Municipal Cemetery is open year-round for pedestrian traffic. No person shall enter
the Kenai Municipal Cemetery except through the established access routes. Summer/Winter hours when vehicle
access is permitted are as follows:
1. Summer Hours—6:00 a.m.to 10:00 p.m. from May 1st to September 30th
2. Winter Hours—Closed from October 1st to April 30th
Fees:All fees shall be as set forth in the City's schedule of fees adopted by the City Council.The purchase of interment
spaces,interment services or required deposits shall be made through the City Clerk or a professional service provider
licensed by the State of Alaska and authorized by the City.At the time of purchase of an interment space,a designated
interment space will be assigned upon receipt payment.
Re-sell or re-assign: It is prohibited for the purchaser of an interment space to re-sell or re-assign except to the
City.
Records:The City Clerk shall maintain all records of interment or disinterment within the Kenai Municipal Cemetery.
The record shall include all files, maps and burial records.
Interment and Disinterment
All interment or disinterment's shall be made in compliance with the laws and regulations of the City of Kenai and
State of Alaska.
The City Clerk shall be provided with the appropriate State burial-transit permits before interment will be permitted;
a burial-transit permit is not required when interring cremains. The burial plots can be used for no other purpose
than interment of human remains and cremains plots or columbarium niches can be used for no other purpose but
inurnment of human remains.
Interment Space Specifications: One(1)casket and up to two (2)cremains may be buried in a standard or infant plot.
Up to three(3)cremains may be buried in a standard or infant plot.Only one(1)cremains may be buried in a cremains
plot. Up to two cremains may be buried in a standard columbarium niche. (Inner Niche dimensions 12"x 12".)
All columbarium niche openings and closings shall be overseen by the City and under the supervision of the Parks and
Recreation Director or designee. A niche may be opened only at the request of the niche owner as listed in the
cemetery records or as determined by the City Clerk. The initial opening and closing (inurnment) of the niche is
included in the original cost of the niche. Additional openings and closings thereafter, for a second interment or for
other reasons are charged at a rate pursuant to the City's fee structure.
All plot preparations for interments or disinterment's shall be overseen by the City and under the supervision of the
Parks and Recreation Director or designee. Opening and closing of graves shall be conducted by a professional
licensed by the State of Alaska and authorized by the City to provide interment services within the Kenai Municipal
Cemetery.
Maintenance and Landscaping
The City of Kenai shall take reasonable precaution to protect all interment markers within the Kenai Municipal
Cemetery from loss or damage but expressly disclaims any responsibility for loss or damage from causes beyond such

reasonable precautions. Damages incurred directly or collaterally and caused by or resulting from thieves, vandals,
malicious mischief, natural disaster or unavoidable accidents shall be excluded from the City of Kenai's
responsibilities.
The City will if able to, clear a path to the interment site when an interment is scheduled during winter months;
however, the City reserves the right to suspend interment services due to high snow levels, other severe weather
conditions or natural disasters.
Plants and Decorations
Prohibited:
• Enclosures such as picket fences or establishing a perimeter around an interment site are prohibited.
• Planting of trees, shrubbery, plants or turf within the Kenai Municipal Cemetery is prohibited.
• Attaching decorations to trees, shrubs or fences is prohibited.
Permitted:
• Boxes, shelves, toys and other such articles upon a grave or burial lot shall be permitted only if contained
within the plot and maintained monthly (April 1 through September 30). Articles that are not maintained,
impede maintenance efforts, or become unsightly will be removed and discarded without prior notice at the
discretion of the Parks and Recreation Director or designee.
• Plastic or silk flowers and artificial decorations are permitted.
• All decorations(except those on burials less than thirty(30) days)will be removed during a selected Saturday
in the month of May each year during the annual cemetery clean up.A twenty(20) day notice will be posted
at the cemetery. Family and friends may either remove their properly placed decorations before Saturday's
clean up and replace them later, or request the cemetery not to remove their properly placed decorations
by calling or writing the Parks and Recreation Director. A final cleanup of the cemetery will also occur in late
September.
• A professional licensed by the State of Alaska and authorized by the City may provide, place and remove
greens, decorations or seating used for an interment service and must provide necessary lowering devices.
Plants, flowers, decorations, or articles not otherwise removed by the deadlines or regulations set forth herein, or
that have become withered or discolored, will be removed by the Parks and Recreation Director or designee without
prior notice.The cemetery is not responsible for damage or liable for the return of such items.
No material shall be allowed to remain in the Kenai Municipal Cemetery longer than is reasonably necessary for any
construction work. During periods of break-up, no heavy hauling will be permitted. Within one (1)year of interment,
graves shall be restored to ground level and re-seeded.
Marker and Headstones
No more than one (1) marker or headstone per plot shall be allowed. All marker or headstone placement and
removals shall be overseen by the City under the supervision of the Parks and Recreation Director or designee.
Upright markers or headstones shall only be allowed in specific designated areas,all other areas shall be marked with
flat markers or headstones that are flush with the ground and are maintained within the foot print of the plot.
Markers shall be constructed of materials that will not decay, rot or decompose. Examples are hard stone, concrete
or hard metals.
The City will attempt to reasonably accommodate any religious practices that make conformance with the below
requirements impossible.
Marker Deposit: If at the time of interment, a marker or headstone is not ordered, the City will collect a deposit.
Deposit refunds will be issued after proper installation of a marker or headstone. If after eighteen (18) months for a
plot and six (6) months for a columbarium niche a permanent marker or headstone has not been installed, the City
shall install a marker or headstone utilizing the deposit as payment.

Marker and Headstone Placement: Markers for cemetery plots may be set in a concrete base and installed at
the head of the grave, centered and within the assigned plot. The Parks and Recreation Director must be notified
prior to any plot preparation, construction, or placement of headstone or marker.
Columbarium Markers:These markers shall follow a standard format,font,and size as determined by the City and
shall include the first and last name of the deceased,year of birth, and year of death.
Columbarium Inscriptions:An inscription is required to be inscribed directly onto the granite faceplate.The Kenai
City Cemetery requires a specific format for unification of inscriptions that shall be followed according to the
purchaser's name designation. Emblems and/or photos will be allowed as space allows. When a suffix is needed (Jr.,
Sr., IV, etc.)they will be placed after the first name.

Alcoholic beverages or controlled substances are strictly prohibited within the confines of the cemetery.
Fire/Flames: Open flames or fires of any type are prohibited within the confines of the Cemetery. This includes
candles, memorial lanterns, barbeques or any other type of flame or fire.
Motorized Vehicle:Trucks over one ton, buses,tractors,trailers and over sized vehicles are strictly prohibited from
the cemetery unless approved in writing by the Parks and Recreation Director or designee.
Motorized-Off Road Vehicles: motor bikes,three and four wheelers are prohibited in the cemetery. It is unlawful
for any person to operate any motorized off-road vehicles within the cemetery.
Non-Motorized transportation: Bicycles, skateboards, roller blades, roller skates or other such riding devices are
prohibited within the cemetery.

SOLDOTNA COMMUNITY MEMORIAL PARK
PURPOSE
The Soldotna Community Memorial Park is a place of rest, remembrance and serves as an
appropriate site for the interment of human remains.
The purpose of this Administrative Policy is to provide guidelines and operational rules for the
administration of the Soldotna Community Memorial Park. These rules apply to all persons
utilizing the park.
DEFINITIONS
Baby Lawn means that section of the Memorial Park identified for the specific use of families to
inter a child that was under the age of seven at the time of death, unless special permission has
been granted by the City.
Columbarium means a structure containing niches for the interment of cremated remains.
Columbarium Niche means a recessed compartment in a columbarium, designed to hold urns.
Contractor means a professional, licensed by the State of Alaska and authorized by the City
through a Memorandum of Understanding or single interment contractor permit to provide
interment services within the Memorial Park.
Cremains means the cremated (ash) remains of a deceased person.
Disinterment means the legal removal (exhumation) of a deceased person's remains from an
interment site.
Family Monument means the family monuments installed within a Family Plot, that protrude
above the lawn surface requiring a foundation.
Family Plot means the purchase of a minimum of two plots, the plots must be side-by-side and
connected by the sharing of at least one border; installation of a family monument within a
family plot is limited to the upright marker sections of the Memorial Park.
Interment means the burial of a deceased person's remains, the placing of an urn in the
Columbarium and/or the scattering of ashes in the Memorial Park Scatter Garden.
Interment Application means the City form to be completed and filed with the City Clerk or
designee prior to the interment of a deceased person's remains in the Memorial Park. This
application provides the Clerk with the necessary information to maintain the mandatory
records of the Memorial Park.
Interment Location means a specific location, lot, plot, niche, space or site in the Memorial
Park designated as being used, or to be used, for the interment of human remains.
Interment Site Preparation means the excavation, backfill and removal of excess material
from an interment location and replacement of the existing ground cover.
Interment Reservation Certificate means a revocable use permit to reserve interment
location(s) in the Memorial Park.
Memorial Marker means any marker, monument, tablet, headstone or structure upon or in an
interment location, or niche placed thereupon for the identification or memory of the interred.
Memorial Plaque means a standard sized plaque placed on the Memorial Wall in
remembrance of a deceased individual.

Memorial Wall means the railing or wall constructed within the Memorial Park for placement of
memorial plaques for the purpose of memorializing loved ones who have passed.
Reservation Holder means any person holding a valid reservation certificate for an interment
location or niche for future interment or a reservation certificate for a plaque for future
placement on the Memorial Wall.
Scatter Garden means a location established within the Memorial Park that is used for the
spreading of cremated remains that have been removed from their container and can be
mixed with or placed on top of the soil or ground cover and that are non-recoverable.
Veterans Section means that section of the Memorial Park designed specifically for veterans
of any of the six branches of the US military. When a veteran is interred in the Veterans Section,
the veteran's spouse may also be interred in the Veterans Section.
GENERAL PROVISIONS
Rules and Regulations. These rules and regulations may be amended at any time by the City
upon approval by the City Council in accordance with Soldotna Municipal Code. The
regulations are written to ensure the continuity and integrity of the Memorial Park; and the
protection of the health and welfare of the community.
Fees and Charges. Fees and charges shall be in accordance with prices established on the
Soldotna Community Memorial Park Fee Schedule, shown on page 9 of this document.
Memorial Park Hours. The Memorial Park will remain open at all times to pedestrian visitors,
unless otherwise posted by the City. Hours of operation and accessibility will be posted at the
entrance to the Memorial Park. Summer/Winter hours when vehicle access is permitted are as
follows:
Summer Hours - 8:00 a.m. until 8:00 p.m. Daily from May 1 st through September 30th.
Winter Hours and Access - The Memorial Park vehicle gate may be closed depending
upon weather and/or road conditions from October 1 st through April 30th.
Reservations. Applications to reserve an interment location or columbarium niche are
available through Peninsula Memorial Chapel located at 5839 Kenai Spur Highway, Kenai, and
telephone number (907) 283-3333 and at the Office of the City Clerk. All reservation fees are
due in full when placing a reservation. Interment sites, with the exception of those in the Baby
Lawn, may be reserved on a first come, first served basis by any person for themselves or their
family members to a maximum of ten interment sites or four columbarium niches. In order to
encourage family interment plot use and to discourage institutional speculation, funeral homes,
and other similar corporate or business entities are excluded from acquiring interment sites,
except for a specific, immediate interment.
Reservation Holder. The reservation of an interment location or columbarium niche conveys
the right to use the location or columbarium niche for interment purposes and not ownership of
such real property.
Reservation Sunset Date. Reservations shall include a 30-year sunset clause, requiring renewal
at no fee to the reservation holder. At the expiration of 30-years, if an interment has not taken
place or a marker has not been installed, the City will send notice to the reservation holder on
file of the renewal requirement. If the reservation holder fails to renew or the City cannot locate
the reservation holder, the reservation may be cancelled and the interment location or

columbarium niche returned to the City, to be made available for reservation by another
person.
Transfer of Reservation. Interment location or columbarium niche reservations may be
transferred, upon making written application on a form provided by the City Clerk.
Infant Plots. There will be no fee for the purchase of plots within the Baby Lawn section of the
Memorial Park.The contractor may have applicable fees associated with the interment services
provided by contractor, if a memorial marker is not ordered at the time of interment a marker
deposit is required. These plots cannot be reserved in advance.
Personal Property. The City is not responsible for any items placed or left on or around any
internment location. Any items placed or left on or around any interment that does not qualify
as allowable within this policy, shall be deemed abandoned property and may be removed
and disposed of as the City deems appropriate.
Maps and Tours. An interactive Memorial Park map is available on the City website. The
Contractor may provide on-site tours of the Memorial Park to facilitate site selection.
Records. The City Clerk shall have access to plats for assigning interment locations upon
request, and shall have oversight of interment records, files and maps, which shall be stored by
the City.
INTERMENT AND DISINTERMENT
All interment or disinterment shall comply with the regulations and laws of the State of Alaska
and the City.
Internment Location Specifications. One (1) casket and two cremains may be interred into a
"Standard Sized Plot" and "Infant Sized Plot" or three (3) cremains may be interred into a
"Standard Sized Plot" and "Infant Sized Plot". Only one (1) cremains may be interred in a
"Cremains Sized Plot".
Transit Permit Required. The City Clerk shall be provided with a Burial-Transit Permit issued by
the Alaska Bureau of Vital Statistics before an interment will be permitted. A Transit Permit is not
required when interring cremains.
Notice to City and Payment. The city must be notified a minimum of 72-hours in advance of the
time of interment and all fees must be paid prior to interment.
Location Preparation for Interment. The Contractor must approve any workers used to
excavate, fill or modify an interment location.
Arrangements. Interment and disinterment services are arranged and provided by the
contractor, to include, but not limited to all openings, closings, plot preparation, interments,
disinterment, and the placement/removal of markers. All arrangement fees of the contractor
are managed by and payable to the contractor.
Ceremonial Participation. The Contractor may allow the ceremonial participation by family
members or friends in the excavation or backfilling of an interment site upon approval by the
Contractor.
Right to Delay Interment. It is the intention of the City to accommodate the interment of
deceased individuals in a timely manner; however, the physical condition of the Memorial Park
(snow, weather, frozen soil, saturated ground and other reasons) may make timely interment

difficult. The City reserves the right to delay interment if necessary for the maintenance of the
Memorial Park grounds.
Disinterment Requirements. No disinterment shall occur without prior receipt by the City of a
duly executed Court Order for such disinterment, issued by a district court for the State of Alaska,
or the issuance of a State of Alaska Disinterment Permit. A Contractor licensed by the State of
Alaska must be present during a disinterment.
COLUMBARIUM
Interment. Only human cremains in an urn may be placed in a columbarium niche.A separate
interment application shall be required for each urn to be interred. A maximum of two urns may
be placed in a columbarium niche.
Columbarium Niche. The columbarium interior space measurements are 1 1'/4 inch deep, 1 19/4
inch wide and 1 0'/4 inch high.
Opening and Closing. The initial opening and closing of the niche is included in the cost of the
niche. The opening and closing is conducted by the Contractor. If it is necessary to reopen a
niche at a later date, for interment of a second or subsequent urn or other reasons, an additional
fee shall be applied and is payable to the Contractor.The City Manager, City Clerk or a specific
designee are the only personnel permitted to authorize opening, closing and documentation
of such.
Columbarium Inscriptions. The inscription on the niche plaque will include the first and last
name(s) of the deceased, the date of birth and date of death. The cost of the niche includes
an initial engraving of up to 40 letters. All inscriptions will be of a standardized font and size
dictated by the City. No additional carvings will be added to any niche plaque.
Decorations. The following rules shall apply to the placement of items at the Columbarium.
• Natural, fresh flower arrangements are permitted on top of or at the base of the
columbarium during the months of May through September.
• Plastic or silk flowers, glass or ceramic containers, and other personal items are prohibited.
• Flowers may not be affixed to a niche plaque or front, or to the Columbarium.
• Flower arrangements that have become unsightly shall be removed at the discretion of the
City.
• Prohibited items may be removed immediately, at the discretion of the City.
Right to Remove Cremains. The City has the right to remove urns, niche plaques, and
cremains. In the event repairs, natural disasters or other events that may require maintenance
to the columbarium, the City retains the right, in its sole discretion, to remove urn(s) and niche
plaques, or to relocate all or any part of the cremains, as it deems necessary. The City will make
every attempt to contact the applicant, alternate contact or the responsible party should such
action become necessary.
Personal Property. The City is not responsible for any items placed or left on or around the
columbarium. Any items placed or left on or around the columbarium that do not qualify as
allowable as described within this policy, shall be deemed abandoned property and may be
removed and disposed of as the City deems appropriate.

SCATTER GARDEN
Human Cremains. Only human cremains may be scattered in the Memorial Park. The cremains
of any person(s) accepted for interment may be scattered in the Scatter Garden upon receipt
of a completed interment application filed with the City Clerk.
Application Required. The cremains must be accompanied by a city interment application
and fee. None of the cremains will be recoverable or preserved intact. The actual physical
location of the interment itself will not be marked.
Memorial Register. The names of persons whose cremains are interred in the Scatter Garden
areas will be entered in a permanent Memorial Register maintained by the City Clerk and those
choosing to do so may purchase a plaque for placement on the Memorial Wall to recognize
the individual that has passed.
Condition of Cremains. Cremains intended to be interred in either Scatter Garden must be of
appropriate fineness to eliminate the possibility of large segments that do not mix easily with
surrounding flora.
MEMORIAL WALL
Intent. The Memorial Wall was developed for memorializing deceased members of the
community who were not interred in the Memorial Park.
Memoriam. Plaques placed on the wall may only memorialize humans. A Memorial Wall
application shall be required for each plaque prior to placement on the wall.
Plaques Specifications. Plaques shall be aluminum alloy and 3" high by 8" wide; finish shall be
gunmetal grey with a sand background and satin raised letter face and border; font shall be
Avant Garde, all caps.
Decorations. All decorations are prohibited on the Memorial Wall.
Plaque Purchase. The cost of the plaque shall include the standard plaque as established by
the City and inscription. Inscriptions space includes 57 spaces for the name of the deceased; 26
spaces for the dates of birth and death; and 33 spaces for an additional inscription.
Memorial Wall Inscriptions. The inscriptions on the memorial wall plaques will include the first
and last name, date of birth, and date of death.
Reservation. Memorial wall reservations shall be limited to one reservation per person; and
reservation on the memorial wall must be for a location immediately next to a plaque placed
for the purpose of memorializing a loved one who has already passed.The cost for a reservation
shall include the same provision as a purchased plaque as outlined above. Reservations shall
include a 30-year sunset clause, requiring renewal at no fee to the reservation holder. At the
expiration of 30-years, if a plaque has not been placed, the reservation holder fails to renew, or
the City cannot locate the reservation holder the physical location on the Memorial Wall returns
to the City.

RECORDS
Register. The City Clerk shall keep records of all interment and disinterment within the Memorial
Park. The records shall include a register for each interment location or niche containing an
alphabetical index of the names of the persons interred or disinterred from the plot and other
vital information. Information will include the deceased's place and date of birth, place and
date of death, date of interment or disinterment and interment site location as may be
available.
Map. An official map of the Soldotna Community Memorial Park shall be maintained by the City
so that the exact place of interment or disinterment by section and plot can be ascertained.
MAINTENANCE AND LANDSCAPE REGULATIONS
The City reserves for itself the perpetual right of ingress and egress over all plots for the purpose
of maintenance, operations or any emergencywork necessary to the operation of the Memorial
Park.
Threat to Interment Location. The City reserves the right to move the remains in any interment
locations or niches which are located in the Memorial Parkwhen and if such sites are in imminent
danger of destruction by natural elements. The City shall make every attempt to notify relatives
of the deceased whose interment sites are in danger if such relatives can be identified within
the City records.
Application of Maintenance. The City is responsible for the maintenance of the Memorial Park;
maintenance shall be administered by the City's Parks and Recreation Department.
Winter Access. The City will maintain a one lane driveway in winter as conditions allow. The
City or the Contractor will clear the path to the interment site as conditions allow when an
interment is scheduled during the winter months.
Grounds Maintenance. The City shall maintain Memorial Park grounds at reasonable intervals,
to include, however, not limited to: raking, cleaning, grading, landscaping, and removal of
prohibited or abandoned items. Only City approved personnel or a City approved contractor
shall discharge any chemical or organic fertilizer, herbicide or other substance within the
Memorial Park.
Loss or Damage to Markers.The City shall take reasonable precaution to protect all interment
markers within the Memorial Park from loss or damage; however, expressly disclaims any
responsibility for loss or damage from causes beyond reasonable precautions to include;
however, not limited to: damages caused by natural disasters or weather; damages incurred
directly or collaterally, caused by or resulting from thieves, vandals, malicious mischief, or
unavoidable accidents shall be excluded from the City's responsibilities. Severely damaged
markers must be repaired or replaced at the expense of the family, the reservation holder or the
responsible party.

Interment Landscaping Procedures. Preparation of an interment site shall be the responsibility
of the Contractor. The Contractor will provide, place, and remove greens, decorations or
seating used for an interment and must provide necessary lowering devices.
PLANTS AND DECORATIONS
Placement of Flowers and Plants. Live plants, freshly cut flowers, wreaths, or flower baskets
maybe placed on or immediately adjacent to a marker on an interment location. Flowers shall
not be placed in or attached to trees, shrubs, or the gate.
Placement of Other Decorations. Glass or ceramic vases, figurines, statues, balloons, personal
items, and other similar decorations are not allowed in the Soldotna Memorial park, and are
subject to removal by the City as described below.
Removal of Decorations. The City shall conduct regular ground maintenance (typically
monthly), and will remove all decorative items and unsightly plants/flowers from interment
locations at the City's discretion. The City will not be responsible for providing advance notice
of when maintenance activities are to occur. The City assumes no responsibility for the return of
items placed on an interment location. Items disposed of by the City will not be recoverable.
Responsibility for Decorations. Any decoration placed by any individual is the responsibility
of that individual. The City does not guarantee that any items placed on any interment site or
columbarium niche will be protected in any way from the elements, wildlife, thieves or vandals.
All items placed are at the risk of the individual and subject to disposal by the City. The City is
not responsible for damage or liable for the return of items placed on or near an interment
location.
MEMORIAL MARKERS
Temporary Markers. All interment sites shall have a temporary marker immediately installed
upon interment and a permanent marker installed within 24 months after interment. Design and
dimensions of permanent markers must meet the requirements established within this policy.
Marker Deposit. If at the time of interment, a marker is not ordered, the Citywill collect a marker
deposit. The deposit will be refunded when a permanent marker is placed. If a permanent
marker is not installed within 24 months of the interment, a 12" x 8" x 2" marker will be installed
by the City and the full marker deposit will be retained by the City. The marker placed by the
City will include the first and last name, date of birth and date of death of the interred.
Flat Markers. All flat markers shall be constructed of granite or bronze, will be a minimum 8.5"
x 5.5" x 7/16" in dimension, not to exceed 48" x 24" x 4" in dimension and set flush with the
ground.
Upright or Slanted Markers. All upright or slanted markers shall not exceed 48" in width and
the height shall not exceed 48" above grade. Upright or slanted markers must be set on and
affixed to a single poured concrete or granite base. The base must be installed at the head of
the interment location, and centered within the width of the plot. The base shall extend 3"
beyond all sides of the marker, shall be at least 4" thick, set flush with the ground and must not
exceed 24" in depth. All marker bases shall be installed by the Contractor.
Flat Marker Interment Section. No more than one marker per interment shall be allowed in
the flat marker section of the Memorial Park (maximum of three interments/markers per plot).

Upright or Slanted Marker Interment Section. No more than one upright marker may be
placed on a plot in the upright marker section of the Memorial Park. In the upright marker section
one marker may mark up to two plots. If marking two plots with one upright marker, the marker
must be placed at the head of the plots, then centered between the two plots.
Markers within a Family Plot. When a sufficient number of plots are purchased to qualify as a
Family Plot; and a Family Monument is installed or planned to be installed, each interment within
the Family Plot shall be marked with a flat marker.
Family Monuments. Family monuments shall not exceed 60" in width and the height shall not
exceed 60" above grade. When a sufficient number of interment locations are purchased to
qualify as a Family Plot a Family Monument may be installed within the Family Plot area. The
intent of this section is to allow a maximum of one above-ground monument per family plot.
Family Plot Monument Foundations. Any monument that exceeds 48" in height shall require
a foundation analysis. Foundation analysis will be submitted to the City for review and approval
prior to installation.
PROHIBITED
Alcoholic beverages or controlled substances are strictly prohibited within the confines of the
Memorial Park with the exception of special Memorial Park events, which must be approved in
writing and in advance by the City Manager or designee.
Decorations. Glass containers of all types, unattended lit candles and permanent raised
obstructions such as mounds and fences are prohibited within the Memorial Park.
Disruption of an Interment Ceremony. No work utilizing any type of power tools shall be done
during an interment service. No work of any kind may be performed within 200-feet of an
ongoing interment service. When there is more than one Interment Ceremony scheduled for
any given day, contractors shall coordinate logistics together and with the City so as to minimize
disruptions.
Driving off the Roadway is prohibited. No motorized vehicles of any type shall drive on any of
the Memorial Park lawn areas, except as authorized in writing by the City Manager or designee
for the operation of the Memorial Park.
Horseback Riding or Horse and Carriages. Unless part of an interment ceremony, Horseback
riding or Horse and Carriage are prohibited within the Memorial Park.
Inscriptions. Inappropriate language, as determined by the City Manager, City Clerk or
designee, will not be permitted on any of the markers, plaques or emblems at the Soldotna
Community Memorial Park.
Motorized Vehicles. Trucks over one ton, buses, tractors, trailers and oversized vehicles are strictly
prohibited from the memorial Park property unless approved in writing by the City Manager or
designee. City Maintenance vehicles and equipment owned by the City or Contractor are
exempt from this provision.
Motorized-Off Road Vehicles are prohibited in the Memorial Park. It is unlawful for any person to
operate any motorized off-road vehicle with the Memorial Park.
Non-Motorized transportation. Skateboards, rollerblades or other such riding devices are
prohibited within the Memorial Park. Bicycles are restricted to the Memorial Park roadways only.

Payment to attendants. No money shall be paid to the attendants at the Memorial Park and
visitors [/PLOT PERMIT HOLDERS] must not otherwise engage City or Contractor employees to
perform work. All orders, inquiries, and complaints must be filed with the City Manager.
Solicitation/Peddling. It shall be unlawful for a person to sell or offer for sale any article of
merchandise or any consumable within the limits of the Memorial Park unless a specific activity
is approved in writing by the City Manager.
Vegetation. No Person shall plant or set any tree, shrub, flower or other plant of any kind in the
Memorial Park without the written approval of the City Manager or designee. No person shall
disturb, pluck, pick, remove, relocate or mutilate any flower, plant, tree, shrub or other type of
vegetation within the Memorial Park. Digging holes or the removal of grass or sod for any
purpose; construction or placement of concrete slabs; or the placement of rocks or any other
coverings over interment sites is prohibited
Waste. No person shall deposit waste or other hazardous or unsightly substances in the Memorial
Park.
Working within the Park. It is unlawful for any person except a City employee or the Contractor
to perform work in the Memorial Park. No person shall perform any work in the Memorial Park in
such a manner as to interfere with the walks, decorations, or general arrangement of the
Memorial Park, except through the written permission of the City Manager or designee.

SPECIAL MEMORIAL FEATURES - Phases I & II
As standard burial lawns are created throughout Memorial Park,these special remembrance areas can expand
within their original location to become a focal point for the park and meet capacity needs until year 2100.
Angel Garden
This special burial area is reserved for children under age seven.Starting with the back row,burials are to oc-
cur along the row until it's full,then begin a new row in front of the finished row. Phase I includes two rows
with(32)3'x 5'burial plots.At 1 burial per year,this phase meets needs through—2040. The landscape
bed is shaped to embrace the burial area.It contains a well-maintained collection of flowering trees
and shrubs to exhibit a high level of care and symbolize fragility,love,faith,and hope.
Memorial Walk
n t r This feature is composed of island-shaped stone planters with railings to mount memorial
plaques.It provides the Soldotna community a place to memorialize and honor member of
the community who have passed on,regardless of their time of death or final resting
q place.One of the islands is reserved for plaques honoring Soldotna area
"Pioneers". As the railings fill up with plaques,additional is-
ti P, s v lands can be added in the "braided river" pattern as
shown on the plan. Structural fill is in place under the
topsoil to allow for easy construction of additional is-
lands for the plaques. Visitors can stroll the trails of

wooded area and provide a landscape bed similar to that surrounding the Phase I burial area. Each ex-
pansion area add 30 years capacity at a rate of 2 per year.
