RESOLUTION NO. 475
WHEREAS, the structure situated on Lot.' 13 and the North one-half
of Lot 14 in Block 10 of the Original Townsite of The City of
Seward, Alaska, and known as the Northern Building was gutted by
fire on ~ ~ 116J'-- ; and
WHEREAS, as 'provided by Section 203 of Ordinance No. 318, said
structure was inspected by the City Manager-Building Inspector
and found to be structurally unsafe and extremely dangerous to
the public safety as a result of the fire; and

WHEREAS, legal notice of such finding and order to commence demo-
lition and removal of said structure within 48 hours of service
of said notice upon the owner(s) of record was personally served
upon ~tr. B. A. Sims aka Bob Sims of Seward, Alaska on the 30th
day of July, 1965 and was served upon Mr. Harry S. Kawabe of 515
Madison Street, Seattle, Washington by certified mail receipt
number 613583, receipt of which was acknowledged and dated August
26, 1965; and
WHEREAS, more than 48 hours has elapsed from date of service of
notice and owner(s) have not commenced demolition and removal of
said structure; and
~IEREAS, after receipt of said notice both owner(s) discussed it
with the City Manager-Building Inspector, not denying that the
structure is dangerous but each apparently attempting to place.
responsibility for it with the other; and
WHEREAS, there is a clear and imminent danger to the public safety
due to the conditions described in the aforementioned legal notice
dated July 30, 1965;
NOW, THEREFORE, BE IT RESOLVED that as a result of the above
described conditions and actions taken, which are hereby made a
part of this Resolve the same as if set forth herein, that the
structure situated on Lot 13 and the North one-half of Lot 14
in Block 10 of the Original Townsite of The City of Seward and
known as the Northern Building is declared to be a danger and a
menace to the public safety and the .following orders are entered
in this Resolution:
1. The City Attorney shall forthwith commence prosecution
of the owner(s) of said structure as violators of the pro-

visions of Ordinance No. 318 of The City of Seward.
2. The City Manager shall take such action as is necessary
to prevent use of Fourth Avenue in front of this structure
for pedestrian traffic or parking of vehicles.
3. The City Manager shall forthwith proceed to demolish
and remove said structure.
4. He shall determine whether or not it is feasible to sal-
vage any material or equipment from said structure and re-
quire salvage where determined to be feasible. All salvaged
material or equipment shall be sold at public auction and
the net proceeds shall be applied to the cost of demolition
and removal.
5. He shall compile a complete accounting of the cost of
such work and shall then transmit same to the City Council

which shall b1 resolution:
A. Cause same to be paid.
B. Confirm the total cost and 1e'vy a spec ia1 assessment
against the property in the sum of the total cost of the
such work.
C. Fix a time within which the special assessment shall
be paid and the time when it shall become delinquent,
which time shall not be less than 60 days after the adop-
tion of the resolution.
D. Set forth the legal interest rate of 12% per year and a
penalty not in excess of 10% which shall also draw inter-
est at the rate of 12% per year.
E. Provide for notice to the owners of such special assess-
ment payment procedure and notice that The City shall have
a first lien against said property enforceable in the same
manner as real property taxes for any delinquent special
assessment.
5. The City Clerk-Treasurer shall notify the owners of these
orders by serving a copy of this Resolution upon them in the
manner provided by Ordinance No. 318 within 5 days of passage
and approval.
