The April 2, 2024, regular meeting of the Planning & Zoning Commission was called to order at
7:00 p.m. by Presiding Officer Carol Griswold
(Clerk’s Note- Due to lack of Chair and Vice Chair, Commissioner Griswold was selected to be
the Presiding Officer)

SPECIAL ORDERS, PRESENTATION, AND REPORTS
Proclamations and Awards
Recognition of Clare Sullivan for her service on Planning and Zoning Commission was presented
by Commissioner Charboneau and received by Sullivan.
City Administration Report
Community Development Director Danny Mueninck thanked the commission for the double
header tonight with the work session and the meeting. He said newly appointed Commissioner
Hubbard would make her debut at the next work session. Vice Chair Verhey was currently taking
a leave of absence. Meuninck noted there were a lot of new staff and commissioners and there was
a lot to learn. He was looking into revising the P&Z Rules of Procedure manual which was last
updated in 2014. Meuninck also wanted to increase the public understanding of the applications
and processes of the Community Development office. He noted that three future P&Z meeting
nights would conflict with the Tuesday election dates in the latter half of 2024. Meuninck also
updated the commission on various grant opportunities, Comprehensive Plan, Municipal Land Use
Management Plan, new harbormaster building plans, port improvements, and future work session
topics.

PUBLIC HEARINGS
Resolutions Requiring Public Hearing
Resolution 2024-009, of the Planning and Zoning Commission of the City of Seward, Alaska,
Recommending City Council approval of the Land Use Amendment to rezone two city owned
properties located at 2301 Crabapple Street and 537 First Ave, to the recommended zoning stated
in the Municipal Lands Inventory and Management Plan
Motion (Charbonneau/Hornseth) Approve Resolution 2024-009
City Planner Courtney Bringhurst said 2301 Crabapple Street property was the location of the
north water tank and pumping facility. She noted there was an incorrect statement in the resolution
about the Conditional Use Permit requirement. There was a substitute version Resolution 2024-
009 that corrected the error. Bringhurst summarized the zoning recommendations from the
Municipal Lands Inventory and Management Plan. The second property referenced in this
resolution was the Mt. Marathon Hiking Trail trailhead. This parcel was currently zoned for single
family housing, and this rezone would officially zone the trailhead property as a park.

Notice of the public hearing being posted and published as required by law was noted and the
public hearing was opened.
Sharyl Seese, inside city limits, said she was happy to hear the property at 537 First Ave would
be used exactly as it is now. Seese requested there be better signage for parking at the Mt. Marathon
hiking trailhead. Historically there had been several issues with parking in the area and many phone
calls to the police to come deal with enforcement. Seese also hoped there would be no parking
allowed on each corner of First and Monroe because it impacted visibility of traffic.
No one else appeared and the public hearing was closed.
Charbonneau said the Crabapple Street portion of the resolution made perfect sense. The First
Avenue portion of the resolution was carefully evaluated to make sure it would not be considered
illegal spot zoning.
Motion (Charbonneau/Hornseth) Approve Substitute Resolution 2024-009
Bringhurst explained the substitute version of the resolution. She said it corrected an error about
the Conditional Use Permit as well as clarified the recommendation for action to city council.
The substitute version of Resolution 2024-009 was amended to include:
Section 2. The Planning and Zoning Commission recommends the City Council approve
upgrading the signs at the trail head to a uniform height and larger size that say: “No
Parking Emergency Vehicle Access Only” with red arrows pointing towards the center.
Section 3. The Planning and Zoning Commission recommends the City Council approve
adding two signs on the north and south sides of Monroe and First Ave that say: “No Parking
From Here to the Corner.”

Subdivision, Replat No. 7, Lot 10A-2, Located at 905 Sea Lion Ave, from an Institutional (Ins)
Zoning District to an Auto Commercial (AC) Zoning District

City Planner Courtney Bringhurst said there was a small parcel that was still zoned institutional,
and it was surrounded by auto commercial zoning. She recommended the lot be rezoned to auto
commercial. She noted there was a substitute resolution as a laydown which recommended updates
to the Muni Land Plan and future land use maps.
Notice of the public hearing being posted and published as required by law was noted and the
public hearing was opened. No one appeared and the public hearing was closed.

Ulman thanked the citizens for their comments during the public hearing. He thanked the city staff
for setting up P&Z for success.
Charbonneau thanked administration for all their hard work. He thanked the newly appointed
commissioners for joining and congratulated the new chair and vice chair.
Hornseth thanked everyone for putting in the long hours for P&Z topics. He thanked the newly
selected chair.
Griswold thanked the public for the wonderful turnout of people and she appreciated their
comments. She thanked administration for the substitute resolutions which she felt were stronger
than the originals. Lastly, Griswold appreciated the very productive work session prior to the
meeting.

Subject: Resolution 2024-010: Recommending the City Council Amend Seward
City Code 15.10.226 – Land Uses Allowed Table, Prohibiting Cluster
Subdivisions in all Zoning Districts
Background and justification:
On April 2, 2024, Community Development held public work sessions with the Planning and
Zoning Commission to discuss Planned Unit Developments and to determine if any specific
regulations should be incorporated into city code. As part of the discussion, Cluster Subdivisions
were brought up since they are a form of a Planned Unit Development.
The definition of a cluster subdivision is, “A development design technique that permits a
reduction in lot area provided there is no increase in the number of lots permitted under a
conventional subdivision or increase in overall density of development by concentrating
buildings in specific areas on a site to allow the remaining land to be used for recreation,
common open space and preservation of environmentally sensitive areas”.
Currently our city code allows cluster subdivisions to be built in single-family, two-family, and
multi-family residential zoning districts with an approved conditional use permit. The Planning
and Zoning Commission supports the current minimum lot size requirements in city code for
each of these zoning districts and does not want to allow lot sizes to be any smaller.
Prohibiting cluster subdivisions would not restrict future developments to be able to set aside
land for recreation, common open space and preservation of environmentally sensitive areas, it
would simply mean that any such dedications would have to be done according to the current
lot size requirements in city code.
The effect of this legislation would be to prohibit cluster subdivisions in all zoning districts
within the City of Seward.
Comprehensive and Strategic Plan Consistency Information

Recommendation
The public notice and public hearing process has been complied with as required by
15.01.035(C)(1) and 15.010.040. If the Commission is in favor of the proposed amendment, SCC
15.01.035 gives the Commission power to provide a recommendation to City Council to amend
Seward City Code 15.10.226 – Land Uses Allowed as outlined in the attached Ordinance 2024-
XXX.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING THE CITY
COUNCIL AMEND SEWARD CITY CODE 15.10.226 – LAND USES
ALLOWED TABLE, PROHIBITING CLUSTER SUBDIVISIONS IN ALL
ZONING DISTRICTS
WHEREAS, according to Seward City Code 15.01.035, the Planning and Zoning
Commission by its own motion may recommend amendments to Title 15 to the City Council; and
WHEREAS, it is in the best interest of the community to periodically review and update
the City zoning code to reflect community changes and needs; and
WHEREAS, the Planning and Zoning Commission held a work session on April 2, 2024,
to review the use and regulation of Planned Unit Developments in city code; and
WHEREAS, during that work session, Cluster Subdivisions were also discussed as they
are a type of a Planned Unit Development; and
WHEREAS, the definition of a Cluster Subdivision is, “A development design technique
that permits a reduction in lot area provided there is no increase in the number of lots permitted

Subject: Resolution 2024-011: Recommending City Council approval of a
horizontal layout for the printed version of the official Seward Zoning
Map, which will display all zoned lands within the Seward City limits
Background and justification:
Seward City code requires that the official zoning map be adopted by City Council and signed
by the City Clerk (SCC 15.01.030(C)). City code 15.01.030(D) also states that “no changes of
any nature shall be made to the official maps except in conformity with the procedures set forth
in” Title 15, which procedures are the requirements for a public hearing.
The City of Seward has an online zoning map and a printed zoning map. The printed version of
the zoning map is a vertical layout that focuses primarily on the portion of the city that is located
on the west side of Resurrection Bay. The Seward Marine Industrial Center (SMIC) is placed
on the map as an inset graphic. An even smaller inset graphic shows the entire city limits and
the other portions of land that are not included in the two main areas of detail.
The vertical map layout has been used for some time since displaying the entire City of Seward
limits on a printed map is difficult and results in many of the parcels being reduced to a size that
is difficult to see. However, as the printed version of the zoning map is what is included in the
Seward Comprehensive Plan, it is essential that the map include the entire city limits.
Understanding the complexities of planning within Seward and how the various zoning districts
coincide is necessary to have maps that display the entire city limits.
The new layout will include a table that displays the Ordinances that have approved Land Use
Amendments since 1990. The numbers from the lines on the table are listed on the corresponding
parcels where land use amendments have been approved.
This new layout of the printed version of the Seward Zoning Map will not change any of the
current zoning designations.
On April 16, 2024, Community Development held a public work session with the Planning and
Zoning Commission to review the new layout for the official land use and zoning map.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL

WHEREAS, according to Seward City Code 15.01.030C, official land use and zoning
maps shall bear the adoption date and shall be signed by the City Clerk; and
WHEREAS, the City of Seward has two viewing formats for the official land use and
zoning map, an online version, and a printed version; and
WHEREAS, the current printed version of the official land use and zoning map is
displayed in vertical format and does not show the entire city limits; and
WHEREAS, the printed version of the official land use and zoning map is included and
referenced in the Seward Comprehensive Plan; and
WHEREAS, all land within the city of Seward limits have a designated zoning district,
and should be included on the official land use and zoning map; and
WHEREAS, the new proposed layout is a horizontal layout, rather than vertical, which
will include the entire city limits; and
WHEREAS, the proposed printed version of the official land use and zoning map only
changes the formatting of the map and does not change any of the zoning designations; and
WHEREAS, the new layout will also include a chart listing all of the Ordinances that have
approved land use amendments since the year 1990 and lists the corresponding number on the
properties where the zoning designations were changed; and
WHEREAS, the Planning and Zoning Commission held a work sessions on April 16, 2024
to review the new layout for the official land use and zoning map.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission, that:
Section 1. The Commission recommends this printed version of the official land use and
zoning map, incorporated herein by reference, be forwarded to City Council for approval.
Section 2. This resolution shall take effect immediately upon adoption.

1823 Nash Road; Within an Industrial (I) Zoning District
Background and justification:
Phil Zimmerman has submitted a Conditional Use Permit application to construct and operate a
camper park at 1823 Nash Road. The property it located within an industrial zoning district,
which allows the land use of a camper park with an approved CUP and an annual administrative
permit, which is issued by the City Clerk’s office.
This property has been used for camping and parking for many years, although it has never been
properly permitted. The conditional use permitting process will ensure that the use is consistent
with the purposes of the zoning district, that the value of the adjoining land will not be
significantly impaired, that the proposed use is in harmony with the comprehensive plan, that
public services and facilities are adequate to serve the proposed use, and that the proposed use
will not be harmful to the public safety, health or welfare. The administrative permitting process
will ensure that the use is compliant with Title 8.15 Article 4 – Camper Parks.
During the summer months, the tidelands adjacent to this property are used by a numerous
amount of fisherman. There is a public parking area further east off of Nash Road, but it is not
large enough to accommodate the many visitors that come to fish in Seward. The use of 1823
Nash Road to provide additional parking and camping for fishermen will relieve the congestion
of vehicles parking along Nash Road.
Surrounding Land Use and Zoning:
Development Requirements: All development within this planned unit development will
comply with Seward city code §8.15 Article 4 – Camper Parks.
Surrounding Land Use: The property to the west is zoned Resource Management, vacant, and
owned by the State of Alaska. Tidelands, owned by the City of Seward, are located to the south.
The property to the north is outside of city limits but is privately owned and also operated as a
campground. The property to the east is zoned Industrial and vacant land.

Floodplain Status: The northern portion of the property is located within an AE flood zone.
Any development within this area will require additional permitting through the city and
borough. The parking of RV’s within a flood zone are required to abide by §15.25.050(E).
Utilities: The camper park will be for dry camping and only accessible to self-contained RV’s.
Parking: There is no additional parking required for a camper park. However, there will be
parking provided for individuals to access the tidelands for fishing. The use of the land for a
parking area is allowed outright and will abide by §15.10.215(H). RV parking spaces will abide
by the regulations in §8.15.415, which requires at least 10 feet of clear space between camping
units.

hearing requirements of Seward City Code §15.01.040 were complied with.

2. An emergency vehicle parking / staging area shall be designated along the southwest end
of the property and marked as such to prevent any other vehicles from parking in that
location.
3. Per Seward City Code §15.10.325(f). an approved CUP shall lapse six months from the
date of approval if the use for which the permit was issued has not been implemented, a
building permit obtained, or other definitive steps taken to begin implementation of the
planned unit development. The Commission may grant a six-month extension upon finding
that circumstances have not changed sufficiently since the date of initial permit approval.
4. Modification of final approval of a conditional use permit may, upon application by the
permitee, be modified by the Planning and Zoning Commission:
a. When changed conditions cause the conditional use to no longer conform to the
standards for its approval.
b. To implement a different development plan conforming to the standards for its
approval.
c. The modification plan shall be subject to a public hearing and a filing fee set by
City Council Resolution.
Recommendation
The proposed use is permittable through the Conditional Use Permit process, which allows the Commission
the opportunity to ensure that the use is consistent with the purpose of the zoning district and surrounding
land uses, is in harmony with the Comprehensive Plan, and will not be harmful to the public safety, health,
or welfare.

campers or travel trailers are serviced or accommodated, no special toilet facilities will be
required”; and
WHEREAS, public parking along Nash Road to access the tidelands for fishing is
inadequate to accommodate the total the number of visitors that come to fish; and
WHEREAS, providing parking and camping on private land for fisherman to access the
tidelands would greatly alleviate the traffic congestion on Nash Road; and
WHEREAS, the applicant has complied with all the public hearing requirements of
Seward city code §15.01.040.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA, that:

Section 1. According to SCC 15.10.320.D., the Commission shall establish a finding that
the use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district.
Finding: According to the Land Use Allowed Table, §15.10.226, a camper park is
allowed within an industrial (I) zoning district with an approved conditional use permit.
The purpose of an industrial zoning district is to “establish a district in which the
principal use of land is for business, manufacturing, processing, fabricating, repair,
assembly, storage, wholesaling and distributing operations, which may create some
nuisance, and which are not properly associated nor compatible with residential land
uses. It is intended to provide environmental safeguards for people employed in or
visiting the district. Some visual amenity is expected in this district to make it
compatible with adjoining residential or business districts.”
B. The value of adjoining property will not be significantly impaired.
Finding: This condition has been met. This property has operated as a campground for
many years, however, it was never properly permitted or developed according to city
regulations. While the proposed use is the same, it will now be legal and constructed
and operated according to current standards and regulations for campgrounds.
C. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: This condition has been met. The proposal is in harmony with the Seward
2030 Comprehensive Plan.

D. Public Services and facilities are adequate to serve the proposed use.
Finding: This condition has been met. The proposed use is dry camping. Only self-
contained RV’s will be allowed. Any changes to the use will be required to follow the
regulations as outlined in Title 8.15 Article 4 – Camper Parks. The property has access
to Nash Road.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: This condition has been met. All construction will abide by International Fire
Code and International Building Code. All improvements, where applicable, will also
meet DEC requirements.

F. Any and all specific conditions deemed necessary by the commission to fulfill the
above-mentioned conditions shall be met by the applicant. These may include but
are not limited to measures relative to access, screening, site development, building
design, operation of the use, and other similar aspects related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be subject to the
following conditions:
1. The access roads into and through the camper park shall be constructed and maintained at
a minimum width of 26’.
2. An emergency vehicle parking / staging area shall be designated along the southwest end
of the property and marked as such to prevent any other vehicles from parking in that
location.
3. Per Seward City Code §15.10.325(f). an approved CUP shall lapse six months from the
date of approval if the use for which the permit was issued has not been implemented, a
building permit obtained, or other definitive steps taken to begin implementation of the

the administration to issue a conditional use permit to OLV LLC to construct and operate a camper
park at 1823 Nash Road legally known as The Point Subdivision Tract A That Point Thereof Lying
Within the Seward City Limits; within an industrial (I) zoning district.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320:
Conditional Use Permits and authorizes the administration to issue a conditional use permit.
Section 4. Administration shall periodically confirm the use conforms to the standards of
its approval. Nonconformance to these above stated conditions shall be grounds for revoking the
Conditional Use Permit.
Section 5. This resolution shall take effect 10 days following its adoption.

Meeting Date: May 7, 2024
To: Planning and Zoning Commission

Subject: Rescheduling certain Planning & Zoning meeting dates that conflict with
election dates
Background and justification:
The Planning and Zoning Commission holds regular meetings on every first Tuesday of the
month, and work sessions on every third Tuesday of the month. This year, there is a State election
scheduled to take place on August 20th, which is a P&Z work session; a Municipal election
scheduled to take place on October 1st, which is a P&Z regular meeting; and a State and National
election on November 5th, which is a P&Z regular meeting.
On these election dates, the Council Chambers will be occupied all day, and the City Clerk and
Deputy Clerk are unavailable.
Community Development staff recommends the Planning and Zoning Commission approve these
suggested changes to the meeting dates / locations to accommodate the elections:
Tuesday, August 20th – Since this is a work session, we will keep this date, but move the meeting
location to the library Community room.
Tuesday, October 1st – Since there are five Tuesdays in October, we would push back both
October P&Z meeting dates one week. The new P&Z regular meeting in October would be on
Tuesday the 8th (instead of the 1st), and the new P&Z work session would be on Tuesday, October
22nd (instead of the 15th).
Tuesday, November 5th – We cannot move this meeting date back a week since City Council is
meeting on November 12th to avoid meeting on Veteran’s Day (Nov 11th). So, we would like to
have the November 19th P&Z work session double as a regular meeting and work session. We
will plan to hold the work session from 5:30-6:45 pm, and then have the regular meeting follow
at 7:00 pm.
