It was made clear the land use code / table didn't not clarify or list retail stores that housed or accommodated
on site consumption per an additional endorsement process with AMCO. More over Marijuana businesses in
general were not clearly listed or identified in the COS planning and land use regulation table.
Department staff recovered and provided the City Code for Marijuana Establishments as outlined in Chapter 8
(Updated / created Jan 2, 2024) and Chapter 15 of the City Code.
In Chapter 15.10.140 the definition for Retail marijuana store does not include any allowances for on site
consumption. Nor has there been any local public hearing process to consider allowing such in MJ retails shops.
P&Z Commissioners requested staff to separate out potential retail stores that may acquire an on -site
consumption endorsement, from regular retail stores as defined in the City Code. (2019 AK State / AMCO
offered an on -site consumption endorsement for Retail Store owner/applicants).
July 16th, 2024 Work Session
Department staff presented a revised land use draft highlighting the following changes;
1. Consolidated 15.10.226 H, sections 3,4,5,& 6, to read:
All marijuana establishments shall meet all other criteria in this code and in Alaska Statutes and
Administrative Codes.
2. Added a list of Marijuana establishment types on to the land used table including Marijuana Retail
establishment that may have an onsite consumption endorsement for either in or outdoor use.
It was acknowledged early in this meeting that while clarifying the code and listing establishments in the land
use table we should perhaps only note and list that which is existing and not include additional definitions or
endorsements (without due process). Per further discussion the Commissioners resolved to certain inclusions
and exclusions as presented in the current drafts.
August 6th-- Until now and with what we are presented with in draft form, there has been no allowances for on -
site consumption in marijuana retail establishments listed in our code or land use tables.
Therefore I would like to move that we strike "Marijuana establishment, Retail store with onsite
consumption endorsement for both in or outdoor use", from the land use table while maintaining the
allowance of a Marijuana Retail Store as defined in Chapter 15.10.140, 55 d.
Then via due process let it be the Publics' / Council's will to approve any additional endorsements for on site
consumption.
3. Change #12 WHEREAS: The Commission recommends that a category for retail marijuana store with
onsite consumption, both indoor and outdoor NOT be added to the Land Uses Allowed Table until such
local endorsements are created thru public process.
NOW THEREFORE, THE CITY OF SEWARD ORDAINS that:
H3.. Except for onsite consumption endorsements of Retail Marijuana Stores all marijuana establishments
shall meet all other criteria in this Code and in Alaska Statutes and Administrative Code.
