RESOLUTION 2024-051
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO USE GRANT
FUNDS FOR PROFESSIONAL DESIGN AND ENGINEERING SERVICES
FROM PND ENGINEERS, INC, IN THE AMOUNT OF $117,673, FOR THE
DESIGN OF THE SECOND AVE FISH PASSAGE CULVERT
WHEREAS, in 2020 the Pacific States Marine Fisheries Commission allocated grant
funds from the Pink Salmon Fishery Disaster Relief Fund to communities in the Gulf of Alaska
affected by the Pink Salmon Fishery Disaster; and
WHEREAS, with Resolution 2022-110, City Council accepted a grant in the amount of
$118,914 for the purpose of adding culverts to improve salmon access*'from the lagoon to stream
water; and "•.
WHEREAS, Pacific States Marine Fisheries Commission has e3(1ded the deadline to use
grant funds to March of 2025; and • '' "•
WHEREAS, PND Engineers, Inc has created a.comprehensive scope with a proposal for
the design and engineering and writing the RFP for construction of tiie:fish..passage culvert for
streams from First and Second Lakes across Second Ave to the lagoon foifixed fee of $117,673;
and
WHEREAS, PND Engineering, Inc has proven expertise designing fish passage
culverts and local experience, including excellent engineering services for the 2017 storm
surge damage on Lowell Point Road; and
WHEREAS, staff have reviewed the proposed project scope with listed deliverables
and approved it as written.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby approves the use of grant funds for the Second Ave
fish passage culvert design proposal by PND Engineers, Inc.
Section 2. Funding in the amount of $117,673 is hereby accepted in 2016 Alaska Pink
Salmon Fishery Disaster Relief Fund 80022-0000-8101 infrastructure expense account.
Section 3. This resolution shall take effect immediately upon adoption.

Subject: Resolution 2024-051: Authorizing the City Manager to Use Grant Funds

Background and justification: The Pink Salmon Disaster Relief Fund, administered through the
Pacific States Marine Fisheries Commission, provided grant funding to be used for the design and
engineering costs for the installation of a fish passage culvert under Second Ave at the lagoon.
Water flowing from First and Second Lakes passes under Second Ave through two culverts. The
culverts are rusting out and partially clogged. Additionally, they are undersized and skewed along
the road, resulting in an excessive length of pipe. Most importantly, they were not designed for
fish passage. A new structure would improve the flow of water to alleviate flooding at nearby
properties, reduce the length of pipe, and improve ecological function for fish passage.
This project also creates the opportunity to design a viewing platform at the Rotary Pavilion for
educational opportunities and public enjoyment. This proposal will provide the engineering and
design necessary to complete an RFP for construction.

SUBJECT: SEWARD SECOND AVENUE FISH PASSAGE DESIGN FEE PROPOSAL
Doug:
PND Engineers, Inc. (PND) is pleased to provide a fee proposal for design for this fish passage culvert
replacement project. We understand that the City of Seward has funding for design services to provide
fish passage at the crossing of an unnamed tributary to "The Lagoon" and Second Avenue. The current
crossing consists of two 24-inch-diameter corrugated metal pipe (CMP) culverts and a 36-inch-diameter
CMP overflow culvert. The existing 24-inch CMPs are undersized and skewed along the road resulting in
excessive length of pipe. We understand that the City's objective is to install a new structure to provide
fish passage and improved ecological function. In addition to the fish passage structure, the City desires
to have a viewing platform constructed adjacent to the culvert outlet and restored channel as an
educational area for viewing fish moving upstream.
The size and location of the proposed new hydraulic structure is limited due to adjacent utilities, including
a water main located approximately 11 feet below top of road and a sewer main located approximately 6
feet below top of road. The proposed structure must fit between these two mainline utilities. While onsite,
we discussed installing a new, shorter structure, and reconstructing the channel adjacent to Rotary Park
(see Figure 1). This alternative would provide additional stream channel habitat and provide a public
viewing location and potential educational opportunities at the proposed platform. PND will investigate
this option during the concept development and through coordination with environmental permitting
agencies.
This proposal presents design and permitting fees to provide a bid -ready set of documents for this project.
We propose to complete the following tasks:
1) Site Visit & Survey
PND will conduct a hydrologic site assessment to gather necessary data for stream simulation design and
hydraulic modeling and verification of the U.S. Fish & Wildlife Service (USFWS) analysis.
PND will also collect topographic and bathymetric survey to supplement existing USFWS survey data
around the proposed crossing location and observation platform over the channel reconstruction area. It
is assumed that depths of the water and sewer mains will be verified by the City.

2) Hydrologic & Hydraulic (H&H) Report

DESIGN FEE PROPOSAL
PND will prepare a draft H&H report to include 35% concept design plans and hydraulic analysis for the
City's review. As part of this initial phase, design criteria will need to be developed and agreed upon. Based
on review of previous analysis and considering site constraints, it is likely that typical hydraulic design
criteria will not be achievable. Upon approval of the concept design, PND will progress design, preparing
plans, specifications, and construction estimates.

3) Plans, Specifications, & Estimates
After preparation of the H&H Report and a 35% concept design, additional design packages, including
plans, specifications, and construction cost estimates, will be prepared at the 65%, 95%, and 100% design
milestones. After each package has been reviewed by the City, PND will conduct a comment resolution
meeting to review comments and ensure design acceptance prior to progressing to the next milestone.
4) Permitting
At the 65% level, PND will develop environmental permit drawings and applicable permit applications for
review and comment. After incorporating the City's comments, PND will finalize applications and either
return them to the City for submission to agencies, or PND can submit them as the City's agent. It is
assumed that the City will cover any permit fees directly.

5) Bid Support
SECOND AVENUE FISH PASSAGE
DESIGN FEE PROPOSAL
After completion and acceptance of all project documents, PND will prepare a construction bid package,
conduct an on -site pre -bid meeting, and be available during the bid process for review and response to
questions as necessary.
Enclosed, please find a detailed breakdown of PND's fee proposal to complete the work described above.
PND proposes a fixed fee of $117,673 for design, permitting, and assistance during bidding. If desired,
PND can provide construction administration services for an additional fee. Services will commence
immediately upon receipt of notice to proceed (NTP) with site reconnaissance tentatively scheduled for
August or early September. The remainder of the tasks will follow a schedule that is to be coordinated
and agreed upon between PND and the City of Seward.
