ADJOURNMENT City Council Meeting Agenda May 12, 2025 3 1 P a g e PROCLAMATION National Public Works May 18-24, 2025 "People, Purpose, Presence" WHEREAS, the public works professionals focus on infrastructure, facilities, and services that are of vital importance to sustainable and resilient communities and to public health, high quality of life, and well-being of the people of the City of Seward Alaska; and WHEREAS, these infrastructure, facilities, and services could not be provided without the dedicated efforts of public works professionals, who are engineers, managers, and employees at all levels of government and the private sector, who are responsible for rebuilding, improving, and protecting our nation's transportation, water supply, water treatment and solid waste systems, public buildings, and other structures and facilities essential for our citizens; and WHEREAS, it is in the public interest of the citizens, civic leaders, and children in the City of Seward Alaska to gain knowledge of and maintain an ongoing interest and understanding of the importance of public works and public works programs in their respective communities; and WHEREAS, the year 2025 marks the 65th annual National Public Works Week sponsored by the American Public Works Association/Canadian Public Works Association be it now; and NOW, THEREFORE, I, Sue McClure, Mayor of the City of Seward do hereby designate the week of May 18-24, 2025, as National Public Works Week. Dated this 12th day of May 2025 THE CITY OF SEWARD, ALASKA Sue McClure, Mayor 5 PROCLAMATI ON Building Safety Month — May 2025 WHEREAS, the City of Seward is committed to recognizing that our growth and strength depends on the safety and essential role our homes, buildings and infrastructure play, both in everyday life and when disasters strike; and WHEREAS, our confidence in the resilience of these buildings that make up our community is achieved through the devotion of vigilant guardians —building safety and fire prevention officials, architects, engineers, builders, tradespeople, design professionals, laborers, plumbers and others in the construction industry —who work year-round to ensure the safe construction of buildings; and WHEREAS, these guardians are dedicated members of the International Code Council, a nonprofit that brings together local, state, territorial, tribal and federal officials who are experts in the built environment to create and implement the highest -quality codes and standards to protect us in the buildings where we live, learn, work and play; and WHEREAS, these modern building codes and standards include safeguards to protect the public from hazards such as hurricanes, snowstorms, tornadoes, wildland fires, floods and earthquakes; and WHEREAS, Building Safety Month is sponsored by the International Code Council to remind the public about the critical role of our communities' largely unknown protectors of public safety —our code officials —who assure us of safe, sustainable and affordable buildings that are essential to our prosperity; and WHEREAS, "Game On!," the theme for Building Safety Month 2025, encourages us all to get involved and raise awareness about building safety on a personal, local and global scale; and WHEREAS, each year, in observance of Building Safety Month, people all over the world are asked to consider the commitment to improve building safety, resilience and economic investment at home and in the community, and to acknowledge the essential service provided to all of us by local, state, tribal, territorial, and federal building safety and fire prevention departments, in protecting lives and property. In addition to the training, Sorensen noted it had been a whirlwind week with lots of events including the Chugachmiut open house and the US Coast Guard Mustang decommissioning ceremony. In between all the events and training, the city conducted interviews for the Chief of Police and she introduced Louis Tiner to council. 8 City of Seward, Alaska City Council Meeting Minutes April 28, 2025 Volume 42, Page Deputy City Manager Jason Bickling updated council on the Jesee Lee Home site. There would be more core samples required. There will be a work session in the near future for council input on the site. Electric Operations Supervisor Taylor Crocker updated council on the recent power outage that was caused by falling trees during a windstorm. This was a continual hazard because the trees kept blowing down in the Kenai Lake area. The city was back on backup generators in 40 minutes. Sorensen added that it was one of the windiest, scariest drives back from Anchorage that day. City Clerk Report - None City Attorney Report - None Other Reports and Announcements- None Presentations - None PUBLIC HEARINGS - None UNFINISHED BUSINESS Ordinances for Enactment Ordinance 2025-007: Amending Seward City Code §15.10.140 Definition of an Efficiency Apartment; § 15.10.226 Land Uses Allowed Table, Adding Attached and Detached Accessory Dwelling Units; and Updating §15.10.215 Parking for Accessory Dwelling Units [This item had a public hearing on April 14, 2025, and was postponed] Motion (already on the floor) Approve Ordinance 2025-007 Sorensen explained the two laydowns provided by Community Development that were labeled as Substitute Ordinance 2025-007 Version 1 and Substitute Ordinance 2025-007 Version 2. McClure motioned to amend Ordinance 2025-007 by adopting the changes in Substitute Ordinance 2025-007 Version 2. This amendment passed. Main Motion as Amended Passed Unanimous 9 City of Seward, Alaska City Council Meeting Minutes April 28, 2025 Volume 42, Page NEW BUSINESS Resolutions Resolution 2025-037: Authorizing the City Manager to Create the Full -Time Position of Utility Billing Specialist in the Electric Department to Provide Services Currently Outsourced to the Util- Assist Contractor Motion (Osenga/Wells) Approve Resolution 2025-037 Crocker explained how the city was outsourcing billing services to Util-Assist in Canada and how customers had to call a 1-800 number for billing questions. He would rather see this money spent towards hiring a local to fill this position. This newly hired billing specialist could also provide backup support to the front desk staff at the Electric Department. Wells recalled being on council in 2023 when the billing services was outsourced to Util-Assist. He said it was mainly done out of desperation because the job posting was vacant for such a long time. He wondering what the current odds were of being able to fill this position. Sorensen said she was confident the city would be able to fill the position this time around due to the wage increase. Crocker added with a smile that people also knew how great the Electric Department was now. Motion Passed Unanimous Resolution 2025-039: Recommending Kenai Peninsula Borough Approval of the Preliminary Plat of 204 Lowell Canyon Road and 206 Lowell Court, Vacating the Eastern Portion of the Lowell Court Right -of -Way and Vacating the Southern 10' of the Property Located at 204 Lowell Canyon Road Motion (Osenga/Wells) Approve Resolution 2025-039 City Planner Courtney Bringhurst stated this was a recommendation in the 2023 Muni Lands Plan. She summarized from the agenda statement in the packet. Finch declared a potential conflict of interest due to being one of the affected property owners. McClure ruled a conflict of interest did exist and she excused Finch from discussion and voting. He said per code for council to initiate an improvement district there needed to be an official motion made by council. This would save time compared to the property owners doing another petition. Sorensen thanked all the retirees tonight for their service. This weekend she will be heading to Washington, D.C. with Vice Mayor Osenga, and they had lots of good meetings lined up. Crites congratulated the retirees and said welcome to Police Chief Tiner. Warner echoed the previous comments from Crites. Finch thanked the US Coast Guard Mustang for years of service to Seward. He congratulated the retirees and welcomed Police Chief Tiner. Wells said he also drove on the Seward Highway during that windstorm and saw the electric crews on site working to restore the power. He was impressed with their scary job and was grateful for their work. He attended the town hall meeting at bear creek and gave a shout out to comm dev. The presentations were incredible and community participation. It was very busy and he was looking forward to a busy summer season. Osenga echoed previous comments and thanked the retirees and wished them the best in future endeavors. He appreciated the Mustang for the years of service in Seward. Lastly, he extended a warm welcome to Police Chief Tiner. McClure echoed previous comments and congratulated the retirees and welcomed Police Chief Tiner. She attended several events lately such as: the decommissioning of the Mustang, the Chugachmiut open house, and the Comprehensive Plan town hall meetings. She noted the town halls were very well run, and May 3, 2025 was last chance for comments on the surveys. McClure was already looking ahead to the Solstice Cemetery Tour in June, and she has a great lineup planned out for the tour. The internal city department checklist is quite comprehensive, and the city utilizes OpenGov software to make these internal compliance checks streamlined and efficient. Compliance checks outside the scope of these city departments require the clerk's office staff to manually create a spreadsheet of all applicants and email this document back and forth to the KPB sales tax division. This manual process is tedious and time-consuming and creates frustration with both the applicants and city staff. If a business is not in compliance, it requires us to manually and periodically re -check with the KPB. This ordinance would streamline the process for business applications by focusing only on the internal city compliance checks. X Yes Attorney Signature: Not applicable Comments: 14 Ordinance 2025-009 Sponsored by: City Clerk Introduction: May 12, 2025 Public Hearing: May 27, 2025 Enacted: TBD CITY OF SEWARD, ALASKA ORDINANCE 2025-009 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE, TITLE 8, CHAPTER 8.30.015 BUSINESS LICENSE REQUIRED AND 8.30.025 APPLICATION FOR A BUSINESS LICENSE WHEREAS, Seward is the only city in the Kenai Peninsula Borough that requires a city business license; and WHEREAS, the City Clerk's office staff spends an onerous amount of time manually checking borough sales and property tax requirements which are outside the scope of the city's OpenGov compliance check program; and WHEREAS, it is the responsibility of the business to maintain compliance with all borough and state requirements, including but not limited to, sales tax, property tax, health and safety, fire code, and food sanitation; and WHEREAS, in order to streamline the application process for city staff, this ordinance will no longer require city staff to run compliance checks beyond the internal city department checklist. NOW, THEREFORE, THE CITY OF SEWARD ORDAINS, that: Section 1. Seward City Code Title 8 is hereby amended to read as follows with new language underlined and deleted language is stricken: 8.30.015 Business license required. A. No person may engage in a business in the City without first obtaining an annual or seasonal business license as provided in section 8.30.025 of this chapter. B. A separate business license is required for each business. C. {€}The business license or approved duplicate license shall be displayed prominently at the site of the business. D. {d}A business license may not be sold, assigned, transferred or otherwise conveyed. If a person ceases to engage in business, changes the name or type of business, nature or business location, the business license expires. becomes void. 15 Ordinance 2025-009 CITY OF SEWARD, ALASKA ORDINANCE 2025-009 Page 2 of 3 8.30.025 Application for a business license. A. A person engaging in a business shall apply to the City Clerk for a business license bar completing the required application steps as outlined below. on a form prescribed by the City and The business shall not open for business until the business license is issued. Renewal license applications must be filed no later than January 31 in each subsequent year, except that a seasonal business operating during the summer season, May 1 to September 30 only, shall file a renewal application no later than May 1 in each subsequent year. B. Each application shall contain the following information: 1. The legible signature of the applicant; 2. An affirmation or oath as may be required on the application form; and 3. A description of the type and nature of the business. C. Each application shall be accompanied by: 1. An annual, non-refundable fee of $30.00 per license, provided that the fee per license for an application submitted after the due date shall be $60.00 subject to a late fee. Business license fees shall be set by City Council fee schedule resolution; 2. Proof satisfactory that the applicant has received or applied for a A valid state business license when such a license is required by state law; 3. Proof satisfactory An affirmation that the applicant possesses a valid will remain in compliance with the Kenai Peninsula Borough sales tax division; license when such license is required by law; 4. Proof satisfactory An affirmation that the applicant has received an applicable federal or state occupational license when such license is required by federal and/or state law; 5. Proof satisfactory of any Any permits as required by any other sections contained in this code; 6. Depending on the type of business, the verification process may include from review by the city community development department, harbor department, fire department, police department, electric department, and finance department attesting that a-I4 accounts for utilities, taxes and assessments arc current the business's accounts are current and that it is in compliance with the requirements of each of these respective city departments. 7. Verification from the Kenai Peninsula Borough that all sales and property tax accounts arc current. D. Upon receipt of the application, accompanied by the annual fee, the City Clerk shall review the application and may consult with appropriate officials to determine whether the 16 Ordinance 2025-009 CITY OF SEWARD, ALASKA ORDINANCE 2025-009 Pa2e 3 of 3 information contained therein is true and complete and otherwise in compliance with this chapter. E. Upon determining that the business application is in compliance with this chapter, the City Clerk shall issue a business license. F. If the application is denied, the City Clerk shall indicate on what grounds the denial is based. The application fee will not be refunded. G. It is the responsibility of the business to maintain compliance with all borough and state requirements, including but not limited to, sales tax, property tax, health and safety, international fire code, and food sanitation. H. If an application is denied, thc City Clerk may issue a temporary license valid for no more than 14 calendar days to permit thc applicant time to reapply. If no application is submitted within thc 14 day period, or if the subsequent application is denied, Failure to obtain a city business license the applicant is in is a violation of this chapter and the business must either cease engaging in business or be subject to the penalty provisions contained in this chapter. The format was a little different this year — more in-depth presentations on topics and organization on the Kenai Peninsula. A few highlights include In depth Economic Analysis of the Kenai Peninsula by Wink Consulting. One of the interesting facts that came up was that the Seward Bear Creek Area is one of the only areas in the Borough that is shrinking in population and school enrollment. Presentation by Cory Ortiz, the new AVTEC Director. I think that we will be seeing some tangible positive changes from a number of their programs in the near future. There was also an in-depth discussion of the natural gas shortage in Cook Inlet and both short - and long-term strategies to manage that situation. Cassidi Cameron will be coming and speaking to Council on June 23 on the Comprehensive Economic Development Strategy (CEDS) for the Kenai Peninsula Borough. Harbormaster's Office and South Harbor Uplands Design Charette: On Thursday, April 17 R&M and KPB staff came into town to do a walkthrough of the current harbor facilities and had discussions with the staff on how they use their spaces and what they needed to be more efficient. They also walked the south harbor uplands for future development ideas. Tony Sieminski and Jason Bickling spent the rest of the afternoon having planning and design conversations with that group. Contact: 907-224-3445 • Seward and Bear Creek Fire departments tested out 8 new members on their Firefighter 1 on April 26th • We have 12 students from Seward and Bear Creek FD in Fire Apparatus Operator Pumper class that is 3 weeks long and covers driving, operating, and pumping fire apparatus • On May 2, crews rescued a female victim from a boat fire at SMIC and safely extinguished the fire. Thanks to Bear Creek, Lowell Point, and SVAC for their assistance Community Development • Community Development is working on analyzing and compiling the information and feedback given at the recent Comprehensive Plan Town Hall workshops. Over 100 members of the community participated in the process. We don't have much feedback from the younger demographic (18 and under) and so we are working with the Middle and High School to potentially connect with their students before the end of the school year. At the time of drafting this CMR, there are 73 participants signed up. • We are currently transitioning our membership to MyRec from RecDesk. MyRec is gym management software that provides more communication in the platform and will enhance members' experience at AVTEC gym. Gym users can expect to check in using the new software on June 1st. The biggest change for members is that they will be scanning into the gym on a barcode scanner, which they can either do using a physical key tag or a barcode saved on their phone. • Bike Rodeo and Super Saturday was Saturday, May 10 in front of City Hall on Adams Street. Kids received a free bike helmet, participated in a bike course, pumped their bike tires, and got a free tune-up from Karl at the Seward Bike Shop. During this time, we will be providing yellow trash bags for participants to aid our community in the post -winter trash pickup. We have prizes such as kayaking trips and boat tours available for the party that picks up the most trash! • We kicked off our Drive Less, Move More Challenge! This annual emissions reduction challenge takes place from Earth Day to the end of August. Participants log their hours on RunSignUp to earn a sticker after they accumulate 10 miles of either walking or biking to commute to work or for errands. The winner of the biking and walking category will each receive a $100 gift card. Tell your coworkers about this challenge, it's a great excuse to spend more time outdoors in your daily routine! • Exit Glacier Run will be held Sat, May 17 in conjunction with the Torch Run. Race begins at 10 AM. Same day registration until 9:30 AM • The Kite Festival was a massive success, with a large bit of help provided by some outstanding weather. We had music, vendors and a bonfire to accompany the return of the Easter Egg Hunt on Friday, April 18th. We had around 30 kids show up for the Egg Hunt. Saturday was a beautiful day with hundreds in attendance. Alaskakiters provided wonderful kite displays in Marathon Campground, and we had more amateur kite flying occur than in past years. 49 CMR May 12, 2025 Teen Rec Room: • April has been a big month for the Teen Rec Room. As of April 21, the Teen Rec Room has taken on a new lead with Adam Thomas stepping into the role of Program Assist to the Teen Rec Room. • The Teen Rec Room has seen 38 check -ins in the second half of April (4/16-5/1) with a total usage time of 73 hours and 21 minutes. We have noticed that the usage of the teen room is beginning to look more consistent with at least 3 teens using the facility at any given point. Though we are starting to see more consistency, we are still adding new members each week. • First impressions of the point system are showing promise moving forward. We currently have 7 teens showing up and offering to help us clean and do other tasks on a daily basis with more teens showing interest every day. • We have officially made pizza available for teens to purchase every day of the week. The teens have already begun taking advantage of the new punch passes. Not only are they taking advantage of the new access to meals, they are also jumping at every chance they get to help us prepare the food, as well as clean up afterwards gaining skills that will follow them as they grow into young adults. Campgrounds: • Our Campground season is officially open for the Summer season! • All the Parks restrooms are now open including the Shower house. • Installed new Water fountains / bottle fillers at Kawabe Park and Adams restrooms. • Prepping Gardens around town to plant beds in June. 50 CMR May 12, 2025 Park Maintenance: • The permanent restroom installation for Williams Campground is complete! Harbor Department • No major issues have been reported within the Harbor area. • Deputy City Manager Bickling and I will be meeting with R&M and KPB Architects on 5.6 to continue our design discussion about the new Harbormaster building and South Upland concept. • Starting May 4, the Harbor office will be starting our summer hours and open seven days a week. • Seasonal services and facilities are now open for the summer. We had some minor repairs and will continue to address those issues as they arise. • The AAHPA awarded our three scholarships on April 29 and one Transpac Marinas scholarship on May 24. The AAHPA received 31 applicants and Transpac received 34 for their generous scholarship. • We saw 37 lifts with the 50-ton Travelift 51 CMR May 12, 2025 • Ryan Anger, Elijah Wessel, Mike Newcomb and I cut the lines loose one final time for the USCGC Mustang on April 25 and watched her leave and head South to her new home. This was an end of an era for the 110's with the last 3 in the nation here in Alaska. We are excited about that next phase and look forward to welcoming a new Sentinel -Class Cutter. • Fun Fact —James Cook entered Prince William Sound in 1778 and initially named it Sandwich Sound, after his patron the Earl of Sandwich. Later that year, the Sound was named to honor George Ill's third son Prince William Henry. SMIC • A boat fire occurred on May 1 within the SMIC storage yard. Details are still unknown and more to follow if needed. • The new lease for JAG's yard/rail extension project has been completed. JAG has sent it to their legal team and we are waiting for a response • We saw 12 lifts with the 300-ton Travelift Electric Department • Power Sales Agreement Progress: The Power Sales Agreement between Chugach Electric Association and the City of Seward continues to move forward positively. We anticipate finalizing and closing the agreement by the end of May. • Staffing Changes and Recruitment: Our Electric Utility Cashier has announced plans to relocate to another area of the peninsula, bringing the total current job openings within the Electric Department to three. Open positions include Electric Utility Cashier, Electric Billing Specialist, and Journeyman Lineman. • Lawing Substation Rebuild Engineering: Engineering efforts for the Lawing Substation rebuild have significantly progressed. The project site has now been surveyed, and detailed substation design work continues to advance toward completion. • GIS Mapping Project RFP: The Electric Department currently has an open Request for Proposals (RFP) to true up and update our electric system assets within the City's Geographic Information System (GIS) software. Accurate GIS mapping is critical as it will support the development of our five-year maintenance plan and improve asset valuation and management. 52 CMR May 12, 2025 • KPFF Project Management Selection: The City has officially engaged KPFF Project Management to oversee the EPA -funded Shore Power Project. KPFF's extensive project management experience will be instrumental in guiding this significant infrastructure initiative successfully. Human Resources • The City recently posted three positions to the public. The Electric Department has two new openings — Electric Utility Cashier and Electric Utility Billing Specialist. Both are customer service -focused positions. • The Electric Utility Billing Specialist position is a new role in the City and will focus on customer billing issues, utility tariffs and accounting related to enterprise funds. This position will also alleviate the need to use a non -local contractor for these services, something we expect the Seward community will greatly appreciate. • Community Development is looking for an executive assistant. This versatile position will not only support the administrative functions of Community Development but also assist the Director and Planner with research to help formulate code and assist with Planning & Zoning Commission meetings. • There are still positions available in the Finance Department, openings for patrol officers, and several seasonal jobs at Parks & Recreation. After carefully reviewing each one, we selected the following 4 students to participate. Logan Johnson is currently a sophomore at SHS, and this will be his first experience participating in a student exchange program. He is active in a variety of extracurricular activities and enjoys hiking, biking, skiing, fishing, and photography, among many other interests. Logan also gives back to his community by shoveling snow for seniors, participating in town cleanups, and volunteering at local and church events. Jaelyn Crites is also a sophomore at SHS and will be taking part in her first student exchange program. Her family has been involved in hosting students from Obihiro for several years, often in partnership with the Rotary Club. Jaelyn enjoys volleyball, theatre, reading, and academics. Alex Fink, a sophomore at SHS, is also participating in his first student exchange program. He is involved in cross country and track and field, and outside of school, he enjoys aviation, skiing, video games, and traveling. He also runs in the Mount Marathon Race. Electric Utility: The Railbelt Transmission Organization was issued a Certificate of Public Convenience and Necessity by the Regulatory Commission of Alaska (Docket U-24-042). Now that it is certificated, the RTO will be able to finalize its tariff application and file before July 1, 2025. We continue to aid in negotiations with Chugach Electric on a new long-term Power Supply Contract. We represented the City in another RCA case concerning the Electric Reliability Organization, the Railbelt Reliability Council or RRC (Docket E-25-001). The docket consisted of the RRC's first tranche of reliability standards which the City has helped develop and will be required to meet if approved by the RCA. We provided guidance on a billing dispute involving mislabeled meters. We provided advice regarding utility bill liens. Personnel: We continued to advise on personnel questions as they arise.
