HomeMy WebLinkAboutRES2025-100 Hemlock Ave ImprovementsSponsored by: Sorensen CITY OF SEWARD, ALASKA RESOLUTION 2025-100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE ALLOCATION OF $240,680 FROM THE GENERAL FUND FOR THE CITY'S COST SHARE OF WATER AND SEWER INFRASTRUCTURE IMPROVEMENTS ON HEMLOCK AVENUE AND APPROPRIATING FUNDS WHEREAS, the City of Seward supports public -private partnerships that facilitate community growth, housing development, and the extension of municipal utilities in a cost- effective and sustainable manner; and WHEREAS, Title 16, Chapter 16.05, of the Seward City Code specifies certain improvements that must be provided by the subdivider, owner, proprietor or developer (collectively referred to in this Agreement as "Developer") prior to conveying platted lots to any other person; and WHEREAS, such lots must be provided with streets, communication and electric lines, water systems, sewer systems and street lighting, (SCC § 16.05.010); and WHEREAS, no building permit may be issued for construction of a dwelling unit on a platted lot until the owner thereof has provided the required improvements for such lots (SCC § 16.01.025); and WHEREAS, consistent with the land swap agreement and the mutual obligation to comply with the water and sewer condition to record the final plat, the Developer and City agree to share the expense of bringing water and sewer utilities down Hemlock Ave to the newly created parcels designated as Tracts 5B-1 and 5B-2, which was a condition of the Seward Planning and Zoning Commission Resolution 2025-020; and WHEREAS, the Developer is responsible for constructing and installing the water and sewer utilities to standard specifications to Tracts 5B-1 and 5B-2; and WHEREAS, the Developer intends to construct and install the water and sewer utilities primarily with their own resources and not rely on any substantial subcontracting of mechanics and laborers; and WHEREAS, the total estimated cost of improvements is $481,360, including a 10% contingency.; and WHEREAS, the City has a vested interest in bringing utilities to the nearby lot for future development; and. CITY OF SEWARD, ALASKA RESOLUTION 2025-100 Page 2 of 2 WHEREAS, the City and Developer have agreed to share equally (50/50) in the cost of constructing and installing the water and sewer utility improvements, with the City's share not to exceed $240,680, including contingency and proportional change orders. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Council hereby authorizes the City Manager to execute all necessary documents and coordination to ensure project completion. Section 2. Funding in the amount of $240,680 will be transferred from the General Fund unassigned fund balance 01000-0000-3710 to the Utility Improvement District City Funding 80070-0000-3700, and the expense will be allocated in the 80070-0000-8101 Infrastructure Expense Account. Sue McClure, Mayor Barnwell, Calhoon, Osenga, McClure None Warner, Draper, Crites None 1 1 City Council Agenda Statement Meeting Date: October 27, 2025 To: City Council Through: Kat Sorensen, City Manager Subject: Resolution 2025-100: Authorizing the Allocation of $240,680 from the General Fund for the City's Cost Share of Water and Sewer Infrastructure Improvements on Hemlock Avenue and Appropriating Funds Background and justification: The City of Seward and a private developer both wish to install utilities down Hemlock Ave. Under Title 16 of the Seward City Code, developers are required to provide certain subdivision improvements, such as water, sewer, and street infrastructure, before lots can be conveyed or building permits issued. To meet these requirements and extend utility infrastructure down Hemlock Avenue, the City and the developer have agreed to share the cost of water and sewer installation equally. The improvements include approximately 650 linear feet of sewer line, 620 linear feet of water line, three fire hydrants, three sewer manholes, and 7,800 square feet of asphalt restoration, with a total estimated project cost of $481,360 (including contingency). The developer will pay the total project cost up front. The City's share of the cost, not to exceed $240,680, will be funded from the General Fund. The developer will manage the project, including installation and construction, and will provide documentation to the City for reimbursement after the project's completion. This shared investment supports both private development and the City's long-term infrastructure goals. The improvements will serve the new development while also providing utility capacity for adjacent City -owned parcels, reducing future project costs and promoting efficient use of public resources. By partnering on this project, the City advances housing opportunities and strengthens its infrastructure network at a cost-effective rate.
