HomeMy WebLinkAboutRES2025-107 2405 Seward Hwy Land Exchange1 1 Sponsored by: Sorensen Public Hearing: November 17, 2025 CITY OF SEWARD, ALASKA RESOLUTION 2025-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE DISPOSAL OF CITY PROPERTY NEAR 1000 HEMLOCK AVENUE AND THE ACQUISITION OF PRIVATELY - OWNED PROPERTY NEAR 2405 SEWARD HIGHWAY FOR A LAND EXCHANGE WHEREAS, the City owns property at 1000 Hemlock Avenue and 2500 Laurel Street (collectively known as the "Snow Dump"), which is used for storing equipment, materials, and snow; and WHEREAS, the City has been looking for an opportunity to negotiate a land swap to expand the Snow Dump and enhance its usability; and WHEREAS, the owners of the adjacent property (Travis Maurer and Robert Williams) at 2405 Seward Highway are willing to negotiate a land swap; and WHEREAS, a land swap would benefit the public, while also benefiting the adjacent private property owners (Maurer & Williams); and WHEREAS, the Council authorized the City Manager to negotiate the land swap with Resolution 2024-041 (August 12, 2024); and WHEREAS, the City Manager has matured the land swap negotiations for Council consideration; and WHEREAS, upon completion of the land swap, the City would own a parcel that is generally described as Tract 5B-1, Forest Acres Subdivision Seward Gateway Properties, Seward Recording District, State of Alaska, containing 8.083 acres more or less; and WHEREAS, upon completion of the land swap, Maurer & Williams would own a parcel that is generally described as Tract 5B-2, Forest Acres Subdivision Seward Gateway Properties, Seward Recording District, State of Alaska, containing 5.716 acres more or less; and WHEREAS, the Seward Planning and Zoning Commission recommended the City Council and Kenai Peninsula Borough approve the plat via Resolution 2025-017 (May 6, 2025) and recommended the City Council approve the rezone via Resolution 2025-020 (June 3, 2025). CITY OF SEWARD, ALASKA RESOLUTION 2025-107 Page 2 of 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Public Interest Finding. This land exchange is in the public's interest because access to both the City and Maurer & Williams parcels will be improved, the City can expand the snow dump area to enhance its usability, and the private property will have greater development potential for housing, which is needed in the community. Section 2. Land Exchange Authority. The Council authorizes the City Manager to execute a land exchange that disposes of approximately 0.973 acres of City property (portion of Lot 13, For Raymond Subdivision, Plat 86-10, Seward Recording District; see Exhibit A) to Maurer and Williams in exchange for acquiring approximately 0.973 acres of privately owned land (portion of U.S. Survey 149, Seward Recording District; see Exhibit B) from Maurer and Williams. Section 3. Essential Terms and Conditions. The land exchange is subject to the following essential terms and conditions: A. Purpose. The purpose of this negotiated land swap is to create Tract 5B-1 and Tract 5B-2, Forest Acres Subdivision, Seward Gateway Properties. B. Means of acquisition and disposal. Negotiations with the adjacent private property owners (Maurer & Williams). C. Purchase and sale price. The approximately 0.973 acres of land being exchanged is of equal value. Because the land is of equal value and an appraisal would unnecessarily increase the land exchange transaction costs, the public interest is best served by not requiring an appraisal. D. Contingencies. The land exchange is contingent on the following events occurring: 1. Rezone. The properties are rezoned to an Auto Commercial zoning district. 2. Subdivision agreement. The City Manager and Maurer & Williams execute a subdivision agreement in which the City pays half of the costs to construct water and sewer utilities as required by SMC 16.05.015. 3. Plat approval. The properties are platted as recommended by the Planning and Zoning Commission Resolution 2025-17. E. Closing costs. The City Manager may include other terms and conditions as the City Manager determines to be in the public interest. Section 4. This resolution shall take effect 30 days after adoption. To expand and enhance the usability of the Snow Dump, the City has been exploring opportunities for a land swap with adjacent property owners. Travis Maurer and Robert Williams, owners of the property at 2405 Seward Highway, are willing to negotiate a land exchange. This proposed land swap benefits the public by improving access to both parcels, expanding the City's snow storage area, and providing the private property owners with additional development potential, including housing opportunities. The Council previously authorized the City Manager to negotiate this land exchange through Resolution 2024-041 (August 12, 2024). Negotiations have now been finalized for Council consideration. The land swap involves the following key components: • Disposal of approximately 0.973 acres of City -owned property at 1000 Hemlock Avenue to Maurer & Williams. • Acquisition of approximately 0.973 acres of privately owned land from Maurer & Williams near 2405 Seward Highway. • Creation of Tract 5B-1 and Tract 5B-2 in the Forest Acres Subdivision (Seward Gateway Properties). • Rezone of the properties to Auto Commercial zoning. • City and private cost -sharing for water and sewer utility installation as required by the subdivision agreement. The Seward Planning and Zoning Commission recommended approval of the plat (Resolution 2025-017, May 6, 2025) and the rezone (Resolution 2025-020, June 3, 2025).
