RESOLUTION 2026-046
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, APPROVING
THE DEVELOPER REIMBURSEMENT PROGRAM APPLICATION SUBMITTED BY
ROBERT WILLIAMS AND TRAVIS MAURER FOR WATER, SEWER, ELECTRIC, AND
ROAD EXTENSIONS BENEFITING TRACTS 5B-1 AND 5B-2, FOREST ACRES
SUBDIVISION, AND AUTHORIZING AN EXPENDITURE IN THE AMOUNT OF
$639,100 AND APPROPRIATING FUNDS
WHEREAS, on April 13, 2026, the City Council held a work session to review Developer
Reimbursement Program (DRP) applications and directed administration to return with resolutions
funding each applicant at 50 percent; and
WHEREAS, the proposed improvements include water, sewer, electrical, road, and lighting
infrastructure to serve properties as described in the title of this resolution, which are subject to a
pending replat approved by the City of Seward to create Tracts 5B-1 and 5B-2, Forest Acres
Subdivision, Seward Gateway Properties; and
WHEREAS, the improvements are intended to serve the parcels that will be created through this
replat; and
WHEREAS, a Conditional Use Permit has recently been approved for a 17-unit multifamily
development on one of those proposed parcels, demonstrating near -term housing development
potential; and
WHEREAS, the total estimated cost of the Special Improvement District is approximately
$639,100, and the City will pay for the installation of public improvements upfront, utilizing
Reimbursement Method 1, with the developer reimbursing 50 percent of those costs through the
Developer Reimbursement Program; and
WHEREAS, following completion of the project, the actual costs will be calculated and a
subsequent resolution will establish the final assessment, payment terms, and any applicable
penalties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA:
Section 1. The special improvement district, referred to as the Williams/Maurer Improvement
District, will include 1 - 4 of portions of the properties described as (MERIDIAN SW 0860010
FORT RAYMOND SUB LOT 13, and SEWARD MERIDIAN SW THAT PORTION OF US
SURVEY NO 149 BEGIN AT POINT ON THE NORTHERLY LINE OF SAID SURVEY, NORTH
63 DEGREES 41' E 1178.10 FT FROM CORNER NO 2 THEREOF, POB; THENCE S 54
DEGREES 31' E 251.62 FT TO WESTERLY ROW LINE OF ALASKA RAILROAD; THENCE
S 29 DEGREES 10' W ALONG WESTERLY ROW LINE 521.21 FT; THENCE N 54 DEGREES

31' W 586.7 FT TO NORTHERLY BOUNDARY OF SAID SURVEY; THENCE N 63 DEGREES
41' E 587.8 FT TO POB, EXCLUDING THE SEWARD HIGHWAY ROW AND THE ALASKA
RAILROAD ROW), which are subject to a pending replat to create Tracts 5B-1 and 5B-2, Forest
Acres Subdivision, Seward Gateway Properties
Section 2. After full review by the City Council of all the facts and opinions presented, it is hereby
determined that the proposed Williams/Maurer Improvement District is in the public's interest, is
necessary, and will benefit the properties to be assessed.
Section 3. The City Council hereby approves the Williams/Maurer Developer Reimbursement
Application and the reimbursement of 50 percent of the costs related to the installation of public
improvements and authorizes the City Manager to proceed with the design and construction of the
Williams/Maurer Improvement District.
Section 4. The City Manager is hereby authorized and directed to keep account of all costs
associated with the improvements, including acquisition of interests in land, design, engineering,
administration, overhead, professional services, bond or loan costs, and all other costs resulting
from the construction of the improvements.
Section 5. Funding in the amount of $639,100 is hereby appropriated from the Developer and
Incentive and Reimbursement Fund (80071-0000-8101-0196), and other applicable funds as
determined necessary, for the purpose of completing the improvements associated with the
Williams Improvement District.
Section 6. Following completion of the project, the actual costs will be calculated to determine the
final assessment, which will be levied and recorded through a subsequent resolution adopted by
the City Council.
Section 7. This resolution shall take effect immediately upon adoption.

Acres Subdivision, and Authorizing an Expenditure in the amount of
$639,100 and Appropriating Funds
Background and justification:
On April 13, City Council held a work session to review Developer Reimbursement Program
(DRP) applications. At that time, Council directed administration to return with resolutions
funding each applicant at 50 percent.
Administration has determined that the proposed Special Improvement District is in the public
interest, is necessary, and will benefit the properties to be assessed. City Code Section 5.20.035
states that "the costs of an improvement shall be the actual costs of the improvement, including
acquisition of interests in land for the improvement, design, engineering, administration,
overhead, professional services, guarantee fund, bond costs and interest incurred as a result of the
improvement, and all other costs resulting from the construction of the improvement."
This development will provide water, sewer, electrical, road, and lighting improvements to the
properties as described in the title of this resolution, which are subject to a pending replat approved
by the City of Seward to create Tracts 5B-1 and 5B-2, Forest Acres Subdivision, Seward Gateway
Properties. The improvements are intended to serve the large parcels that will be created through
this replat. As part of the current development proposal, a Conditional Use Permit has recently
been approved for a 17-unit multifamily development on the first of those parcels.
The total estimated cost of the Special Improvement District is approximately $639,100, which
will be assessed to the benefited property as described in this resolution. The City will pay for the
installation of public improvements up front, using Reimbursement Method 1 for actual costs up
to $639,100, and the developer will reimburse the City for 50 percent of those costs in accordance
with the DRP.
Following completion of the project, the actual costs will be finalized and used to determine the
final assessment amount. A subsequent resolution will be brought forward to Council to levy the
assessment, establish payment terms, and outline any applicable penalties for the Special
Improvement District. The final assessment will reflect the legal configuration of the property at
the time of recording.
