HomeMy WebLinkAboutPZ RES2026-006 CUP Extension 2025-010Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2026-006 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A SIX-MONTH EXTENSION OF CONDITIONAL USE PERMIT (CUP) 2025-010 FOR THE CONSTRUCTION AND OPERATION OF A HOTEL AT 313 AND 315 FOURTH AVENUE WHEREAS, on December 2, 2025, the Planning and Zoning Commission approved Resolution 2025-039; and WHEREAS, Resolution 2025-039 authorized the issuance of Conditional Use Permit (CUP) 2025-010 to Grace Group Properties 1 LLC for the construction and operation of a hotel at 313 and 315 Fourth Avenue; and WHEREAS, CUP 2025-010 became effective on December 12. 2025; and WHEREAS, Seward City Code (SCC) 15.10.320(G)(1) provides that an approved conditional use permit lapses six months after approval if no building permit is obtained or if the approved use is not initiated; and WHEREAS, CUP 2025-010 is scheduled to expire on June 12, 2026; and WHEREAS, the applicant has informed City staff that construction of the hotel will not commence until August 2026; and WHEREAS, SCC 15.10.320(G)(2) authorizes the Planning and Zoning Commission to grant extensions of up to six months upon finding that circumstances have not changed sufficiently to warrant reconsideration of the conditional use permit approval. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF SE\%ARD, ALASKA: Section 1. The Commission approves the six-month extension of CUP 2025-010 issued to Grace Group Properties 1 LLC for the construction and operation of a hotel at 313 and 315 Fourth Avenue. Section 2. The permit became effective on December 12, 2025. Pursuant to Seward City Code (SCC) 15.10.320(G)(1), an approved conditional use permit lapses six months after approval if no building permit is obtained or if the approved use is not initiated. As such, CUP 2025-010 is scheduled to expire on June 12, 2026. The applicant has informed City staff that construction of the hotel is not anticipated to begin until August 2026 and has therefore requested a six-month extension of the permit. SCC 15.10.320(G)(2) authorizes the Planning and Zoning Commission to grant extensions of up to six months when circumstances have not changed sufficiently to warrant reconsideration of the original approval. Staff finds that the conditions surrounding the project and the proposed use of the property have not substantially changed since the original approval of CUP 2025-010. Approval of the requested extension would allow the applicant additional time to obtain the necessary permits and initiate the approved development without requiring a new conditional use permit application. Comprehensive and Strategic Plan Consistency Information This legislation is consistent with (citation listed): Comprehensive Vol 1, Chapter 2.2.11— "Promote infill development by encouraging and Plan: promoting construction on vacant sites in areas of the city which are already established." Vol 1, Chapter 3.1.1.2 — "Encourage and support downtown revitalization efforts on vacant and dilapidated buildings." Vol 1, Chapter 3.1.1.4 — "Support private sector business, employment, 8 and programs." Strategic Plan: N/A Seward City Code § 15.10.320(G) provides that the Commission may grant an extension of up to six months for a conditional use permit, provided the request is submitted before the permit expires and circumstances have not changed enough to require reconsideration of the original approval. 9
