Review updates to Title 2.30, Article 2, Seward Planning and Zoning Commission, and
Purpose: review the Conditional Use Permit process

Meeting Called to Order at 6:01 P.M.
Purpose
• Review proposed Title 2 amendments affecting Planning & Zoning Commission procedures.
• Review Conditional Use Permit (CUP) processes, application requirements, enforcement
mechanisms, and land use regulations.
• Identify opportunities to improve administrative efficiency, strengthen decision -making criteria, and
reduce reliance on CUPs where development standards may adequately address potential impacts.
Title 2 Amendments
• Absence Procedures
o Reviewed procedures for excused and unexcused absences.
o Discussed establishing objective standards for excused absences based on advance notice rather
than evaluation of personal circumstances.
o Discussed simplifying administrative notification procedures.
• Meeting Administration
o Reviewed procedures for meeting cancellations and work sessions.
o Discussed providing clear authority to cancel meetings under specific circumstances and
recognizing work sessions within code while maintaining flexibility regarding their use.
• Voting Requirements
o Reviewed voting thresholds for Commission actions.
o Discussed the relationship between voting requirements, attendance levels, quasi-judicial
decision -making, and consistency with other City boards and commissions.
o Determined that additional research and comparison with other municipalities is warranted
before recommending changes.
• Commissioner Compensation
o Reviewed commissioner compensation language.
o Discussed revisions to ensure code reflects existing practice regarding voluntary acceptance of
compensation.

Conditional Use Permits
• Historical Trends and Observations
o Reviewed historical CUP activity and distribution throughout the community.
o Noted that a substantial number of approved CUPs are no longer active, reflecting changing land
use patterns over time.
o Reviewed concentrations of CUP activity by zoning district and use type.
o Discussed whether existing CUP requirements continue to align with current planning objectives
and development patterns.
• Policy Questions Identified
o Whether opportunities exist to reduce reliance on CUPs while maintaining compatibility with
surrounding uses and community goals.
o Whether commissioners receive sufficient information to make well -supported decisions and
findings.
o Whether existing compliance and enforcement tools are adequate to ensure continued adherence
to approved CUP conditions.
Application and Review Process
• Application Requirements
o Reviewed existing CUP application requirements and identified opportunities to improve the
quality and completeness of submitted information.
o Discussed expanding application materials to better address site design, operational impacts,
public services, nuisance mitigation, accessibility considerations, and required external
approvals.
• Review Criteria
o Reviewed examples of CUP standards from other jurisdictions.
o Discussed the value of objective and measurable review criteria to improve consistency, reduce
subjectivity, and strengthen findings.
• Departmental and Agency Coordination
o Reviewed the role of internal departments and external agencies in the CUP review process.
o Discussed improving coordination, review quality, and identification of conditions or concerns
during project evaluation.
o Emphasized the importance of documenting required approvals from other permitting agencies.
Compliance and Enforcement
• Reviewed challenges associated with monitoring and enforcing CUP conditions.
• Discussed the need for improved compliance tracking, follow-up procedures, and enforcement tools.
• Considered methods for improving accountability and ensuring approved conditions are completed
and maintained over time.
• Discussed how compliance history may inform future permit conditions and enforcement strategies,
consistent with applicable legal requirements.

Land Use Table Review
• Reviewed opportunities to reduce reliance on CUPs where development standards may adequately
address potential impacts.
• Residential Uses
o Discussed whether certain housing types could be permitted outright in appropriate zoning
districts while maintaining standards to address compatibility and site impacts.
o Considered the use of thresholds or standards to determine when CUP review remains
appropriate.
• Commercial and Mixed -Use Areas
o Reviewed whether certain uses currently requiring CUP approval continue to warrant
discretionary review.
o Discussed opportunities to align land use regulations with zoning district intent and community
development goals.
• Land Use Table Consistency
o Identified areas where existing land use classifications and approval requirements may benefit
from clarification and modernization.
Direction to Staff
• Prepare draft Title 2 amendments addressing absence procedures, meeting administration, voting
requirements, and commissioner compensation.
• Develop revised CUP application materials that provide more complete information relevant to
review criteria and project impacts.
• Prepare proposed land use table revisions identifying uses that may be appropriate for outright
approval and circumstances where CUP review should remain necessary.
• Evaluate compliance and enforcement tools and consult with legal counsel regarding implementation
options.
• Coordinate with City departments to improve review procedures and consistency of comments.
Next Steps
• Commissioners will provide additional feedback on CUP review criteria, standard conditions, and
land use regulations.
• Staff will return with draft amendments, revised application materials, and land use table revisions
for further review.
• Additional work sessions will be scheduled as needed to refine recommendations before
consideration by the Planning & Zoning Commission and City Council.
