CITY OF SEWARD, ALASKA
RESOLUTION 2004-122
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH ENTERPRISE ENGINEERING, INC. (EEl) TO
PROVIDE CONSULTING SERVICES FOR MIDDLE SCHOOL REVIEW TO
THE CITY OF SEWARD AND APPROPRIATE FUNDS FOR AN AMOUNT
NOT TO EXCEED $20,000.00
WHEREAS, the Kenai Peninsula Borough (KPB) has given the City of Seward an
opportunity to purchase/lease the existing Seward Middle School; and
WHEREAS, after conducting their own code compliance review and final budgetary cost
estimate to retain and refurbish the facility, the Kenai Peninsula Borough decided to appropriate
money to demolish the existing KPB Middle School should the City of Seward decide not to
purchase/lease it; and
WHEREAS, the City administration was provided with a report of those findings (referenced
by EEl as the May 31, 2002 Code Compliance Report) prepared for EEl by Alaska Construction
Management, Inc. and submitted to the KPB; and
WHEREAS, in October 2004 key City officials participated in a walkthrough ofthe existing
Seward Middle School facility to consider whether it may be a viable option to purchase/lease the
facility for City and other programs as suggested by Seward Parks and Recreation Director Karin
Sturdy; and
WHEREAS, EEl has submitted a fee proposal to the City of Seward to provide Consulting
Services for the proposed project to retain the existing Seward Middle School building; and
WHEREAS, the project would consist of reviewing the existing Seward Middle School
record drawings, the May 31, 2002 Code Compliance Report, and the April 7, 2002 Life Cycle Cost
Analysis (LCCA) previously prepared for the Kenai Peninsula Borough; and
WHEREAS, an updated report would be provided including estimated capital costs of
anticipated repairs needed to bring the building up to 2003 International Building Code (rnC)
requirements, and estimated annual operating and maintenance costs; and
WHEREAS, City Code~ 6.10.120 (8) provides for an exemption to the normal bid process
for professional services.
NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:

Section 1. Competitive procurement procedures for professional services are not required for
the reasons described in the recitals above, which recitals are incorporated herein by this reference
and authorize the City Manager to enter into the attached contract with Enterprise Engineering, Inc.
for an amount not to exceed $20,000 to provide Engineering services to the City in order to obtain
information needed to assist the City in their decision making process as to whether to purchase/lease
the existing Middle School.
Section 2. Funds in the amount of$20,000 are hereby appropriated from the General Fund
fund balance account number 101-0000-3050 to the Engineering department contracted services
account number 101-1230-5390, with said appropriation being effective January 1, 2005.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 14th day of
December, 2004.

BACKGROUND & JUSTIFICATION:
The Seward Parks and Recreation Director has been discussing the possibility of doing a
purchase/lease of the old middle school for City and other programs with the Kenai Peninsula
Borough (KPB). The KPB has programmed the school for demolition after the new middle school is
built. After participating in a walkthrough of the existing KPB Middle School and discussing with
pertinent City department heads the pros and cons of purchasing/leasing the school, it was determined
further information and/or consultation would be necessary before the City could make a decision as
to whether it may be a viable option to purchase/lease the facility.
Enterprise Engineering, Inc. (EEI) submitted a proposal to provide Consulting Engineering services
to the City of Seward. The Scope of the project is based on the information provided to EEI by
myself and Assistant City Manager Rick Gifford on November 2, 2004. The estimated cost of the
study is between $16,000 and $20,000. The study is to determine both required repairs and projected
operating cost if the City were to purchase/lease the existing KPB Middle School. The scopes of
services and fees for providing such services are attached as supporting documentation.
The existing Middle School is located on a 51.91 acre parcel of land owned by the KPB, tax parcel #
145-021-34, having a legal description of Tract A, USS 1864 KPB Replat.
The land is zoned institutional, which allows outright uses such as “auditoriums”, offices,
government/quasi-government administration”, “playground, public tot lot”, “utility facility, public
electric, water, sewer, etc.”, and allows by Conditional Use Permit uses such as: “center, senior or
teen”, “center, community civic”, (Seward City Code Table 15.10.225 Pages 15-64&69).

FISCAL NOTE:
Funds for this project were not anticipated during the preparation of the 2005 Budget. Therefore, an
appropriation is necessary. The administration recommends funding from the General Fund fund
balance. Funds for the proposed consulting services will be available in the Engineering Department
Contract Services account number 101-1230-5390 once appropriated from the General Fund fund
balance account number 101-0000-3050.

RECOMMENDATION:
Council approves Resolution 2004-122, authorizing the city manager to enter into a contract with
EEI to provide consulting services to the City of Seward for an amount not to exceed $20,000.
