CERTAIN PERSONAL PROPERTY OF THE CITY OF SEWARD

WHEl\EAS, the CITY OF SE\-lARD is the owner of certain QUICK
FREEZE 1. Q. F. EQUIPl'fENT purchased pursuant to Resolution No. 707
of the CITY OF SEWARD passed on Nay 31, 1968, to meet an emergency
situation to permit the operation of the. HALIBUT PRODUCERS COOPERATIVE
'plant by the sublessee SCALLOP PRODUCER'St INC. during the 1968 and
1969 yearst and
WHEREASt the plant is in the process of being subleased
to SEWARD FISHERIES, INC. who plan to carryon fishing operations
which require the use of the I.Q.F. equipment starting immediately,
and SEWARD FISllliRIES, INC. has indicated a desire to purchase said
I.Q.F. equipment, and
WliEREAS, the equipment is specialized for use in the fisheries
processing, and it is desirable that it be used in that business,
and
WHEREASt the Ordinances of the CITY OF SEWARD provide for
the sale or other disposition of personal property owned by the
CITY OF SEWARDt which is not dedicated to any public use, and the
subject property is not dedicated to any public use, and
WHEREAS, the Ordinances provide that the Council may,
by motion passed, find that the public interest will not be served
by sale of said subject property either by auction or sealed bidt
and
WHEREAS, Council has determined that the public interest
will not be served by public sale but that the public intere~t
will be served by a negotiated sale of the property to SEWARD
FISHERIES, INC., and
WHEREAS, the OrdinnDc8s of the CI1Y OF SEWARD provide
that Council may authOJ:L--(~ the City Manager to negoti.ate a sale
of personal property by Rl'solution duly enacted,
NOW, THEREFOl\E, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA:
Section 1. That it is in the public interest to sell the
I.Q.F. QUICK FREEZE EQUIPMENT to SEWARD FISHERIES, INC., all pro-
visions with reference to public advertisement for sale of the
property are hereby declared to be not in the public interest.
Section 2. That the City Manager is authorized and
directed to negotiate the sale of such I.Q.F. equipment in
accordance with the Ordinances of the CITY OF SEWARD and the
Lessee's proposal dated the ~ d~ of

, 1969,
and to do all things necessary to consummate said sale and the
proper city officials are authorized and directed to execute the
documents of sale.
Section 3. That this Resolution shall be filed and pub-
lished as in the case of Resolutions for public sale of property
and the bill of sale shall not be executed until sa~d Resolution
has been on file in the office of the Clerk for thirty (30) days.

HHEREAS, the CITY OF SEHARD is the owner of certain QUICK
FREEZE I.Q.F. EQUIPMENT purchased pursuant to Resolution No. 707
