HomeMy WebLinkAboutRes2002-081 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2002-081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE TO THE UNITED STATES OF AMERICA, DEPARTMENT OF ARMY, FOR THE NON-EXCLUSIVE USE OF THE SOUTHERN PORTION OF LOTS l1A AND 12A, FORT RAYMOND SUBDIVISION, REPLAT NO.1, 87-12, SEWARD, ALASKA CONTAINING FIVE (5) ACRES, MORE OR LESS, FOR THE PURPOSE OF STUDYING THE POTENTIAL DEVELOPMENT OF A JOINT PUBLIC-PRIVATE VENTURE FOR A BOWLING ALLEY AND CONCESSION RECREATIONAL FACILITY WHEREAS, the Department of Army (DOA) has requested that the City enter into a three year lease of city-owned property for the purpose of studying the potential development of a joint public-private venture for a recreational activity center that would include a bowling alley and concession; and WHEREAS, the requested property is approximately five acres of city-owned land identified as the southern portion of Lots llA and 12A, Fort Raymond Subdivision Replat No.1. The property is located north of Sea Lion Drive between Dimond Boulevard and the Seward Highway and is currently zoned Park and Institutional; and WHEREAS, the City Council at its regular meeting held on January 22,2001 approved Resolution No. 2001-018 supporting the concept of the Seward Resort's proposed recreational activity center; and WHEREAS, at its regular meeting of February 25, 2002 the City Council requested that the Planning and Zoning Commission review and provide a recommendation regarding the pros and cons of disposing of an interest in the property to the Department of Army to lease approximately five acres of land for a three year period for the purpose of studying the potential development of a joint public-private venture; and WHEREAS, the Commission at its regular meeting of March 5, 2002 recommended that the City Council identify the approximately five acre portion of Lots llA and 12A, Fort Raymond Subdivision Replat No. 1 requested by the DOA as available for disposal by lease to the DOA for a three year term for the purpose of studying the potential development of a joint public-private venture for a recreational activity center; and WHEREAS, the Commission further recommended that the City Council require that the proposed three year lease allow the existing public uses on the property to continue during the CITY OF SEWARD, ALASKA RESOLUTION 2002-081 term of the proposed lease and the Commission also noted that any possible future long term lease would require further review by the Commission in order to address subdivision and zoning issues as the current designation of the property would not allow a recreational facility; and WHEREAS, the City Council held a public hearing on March 25, 2002 and authorized the disposal by lease, an interest in City-owned lots llA and 12A, Fort Raymond Subdivision replat No.1, by sole source negotiation with the DOA, for a three year term for the purpose of studying the potential development of a joint public-private venture for a recreational activity center; and WHEREAS, the City Council held a public hearing on August 26, 2002 to determine if it is in the public's interest to lease to the DOA the non-exclusive use ofthe southern portion of Lots llA and 12A, Fort Raymond Subdivision, Replat No.1, 87-12, Seward, Alaska containing five (5) acres, more or less, for the purpose of studying the potential development of a joint public-private venture for a bowling alley and concession recreational facility. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The above recital's are incorporated herein by reference. The Council finds that it is in the public interest to make available for lease, the requested property to the Department of the Army, under the terms of the attached lease, in order to study the potential development of a public-private venture for a recreational activity center because if the study results in a favorable determination of project success, it could result in the following community benefits: construction of a needed community recreational facility that shall be open to the general public, possible construction of the facility by a local firm, additional jobs for local residents and increased tax revenue to the City. Section 2. The Council finds that the public interest will not be served by an appraisal in connection with such a short term lease because the lease does not permit construction or development and is for non-exclusive use to investigate the feasibility of future development, and to the extent the rental amount is less than the fair market value, the Council finds that it is in the public interest to lease the property for such amount because the City's and public's use ofthe property may continue during the lease term and the short term lease may eventually lead to a long term lease for the development of recreational facilities with the benefits to the community as described above. Section 3. The Council authorizes the City Manager to execute the attached lease to the United States of America, Department of the Army, in substantial form as attached hereto, for the non-exclusive use of the southern portion of Lots llA and 12A, Fort Raymond Subdivision . Section 6. This resolution shall take effect thirty (30) days after passage and posting. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 26th day of August, 2002.
