Sponsored by: Jones Introduction Date: January 9 1995 Public Hearing Date: January 23 1995 CITY OF SEWARD, ALASKA ORDINANCE NO. 95-01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE ~3.15.045, PAY RATE ADJUSTMENTS, AND ~3.15.060, OVERTIME, TO CLARIFY RATES OF PAY FOR POLICE RECRUIT TRAINING WHEREAS, while in training at the Alaska Public Safety Academy, police recruits are often in training up to sixteen hours per day; and WHEREAS, paying these recruits in training at the appropriate overtime rate would negatively impact the Police Department's budget; and WHEREAS, the Alaska State Troopers have successfully implemented a formula for the calculation of recruit training pay rates to reflect the hours per day spent in training up to sixteen hours per day; and WHEREAS, it is in the public interest for the City of Seward to amend its Personnel Code to implement a similar policy to cover police recruit training; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that Section 1. Seward City Code 93.15.045, Pay Rate Adjustment, is hereby amended by adding a new Subsection "7" to read as follows: 7. Police recruit trainin'i. The then current rate of pay for a police recru it shall be reduced accordinK to the following equation for the time that the recmit is traveling to or from or actually attending the Department of Public Safety Academy in Sitka, Alaska: [(current hourly rate x 2080) c- 12) x .00156 = basic training rate In no event shall the basic training rate be below the minimum rate required by law. Section 2. Seward City Code S3.15.060, Overtime, Subsection C, is hereby amended to read as follows: CITY OF SEWARD, ALASKA ORDINANCE NO. 95-01 C. Overtime for police o(ficers and volice recruits. 1. Police Q(ficers. Police officers who are not exempt from the overtime requirements of the federal Fair Labor Standards Act shall be entitled to overtime pay when required to attend court session while not on regular duty. 2. Police recruits. For each day that a police recruit attends or travels to or from the Department of Public Safety Academy in Sitka, Alaska, the recruit will be assigned an eight-hour uninterrupted and unpaid sleep period in compliance with the federal Fair Labor Standards Act. All remaining hours will be considered hours worked and the recruit will be paid asfollows: a. Re'l1llar duty day. The recruit shall be paidfor: (1) eight hours at the basic training rate determined pursuant to see $3.15.045.7., provided, however, that if the police recruit has worked more than forty hours in the workweek that portion of the eight-hour period that exceeds forty hours in the work week will be paid at one and one-halftimes the basic training rate; and (2) for eight hours at one and one-half time the basic training rate. b. Re'l1llar day off. sixth and seventh day. and holiday. The recruit shall be paid for sixteen hours at one and one-half times the basic traininK rate. Section 3.
