RESOLUTION 2003-014
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, CALLING FOR A SPECIAL ELECTION TO BE
HELD ON APRIL 8,2003 FOR THE PURPOSE OF SUBMISSION TO THE
QUALIFIED VOTERS OF SEWARD THE QUESTION OF REPEAL OF
ORDINANCE 2002-13, WHICH INCREASED THE CITY SALES TAX
FROM 3% TO 4%
WHEREAS, the City Council adopted Ordinance 2002-13 on December 18,2002; and
WHEREAS, Ordinance 2002-13 amended the Seward City Code Chapter 5.35, Sales
Tax, increasing the City sales tax from three percent to four percent beginning April 1 ,2003; and
WHEREAS, a referendum petition was issued by the City Clerk on December 31, 2002
; and
WHEREAS, the referendum petition was returned and certified as sufficient with 170
verified signatures on January 17,2003; and
WHEREAS, Seward City Code 4.15.050 requires that the City Council either repeal
Ordinance 2002-13 or set a special election within 75 days of a certified petition being submitted
to the City Council; and
WHEREAS, the City Council supports this referendum petition issue going to a special
election rather than a repeal of Ordinance 2002-13; and
WHEREAS, April 8, 2003 is within 75 days of the petition being submitted to the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section L The City Clerk is hereby directed to set a special election ofthe City of Seward
to be conducted on April 8, 2003 in accordance with Seward City Code and Charter provisions for
the calling of special elections for the purpose of submission to the qualified voters of Seward the
question of repeal of Ordinance 2002-13, and to sponsor a resolution at the next regular council
meeting to appropriate funds to conduct the special election.
Section 2. The question of repealing Ordinance 2002-13 shall be substantially in the
following form:

Repeal of Ordinance 2002-13
Shall Ordinance 2002-13, which amends the Seward City Code Chapter
5.35, sales tax, increasing the sales tax from three percent to four percent effective April
1,2003 be repealed?
A "YES" vote supports repeal of Ordinance 2002-13.
A "NO" vote opposes repeal of Ordinance 2002-13.
Section 3. The City Clerk is further directed to seek pre-clearance of the special
election date from the U.S. Department of Justice as required by the Federal Voting Rights
Act of1972.
Section 4. This resolution shall take effect immediately upon adoption.

27th day of January 2003.
