HomeMy WebLinkAboutRes1971-817 r ATTACHED TO AND MADE A PART OF THE MINUTES OF THE Sf WARD CITY COUNCIL lTpL 15 - ZJGE2Jf . ~R(S.i~ C/City Clerk-Treasurer CITY OF SEWARD RESOLUTION NO. 817 A RESOLUTION PROVIDING FOR ISSUANCE OF A TEMPORARY USE PERMIT WHEREAS, the City of Seward is the owner of the following described property: A building located on the Southwest corner of Fourth and Armstrong Avenues in the City of Seward, Alaska, commonly known as the old Alaska Railroad Carpenter Shop. WHEREAS, the ordinances of the City of Seward provide for the sale, lease or other disposition of real property owned by the City of Seward, which is not dedicated to any public use, and the subject property is not dedicated to any public use, and WHEREAS, the ordinances provide that the Council may, by motion passed, find that the public interest will not be served by lease of said subject property either by auction or sealed bid, and WHEREAS, Council has determined that the public interest will not be served by public auction or sealed bid but that the public interest will be served by a temporary use permit granted to Leonard Ross, d/b/a Ross Upholstery, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA: Section 1. That it is in the public interest to grant a temporary use permit to Leonard Ross, d/b/a Ross Upholstery, all provisions with reference to public advertisement for lease of the property are hereby declared to be not in the public interest. Section 2. That the City Manager is authorized and directed to execute this agreement in accordance with the ordinances of the City of Seward and substantially in accordance with the temporary use permit attached hereto, and to do all things necessary to consummate said agreement, and the proper city officials are authorized and directed to execute the same. Section 3. That this resolution shall be effective and such permit may be executed on the date of passage and approval. HUU4 2 SEWARD CITY COUNCIL RESOLUTION NO. 820 3 Relating to amending Section 4 07.15.340 of ALASKA STATUTES, Title 5 7, Boroughs, to delete Borough 6 Planning and Zoning authority from 7 first class cities. g BE IT RESOLVED BY THE S:&:WARD CITY COUNCIL: 9 WHEREAS Section 07.15.340 of ALASKA STATUTES, Title 7, Boroughs, 10 provides: "(a) The first and second class borough has the responsibility of 11 planning, platting, and zoning on an areawide basis and shall do so in the 12 manner provided for first class cities, except that the planning commission 13 shall also be the zoning commission, and; further, that nothing in this section 14 prevents any city from having a planning and zoning commission in an advisory 15 capacity; II and 16 WHEREAS Section 07.15.340, &S written into law in Title 7 of the 17 Borough Act, creates a duplication and centralization of government 18 unnecessarily with boroughs and first class cities physically engaging in the 19 same tasks; and 20 WHEREAS this cumbersome system of government centralization 21 necessitates in most cases the elected and appointed hegemony of a borough to 22 make decisions of planning and zoning within first class cities, where they have 23 little or no knowledge; and 24 WHEREAS the citizens of first claS5 cities feel the best interests of 25 their cities planning and zoning requirements will be met more competently, A'l'TACHED TO AND A PART OF THE MINtrrES OF THE SEWARD CITY COUNCIL / ,01 15 lAG}! ames R. F~ City Clerk-Treasurer 1 diligently and expeditiously under the sole jurisdiction of first class city 2 authority; and 3 WHEREAS certain cities within the KENAI PENINSULA BOROUGH had their 4 own planning, platting, and zoning authority before the advent of the Borough 5 form of government in the STATE of ALASKA, which poses a serious constitutional 6 problem. 7 BE IT RESOLVED that it is the will of this Seward City Council that 8 the SEVmTH LEGISLATURE, FIRST SESSION, STATE of ALASKA, amend Section 07.15.340 9 of Title 7 of the Borough Act to exclude borough planning, platting, and zoning 10 authori ty from first class cities. 11 COPIFB of this Resolution shall be sent to the Honorable William A. 12 Egan, Governor of the State of Alaska; the Honorable John Rader, Chairman, 13 Senate Local Government Committee; the Honorable Jan M. Koslosky, Chairman, 14 Senate State Affairs Committee; the Honorable H. Hiller, Chairman, House Local 15 Government Committee; the Honorable Richard L. McVeigh, Chairman, House State 16 Affairs Committee; the Honorable W. 1. "Bob" Palmer, Alaska State Senate; the 17 Honorable Clem Tillion, Alaska House of Representatives; and, the Honorable 18 Keith Specking, Alaska House of Representatives.
