RESOLUTION NO. 81-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, PROVIDING FOR JUST COMPENSATION TO BE PAID FOR
PROPERTY OWNED BY DOROTHY STEWART NOYES.
~'JHEREAS, the City Council for the City of Seward,
Alaska determined that it was in the public interest to build a
public road or highway to the Fourth of July Creek area within
the City limits of the City of Seward; and
WHEREAS, the City Council on March 24, 1980 by Resolu-
tion No. 80-14 provided for the taking of a right-of-way across
two parcels of land for access to the Fourth of July Creek area
by the right of eminent domain and for the filing of a declara-
tion of taking; and
WHEREAS, the city of Seward, Alaska engaged Appraisal
Company of Alaska to provide an opinion as to the value of the
subject property; and
WHEREAS, Appraisal Company of Alaska valued the subject
property at approximately 20.4~ per square foot; and
~'mEREAS, Dorothy Stewart Noyes employed the Wakeland
Company to provide an opinion as to the value of the subject
property; and
WHEREAS, the Wakeland Company valued the subject prop-
erty at 31~ per square foot:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA that
The City of Seward, Alaska shall, upon completion of a
title investigation, pay to Dorothy Stewart Noyes the sum of
THIRTEEN THOUSAND SEVEN HUNDRED TWENTY-NINE AND NO/IOO DOLLARS
($13,729.001 which is 31~ per square foot for approximately 1.017
acres as described by the attached exhibit. Said sum will be the
full and complete just compensation for said parcel. Documents
will be executed by the parties confirming the same.
PASSED AND APP~VED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, this 11--- day of October, 1981.

A parcel of land locatett within Government Lot 3, Section 1, Township 1
South, Range 1 West, Seward Meridian, Alaska being more particularly
described as follows:
Commencing at the CE1/16 corner of said Section 1; thence NooOOl4511E along
the 1/16 line, 783.37 feet to a point on a first curve, said point being the
POINT OF BEGINNING; thence along said curve, being concave to the
southwest (having a delta angle of 305713911, a radius of 1223.24 feet, a
chord bearing of N6400210511W, and an arc length of 84.54 feet); thence along
a line tangent to said curve N6600015411W, 216.78 feet to the point of
curvature of a second curve; thence along said second curve, being concave
to the north (and having a delta angle of 504214811, a radius of 868.51 feet,
a chord bearing of N63009'3111W, and an arc length of, 86.60 feet) to a point
on the easterly right-of-way line of Nash Road, said point being 100. left of
Nash Road C( Station 130+59.66; thence N2600712411W along said right-of way
line, 215.23 feet to a point on a third curve, said point being 1001 left of
Nash Road C( Station 128+44.43; thence departing fro~ said right-af-way
line and along said third curve, being concentric to said second curve (and
