RESOLUTION NO. 82-22
FINDINGS OF CITY COUNCIL OF SEWARD, ALASKA,
THAT THE PUBLIC INTEREST WOULD BE BEST SERVED
BY NOT REQUIRING COMPETITIVE BIDDING FOR THE
PURCHASE OF A ROAD GRADER.
WHEREAS, at the City Council meeting of April 12, 1982,
the Ci ty ~1anager reques ted permiss ion to purchase a Champion,
Model 740, road grader without utilizing the competitive bidding
procedures, and
WHEREAS, Ordinance No. 503 of the City of Seward,
Section 10-8(g) provides that where the public interest would be
best served by not requiring competitive bidding, the provisions
of that ordinance may be waived upon written findings by the City
Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, makes the following findings:
1. In 1981, the State of Alaska, through the Department
of Transportation, invited competitive bids for acquisition by
the State of Alaska of road graders for use in highway
maintenance, snow plowing, and other services. The original
invitation and bid was for twenty-four (24) road graders.
2. The competitive bidding procedures of the State of
Alaska were followed and competitive bids were received from
several manufacturers.
3. The competitive bid received from Evans Engine and
Equipment Company of 720 Whitney Road, Anchorage, Alaska, was
substantially lower than that of other bidders.

Champion, Model 740, grader is $130,332.00.
6. Substantially as a result of the relatively low
price bid by Evans Engine and Equipment Company, the State of
Alaska has since then ordered an additional twenty-one (21) road
graders.
7. Evans Engine and Equipment Company has offered to
make available to municipalities within the State of Alaska
identical Champion, Model 740, road graders as at the identical
price and terms as bid to the State of Alaska.

8. Since those offers have been made, the

list price since that date has increased due to inflation.

single road grader would be less than the competitive bid for the
purchase of twenty-four (24) road graders and twenty-one (21)

economies of scale, volume discounts, or other factors.
12. It is highly unlikely that the competitive bidding
process by the City of Seward for a single road grader would
resul t in a lower bid price then that made by Evans Engine and
Equipment Company to the State of Alaska.

14. The budget for the Ci ty of Seward contains funds
for the acquisition of new and/or used equipment for the
Department of Public Works and Roads and Streets.
15. A review by the City of Se\'lard Engineering and
Public Works Department has determined that the specifications of
the Champion, Hodel 740, road grader match the requirements and
needs of the City of Seward.
For the above reasons, the purchase of a Champion,
Model 740, road grader from Evans Engine and Equipment Company as
requested by the City Manager without requiring competitive
bidding is found to be in the public interest as provided for in
Paragraph (g) of Section 10-8 of Ordinance No. 503.
