RESOLUTION NO. 82-40
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AWARDING CONTRACT FOR
CONSTRUCTION OF ONE ADDITIONAL PUBLIC RESTROOM
TO METCO, INC.
WHEREAS, by Resolution 82-35 passed on May 24, 1982, the
City determined that a contract should be awarded for the
construction of two public restrooms for use by the City and its
residents in its public parks, and
WHEREAS, at the Council's discussion prior to the
passage of such resolution, it was noted by the City Manager that
it might be possible to construct one additional restroom with
available funds and that the response by Metco, Inc., at
$66,221.00 for the construction of two restrooms was
substantially below that estimated by the City, and
WHEREAS, the City Manager was instructed to review the
possibility of a construction of a third restroom at the same
price per restroom, and
WHEREAS, the Ci ty

WHEREAS, the costs of engineering, bid document
preparation, advertisement for bid, and normal public bidding
procedures, would preclude the possibility of a construction of
three restrooms and would in all probability permit only one, or
at the most, two restrooms to be constructed, and
WHEREAS, Section 10-8(g) of the City Code provides that
the City Council may not apply the formal bid proceedings where
it finds that the public interest would be best served by not
requiring competitive bidding, and
WHEREAS, actual bid solicitations were received and all
knovm prospective bidders wi thin the Seward area were contacted
by the City.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The award for the contract of construction
of public restrooms contained in Resolution 82-35 is hereby
amended to provide for the construction of three public restrooms
by Metco, Inc., for a price not to exceed NINETY-SEVEN THOUSAND
FOUR HUNDRED SEVENTY-ONE AND NO/IOO DOLLARS ($97,471.00).

Section 2. The City Council of the City of Seward finds
that for the reasons set forth above the public interest would be
best served by not requiring formal competitive bidding in this
particular case on the grounds that the construction of the
restrooms can be done at a lower cost without competitive
bidding, that favorable proposals have been received which are
less than the engineer's estimate, and by not using the public
bidding procedure, three restrooms may be constructed rather than
two.
