CITY OF SEWARD, ALASKA
ORDINANCE NO. 96-32
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, REVISING CHAPTER 11.15 OF THE SEWARD CITY CODE TO
PROVIDE FOR IMPOUNDMENT OF VEHICLES PARKED IN CLOSED OR
RESTRICTED AREAS
WHEREAS, the City's snow removal efforts are frequently hampered by vehicles parked
in areas which have been closed for plowing; and
WHEREAS, there is currently no provision in the City Code to authorize the City to
impound vehicles so parked in order to allow the safe removal of accumulated snow; and
WHEREAS, those individuals who refuse to cooperate with the City's request to move their
vehicles during snow removal operations create a dangerous situation for the operators of the snow
removal equipment and increase the likelihood that the equipment will inadvertently damage a
vehicle during the plowing operations;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Seward City Code Section 11.15.085, Subsection B., is hereby revised to read as
follows:
11.15.085 Parking prohibited during certain hours.
A.
B. When signs are placed on streets prohibiting parking of vehicles, no
person shall park any vehicle in closed or restricted areas, and any
vehicle found so parked shall be impounded.

Section 2. Seward City Code Section 11.15.087 is hereby created to read as follows:
11.15.087 Parking prohibited during snow and ice removal operations.
A. In the downtown area, designated as those streets between Railway
and Jefferson Streets and between Fourth and Fifth Avenues, and in the harbor area,
designated as that portion of Fourth Avenue between North Harbor and South
Harbor Streets, it shall be unlawful for any person to park on those streets during
the hours indicated on temporary signs which will be placed on the streets by the
Engineering and Utilities Department prior to any snow removal operations.
Vehicles parked in violation of this section will be impounded.

B. In all other areas of the City, other than the "downtown" area, it
shall be unlawfUl for any person to park, or cause a vehicle, camper, boat or other
item to be parked, on the right-ol-way for longer than 24 hours during those times
when snow removal by the Engineering and Utilities Department is occurring.
Vehicles parked in violation of this section shall be impounded.
C. Whenever any police officer finds, or is notified by the Manager of
Engineering and Utilities Department or his designated representative, that a vehicle
is in violation of this section, the officer is authorized to require the owner, drive, or
other person responsible for the vehicle to remove the vehicle to a position off the
area requiring snow removal, or the officer may have the vehicle impounded.
Section 3. This ordinance shall take effect ten (10) days following its enactment.

13th day of January, 1997.
